Judicial activism is a contested phenomenon, with the liberals and even the conservatives championing it while denouncing its particular manifestations. In this article, I examine the recent judicial practice of one of the most activist judiciaries in the world, that of India, where progressive politics is often, and sometimes always, associated with an activist and benign court. Indeed, the Indian Supreme Court has a global reputation as a torchbearer on human rights. In this article, I adopt a social movement perspective (...) to understand the actual impact of the court on the struggles of the poor for livelihood, resources, values, and identity, enacted through struggles for the recognition and realization of economic, social, and cultural rights. After an analysis of the record of the Supreme Court of India, I conclude that the Court has increasingly shown a bias against the poor in its activist rulings and made judicial activism a more problematic device for social movements in India to rely upon. To explain why this is happening, the article introduces two ideas: first, the emergence of the judiciary as an organ of governance and its attendant problems, and second, the internally biased nature of the rights discourse which tends to reproduce binary arguments for either increasing State capacity or for increasing choice of goods in the marketplace. The article concludes by exploring lessons from the jurisprudence of other countries and international law and urges the Indian Supreme Court to reinvent a jurisprudence informed more by the social movements of the poor. Purpose – The purpose of this paper is to examine institutional influences on the customer service and complaints handling practices of the Australian Internet industry. Design/methodology/approach – The study adopted a qualitative research methodology using semi-structured interview as a research method. The study was informed by constructivist/interpretive research paradigm approaches to knowledge. Eleven senior executives from key Internet industry stakeholder organizations were interviewed. Findings – Using the neo-institutional theory lens, this study found that the institutional forces played a pivotal role (...) in bringing all Internet industry stakeholders together to address CS/CH shortcomings in the old Telecommunications Consumer Protection Code 2007. This led to significant changes to the CS/CH practices detailed in the revised TCP Code 2012. The study findings revealed that frequent and fateful collaborations between central institutional actors have led to the emergence of organizational fields. The actors identified in the emerging organizational fields actively influence the CS/CH practices and the subsequent implementation of the practices in vLISPs. Research limitations/implications – The study focused on the functional aspects of service quality. Technical aspects of SQ is equally important, and future research needs to consider both aspects of SQ when assessing overall performance of vLISPs. Practical implications – The study findings encourage vLISP managers to continue collaboration with external stakeholders and develop customer-friendly practices that deliver desirable CS/CH outcomes. Social implications – The study findings revealed that when all vLISP industry stakeholders collaborate with each other on a focal issue, there is noticeable progress towards development of CS practices that will contribute to a better CS experience. Originality/value – An evidence-based approach was used towards understanding and explaining how and why institutional actors of technology-based service organizations act together. A significant contribution arising from this study is the identification and discussion of emerging organizational fields comprising the central actors in the Internet industry. These emerging organizational fields have the potential to develop into mature organizational fields and inform future CS/CH practices and consumer protection policies in the Australian Internet industry. In this paper, we develop a conceptual framework of the intra-firm transfer of best practices in moral reasoning by integrating three streams of literature: internal knowledge transfer in strategic management, moral reasoning and epistemology in philosophy and business ethics, and leader–member exchange in human resource management. We propose that characteristics of moral reasoning (nature of moral knowledge, tacitness of moral reasoning and causal ambiguity), source characteristics (moral development of leaders), target characteristics (integrity capacity and moral development of subordinates), leader–member exchange (...) and internal ethical climate influence the transfer of best practices in moral reasoning. The present study addresses the fluid transport behaviour of the flow of gold -copper /biomagnetic blood hybrid nanofluid in an inclined irregular stenosis artery as a consequence of varying viscosity and Lorentz force. The nonlinear flow equations are transformed into dimensionless form by using nonsimilar variables. The finite-difference technique is involved in computing the nonlinear transport dimensionless equations. The significant parameters like angle parameter, the Hartmann number, changing viscosity, constant heat source, the Reynolds number, and nanoparticle volume fraction on the (...) flow field are exhibited through figures. Present results disclose that the Lorentz force strongly lessens the hybrid nanofluid velocity. Elevating the Grashof number values enhances the rate of blood flow. Growing values of the angle parameter cause to reduce the resistance impedance on the wall. Hybrid nanoparticles have a superior wall shear stress than copper nanoparticles. The heat transfer rate is amplifying at the axial direction with the growing values of nanoparticles concentration. The applied Lorentz force significantly reduces the hybrid and unitary nanofluid flow rate in the axial direction. The hybrid nanoparticles expose a supreme rate of heat transfer than the copper nanoparticles in a blood base fluid. Compared to hybrid and copper nanofluid, the blood base fluid has a lower temperature. (shrink)

Memristor-based oscillators are of recent interest, and hence, in this paper, we introduce a new Wien bridge oscillator with a fractional-order memristor. The novelty of the proposed oscillator is the multistability feature and the wide range of fractional orders for which the system shows chaos. We have investigated the various dynamical properties of the proposed oscillator and have presented them in detail. The oscillator is then realized using off-the-shelf components, and the results are compared with that of the numerical results. (...) A combination synchronization scheme is proposed which uses more than one driver systems to synchronize with one response system. Indeed, we use two different techniques where the first one consists of splitting the transmitted signals into two parts where each part is loaded in different drive systems, while the second one consists of dividing time into different intervals and loading the signals in different drive systems. It is well known that the unpredictable speech production brought on by stress from the task at hand has a significant negative impact on the performance of speech processing algorithms. Speech therapy benefits from being able to detect stress in speech. Speech processing performance suffers noticeably when perceptually produced stress causes variations in speech production. Using the acoustic speech signal to objectively characterize speaker stress is one method for assessing production variances brought on by stress. Real-world complexity and ambiguity make (...) it difficult for decision-makers to express their conclusions with clarity in their speech. In particular, the Neutrosophic speech algorithm is used to encode the language variables because they cannot be computed directly. Neutrosophic sets are used to manage indeterminacy in a practical situation. Existing algorithms are used except for stress on Neutrosophic speech recognition. The creation of algorithms that calculate, categorize, or differentiate between different stress circumstances. An amplitude controllable hyperjerk system is constructed for chaos producing by introducing a nonlinear factor of memristor. In this case, the amplitude control is realized from a single coefficient in the memristor. The hyperjerk system has a line of equilibria and also shows extreme multistability indicated by the initial value-associated bifurcation diagram. FPGA-based circuit realization is also given for physical verification. Finally, the proposed memristive hyperjerk system is successfully predicted with artificial neural networks for AI based engineering applications.

We explored the neural mechanisms allowing humans to report the subjective onset times of conscious events. Magnetoencephalographic recordings of neural oscillations were obtained while human subjects introspected the timing of sensory, intentional, and motor events during a forced choice task. Brain activity was reconstructed with high spatio-temporal resolution. Event-time introspection was associated with specific neural activity at the time of subjective event onset which was spatially distinct from activity induced by the event itself. Different brain regions were selectively recruited for (...) introspection of different event types, e.g., the bilateral angular gyrus for introspection of intention. Our results suggest that event-time introspection engages specific neural networks to assess the contents of consciousness. Subjective event times should therefore be interpreted as the result of complex interactions between introspection and experience networks, rather than as direct reproduction of the individual’s conscious state or as a mere post hoc interpretation. Megastable chaotic systems are somehow the newest in the family of special chaotic systems. In this paper, a new megastable two-dimensional system is proposed. In this system, coexisting attractors are in some islands, interestingly covered by megalimit cycles. The introduced two-dimensional system has no defined equilibrium point. However, it seems that the origin plays the role of an unstable equilibrium point. Therefore, the attractors are determined as hidden attractors. Adding a forcing term to the system, we can obtain chaotic solutions (...) and coexisting strange attractors. Moreover, the effect of three different values of the forcing term’s amplitude is studied. The dynamical properties of the designed system are investigated using attractor plots, bifurcation diagrams, and Lyapunov Exponents diagram. Phase portraits of the novel megastable oscillator are presented by FPGA design. Xilinx system generator block diagrams of the proposed system and trigonometric functions are also presented. Recently, megastable systems have grabbed many researchers’ interests in the area of nonlinear dynamics and chaotic systems. In this paper, the oscillatory terms’ coefficients of the simplest megastable oscillator are forced to blink in time. The forced system can generate an infinitive number of hidden attractors without changing parameters. The behavior of these hidden attractors can be chaotic, tori, and limit cycle. The attractors’ topology of the system seems unique and looks like picture frames. Besides, the existence of different coexisting (...) attractors with different kinds of behaviors reflects the system's high sensitivity. Using the sample entropy algorithm, the system’s complexity for different initial values is assessed. In addition, the circuit of the introduced forced system is designed, and the possibility of implicating the system with analog elements is investigated. (shrink)

Single-sided deafness (SSD) or profound unilateral hearing loss obligates the only serviceable ear to capture all acoustic information. This loss of binaural function taxes cognitive resources for accurate listening performance, especially under adverse environments or challenging tasks. We hypothesized that adults with SSD would manifest both functional and structural brain plasticity compared to controls with normal binaural hearing. We evaluated functional alterations using magnetoencephalographic imaging (MEGI) of brain activation during performance of a moderately difficult auditory syllable sequence reproduction task and (...) assessed structural integrity using diffusion tensor magnetic resonance imaging (DTI). MEGI showed the SSD cohort to have increased induced oscillations in the theta band over the left superior temporal cortex and decreased induced gamma band oscillations over the frontal and parietal cortices between 175-475 ms following stimulus onset. DTI showed the SSD cohort to have extensive fractional anisotropy reduction in both auditory and non-auditory tracts and regions. Overlaying functional and structural changes revealed by the two imaging techniques demonstrated close registration of cortical areas and white matter tracts that expressed brain plasticity. Hence, complete loss of input from one ear in adulthood triggers both functional and structural alterations to dorsal temporal and frontal-parietal areas. (shrink)

G protein‐coupled receptors (GPCRs) are the largest family of transmembrane receptors and primarily signal through two main effector proteins: G proteins and β‐arrestins. Many agonists of GPCRs promote “biased” responses, in which different cellular signaling pathways are activated with varying efficacies. The mechanisms underlying biased signaling have not been fully elucidated, with many potential “hidden variables” that regulate this behavior. One contributor is “location bias,” which refers to the generation of unique signaling cascades from a given GPCR depending upon the (...) cellular location at which the receptor is signaling. Here, we review evidence that GPCRs are expressed at and traffic to various subcellular locations and discuss how location bias can impact the pharmacologic properties and characterization of GPCR agonists. We also evaluate how differences in subcellular environments can modulate GPCR signaling, highlight the physiological significance of subcellular GPCR signaling, and discuss the therapeutic potential of exploiting GPCR location bias. Magnetoencephalography is increasingly used for presurgical planning in people with medically refractory focal epilepsy. Localization of interictal epileptiform activity, a surrogate for the seizure onset zone whose removal may prevent seizures, is challenging and depends on the use of multiple complementary techniques. Accurate and reliable localization of epileptiform activity from spontaneous MEG data has been an elusive goal. One approach toward this goal is to use a novel Bayesian inference algorithm—the Champagne algorithm with noise learning—which has shown tremendous success in (...) source reconstruction, especially for focal brain sources. In this study, we localized sources of manually identified MEG spikes using the Champagne algorithm in a cohort of 16 patients with medically refractory epilepsy collected in two consecutive series. To evaluate the reliability of this approach, we compared the performance to equivalent current dipole modeling, a conventional source localization technique that is commonly used in clinical practice. Results suggest that Champagne may be a robust, automated, alternative to manual parametric dipole fitting methods for localization of interictal MEG spikes, in addition to its previously described clinical and research applications. In this paper, we propose a new and simple method for image encryption. It uses an external secret key of 128 bits long and an internal secret key. The novelties of the proposed encryption process are the methods used to extract an internal key to apply the zigzag process, affine transformation, and substitution-diffusion process. Initially, an original gray-scale image is converted into binary images. An internal secret key is extracted from binary images. The two keys are combined to compute the (...) substitution-diffusion keys. The zigzag process is firstly applied on each binary image. Using an external key, every zigzag binary image is reflected or rotated and a new gray-scale image is reconstructed. The new image is divided into many nonoverlapping subblocks, and each subblock uses its own key to take out a substitution-diffusion process. We tested our algorithms on many biomedical and nonmedical images. It is seen from evaluation metrics that the proposed image encryption scheme provides good statistical and diffusion properties and can resist many kinds of attacks. It is an efficient and secure scheme for real-time encryption and transmission of biomedical images in telemedicine. (shrink)

Primary progressive aphasia is a clinical syndrome in which patients progressively lose speech and language abilities. Three variants are recognized: logopenic, associated with phonology and/or short-term verbal memory deficits accompanied by left temporo-parietal atrophy; semantic, associated with semantic deficits and anterior temporal lobe atrophy; non-fluent associated with grammar and/or speech-motor deficits and inferior frontal gyrus atrophy. Here, we set out to investigate whether the three variants of PPA can be dissociated based on error patterns in a single language task. We (...) recruited 21 lvPPA, 28 svPPA, and 24 nfvPPA patients, together with 31 healthy controls, and analyzed their performance on an auditory noun-to-verb generation task, which requires auditory analysis of the input, access to and selection of relevant lexical and semantic knowledge, as well as preparation and execution of speech. Task accuracy differed across the three variants and controls, with lvPPA and nfvPPA having the lowest and highest accuracy, respectively. Critically, machine learning analysis of the different error types yielded above-chance classification of patients into their corresponding group. An analysis of the error types revealed clear variant-specific effects: lvPPA patients produced the highest percentage of “not-a-verb” responses and the highest number of semantically related nouns ; in contrast, svPPA patients produced the highest percentage of “unrelated verb” responses and the highest number of light verbs. Taken together, our findings indicate that error patterns in an auditory verb generation task are associated with the breakdown of different neurocognitive mechanisms across PPA variants. Specifically, they corroborate the link between temporo-parietal regions with lexical processing, as well as ATL with semantic processes. These findings illustrate how the analysis of pattern of responses can help PPA phenotyping and heighten diagnostic sensitivity, while providing insights on the neural correlates of different components of language. This work introduces a three-dimensional, highly nonlinear quadratic oscillator with no linear terms in its equations. Most of the quadratic ordinary differential equations such as Chen, Rossler, and Lorenz have at least one linear term in their equations. Very few quadratic systems have been introduced and all of their terms are nonlinear. Considering this point, a new quadratic system with no linear term is introduced. This oscillator is analyzed by mathematical tools such as bifurcation and Lyapunov exponent diagrams. It is (...) revealed that this system can generate different behaviors such as limit cycle, torus, and chaos for its different parameters’ sets. Besides, the basins of attractions for this system are investigated. As a result, it is revealed that this system’s attractor is self-excited. In addition, the analog circuit of this oscillator is designed and analyzed to assess the feasibility of the system’s chaotic solution. The PSpice simulations confirm the theoretical analysis. The oscillator’s time series complexity is also investigated using sample entropy. It is revealed that this system can generate dynamics with different sample entropies by changing parameters. Finally, impulsive control is applied to the system to represent a possible solution for stabilizing the system. (shrink)

This paper is reporting on electronic implementation of a three-dimensional autonomous system with infinite equilibrium point belonging to a parabola. Performance analysis of an adaptive synchronization via relay coupling and a hybrid steganography chaos encryption application are provided. Besides striking parabolic equilibrium, the proposed three-dimensional autonomous system also exhibits hidden chaotic oscillations as well as hidden chaotic bursting oscillations. Electronic implementation of the hidden chaotic behaviors is done to confirm their physical existence. A good qualitative agreement is shown between numerical (...) simulations and OrCAD-PSpice results. Moreover, adaptive synchronization via relay coupling of three three-dimensional autonomous systems with a parabolic equilibrium is analysed by using time histories. Numerical results demonstrate that global synchronization is achieved between the three units. Finally, chaotic behavior found is exploited to provide a suitable text encryption scheme by hidden secret message inside an image using steganography and chaos encryption. (shrink)

Here, a novel conservative chaotic oscillator is presented. Various dynamics of the oscillator are examined. Studying the dynamical properties of the oscillator reveals its unique behaviors. The oscillator is multistable with symmetric dynamics. Equilibrium points of the oscillator are investigated. Bifurcations, Lyapunov exponents, and the Poincare section of the oscillator’s dynamics are analyzed. Also, the oscillator is investigated from the viewpoint of initial conditions. The study results show that the oscillator is conservative and has no dissipation. It also has various (...) dynamics, such as equilibrium point and chaos. The stability analysis of equilibrium points shows there are both stable and unstable fixed points. (shrink)

To understand the variations in the financial characteristics, we examine the dynamical behaviors by considering the chaotic financial model with external force. First, the dynamical characteristics are analyzed by introducing the external driven force in the price index with commodity demand. We discover that the presence of an external force causes the alternate occurrence of oscillatory and steady states as a function of time. Interestingly, we find the existence of bifurcation delay during the transition from oscillatory to steady state or (...) vice versa. Bifurcation delay is a phenomenon in which the bifurcation does not occur at the actual bifurcation point but rather at a later time, which is referred to as bifurcation delay. To confirm the delay in bifurcation, we estimate the actual bifurcation point and compare it to the observed bifurcation transition. Furthermore, to understand the variations in the bifurcation delay, we estimate the delay time between each consecutive cycle and find random fluctuations in the BD. Following that, the BD is virtualized via a transformed phase portrait. In addition, we show decreasing the value of average BD while increasing the frequency of external forcing. Second, the presence of BD is explored by incorporating external forces into the investment demand with unit investment cost. We discover the existence of a similar phenomenon with a constant bifurcation delay. (shrink)

Airway mucin secretion is important pathophysiologically and as a model of polarized epithelial regulated exocytosis. We find the trafficking protein, SNAP23, selectively expressed in secretory cells compared with ciliated and basal cells of airway epithelium by immunohistochemistry and FACS, suggesting that SNAP23 functions in regulated but not constitutive epithelial secretion. Heterozygous SNAP23 deletant mutant mice show spontaneous accumulation of intracellular mucin, indicating a defect in baseline secretion. However mucins are released from perfused tracheas of mutant and wild-type mice at the (...) same rate, suggesting that increased intracellular stores balance reduced release efficiency to yield a fully compensated baseline steady state. In contrast, acute stimulated release of intracellular mucin from mutant mice is impaired whether measured by a static imaging assay 5 min after exposure to the secretagogue ATP or by kinetic analysis of mucins released from perfused tracheas during the first 10 min of ATP exposure. Together, these data indicate that increased intracellular stores cannot fully compensate for the defect in release efficiency during intense stimulation. The lungs of mutant mice develop normally and clear bacteria and instilled polystyrene beads comparable to WT mice, consistent with these functions depending on baseline secretion that is fully compensated. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. What are the realities of research on human participants that require a new standard of informed consent, the reasonable volunteer standard, to be developed beyond the two standards in patient care, the professional standard, and the reasonable person standard? Counterpoint Arguments The following are counterpoint arguments that need to be appreciated to more fully understand the concepts that impact the thesis that ‘raw data’ should be open to the public to allow the opportunity of checking of the results of its associated scientific paper and for further analysis. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. Yet, the legal doctrines of consent and informed consent differ in their applications. In patient care, the judicial doctrines of consent and informed (...) consent are disclosure doctrines based on the obligation of physicians to inform their patients of the following types of information: the nature of the procedure the physician is recommending in the patent’s care (P), the alternatives to the physician‐recommendation (A), and the risks of procedure and its alternatives (R). In addition, the physician must provide truthful answers to the patient’s questions (Q) to the best of the physician’s abilities. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. This paper reviews the obligations that study sponsors owe to their study participants based on the very definition of research as a systematic activity whose purpose is to develop generalizable knowledge to help all humans.
