The article aims to provide a semiotic interpretation of the sign of the Ecclesiastical Court within the legal framework from temporal and spatial perspectives. The starting point of the research is the idea that the history of the Russian Ecclesiastical Court is inextricably linked to the history of Russian society and secular court. Consideration of the pre-revolutionary ecclesiastical and secular law helps us explore principles of the ecclesiastical proceedings and organization, identify contradictions in understanding modern Ecclesiastical Court. Its sign is (...) not only limited to the legal interpretation. In his novel The Brothers Karamazov, Dostoevsky F. M. gave the sign of the Ecclesiastical Court symbolic meaning and, thus, expanded it beyond the existing legal framework. The Ecclesiastical Court is one of the symbols of Russian spirituality which is reflected in the concept of “Russian soul”. Rational elements of the sign of Ecclesiastical Court as well as its sensual and metaphorical components, are analyzed using the category of Truth. Clearly, the Cross is sign-symbol for Christianity. But if applied to the concept of Ecclesiastical Court, the Orthodox Cross becomes a sign-index. As a result, several semantically heterogeneous meanings of the sign of Ecclesiastical Court are revealed and described. (shrink)

This volume offers a systematic philosophical analysis of the normative challenges facing European refugee policy, focusing on whether the response to it can be based on European values. By considering the refugee policy through the lens of European values, cosmopolitan norms and universal human rights, the contributions expose the weaknesses and limitations of existing regulations and make proposals on how to improve them. The EU is often seen as a cosmopolitan project. Europe is supposed to be a community of states (...) that aspires to be guided by cosmopolitan norms. However, the idea of a cosmopolitan Europe has never been unanimously shared, and in recent years, it has come under increasing scrutiny, particularly with regard to the EU’s refugee policy. The guiding idea of this book is that a deeper philosophical understanding of the normative issues at stake can foster greater conceptual clarity and enrich political debates on the future of European refugee policy. The first part of the book revolves around the question of whether the rise in refugee numbers over the past decade has led to a crisis in the EU and, if so, how this crisis relates to or impacts European values. The second part traces the history of the discourse on “European values” and examines from a philosophical perspective how we can plausibly understand these values in terms of their moral grammar, their normative content and their implications for the behaviour of the EU and its member states. Finally, the third part puts forth recommendations for a feasible and normatively more compelling European refugee policy based on human rights, human dignity, justice and democratic self-determination as the decisive normative requirements. This article discusses the reception of Nietzsche’s philosophy within the USSR. It covers the four phases of Soviet Nietzscheanism between 1920 and 1980, paying specific attention to the Soviet Nietzsche studies of the Stalin epoch. By making use of publications and archive materials, this article reconstructs the historical and logical formation of Nietzsche’s negative image in post-revolutionary Russia that characterized him as an ideologist of imperialism and National Socialism. A study of the way in which poets, priests, and sages sought for wisdom in ancient Greece by descending into caves or underground chambers. Yulia Ustinova offers a novel approach by juxtaposing ancient testimonies with the results of modern neuropsychological research.

This paper explores the historical and social context of population genetic research conducted in India by focusing on a study by Reich et al which aimed to reconstruct Indian population history. The paper addresses two themes. First, it considers the agendas and modes of thinking about Indian populations and the caste system on which this study appears to be based. Second, it reflects on the medical implications of this study as they were presented in Reich et al's findings. I suggest (...) that while genetic mapping of Indian populations appears to have inherited many of the problems characteristic of population genetic research conducted in the USA and globally, the specificity of this research in India involves a peculiar interplay of the postcolonial pursuit of genomic sovereignty, desire by the Indian state to become a player in the global realm of biotechnology, and age-old discourses naturalising caste and regional differences. My argument is that, although the study has offered conceptual space for a wide range of interpretations, it has a strong potential not just for naturalising caste and regional differences in India, but also for pathologising them without necessarily bringing tangible healthcare benefits in the foreseeable future. Cet article traite du travail de la FDIF avec les femmes des pays extra-européens, souvent appelés « pays en voie de développement ». La FDIF défend l’anticolonialisme et l’antiracisme, se mobilisant pour l’égalité entre les hommes et les femmes « du monde entier ». L’article explore les enchevêtrements entre le travail de la FDIF pour changer le statut des femmes et les activités de développement dans le contexte de la compétition culturelle de guerre froide. Les documents analysés montrent que les (...) programmes de soutien aux femmes des pays « en développement » mettent en avant la solidarité avec la lutte anticoloniale et le soutien étatique à la maternité et à l’enfance. Si la présentation par la FDIF de ses activités en faveur des femmes des « pays en développement » souligne les différences par rapport aux approches de ses concurrents occidentaux, ses programmes s’appuient pour la plupart sur les mêmes idéologies de la modernité et n’accordent pas beaucoup d’attention aux formes précoloniales et autres formes spécifiques de pouvoir et de solidarité des femmes. En outre, les animatrices de la FDIF expriment souvent leur manque de confiance à l’égard de leurs interlocutrices des « pays en voie de développement » et même des attitudes racistes envers les femmes non-européennes. The question of whether an artificial moral agent (AMA) is possible implies discussion of a whole range of problems raised by Kant within the framework of practical philosophy that have not exhausted their heuris­tic potential to this day. First, I show the significance of the correlation between moral law and freedom. Since a rational being believes that his/her will is independent of external influences, the will turns out to be governed by the moral law and is autonomous. Morality and freedom (...) are correlated through independence from the external. Accordingly, if the actions of artificial intelligence (AI) are determined by something or someone external to it (by a human), then it does not act morally and freely, but heteronomously. As a consequence of AI’s lack of autonomy, and thus lack of access to the moral law, it does not and cannot have a moral understanding that proceeds from the moral law. Another consequence is that it has no sense of duty, which would follow from the moral law. Thus, moral action becomes impossible for the AMA because it lacks autonomy and moral law, moral understanding and sense of duty. It is concluded that, first, AMA not only cannot be moral, but should not be that, since the inclusion of any moral principle would imply the necessity for the individual to choose it, making the choice of the principle itself immoral. Second, although AI has no will as such, which prima facie makes not only moral but also legal action impossible, it can still act legally in the sense of conforming to legal law, since AI carries a quasi-human will. Thus, it is necessary that the creation of AI should be based not on moral principles, but on legal law that prioritises human freedom and rights. (shrink)

Die Philosophie des F.W.J. v. Schelling unter theologischen Gesichtspunkten zu betrachten, ist kaum ungewöhnlich. Man kann sich dabei nicht zuletzt auf Schöllings eigene Charakterisierung seiner Philosophie als primär philosophische Theologie stützen, denn: „Philosophie ist nur so lange wirklich Philosophie, als noch die Meinung oder Gewißheit übrig ist, daß sich durch sie über Dasein oder Nichtdasein Gottes etwas wissenschaftlich ausmachen lasse". Der Vorsokratiker Parmenides dagegen findet in der Theologie kaum Beachtung. Es zeigt sich aber, daß beide Philosophen eine Reihe von bemerkenswerten (...) Ähnlichkeiten aufweisen, nicht zuletzt im Hinblick auf das jeweilige Herzstück ihres Denkens, worauf sich die folgenden Ausführungen konzentrieren werden: das Konzept bzw. Erlebnis einer,philosophischen Grunderfahrung'. Bei Schelling ist dies die sogenannte intellektuelle Anschauung", bei Parmenides die Einsicht in die Wahrheit des Eon. Entscheidend ist, daß es sowohl bei Schelling, wie auch bei Parmenides nicht um bloße Theorie geht, sondern um ein wesentliches existentielles Erlebnis, das dann systematisch entfaltet wird. Para esto se explica qué son los espacios públicos dentro de las ciudades, los espacios públicos se conforman por los encuentros que posibilitan la memoria histórica y los usos y costumbres que propician su "apropiación simbólica", la constitución del genius loci. Las movilizaciones políticas se apropian de los espacios públicos, que se transforman momentáneamente en "espacios políticos", cuya (...) fuerza, carácter y carga simbólica se asimilan a proyectos de identidad, capacidad de movilización y acción política. It's not my place to talk about politics, I'm not a political scientist or even a sociologist. My business is logic, theory of argumentation and communication. So I can only speak confidently about how we reason and how we try to convince someone with the help of our reasoning. Let's look at several arguments, which are offered to us, if not by the state itself, then by those who agree with the "special operation" in Ukraine.

The essence of the financial stability of public and communal higher educational establishments in the context of current socioeconomic situation in Ukraine has been determined as a state of the financial resources which enables educational establishments to organize the qualitative educational and scientific activity and form the occupational competitiveness of graduates on the base of complete and timely financing of submitted expenditures. The basis of efficient economical activity (including fulfillment of special-purpose programmes) and qualitative educational services is the reception of (...) plan special-purpose financial recourses. The author has explored that current practice of the assessment of the financial stability of state higher educational establishments doesn’t take into account the main aspects of this process in their interconnection and interdependence. The intellectual model of estimating the financial stability of state higher educational establishments has been developed on the base of fuzzy logic which enables to assess the level of the financial stability of educational establishments via simultaneous application of quantitative (maneuverability equity ratio, autonomy coefficient, funding coefficient, the ratio of correlation conducted expenditures and income received, the ratio of payables and receivables, the ratio of the approved cost estimate of special and general funds, the ratio of cash and actual expenditures) and qualitative (assessment of scientific and educational potential quality, assessment of education quality, evaluation of international recognition, the graduates satisfaction of received education and the opportunity to use it in work, employers perception of quality of education in Ukrainian universities, experts perceptions of the quality of education in Ukrainian universities, cooperation between universities and companies-employers) indexes. The right to resist and the right to rebel have again become relevant as legal problems. Their justifications traditionally derive from natural law, human rights, the principle of the lesser evil or of the social contract. Interpretation of the right to resist expresses the tendencies to the law of people, in particular, the right to self-determination, distinguishing national and international understanding, and underscores the special nature of such right. Also, two-level research of the right to resist should be distinguished research (...) of the right to resist – the first is a debate about the nature character and legislative consolidation of this right, partly focused on preventive-limiting its properties, whereas the second one is updated at the time of social upheaval and legal concerns, and it contains not only the evaluation of the events, but sometimes attempts to justify ex post risk of abuse and original post-legitimation of public authorities. An important condition for the existence of the right to resistance is a legitimate aim. This could be called the internal condition, which is provided by those who implement this right. Other condition (which can be called external) and the base of implementation should recognize certain actions, acts or decisions by public authorities – those that violate human rights are illegal and unfair. At the same time, the purpose and result of the right to resistance may be changes in the public authorities, the termination of abuse of authority and violation of human rights by its agents, return to democratic legal regime or change in the constitutional system, aimed at creating a state of law, as well as in some cases, when combined with the right to self-determination, – the achievement of independence. The author of the present paper considers that the right to resist is an individual right, a human right. The author inclines to the idea of the collective nature of the right to resist implementation, but warns against simply counting the number of persons engaged in it. In other words, it does not matter how many people commit acts, but it does matter how many people support them. Considering the modalities of implementing the right to resist, it should be noted that these forms can be active or passive, expressed in actions directly or indirectly. The right of rebellion is an extreme form of the right to resist, which is carried out in case if the non-violent means of resistance are exhausted or proved ineffective. The conditions (and bases) of the right of rebellion are phenomena, such as the following: (1) massive human rights violations by public authorities (quantitative criterion); (2) systematic human rights violations by public authorities (accumulating criterion); or (3) extraordinary human rights violations by public authorities (criterion by serious, explicit and violent nature of the violation). Ambiguous is an issue of the limits of the right of rebellion, its permission and proportion, as well as whether it is possible to develop a mechanism for exercising this right. (shrink)

Solutions to word problems are moderated by the semantic alignment of real-world relations with mathematical operations. Categorical relations between entities are aligned with addition, whereas certain functional relations between entities are aligned with division. Similarly, discreteness vs. continuity of quantities is aligned with different formats for rational numbers. These alignments have been found both in textbooks and in the performance of college students in the USA and in South Korea. The current study examined evidence for alignments in Russia. Textbook analyses (...) revealed semantic alignments for arithmetic word problems, but not for rational numbers. Nonetheless, Russian college students showed semantic alignments both for arithmetic operations and for rational numbers. Since Russian students exhibit semantic alignments for rational numbers in the absence of exposure to examples in school, such alignments likely reflect intuitive understanding of mathematical representations of real-world situations. The current research aims to answer the following question: “who will be held responsible for harm involving an artificial intelligence system?” Drawing upon the literature on moral judgments, we assert that when people perceive an AI system’s action as causing harm to others, they will assign blame to different entity groups involved in an AI’s life cycle, including the company, the developer team, and even the AI system itself, especially when such harm is perceived to be intentional. Drawing upon the (...) theory of mind perception, we hypothesized that two dimensions of mind: perceived agency—attributing intention, reasoning, pursuing goals, and communicating to AI, and perceived experience—attributing emotional states, such as feeling pain and pleasure, personality, and consciousness to AI—mediated the relationship between perceived intentional harm and blame judgments toward AI. We also predicted that people are likely to attribute higher mind characteristics to AI when harm is perceived to be directed to humans than when it is perceived to be directed to non-humans. We tested our research model in three experiments. In all experiments, we found that perceived intentional harm led to blame judgments toward AI. In two experiments, we found perceived experience, not agency, mediated the relationship between perceived intentional harm and blame judgments. We also found that companies and developers were held responsible for moral violations involving AI, with developers received the most blame among the entities involved. Our third experiment reconciles the findings by showing that perceived intentional harm directed to a non-human entity did not lead to increased attributions of mind to AI. These findings have implications for theory and practice concerning unethical outcomes and behavior associated with AI use. (shrink)

Introduction. The article examines the role of youth culture (in particular, counterculture and subculture) in reformatting the modern sociocultural space. As long ago asin the 1970s. the researchers pointed out that young people, showing their active position, change the realities of the socio-cultural space in which their parents lived. The research is based on the materials of the graffiti and street art subculture, as an informal artistic practice. The graffiti subculture emerged among African American teenagers in the 1970s in New (...) York City. The first label that this subculture has been endowed with by society and city authorities is vandalism. However, in the late 1970s early 1980s graffiti is involved in the sphere of the art world institutions activities (private galleries) and becomes in demand among collectors. Street art emerges under its influence. The aim of the study is to reveal due to what characteristics of the socio-cultural space the transition from deviation (vandal practice) to the asserting norm became possible. Methods. The methodological basis of the research is the theory of generations by K. Mannheim and his concept of «fresh contact», which indicates the rethinking of the previously assimilated sociocultural experience by the subjects of culture. Another methodological basis is the concept of rhizome, introduced into scientific circulation by the philosophers J. Deleuze and F. Guattari. Scientific novelty of the research. It is shown how the rhizomatic principle of organizing culture is realized during the transition of youth practice from the space of deviant, in accordance with social norms, actions into the institutionalized space of the art world. Results. Using the example of the metamorphosis that the youth subculture of graffiti underwent in the late 20th — early 21st centuries, the author shows how the boundaries between norm and deviation are shifting in modern society. Conclusions. The rhizom principle, clearly manifested in the organization of the space of postmodern culture, allows graffiti and street art to make the above transition. The fall of the great narrative in the art world leads to the loosening of hierarchies and creates an opportunity for the integration of once marginal phenomena into the space of official art. K. Mannheim’s concept of «fresh contact» is effective in the study of postmodern culture. (shrink)

The article presents literary, sociological and cultural points of view on the problem of the literary canon, describes the mechanisms of canonization and defines the boundaries of the Russian classics. The author discovers a connection between the texts claiming the status of the canonical hierarchy and the question of ethnicity. The article establishes that the construction of both a national self-portrait and the image of a foreigner (the Other) are the most important functions of the classical canon. The object of (...) this research is a unified discursive field of Russian classical literature. The subject is the generalized image of the German that forms in this field. The author, resorting references to current research practices of discourse analysis, establishes that the portrait of a German is based on such conceptual categories as: 1) the connection with the soil and nature, 2) the connection with roots, 3) reliance on reality and "mundanity", 4) planning, 5) positivism and subordination, 6) perception of life as a mechanism. The construction of the Other creates an opposition to the "Russian" in the structure of the classical text and builds a series of binary pairs: heredity / freedom, stability on the ground / ability to jump, clear planning / dreaminess, legalism / Paschality, self-aggrandizement / self-abasement, godlessness / Orthodoxy. The article reveals that the German hero acts as a constituent of the Other, provoking self-determination and self-identification. (shrink)

The article is devoted to the Russian Symbolist poet Vyacheslav Ivanov’s perception of Evgeny Boratynsky’s poetry. The specific focus is on Ivanov’s interest concerning the way Boratynsky’s lyrics relate to his philosophy of art. The article examines various types of lyrics in which Ivanov echoes Boratynsky’s poetry. One of these is a revival of the genre of “friendly epistles,” a genre that was popular in Russian poetry of the Golden Age. In poems of this type, Ivanov uses some of the (...) artistic principles typical of “Pushkin era” poems and refers to Boratynsky’s works. The article features Ivanov’s address to Boratynsky in the poem “Before Boratynsky’s portrait,” which serves Ivanov as a means to express his main aesthetic concepts. The article concludes with a suggestion that one of the reasons why these poets belong to the tradition of “the poetry of thought” is the influence of Goethe on both. (shrink)

The paper provides a conceptual study of network conflict phenomenon, identifying the essence and specifics of its manifestation in the social system. The process of modifying the system of social interaction, which leads to the formation of many political, economic and social contradictions, contributes to the formation of network conflicts. The paper identifies such essential characteristics of network processes that affect the dynamics of a conflict situation, such as, first, physical distance and the anonymity of network actors. They contribute to (...) the formation of a sense of responsibility lack for the consequences of the conflict, create the illusion of absence rules, which can lead to a wrong perception of the problem and increase conflict. Secondly, sensory reduction, the inability to create a complete image with visual information leads to a deterioration of mutual understanding. Third, the appearance of the illusion of understanding the actor’s actions due to the creation of a distorted representation and incorrect perception of the information provided. Fourth, the absence of sanctions for violating values and norms makes it impossible to control the development of a conflict situation. Fifth, shortening the time interval for transmitting information creates, on the one hand, opportunities to control the speed of communication and forms additional opportunities for thinking about the problem, on the other hand, leads to the creation of the illusion of control over the situation. The article deals with the ontological, phenomenological and axiological modes of interaction of network structures in the situation of conflict confrontation. The paper concludes that the most effective way to reduce the impact of destabilizing factors on the system is systematically changing the network of interactions between its structural elements. Any system tends to adapt to the changed conditions of existence. Lack of regulation can lead to the destruction of network education. At the same time, the transformation of the conflicting form of interaction between actors leads to a change in the network. The study of conflicts, features and specifics of network elements interaction is practically significant, because this analysis will help to detect and activate integrative social mechanisms. The article discusses the characterization of the visualization of visible reality in Crime and Punishment by Fyodor Dostoyevsky. The author suggests that semiotic and legal analysis should be used to understand the meaning of the color code of the novel. Semiotic discourse reduces the ambiguity, uncertainty, and expression of the color code to a conscious, discrete, and conditioned meaning of individual colors. Legal analysis helps to better understand the main idea and other aspects of the novel, encoded in colors. Psychological, (...) personal associations, and symbolic methods are used to reveal direct and indirect meaning of the colors used by Dostoyevsky. The basic characterization of colors proposed by Goethe is employed as a key for color decoding. The article also establishes the correlation of the color code of the novel with the colors of the flags of the Russian Empire and the German Confederation. The message and meaning of the same colors of these national flags are contrasted. The interpretation is complemented by the author’s drawings, which enable to visualize the color code that stores and transmits information about national identity. (shrink)

The Belarusian-Russian scientific-practical conference “Designing the Future and the Horizons of Digital Reality” is an outcome of long-term cooperation between scientists of the Institute of Philosophy of the National Academy of Sciences of Belarus, M.V. Keldysh Institute of Applied Mathematics, and the Institute of Philosophy of the Russian Academy of Sciences. We are highly tuned to each other's visual attention. Perceiving the eye or hand movements of another person can influence the timing of a saccade or the reach of our own. However, the explanation for such spatial orienting in interpersonal contexts remains disputed. Is it due to the social appearance of the cue—a hand or an eye—or due to its social relevance—a cue that is connected to another person with attentional and intentional states? We developed an interpersonal version of the (...) Posner spatial cueing paradigm. Participants saw a cue and detected a target at the same or a different location, while interacting with an unseen partner. Participants were led to believe that the cue was either connected to the gaze location of their partner or was generated randomly by a computer (Experiment 1), and that their partner had higher or lower social rank while engaged in the same or a different task (Experiment 2). We found that spatial cue‐target compatibility effects were greater when the cue related to a partner's gaze. This effect was amplified by the partner's social rank, but only when participants believed their partner was engaged in the same task. Taken together, this is strong evidence in support of the idea that spatial orienting is interpersonally attuned to the social relevance of the cue—whether the cue is connected to another person, who this person is, and what this person is doing—and does not exclusively rely on the social appearance of the cue. Visual attention is not only guided by the physical salience of one's environment but also by the mental representation of its social relevance. (shrink)

The article considers reflection as a method and condition of the transcendental philosophy of Kant and Husserl. At the beginning, the author refers to Kant's predecessors who used the term reflection (Wolf, Baumgartner) and concludes that Kant, when referring to reflection, rather adheres to the tradition laid down by Leibniz. Based on the text of the “Critique of Pure Reason”, the article argues that it is with the help of reflection that the formation of a priori categories and a priori (...) synthetic principles can be explained. The author distinguishes between reflection and the transcendental unity of apperception and examines, within the framework of the phenomenological interpretation of the “Critique of Pure Reason”, the role of this unity in the predilection of sensory diversity. The article shows the continuity in the understanding of reflection between transcendental phenomenology and Kant's philosophy. In Husserl's philosophy, reflection as a method is associated with reduction and contemplation. The author dwells on the features of the use of reflection in Husserl's studies, which include, first of all, the temporal language of description and the dependence of reflection on the phenomena to which it is directed. The present study examined the effects of gender on the emotional responses (physiology, self-reports of emotion, and emotional facial behaviour) of European Americans (EA) and Hmong Americans (HA) while they relived past emotional events. Women were more emotionally reactive than men: They demonstrated greater changes in electrodermal reactivity overall, reported experiencing more intense emotion while reliving anger and love, and smiled more while reliving happiness and love. The pattern and magnitude of these differences were similar for EA and HA, suggesting (...) that to some degree, the effects of gender on emotional response may hold across ethnic groups. (shrink)

Social enterprises, like almost all organizations, continuously strive for external legitimacy. To be perceived as externally legitimated by society, social enterprises often engage in strategic partnerships. However, scholars have only recently turned their attention to the legitimating function of such partnerships. The purpose of this article is to address the hitherto neglected construct of inter-partner legitimacy. Drawing on institutional theory, we hypothesize that such inter-partner legitimacy affects the resource transfer among partners, which will, in turn, be recognized by society and (...) will subsequently affect each partner’s external legitimacy. Dyadic data of 121 strategic partnerships between social enterprises and their key partners confirm our hypotheses. We add to institutional theory by integrating the often ignored dimension of inter-partner legitimacy into our analysis and demonstrate its relevance to each partner’s external legitimacy and to resource transfer. Further contributions to the literature on institutional theory, legitimacy, social entrepreneurship, and inter-organizational relationships are identified. (shrink)
