Super Visa Program: Immigration Policy Changes and Social Injustice under the Neoliberal Governmentality in Canada.Ivy Li, Sepali Guruge & Charlotte Lee - 2023 - Studies in Social Justice 17 (3):477-494.
In November 2011, Citizenship and Immigration Canada paused the parents/grandparents (PGP) sponsorship immigration and announced a new Super Visa program simultaneously to facilitate family reunification, specifically among older adults waiting to be reunified with their children in Canada. We conducted a qualitative study to understand the experiences of immigrant families with the Super Visa Program. In total, 19 semi-structured interviews were conducted in Toronto with Chinese immigrants and parents holding a Super Visa. Our findings (...)

    A Theory of Legal Personhood.Visa A. J. Kurki - 2019 - Oxford University Press.
This work offers a new theory of what it means to be a legal person and suggests that it is best understood as a cluster property. The book explores the origins of legal personhood, the issues afflicting a traditional understanding of the concept, and the numerous debates surrounding the topic.

  3. Rights, Harming and Wronging: A Restatement of the Interest Theory.Visa A. J. Kurki - 2018 - Oxford Journal of Legal Studies (3):430-450.
This article introduces a new formulation of the interest theory of rights. The focus is on ‘Bentham’s test’, which was devised by Matthew Kramer to limit the expansiveness of the interest theory. According to the test, a party holds a right correlative to a duty only if that party stands to undergo a development that is typically detrimental if the duty is breached. The article shows how the entire interest theory can be reformulated in terms of the test. The article (...)

    How dare you think divergently!Visa Helenius - 2022 - Approaching Religion 12 (1):36-54.
Freethinking seems to be desirable because the human being is seen as an independently thinking being. However, as is well known, freethinking should not be taken for granted: ideological indoctrination, manipulation and propaganda, inter alia, are versatile tools for rulers and, in consequence, regularly repeated phenomena. One of the most drastic intellectual turning points in history occurred in the seventeenth and eighteenth centuries, when the incontestable religious world view of European civilization changed along with early modern science and the Age (...)

  5. Legal Personhood: Animals, Artificial Intelligence and the Unborn.Visa A. J. Kurki & Tomasz Pietrzykowski (eds.) - 2017 - Cham: Springer.
This edited work collates novel contributions on contemporary topics that are related to human rights. The essays address analytic-descriptive questions, such as what legal personality actually means, and normative questions, such as who or what should be recognised as a legal person. As is well-known among jurists, the law has a special conception of personhood: corporations are persons, whereas slaves have traditionally been considered property rather than persons. This odd state of affairs has not garnered the interest of legal theorists (...)

  7. Why Things Can Hold Rights: Reconceptualizing the Legal Person.Visa Kurki - 2017 - In Visa A. J. Kurki & Tomasz Pietrzykowski (eds.), Legal Personhood: Animals, Artificial Intelligence and the Unborn. Cham: Springer.
The chapter argues that the traditional theories of legal personhood, which associate legal personhood with the holding of rights, are outdated and should be reassessed. Many modern theories of rights come into conflict with our convictions regarding who or what is a legal person. For instance, most jurists would agree that foetuses are not natural persons but new-born children are. However, if we apply the so-called interest theory of rights, we will note that foetuses hold various rights, such as rights (...)

Legal Personhood and Animal Rights.Visa Kurki - 2021 - Journal of Animal Ethics 11 (1):47-62.
A relatively recent form of animal activism is lawsuits intended to declare some animals as legal persons. A pioneer of this approach is the U.S.-based Nonhuman Rights Project. This organization’s primary strategy has been to invoke the writ of habeas corpus, which protects the right to personal freedom of “persons.” The article criticizes the notion of legal personhood that the NhRP is employing and explains how an alternative understanding of legal personhood could perhaps make nonhuman rights more palatable for courts.

  9. Animals, Slaves, and Corporations: Analyzing Legal Thinghood.Visa A. J. Kurki - 2017 - German Law Journal 18 (5):1070-1090.
The Article analyzes the notion of legal “thinghood” in the context of the person–thing bifurcation. In legal scholarship, there are numerous assumptions pertaining to this definition that are often not spelled out. In addition, one’s chosen definition of “thing” is often simply taken to be the correct one. The Article scrutinizes these assumptions and definitions. First, a brief history of the bifurcation is offered. Second, three possible definitions of “legal thing” are examined: Things as nonpersons, things as rights and duties, (...)

Aspirational Talk in Strategy Texts: A Longitudinal Case Study of Strategic Episodes in Corporate Social Responsibility Communication.Visa Penttilä - 2020 - Business and Society 59 (1):67-97.
This article examines the embeddedness of corporate social responsibility (CSR) communications in strategic planning. By drawing on the idea that talk and texts about CSR are an essential part of responsibility practices, I study how CSR aspirations—responsibility-related organizational self-descriptions, goals, and ideals that the organization cannot yet live up to or that the organizational constituents deem necessary to maintain—are intertwined with strategy texts and strategic episodes. Conducting a qualitative case study on a series of biennial strategy processes over a 20-year (...)

  11. Hohfeldian Infinities: Why Not to Worry.Visa A. J. Kurki - 2017 - Res Publica 23 (1):137-146.
Hillel Steiner has recently attacked the notion of inalienable rights, basing some of his arguments on the Hohfeldian analysis to show that infinite arrays of legal positions would not be associated with any inalienable rights. This essay addresses the nature of the Hohfeldian infinity: the main argument is that what Steiner claims to be an infinite regress is actually a wholly unproblematic form of infinite recursion. First, the nature of the Hohfeldian recursion is demonstrated. It is shown that infinite recursions (...)

  15. Does a person have a right to attention? Depends on what she is doing.Kaisa Kärki & Visa Kurki - 2023 - Philosophy and Technology 36 (86):1-16.
It has been debated whether the so-called attention economy, in which the attention of agents is measured and sold, jeopardizes something of value. One strand of this discussion has focused on so-called attention rights, asking: should attention be legally protected, either by introducing novel rights or by extending the scope of pre-existing rights? In this paper, however, in order to further this discussion, we ask: How is attention already protected legally? In what situations does a person have the right to (...)

Aboitiz et al. describe a hypothesis on the origin of the isocortex. They propose the reptilian dorsal cortex to be the ancestral brain structure to the mammalian isocortex. But why did the dorsal cortex expand in mammals and not in reptiles? A change in development may have provided the mammalian cortex with the ability to organize and therefore the potential to expand.

Without Trimmings: The Legal, Moral, and Political Philosophy of Matthew Kramer.Mark McBride & Visa A. J. Kurki (eds.) - 2022 - Oxford, United Kingdom: Oxford University Press.
Professor Matthew Kramer is one of the most important legal philosophers of our time - even if the label 'legal philosopher' does not do justice to the breadth of his work. This collection of essays brings together esteemed philosophers, as well as junior scholars, to critically assess Kramer's philosophy. The contributions focus on Kramer's work on legal philosophy, metaethics, normative ethics, and political philosophy. The volume is divided into six parts, each focusing on different aspect of Kramer's work. The first (...)
