It is commonly assumed that the expression “an sich selbst” (“in itself”) in Kant combines with terms to form complex nouns such as “thing in itself” and “end in itself.” I argue that the basic use of “an sich selbst” in Kant’s German is as a sentence adverb, which has the role of modifying subject-predicate combinations, rather than either subject or predicate on their own. Expressions of the form “S is P an sich selbst” mean roughly that S is P (...) ‘in its own right’ or without some further ‘condition’. Accordingly, “an sich selbst” should not be treated as forming complex nouns. This analysis has significant consequences for the interpretation of “thing in itself” in particular, for it implies that the latter is not a complete nominal expression. Instead, one must treat ‘an sich selbst’ as expressing how some S is a ‘thing’, looking to the wider sentential context. I conclude with a brief account of the new significance granted to the concept of a ‘thing’ (Ding) according to the present interpretation. (shrink)

In this, the sixth chapter of _Kantsequentialism: A Morality of Ends_, I argue that the duty of beneficence is best understood as a duty both (a) to adopt helping the needy as a serious, major, continually relevant, life-shaping end and (b) to refrain from acting in a way that would manifest one’s failure to do so. What’s more, I argue that Kantsequentialism offers us the best account of whether an act manifests a failure to have adopted helping the needy as (...) such a life-shaping end. I start by considering some alternative accounts of our duty of beneficence, examining where each goes wrong. I then conclude by showing how Kantsequentialism offers us the best approach to accommodating agent-centered options. (shrink)

The application of recycled aggregate as a sustainable material in construction projects is considered a promising approach to decrease the carbon footprint of concrete structures. Prediction of compressive strength of environmentally friendly concrete containing recycled aggregate is important for understanding sustainable structures’ concrete behaviour. In this research, the capability of the deep learning neural network approach is examined on the simulation of CS of EF concrete. The developed approach is compared to the well-known artificial intelligence approaches named multivariate adaptive regression (...) spline, extreme learning machines, and random forests. The dataset was divided into three scenarios 70%-30%, 80%-20%, and 90%-10% for training/testing to explore the impact of data division percentage on the capacity of the developed AI model. Extreme gradient boosting was integrated with the developed AI models to select the influencing variables on the CS prediction. Several statistical measures and graphical methods were generated to evaluate the efficiency of the presented models. In this regard, the results confirmed that the DLNN model attained the highest value of prediction performance with minimal root mean squared error. The study revealed that the highest prediction performance could be attained by increasing the number of variables in the prediction problem and using 90%-10% data division. The results demonstrated the robustness of the DLNN model over the other AI models in handling the complex behaviour of concrete. Due to the high accuracy of the DLNN model, the developed method can be used as a practical approach for future use of CS prediction of EF concrete. (shrink)

In this chapter, we compare Kant and James’ accounts of freedom. Despite both thinkers’ rejecting compatibilism for the sake of practical reason, there are two striking differences in their stances. The first concerns whether or not freedom requires the possibility of an open future. James holds that morality hinges on the real possibility that the future can be affected by our actions. Kant, on the other hand, seems to maintain that we can still be free in the crucial sense, even (...) if none of our actions can have any effect on the future. The second difference between them is related, and concerns the location of freedom. Kant views experience as determined by natural necessity, and locates freedom outside of it, in things-in-themselves. James, on the other hand, has a richer conception of experience than Kant, and holds that we can locate our freedom within experience alone. In the end, we contend that James has a better account of how freedom relates to our experience, but this comes at a cost. For while Kant's account struggles with the relationship between freedom and experience, it has the advantage of insulating our freedom from potential empirical challenges. (shrink)

The case (Dawson et al. 2024) describes an Institutional Review Board (IRB) chair who seeks consultation about waiving the requirement that investigators obtain prospective, informed consent for collection of microbiome samples by swabbing the perianal region of severely burned patients shortly after their admission to an intensive care unit (ICU). We argue that it is ethically permissible to waive informed consent requirements for the perianal swab and that the IRB should approve a waiver as permitted by regulations.

Conscience and conscientious objections are important issues in medical law and ethics. However, discussions tend to focus on a particular type of conscience-based claim. These types of claims are based upon predictable, generalizable rules in which an individual practitioner objects to what is otherwise standard medical treatment. However, not all conscience based claims are of this type. There are other claims which are based not on an objection to a treatment in general but in individual cases. In other words, these (...) cases may involve practices which the doctor does not usually object to but does so in this instance on these facts. This paper will explore these types of conscience-based claims in two ways. First, it will explore whether these types of individualised conscience-based claims are really conscience claims at all. This understanding of intention and willing, as distinguishable from intentional action, provides a foundation upon which the moral goodness of actions can be determined. “For an action to be good,” Lombardo argues, “it must do more than simply advance our natural inclinations: it must also avoid frustrating them. Only actions that both advance our natural inclinations and avoid frustrating them are morally good” (49). When moral actions have good effects and nonintended bad effects that do not outweigh the good effects—as in cases of self-defense or the use of medicine and medical procedures—these complex actions retain their moral goodness, notwithstanding the bad effects. The reason for this is that the bad effects are not included in the agent’s intention. Lombardo presents the crucifixion of Christ as one of these complex cases in which the bad effects can be separated from the agent’s intention. Chapter 3 explores the reasoning associated with the principle of double effect to clarify how actions implicated in bad or evil effects can be judged to be morally good. Lombardo is hesitant to identify double effect as an isolated principle that is applicable within unique circumstantial cases. Rather, he presents double effect as “merely an algorithm for applying basic concepts to morally ambiguous actions” (72). For example, in addition to affirming that the intended effects of the action are consistent with our natural inclinations, in cases of double-effect reasoning “the action’s positive, intended effects [must] outweigh the action’s negative, nonintended effects” (73). This material, in turn, connects logically with the conclusion of chapter 4 on the ethics of self-sacrifice: “double effect reasoning shows that it can be acceptable, and even heroic, to cause our own death non-intentionally for the sake of some greater good” (79). Kasper's Theology and Church (pp. 94-108; Kasper says simply, "Rahner's characterization of neo-Chalcedonianism is historicaly inaccurate," p. 214, note 18). As it is, Ols's treatment reminds us that Rahner's own writings, which overlooked the later Councils of Constantinople, presume that Chalcedon had been the end of a development in Christology; this inaccurate presumption (...) has dominated too much of the writing which has followed Rahner's essay. Ols returns to this problem of " latent monophysitism " in some classical christologies in the final chapters of his work (VIII-XI). With a careful examination of the christology of Aquinas, the author skillfully demonstrates the rich development of Christ's true humanity that is possible within the classical approach; he deals specifically with the topics of Christ's knowledge, his sinlessness, and the concept of person. (It is interesting to note that, like Rahner and others before and after, Ols thinks that the word "person" is not particularly felicitous and would prefer simply the word hypostasis or subsistence [p. 187]. His wish is likely to have no more success than previous suggestions in this regard.) Although limited in its intent, this hook is rich in many ways. Ols's knowledge of St. Thomas is deep, and he uses that knowledge well. Several good hooks on Kant's political philosophy have appeared in the past decade, hut the literature on Kant's political philosophy is still both slimmer and weaker than on any other aspect of his thought. 536 BOOK REVIEWS Though we still await a definitive study of the topic, this book goes a long way toward filling some important gaps. Even the best books on Kant's political philosophy tend to treat only the broad outlines of Kant's position, shying away from detailed exposition of Kant's theories of individual right and external possession and of the political theory based on them. Mulholland's is not only the most detailed but also the most persuasive account of these matters which has yet been presented in English. The book's first four chapters attempt to lay the foundations for Kant's political philosophy through a general discussion of his ethical theory. The main function of these (somewhat overlong) introductory chapters is to argue for a tension between the law of nature formula (which Mulholland prefers as a guide to Kant's theory of right) and the formula of humanity as end in itself. According to Mulholland, the law of nature formula leads to a theory of rights and political obliga· tion which places Kant in the natural law tradition, whereas the formula of humanity commits him to what Mulholland calls the " deed principle ": that acquired rights can come about only through a deed on the part of those having the duties corresponding to the rights through which these duties have been assumed. Mulholland argues that if we take the deed principle strictly, then we must base political obligation on consent and thus on a social contract. The role of witness is a recurring theme in the work of Stanley Hauerwas: it is through enacting the truth in a world of lies, through seeking peace in a world of violence, that witnesses show who God is, who we are, and what the world is like. The Necessity of Witness is a study of Hauerwas and his fascinating but complex understanding of witness. Ariaan W. Baan argues that Hauerwas's approach makes a significant contribution to current debates in systematic (...) theology on the relation between truth and life. Reading Hauerwas can be a precarious adventure. His rhetoric is overwhelming, but his argument is not always crystal clear and carefully formulated. With the help of semiotic and philosophical analysis and biblical exegesis, Baan articulates Hauerwas's intuitions, fills some of the gaps in his argumentation, and discloses hidden biases. The results of this analysis sometimes surprise. Baan notes that unexpected pericopes in Scripture such as Isaiah and Revelation support Hauerwas's account of witness, and concludes that his work offers insight into how in our late modern society such diverse groups as martyrs and pop stars offer implicit witness through their lives. Ursula K. Le Guin’s classic work of anarchist literature, _The Dispossessed_ (1974), is preoccupied with the issue of imprisonment. This is hardly surprising given anarchism’s longstanding critical engagement with the prison as state apparatus. For classical anarchists, the prison represents one of the most vile and visible examples of state repression. However, while the abolition of prisons constitutes one of the fundamental goals of anarchism, the alternatives put forth by classical anarchist thinkers risk perpetuating the underlying power relations of carceral (...) justice by encouraging social shaming and the policing of norms. The anarchist society of _The Dispossessed_ uses these techniques to discourage the accumulation of power in order to create an egalitarian society. Unfortunately, these same techniques encourage a conformity that hinders other anarchist values, such as creativity and individual self-determination. In essence, the anarchist society depicted in the novel replaces the literal prison with a different form of imprisonment—the social prison, which continues the repressive function of the state through different means. By creating an “ambiguous” anarchist utopia, Le Guin anticipates the critiques of classical anarchism formulated by poststructural and postmodern anarchist theorists. These critiques are most evident in the theme of imprisonment that threads throughout the novel. (shrink)

The rhetoric of 'needs' has been used to legitimate all major turns in UK health policy since 1936. This study identifies the ethical, policy and technical issues arising from the concept of needs. In the first part a theory of needs is developed, which takes into account both the philosophical traditions and the practical problems arising in daily health care. In a second part, health systems throughout the world are described and compared, addressing ethical as well as economical questions.
