This article focuses on service provision for women who are involuntarily referred under the UK Mental Health Act (1983) into medium and high security care in England and Wales. We explore how physical and procedural security in such settings is prioritized over relational care (see also Fallon Report, Department of Health, 1999a and NHS Executive, 2000 – Tilt Report). We are not arguing against the importance of protecting the public from the acts of dangerous members of our society. However, (...) we are arguing that many of the women in our secure services are inappropriately placed and receive inappropriate forms of treatment and care. Rather than physical security, it is high relational care, which the women require. Further, we argue that current service provision often re-produces forms of violence and violation which have marked many of women's lives prior to their entry into the secure system. (shrink)

As one reads the classic works of political philosophy one is limited to books written by male authors. When reading interpretations of these authors it seems that the male philosophers were only concerned with the male citizen. Arlene Saxonhouse argues that these classic authors, from Plato to Machiavelli, while they praised the world of male public action, also recognized that the public world was not the totality of human existence. These authors, Saxonhouse says, saw that a private sphere which included (...) women existed, and that that sphere set limits upon and defined the possibilities of the public world. She argues further that the authors did not ignore the female, rather it is the inadequacies of modern scholarship that have made them appear to have done so. This volume shows how women have been an integral part of political philosophers' vision of the world, not a scattered side show in certain philosophical works. (shrink)

The college hookup scene is a profoundly gendered and heteronormative sexual field. Yet the party and bar scene that gives rise to hookups also fosters the practice of women kissing other women in public, generally to the enjoyment of male onlookers, and sometimes facilitates threesomes involving same-sex sexual behavior between women. In this article, we argue that the hookup scene serves as an opportunity structure to explore same-sex attractions and, at least for some women, to later (...) verify bisexual, lesbian, or queer sexual identities. Based on quantitative and qualitative data and combining queer theory and identity theory, we offer a new interpretation of women’s same-sex practices in the hookup culture. Our analysis contributes to gender theory by demonstrating the utility of identity theory for understanding how non-normative gender and sexual identities are negotiated within heteronormatively structured fields. Based on in-depth interviews with 18 Korean immigrant working couples, this study explores Korean immigrant working wives' ongoing challenge to male dominance at home and to the unequal division of family work. A main factor in wives' being less obedient to their husbands is their psychological resources such as pride, competence, and honor, which they gain from awareness of their contribution to the family economy. Under immigrant family circumstances in which working for family survival is prioritized, wives feel that their (...) negligence of family work, rejection of the superwoman ideal, and perceived right to demand their husbands' help with family work is legitimized. However, Confucian patriarchal beliefs lead these wives to place limits on the degree of challenge. The findings highlight the interplay of wives' psychological resources, gender norms, and the social standing of being immigrant families in affecting wives' challenge to gender inequality at home. Women in the Crossfire seeks to understand the practice of honor killing from a variety of cultural and disciplinary perspectives and analyzes empirical research on honor killing, including a large original study published here for the first time. The book examines the root causes of honor killing both in human psychology and cultural evolution, and it recommends specific measures for protecting potential victims and ending honor killing altogether.

Background Noninvasive prenatal testing (NIPT) designed to screen for fetal genetic conditions, is increasingly being implemented as a part of routine prenatal care screening in the United States (US). However, these advances in reproductive genetic technology necessitate empirical research on the ethical and social implications of NIPT among populations underrepresented in genetic research, particularly Black women with sickle cell disease (SCD).Methods Forty (N = 40) semi-structured interviews were conducted virtually with Black women in the US (19 participants with (...) SCD; 21 participants without SCD) from June 2021 to January 2022. We employed a qualitative approach to examine the study participants’ perceptions of the potential advancement of NIPT for screening SCD in the fetus. Data were analyzed using NVivo 12 qualitative software.Results The themes revealed the complexities involving the intersectional lived experiences of SCD, prenatal care, lack of synergy among health providers, and NIPT decision-making. The results further revealed that even when Black women have shared commonalities in their lived experiences while navigating SCD and motherhood, their perceptions of NIPT screening technologies are divergent.Conclusion Expanding the ethical discourse on the social implications of NIPT is critical to fully elucidate how Black women perceive NIPT’s utility, particularly as NIPT advances to screen for SCD in the fetus. Neglecting to include Black women with genetic conditions in empirical studies on NIPT may contribute to ongoing health inequities and limit and constrain reproductive choices among Black women with and without SCD. Throughout the 1980s, there was considerable public discussion in Britain about the legitimacy of scientific research upon human embryos and about the advisability of seeking to develop new science-based techniques that would further extend medical control over human reproduction. In 1990, legislation was passed permitting such research, but at the same time restricting its scope and specifying how the technologies of assisted reproduction were to be implemented. This book contains a selection of papers from the workshop *Women in the History of Analytic Philosophy* held in October 2019 in Tilburg, the Netherlands. It is the first volume devoted to the role of women in early analytic philosophy. It discusses the ideas of ten female philosophers and covers a period of over a hundred years, beginning with the contribution to the Significs Movement by Victoria, Lady Welby in the second half of the nineteenth century, and ending (...) with Ruth Barcan Marcus’s celebrated version of quantified modal logic after the Second World War. The book makes clear that women contributed substantially to the development of analytic philosophy in all areas of philosophy, from logic, epistemology, and philosophy of science, to ethics, metaphysics, and philosophy of language. It illustrates that although women's voices were no different from men's as regards their scope and versatility, they had a much harder time being heard. The book is aimed at historians of philosophy and scholars in gender studies. (shrink)

In their political treatises, the scholastic writers Ptolemy of Lucca and Giles of Rome discussed the question of whether women should serve in the military. The dispute came in response to Aristotle, who reported in his Politics that Plato and Socrates taught that women should receive the same military training as men and take an equal part in fighting. Such a treatment was made possible by a medieval context in which women under certain circumstances could be feudal (...) lords responsible for maintaining a contingent of knights and sometimes commanding them, and in which a large number of medieval stories of women fighters or leaders of knights circulated, some of them mythical but others based on real women. Both Giles and Ptolemy ultimately rejected female participation but, in keeping with the dialectical method, proposed arguments on both sides. These involve historical precedent, the biological and medical differences between men and women, analogies between female animals and women, divinely ordained gender roles, and the benefits of exercise. The dehumanisation of women has been recorded in world history. In religions one can easily find interpretations that tend to be discriminatory against women. This research aims to see the humanisation of women in the Tafsir Faidh Ar-Rahman by Kiai Sholeh Darat towards the position of women in Islam. This research is a library research. Data collection was done through documentation. Furthermore, the data were analysed qualitatively by a descriptive method. The results of the study showed (...) that. The humanisation of women in the Tafsir Faidh Ar-Rahmân by Kiai Sholeh Darat on the position of women in Islam is; he emphasised that women have an equal position with men. In terms of inheritance, Kyai Sholeh Darat wanted flexibility in understanding the verse regarding the portion of inheritance 2:1 so that the provisions can adapt according to the situation. In certain contexts, women may get the same share as men. Contribution: The thoughts of Kiai Sholeh Darat have contributed to being one of the references in looking at women’s issues in Islam objectively. (shrink)

I discern in Greek myths of the goddess Athena traces of the idea of domination of mind over senses, and that men were seen as superior to women because of their naturally ruling mind. The Athenian, Platonic, androcentric, hierarchical worldview saw women as physically inferior to men. Behind courageous, wise Athena, lies Plato’s dualistic philosophy of reason, and the ideology of control. We must make a distinction between a dualistic philosophy and a holistic approach to reality. This article compares the ways in which Saba Mahmood’s The Politics of Piety and Cressida Heyes’ Self-Transformations: Foucault, Ethics, and Normalization, unlike current governmentality studies, employ the later Foucault’s ethical theory. By explaining the theoretical framework of the ‘middle’ Foucault and the ‘later’ Foucault and then comparing Mahmood and Heyes’ use of Foucault’s work, it is argued that Mahmood and Heyes’ analyses, though thought-provoking and incisive, overlook aspects of Foucault’s later work, ultimately preventing them from offering productive ‘feminist strategies’. The (...) author seeks to link this discussion to contemporary debates and analyses of agency, freedom and Muslim women in the media. The article concludes with an assessment of how Foucauldian feminist perspectives might be drawn on to establish effective ‘cross-cultural feminist strategies’, and closes by presenting a case of a cross-cultural media strategy aimed at countering the stereotypical images of Muslim women in the media. Reeves (philosophy, U. of North Carolina, Chapel Hill) wrote and presented these dialogues as part of a humanities course at Reed College in Portland, Oregon. The dialogues, which touch on many of the philosophical themes of Plato's Republic, take place between the two women students reputed to be members of Plato's Academy and Plato, their fellow students, and Aristotle.

Research on the entry of women into occupational settings confirms the importance of the structural composition of the workplace insofar as women are treated as tokens. This study examines women lawyers in terms of three consequences of tokenism: visibility, polarization, and stereotyping. The results from a survey of lawyers in southern Arizona indicate support for the theory of tokenism. Women are more likely than men to report hearing sexist jokes and remarks, to be referred to by (...) their first names, to be asked whether they are lawyers, and to receive compliments about their appearance rather than their achievements. These results highlight important gender differences in legal careers; it remains to be seen whether changes in women's numerical representation alone will be sufficient for changing the relations between dominants and tokens in legal workplaces. Women’s entry into the legal academy in significant numbers—first as students, then as faculty—was a 1970s and 1980s phenomenon. During those decades, women in law schools struggled: first, for admission and inclusion as individual students on a formally equal footing with male students; then for parity in their numbers in classes and on faculties; and, eventually, for some measure of substantive equality across various parameters, including their performance and evaluation both in and in front of the classroom, as (...) well as in the quality of their experiences as students and faculty members and in the benefits to be reaped from their tenure. This part of the story of women’s entry into the legal academy in the 1970s and 1980s—a story of attempted admission, then inclusion, then integration and assimilation, and then, finally, equality—is now a familiar one, at least in broad outline. It is not, in its entirety, an uplifting story. According to a raft of articles produced by women law students in the 1980s, 1990s, and 2000s, women law students during those decades participated less in the classroom, were called on and responded to differently when they did participate, suffered from more law-school-induced anxiety disorders and other mental health issues, graduated with lower GPAs and less law review experience, published fewer notes and filled fewer editorial positions on those journals, held fewer leadership positions overall while in law school, and had far more difficulties connecting with mentors, teachers, and would-be recommenders among the faculty than male students. Women law professors during those decades were tenured at significantly lower rates than men and, particularly at high prestige schools and at schools with fewer female faculty among the tenured ranks, were hired at lower rates that did not reflect their number in the pool of qualified applicants, had trouble asserting or maintaining authority in the classroom or being perceived as having authority, taught lower-prestige courses and received low teaching evaluations, and, like their students, were published far less frequently in the major and most prestigious law reviews. Much of this, albeit not all, has not changed much for either students or faculty. As women in law schools enter the posttenure and midcareer phase, many of the old problems persist while new ones appear: women faculty are invited to participate on panels less often than men, and both women students and faculty are underrepresented as authors in law reviews. Although gender-neutral parental leave is now available to faculty at most law schools, many such policies are still ad hoc. There is considerable worry, although no hard evidence, over whether men disproportionately use the time off to write rather than care for children. Women are still disproportionately overrepresented in some fields and underrepresented or unrepresented in others, and those fields correlate in unsurprising ways with levels of prestige: the more women in a field, the less prestigious. As elsewhere in the workforce, women faculty in legal education suffer from sexual harassment, most of which is unremedied. Women still suffer a pay gap in law schools that remains unaddressed at most universities, as it does elsewhere in academia. There is a sizeable literature on these depressing phenomena that stubbornly do not seem to abate. In these comments, however, I want to focus on another, less appreciated, part of the story of women’s entry into the legal academy in the 1970s and 1980s: the emergence of a body of scholarship—sometimes called feminist legal theory—produced by some of these women legal scholars over the same time period. The story I want to focus on, in other words, is not that of second- or third-wave women’s struggles within the academy, either for admission, acceptance, assimilation, or equality in law schools. Rather, this Article focuses on the story of the scholarship some of those second-wave assimilated women produced once they got there. Feminist jurisprudence, understood largely as scholarship on issues pertaining to gender equality, was launched in the 1970s, endures today, and continues to shape debates. Feminist legal theory, however, was in effect a subfield within feminist jurisprudence and, as its name implies, was an attempt to fashion a broad- based theoretical account of the relationship of law in liberal legal regimes to women’s subordination, patriarchy, and gender and sexual inequality— particularly in a post–civil rights era, when women enjoyed broad access to rights of formal equality, reproductive liberty, and liberal antidiscrimination law. Feminist legal theory so understood—a body of scholarship in search of a theoretical understanding of the relation of law to women’s subordination or, more simply, of law and patriarchy—was birthed in the 1970s, nurtured in the 1980s, and matured in the 1990s. I suggest in this Article that it is now seemingly in decline, and may soon disappear altogether. The reasons for this trajectory, I believe, are to date unexplored. Some reasons are fairly self-evident. Feminist legal theory was a product of three time-specific factors peculiar to the 1970s and 1980s: it reflected the political and the legal struggles of second-wave feminism. The critical theory schools were, to varying degrees, present or thriving in the academy in the 1970s and 1980s, within which feminist legal theory was birthed, grew, and then coexisted with critical theory, albeit at times very uneasily; and this feminist theory reflected second-wave women faculty and students’ mixed experiences of assimilation, success, and alienation in law schools themselves, as briefly recited above. Those three factors—the background politics, the presence of critical theory in law schools, and the differences in women’s experience of those schools—are all themselves either disappearing or dissipating in felt urgency, albeit in different ways and at different speeds, and that dissipation clearly is a part of the story of feminist legal theory’s decline. There are other reasons for its decline as well, however. Some are internal to feminism and feminist theory, and some pertain to the changing nature of legal scholarship from the 1980s to the present. I explore these reasons in Part II below. The story of the development of a distinctively feminist legal theory during the 1970s through the 1990s, and the story of its decline in the 2000s, is of obvious relevance to the history of second- and third-wave feminism. It should also be of interest for what it reveals about the nature of legal scholarship as it was understood, received, and produced in those decades. Its decline likewise reveals something about the changing nature of legal scholarship and the legal academy today. Thus, one conclusion I draw is that the feminist legal theory of the 1970s through the 1990s—regardless of the truth or lasting power of its claims—stands as an example of a type of legal scholarship that was somewhat distinctive to those decades. That form of legal scholarship, furthermore, likely can only emanate from the legal academy. For a host of reasons, we are currently in danger of losing this entire genre of intellectual work, which would be the polity’s loss, not just feminism’s or the legal academy’s. (shrink)

While the Confucian canon has much to say about women, the Analects contains a few passages that make significant observations about them. These passages deserve the close scrutiny not only because they are all the Analects has to offer on the topic of women, but, more importantly, because at least one passage has been singled out as representing a toxic misogyny that clouds any hope for the continued relevance of Confucianism in today's world. In Analects 17.25, Confucius uniformly (...) and somewhat unfairly dismisses women of servile status as grasping and manipulative, but nevertheless ranks them along with the similarly disconcerting “small men”. While Analects 17.25 also reveals Confucius' awareness of a vague obligation to his inferiors that goes beyond a desire for their unquestioning subservience, in the minds of these lowly figures, his efforts to draw close position him as nothing more than a resource to be exploited. Jesus' healing, preaching, and death are not about abstractions like “patriarchal system,” but seek to establish new patterns of personal relationship and human solidarity among all women and men, bringing liberation and healing even to those at the margins of society.

Standards of reasonableness are pervasive in law. Whether a belief or conduct is reasonable is determined by reference to what a ?reasonable man? similarly situated would have believed or done in similar circumstances. Feminists rightly objected that the ?reasonable man? standard was gender?biased and worked to the detriment of women. Merely replacing the ?reasonable man? with the ?reasonable person? would not be sufficient, furthermore, to right this historic wrong. Rather, in a wide range of cases, feminist theorists and legal (...) practitioners urged instead a standard of reasonableness that reflects the perceptions of women, a perspective informed by women?s vulnerability and oppression. In this essay I examine the role of the ?reasonable woman? standard in two areas of law ? workplace sexual harassment and self?defense ? and argue that it is both legally and politically problematic.
