Rapid changes in the ways of survival in human societies, passing quickly from pre-industrial to industrial societies or industrial societies to knowledge societies, characterized by innovation and constant change, require a kind of a non religious spirituality not tied to beliefs. No need to go to Eastern spiritual traditions, Buddhism, Yoga or Advaita Vedanta to show and experience the possibility of a non-religious spirituality; also within the Christian tradition, we find authors that allow non-religious spirituality. We can count on an (...) important notion of Nicholas of Cusa: The "No-Other" as the absolute dimension of all reality. The Cusano considers that this term is more appropriate to describe that absolute of all reality then the term God. It is also very convenient to live a spirituality that does not divide reality into two poles: the mundane and the divine, the relative and absolute in this world and the next. (shrink)

It is argued in this article that Foucault’s most distinctive contribution to philosophical practice is to be found in his distinctive mode of taking up historiography, exploring critically the conditions and limits of knowledge through archival work. The focus on knowledge would seem to place him in the critical lineage of Kant; however, his appeal to history and archival explorations reconfigure the relation between sensibility and the understanding in a way that suggests a different concern with the conditions of “a (...) possible knowledge.” After discussing how Foucault’s archival work engages a distinct sensibility, I suggest that his concern with knowledge can best be understood not within a transcendental project, however historicized, but within the logical space of Hegel’s Doctrine of the Concept, specifically the discussion of the Idea of cognition where it is a question of the twin processes of unifying subjectivity and objectivity as expressive of cognition’s “urge to truth.” Understood within this conceptual context, Foucault’s distinctive archival approach to what he calls “subjectivation” and “objectivation” allows us to appreciate the distinction between knowledge and truth in a way that leaves open the possibility of transformation. While COVID-19 has generated a massive burden of illness worldwide, healthcare workers (HCWs) have been disproportionately exposed to SARS-CoV-2 coronavirus infection. During the so-called ‘first wave’, infection rates among this population group have ranged between 10% and 20%, raising as high as one in every four COVID-19 patients in Spain at the peak of the crisis. Now that many countries are already dealing with new waves of COVID-19 cases, a potential competition between HCW and non-HCW patients for scarce resources can (...) still be a likely clinical scenario. In this paper, we address the question of whether HCW who become ill with COVID-19 should be prioritised in diagnostic, treatment or resource allocation protocols. We will evaluate some of the proposed arguments both in favour and against the prioritisation of HCW and also consider which clinical circumstances might warrant prioritising HCW and why could it be ethically appropriate to do so. We conclude that prioritising HCW’s access to protective equipment, diagnostic tests or even prophylactic or therapeutic drug regimes and vaccines might be ethically defensible. However, prioritising HCWs to receive intensive care unit (ICU) beds or ventilators is a much more nuanced decision, in which arguments such as instrumental value or reciprocity might not be enough, and economic and systemic values will need to be considered. Although shared decision-making is a standard in medical care, unilateral decisions through process-based conflict resolution policies have been defended in certain cases. In patients who do not stand to receive proportional clinical benefits, the harms involved in interventions such as cardiopulmonary resuscitation seem to run contrary to the principle of non-maleficence, and provision of such interventions may cause clinicians significant moral distress. However, because the application of these policies involves taking choices out of the domain of shared decision-making, they face (...) important ethical and legal problems, including a recent challenge to their constitutionality. In light of these concerns, we suggest a re-conceptualization of informed non-dissent as an alternative approach in cases where the application of process-based policies is being considered. This clinician-directed communication model still preserves what is valuable in such policies and salvages professional integrity, while minimising ethical and legal challenges. (shrink)

A presente obra trata, de forma inigualável, das preliminares ao estudo da teoria tridimensional do direito, examinando a Filosofia e a Ciência do Direito, as dimensões da experiência jurídica, a posição do tridimensionalismo jurídico concreto, a dialética de complementaridade, o personalismo e o historicismo axiológico, as estruturas e os modelos do Direito no processo cultural e a visão integral do mundo jurídico.

Like Kant, Foucault challenges us to rethink the way we relate freedom and truth by stressing the idea of "maturity" understood as a release from the "self-incurred tutelage" (the expression is from Kant) that otherwise characterizes so much of our lives. Though, rather than linking freedom and truth via the concept of autonomy (or lawfulness), as Kant does, Foucault outlines a possible experience of ethics as an individualizing ideal that contrasts with the model of establishing codes within a conception of (...) moral order. Foucault's project can be read as attempting to decouple ethics from the epistemological concern with the objectivity of a moral order in order to reconnect it to the formation of a political sensibility that sees truth(fulness) in a certain practice of freedom, as opposed to seeing our freedom confirmed or granted by a certain kind of (mode of relating to the) truth. I call this reading of Foucault's investigations into ethics the "methodological/prescriptive" approach (asking and responding to what we can do, ethically-speaking) and contrast it with the sketch of an alternative reading which I call "ontological/historical" (asking and responding to what we are, ethically-speaking). This reading, instead of pushing beyond Kant in the direction of a Nietzschean sensibility, rather challenges Kant's moral law from the space of a Hegelian insistence on the (historical) realization or actualization of freedom in and through the normative constraints structuring existing power-relations. I argue in this paper that the attempt by Michael Hardt and Antonio Negri in Empire and Multitude to “theorize empire” should be read both against the backdrop of speculative philosophy of history and as a development of the conception of a “principle of intelligibility” as this is discussed in Michel Foucault’s recently published courses at the Collège de France. I also argue that Foucault’s work in these courses can be read as implicitly providing what I call “prolegomena to any (...) future speculative philosophy of history.” I define the latter as concerned with the intelligibility of the historical process considered as a whole. I further suggest, through a brief discussion of the classical figures of Kant, Hegel, and Marx, that the basic features of speculative philosophy of history concern the articulation of both the telos and dynamics of history. My claim is that Hardt and Negri provide an account of the telos and dynamics of history that respects the strictures imposed on speculative philosophy of history by Foucault’s work, and thus can be considered as providing a post-Foucauldian speculative philosophy of history. In doing so, they provide a challenge to other “theoretical” attempts to account for our changing world. (shrink)

The expression, “Realizing Reason in History,” has at least two senses, both of which Hegel tries to bring out in his philosophy of history. The first suggests that there is reason in history. That is, the task of the philosopher is to show how reason has developed itself through history. The second sense suggests that, not only does history show us that reason has developed over time, but the task of history is precisely to develop or realize reason in time. (...) There is reason in history because that is what history brings about. Thus, the “realization” of reason in history is both something that is recognized and something that must be done. This “realization” is accomplished, willy-nilly, through the doings and sufferings of concrete human beings. Hegel wants to show that history is not a cold, anonymous process which simply sweeps up human lives and never looks back. Indeed, his philosophy of history is primarily concerned with the concrete doings and sufferings of human beings, and wishes to rescue from meaninglessness all those ephemeral human lives which populate the historical process. That, according to Hegel, is what the philosophy of history is all about. (shrink)

Tras dar razón del vínculo existente entre la economía, la ética y la antropología, el autor trata de espigar las principales orientaciones ético-económicas que han sido propuestas en esa última encíclica social con vistas a un tal desarrollo, articulándolas a partir de dos concepciones antropológicas de honda raigambre en la (...) doctrina social de la Iglesia, a saber, la dignidad humana y el personalismo comunitario.Comenta, finalmente, la relevancia económica de la antropología cristiana y su potencial crítico frente al homo oeconomicus, así como la capacidad de interlocución con diversas corrientes de pensamiento contemporáneas que dicha antropología proporciona a la doctrina social de la Iglesia.This article examines the meaning of the human, complete development defended by Benedict XVI in Caritas in veritate, emphasizing its continuity with Populorum progessio and with the previous social teaching in general. After stating the existing link between economy, ethics and anthropology, the author tries to select the main ethic-economic orientations proposed in that last social encyclical in relation to a such development, and structures them beginning with two anthropological conceptions deep-rooted in the social doctrine of the church, that is, human dignity and personalism of the community. Finally, the article comments on the economic importance of Christian anthropology and its critical potential against the homo oeconomicus, as well as the capacity of being an interlocutor with several contemporary trends of thought that anthropology provides the social doctrine of the church with. The inconclusiveness of previous research on the association between gender diverse boards and corporate social performance has led us to revisit the question in light of stakeholder management and institutional theories. Given that corporate social responsibility is a multidimensional concept, we test the influence of GDB on various groups of stakeholders. By considering the interaction between stakeholders’ power and directors’ personal motivations toward the prioritization of stakeholders’ claims, we find that GDB are positively related to CSR dimensions that are related (...) to less powerful stakeholders such as the environment, contractors, and the community. However, GDB do not appear to have a significant impact on CSR dimensions that are associated with stakeholders who benefit from more institutionalized power, such as employees and customers. We propose a lexical account of event nouns, in particular of deverbal nominalisations, whose meaning is related to the event expressed by their base verb. The literature on nominalisations often assumes that the semantics of the base verb completely defines the structure of action nominals. We argue that the information in the base verb is not sufficient to completely determine the semantics of action nominals. We exhibit some data from different languages, especially from Romance language, which show that nominalisations focus (...) on some aspects of the verb semantics. The selected aspects, however, seem to be idiosyncratic and do not automatically result from the internal structure of the verb nor from its interaction with the morphological suffix. We therefore propose a partially lexicalist approach view of deverbal nouns. It is made precise and computable by using the Montagovian generative lexicon, a type theoretical framework introduced by Bassac, Mery and Retoré in this journal in 2010. This extension of Montague semantics with a richer type system easily incorporates lexical phenomena like the semantics of action nominals in particular deverbals, including their polysemy and felicitous copredications. Miranda Barbosa, inspirado na filosofia aristotélico-tomista, tentou construir o edifício de uma lógica pura, a priori, sem fundamentação nem na gnosiologia nem na ontologia. Neste sentido, subordina as contribuições da lógica matemática, do existencialismo e da fenomenologia ao seu intento maior. Por isso o designamos como “o último clássico” da filosofia em Portugal.

Após a instauração da República em 1910, irrompe uma ideologia nacionalista refundadora de Portugal, no sentido de reveladora dos valores clássicos de Portugal, na qual se distinguem Teixeira de Pascoaes, lírico e providencialista, messiânico, e António Sardinha, monárquico, fundador do movimento do “Integralismo Lusitano”. Este artigo procura analisar estas duas orientações, pondo em evidência o respectivo contexto e intentando uma compreensão dos respectivos significados.

This article examines whether and how the participation of women in the firm’s board of directors and senior management enhances financial performance. We use the Fama and French (1992, 1993) valuation framework to take the level of risk into consideration, when comparing firm performances, whereas previous studies used either raw stock returns or accounting ratios. Our results indicate that firms operating in complex environments do generate positive and significant abnormal returns when they have a high proportion of women officers. Although (...) the participation of women as directors does not seem to make a difference in this regard, firms with a high proportion of women in both their management and governance systems generate enough value to keep up with normal stock-market returns. These findings tend to support the policies currently being discussed or implemented in some countries and organizations to foster the advancement of women in business. (shrink)

The article reflects on the symbolic forms of domination developed in the social environment and the real games of power that they are hidden behind the representations in nowadays. It approaches the relation that the medias has in the representation context, being an instrument of domination for the processes ofconstruction of the important meanings for the structure of a society. The study calls the attention for the problematic theoretician presented for the philosopher Pierre Bourdieu, writing on the agent and (...) society, through the antagonism and exclusion between itself. Others two philosophers worked in the research are Michel Foucault and Jürgen Habermas. Thinking on individuals separately, we have that as the participant ones to be responsible in all the constructionof ethical values, politicians, cultural among others that they guide the collective context. However, we will only get success in this question, if we know how to analyze the “search of the real”. (shrink)

Analiso neste artigo a presença na cosmologia de Tomás de Aquino da hipótese real do vacuum in natura afirmada no contexto da discussão sobre a geração e os primeiros instantes da locomoção natural dos corpos simples sublunares. Para tanto, o texto possui três partes. Primeiro, mostro porque o vaccuum in natura é uma discussão pertencente ao domínio da cosmologia entendida como matriz disciplinar cujo objeto é o cosmo enquanto conjunto dos corpos simples. Na segunda parte, por sua vez, apresento (...) a discussão geral sobre a noção de vazio que Tomás estabelece com Aristóteles. Enfim, na terceira parte, exponho, por um lado, a crítica de Tomás à tese de Averróis segundo a qual a resistência é necessária para a locomoção natural e, por outro lado, a hipótese tomista baseada nas noções de generans e vis sobre a locomoção natural e finita no vazio. Abstract:In this article I analyze the presence in the cosmology of Thomas Aquinas of the real hypothesis of the vacuum in natura affirmed in the context of the discussion about the generation and the first instants of the natural locomotion of the sublunary simple bodies. To do so, the text has three parts. Firstly I show why the vaccuum in natura is a discussion belonging to the domain of cosmology understood as a disciplinary matrix whose object is the cosmos as a set of simple bodies. In the second part, I present the general discussion of the notion of void that Aquinas establishes with Aristotle. Finally, in the third part, I present, on the one hand, Aquinas’s critique of Averroes’ thesis that resistance is necessary for natural locomotion and, on the other hand, the Thomistic hypothesis based on the notions of generans and vis on locomotion natural and finite in the void. Publicada em meio a um cenário marcado pelas instabilidades, esta edição, composta por 5 artigos que abordam o tema específico do dossiê Fenomenologia e mais 11 artigos nas áreas de Educação e de Filosofia, se coloca como voz de resistência em um contexto pandêmico que alterou não apenas as estruturas da sociedade, mas sobretudo a dimensão dos nossos afetos, nossas formas de sentir e interagir (...) com o Outro e conosco mesmo enquanto seres no mundo e não apenas do mundo. Apesar dos tempos duros e sombrios, insistimos, seguimos, lutamos. When we say that what two people feel for each other is 'true love,' we seem to be doing more than simply clarifying that it is in fact love they feel, as opposed to something else. That is, an experience or relationship might be a genuine or actual instance of love without necessarily being an instance of true love. But what criteria do people use to determine whether something counts as true love? This chapter explores three hypotheses. The first holds (...) that the ordinary concept of true love picks out love that is highly prototypical. The second, that it picks out love that is especially good or valuable. The third, that people distinguish between psychological states that are 'real' or not, and that it picks out love that is real. Two experiments provide evidence against the first hypothesis and in favor of the second and third. Implications for real-life disagreements about love are also discussed. (shrink)

Valendo-se de O Livre Arbítrio e As Confissões como principais referências, este estudo visa analisar a problematização que Agostinho faz do Mal, vez que o Bispo de Hipona refletiu sobre a possibilidade de conciliar o pilar cristão de infinita bondade divina com a existência do mal no real. Neste artigo separamos duas fases dessa reflexão. A primeira busca resolver o problema do mal como existente no universo físico, desenvolvendo para tanto uma ontologia que culmina na impossibilidade da existência do (...) mal como substância: o Mal é privação do Bem. Já que o Mal não é substância, mas sim privação do Bem, não existe o mal natural: o mal genuíno é resultado da ação humana. Na segunda fase, o debate se dirige para o sujeito e o livre-arbítrio, ou seja, o âmbito moral. É preciso explicar por quais razões Deus nos deu o livre-arbítrio se com ele praticamos o mal. Como veremos, a possibilidade de escolher é um bem dado por Deus que permite a qualificação moral do ato, dessa forma, o homem deve possuir o livre-arbítrio para que possa ser justo ou injusto. Por fim, concluímos mostrando que as origens do mal estão na defecção da vontade que se afasta de Deus. (shrink)

L'évêque d'Hippone a réfléchit sur la possibilité de concilier le pilier chrétien de la bonté infinie de Dieu avec l'existence du mal dans le réel. Nous avons séparé dans cet article deux phases de cette réflexion. La première vise à résoudre le problème du mal comme existant dans l'univers physique. Dans la deuxième phase, le débat se dirige vers le sujet et le libre arbitre, en d'autres termes, le domaine de la morale. Il faut expliquer pourquoi Dieu nous a donné le libre arbitre alors que nous faisons du mal. Comme nous le verrons, la capacité de choisir est un Bien donné par Dieu qui permet à l'action morale, ainsi, l'homme doit avoir le libre arbitre afin qu'il puisse être juste ou injuste. Translating ethical theories into clinical practice presents a perennial challenge to educators. While many suggestions have been put forth to bridge the theory-practice gap, none have sufficiently remedied the problem. We believe the ascendance of hospital medicine, as a dominant new force in medical education and patient care, presents a unique opportunity that could redefine the way clinical ethics is taught. The field of hospital medicine in the United States is comprised of more than 50,000 hospitalists—specialists in inpatient medicine—representing the (...) fastest growing subspecialty in the history of medicine, and its members have emerged as a dominant new force around which medical education and patient care pivot. This evolution in medical education presents a unique opportunity for the clinical ethics community. Through their proximity to patients and trainees, hospitalists have the potential to teach medical ethics in real time on the wards, but most hospitalists have not received formal training in clinical ethics. We believe it is time to strengthen the ties between hospital medicine and medical ethics, and in this article we outline how clinical ethicists might collaborate with hospitalists to identify routine issues that do not rise to the level of an “ethics consult,” but nonetheless require an intellectual grounding in normative reasoning. We use a clinical vignette to explore how this approach might enhance and broaden the scope of medical education that occurs in the inpatient setting: A patient with an intra-abdominal abscess is admitted to the academic hospitalist teaching service for drainage of the fluid, hemodynamic support, and antimicrobial therapy. During the initial encounter with the hospitalist and his team of medical students and residents, the patient reports night sweats and asks if this symptom could be due to the abscess.
