Cesare Beccaria’s On Crimes and Punishments has had a profound impact on, and made significant contributions to, among others, the study of law, justice, crime, and punishment. Unsurprisingly, there is a voluminous literature on this text. This article subjects Beccaria’s treatise to an exegetical reading and focuses on the aesthetic inquiry at heart of the text. Beccaria professes to undertake a rigorous scientific inquiry into crime and punishment. He repeatedly invokes language from modernity and the enlightenment—e.g., probability, correlation, and other (...) mathematical tools (e.g., geometry)—to ground the scientific nature of his treatise. Yet, what Beccaria engages with is aesthetic and what is produced is not scientific knowledge but aesthetic knowledge. Rather than read this as a criticism, the article highlights how the concept of justice—like beauty or virtue—is, and can only or largely be, a matter of aesthetic inquiry, and explicates why Beccaria’s text ought to be read as an aesthetic inquiry into justice. This article casts its attention on acts of supplication in institutional settings. The article focuses upon institutions geared towards the provision of care, that is, sites that are designed to provide services to those in need. The article claims that every act of supplication is an act of violence deployed upon the supplicant by his/her interlocutor and the institution more broadly. This is not violence of an overt type; it is tacit and subtle and takes root at the very essence (...) of the supplicant, that is, his/her being. The article draws on Jacques Derrida’s provocative reading of the impossibility of the gift, an analysis that is indebted to Marcel Mauss’ exposition of the gift as obligatory and, thus, an existential nullity. Drawing upon both theorists, the article theorizes the violence of the gift and proceeds to read the violence in/of care/caring. The article explicates the grounding of this violence and how it is written into each request for care. (shrink)

Background Medical ethics deals with the ethical obligations of doctors to their patients, colleagues and society. The annual reports of Sri Lanka Medical Council indicate that the number of complaints against doctors has increased over the years. We aimed to assess the level of knowledge, attitude and practice regarding medical ethics among doctors in three teaching hospitals in Sri Lanka. Methods A hospital-based cross-sectional study was conducted among doctors using a pre-tested self-administered, anonymous questionnaire. Chi Squared test, and ANOVA test (...) were used to identify the significance of association between level of knowledge and selected factors. Results Most doctors had a poor level of knowledge on medical ethics, with postgraduate trainees showing significantly higher level of knowledge. The average knowledge on medical ethics among doctors was significantly different between the three hospitals. Over 95% had a favourable attitude towards gaining knowledge and advocated the need for training. The majority indicated awareness of unethical practices. 24.6% of respondents stated that they get a chaperone ‘sometimes’ during patient examination while 3.5% never do. The majority responded that they never accept gifts from pharmaceutical companies in recognition of their prescribing pattern. 12–41% of doctors participated in the study acknowledged that they ‘sometime’ engaged in unethical practices related to prescribing drugs, accepting gifts from pharmaceutical companies and when obtaining leave. Conclusion Most doctors had a poor level of knowledge of medical ethics. Postgraduate trainees had a higher level of knowledge than other doctors. The majority showed a favourable attitude towards gaining knowledge and the need of training. Regular in-service training on medical ethics for doctors would help to improve their knowledge on medical ethics, as well as attitudes and ethical conduct. (shrink)

In former socialist countries, neoliberal reform promised to replace stagnation with growth and development. Many places, however, experienced a decade of economic decline, accompanied by rising poverty. Although even the worst performing economies managed positive growth rates by 1999-2000, this growth starts from levels as low as 36 percent of 1989 levels. Less recognized than the problem of rising poverty is the erosion of development gains in countries once characterized by high human development. This article distinguishes de-development from the widely (...) recognized issue of poverty. The authors find that transition outcomes are mixed but that de-development can be seen in parts of Central and Eastern Europe and most of the former Soviet Union. One important question is how to use renewed growth to prevent further erosion of development and to recapture lost gains. (shrink)

This collection of essays is dedicated to a recently deceased philosopher and humanist, Nalin Ranasinghe. His central philosophical and humanistic preoccupation was with the human soul. Not surprisingly, his greatest inspiration was Socrates' credo "Care for your soul," and the title of his first book was 'The Soul of Socrates'. In this and his later writings, Ranasinghe expressed his growing concern over the idea that the human soul has been highjacked due to the way our civilization has developed: (...) the highest and noblest aspirations of our civilization have been replaced by our obsession with money, pleasure, and power. We now live in a time where we do not know who we are, nor who the people around us are. Despite all of the technical gadgets connecting us virtually, this is the age of disconnect and loneliness, as well as of the degradations of humanity. Ranasinghe insisted that the two keys for recovery are the self-knowledge of the soul and a continuous dialogue with others. We need to relearn how to relate to ourselves and others as unique individuals, not as objects for the satisfaction of our needs. Following his ideas, the twenty essays presented here are divided into two parts: "the soul in reflection" and "the soul in dialogue." The contributors come from various countries around the globe and work in different disciplines, and their chapters aim to revive our interest in the soul and the obscured core of our humanity. In The Soul of Socrates Nalin Ranasinghe seeks to “reconstruct the uncanny experience of meeting” Socrates, which has been “lost in the verdant groves of academia”, by emphasizing the philosopher’s humanity, playfulness, and resoluteness in the face of modern nihilistic challenges of “fundamentalism” and “rampant materialism”. In so doing Ranasinghe challenges several current factions in Platonic scholarship, including postmodern philosophers who merely “read Plato with a view to displaying their own cleverness and urbanity,” as well as analytical philosophers (...) who “may interrogate the dialogues with the same rigor that they would lavish on a professional colleague, but... fail to see the dramatic unity of a dialogue”. Ranasinghe also sets himself apart from other scholars who “are keenly aware that a Platonic dialogue is as much a dramatic performance as a logical argument,” and yet whose interpretations paradoxically “lead to a very skeptical opinion of Socrates”. Taking his cues from such “giants” as Stanley Rosen, Leo Strauss, and Jacob Klein, Ranasinghe returns to several early Platonic dialogues, including the Republic, Protagoras, Phaedo, and Symposium, in order to “derive a more positive view of the human condition” and of Socrates’ way of life generally speaking. This positive view sees Socrates as a teacher of philosophic eros, which reflects a perennial tension between poros and penia, plenty and need, and is yet at the same time a “transcendental force that attunes the loving soul to the cosmos”.
