ABSTRACTOn 28 October 2012, Savita Halappanavar, an Indian woman living in Ireland, died in hospital while under medical care for a miscarrying pregnancy. According to her husband, her repeated requests for an abortion were ignored because of the presence of a foetal heartbeat. Ms Halappanavar’s death was a critical event in the process leading to a referendum on 25 May 2018, when the Irish electorate voted to repeal the Eighth Amendment of the Constitution, removing the constitutional ban on abortion. The (...) name Savita has become indelibly linked to the changing course of abortion politics, so it is timely to reassess the role of the media in shaping the parameters of the debate about the impact of her death on the issue. This study presents a frame analysis of Irish newspapers in the weeks following her death, mapping the political, medical, legal and socio-ethical discourses, as well as the related contemporaneous events that set the agenda for the type of debate that was to follow. It identifies four media frames: Public Tragedy, Political Opportunity, Abortion Legacy and Maternal Health. Our central argument is that the overall effect of media framing provided much face-saving for politicians in the way that the legislative issue was viewed through a conservative party-political lens, despite public outrage. The power exercised by technology companies is attracting the attention of policymakers, regulatory bodies and the general public. This power can be categorized in several ways, ranging from the “soft power” of technology companies to influence public policy agendas to the “market power” they may wield to exclude equally efficient competitors from the marketplace. This Article is concerned with the “data power” exercised by technology companies occupying strategic positions in the digital ecosystem. This data power is a multifaceted power that (...) may overlap with economic (market) power but primarily entails the power to profile and the power to influence opinion formation. While the current legal framework for data protection and privacy in the EU imposes constraints on personal data processing by technology companies, it ostensibly does so without regard to whether or not they have “data power.” This Article probes this assumption. It argues that although this legal framework does not explicitly impose additional legal responsibilities on entities with “data power,” it provides a clear normative indication to do so. The volume and variety of data and the reach of data-processing operations seem to be relevant when assessing both the extent of obligations on technology companies and the impact of data processing on individual rights. The Article suggests that this finding provides the normative foundation for the imposition of a “special responsibility” on such firms, analogous to the “special responsibility” imposed by competition law on dominant companies with market power. What such a “special responsibility” might entail in practice will be briefly outlined and relevant questions for future research will be identified. (shrink)

The applicability of Nagel's concept of theory reduction, and related concepts of reduction, to the reduction of genetics to molecular biology is examined using the lactose operon in Escherichia coli as an example. Geneticists have produced the complete nucleotide sequence of two of the genes which compose this operon. If any example of reduction in genetics should fit Nagel's analysis, the lactose operon should. Nevertheless, Nagel's formal conditions of theory reduction are inapplicable in this case. This manuscript presents a demonstration study of Quiet Time, a classroom-based Transcendental Meditation intervention. The aim of the study is to assess the feasibility of implementing and evaluating QT in two pilot settings in the United Kingdom and Ireland. This study contributes to the field by targeting middle childhood, testing efficiency in two settings operating under different educational systems, and including a large array of measures. First, teacher and pupil engagement with QT was assessed. Second, the feasibility of using a (...) quasi-experimental design and a wide range of instruments to measure changes in pupil outcomes before and after the intervention was assessed. This allows us to obtain information about which instruments might be feasible to administer and most sensitive to change. The first setting included 89 students from a primary school in the United Kingdom: those in sixth grade received the QT intervention, while those in fifth grade practiced meditation using the Headspace application. The second setting included 100 fifth- and sixth-grade students from two schools in Ireland: one received the QT intervention, the other served as a control. Recruitment and retention rates were high in both settings, and the intervention was feasible and accepted by students, parents and teachers. Implementation fidelity was lower in the United Kingdom setting where delivery started later in the school year and the practice was affected by preparation for the Standard Assessment Tests. These results show that QT may be feasibly delivered in school settings, and suggest the use of a compact battery of tests to measure impact. We find suggestive evidence that the intervention affected executive function as children who practiced QT showed improved working memory in both settings. In the Irish setting, pupils in the QT group had improved ability to control responses. These results have implications for future studies by a) demonstrating that implementation fidelity is highly context dependent and b) providing suggestive evidence of the malleability of children’s skills in middle childhood. Confirmation functions are generally thought of as probability functions. The well known difficulties associated with the probabilistic confirmation functions proposed to date indicate that functions other than probability functions should be investigated for the purpose of developing an adequate basis for confirmation theory. This paper deals with one such function, the likelihood function. First, it is argued here that likelihood is not a probability function. Second, a proof is given that, in the limit, likelihood can be used to determine which (...) of two observationally distinct hypotheses is true. Finally, a demonstration is given that, in the presence of a finite amount of experimental information, likelihood can serve as a good estimator of truth. (shrink)

Drawing on an analysis of complaint files that we conducted for the Irish Medical Council, this paper offers three possible explanations for the gap between the ubiquity of official commitments to taking patients’ complaints seriously and medical professional regulators’ dismissal—as not warranting an inquiry—of the vast majority of complaints submitted by members of the public. One explanation points to the “regulatory illiteracy” of many complainants, where the remit and threshold of seriousness of regulators is poorly understood by the general public. (...) Another points to possible processes of “institutional epistemic injustice” that unjustly undermine the credibility of certain complainants, such as those with low levels of formal education. A third explanation highlights the marginalization of the general public from “symbolic power” to define what matters in medical professional regulation. The paper is offered in a spirit of ideas in progress and raising questions rather than definitive insights into the regulatory process. (shrink)

In this article, I use a nineteenth-century anatomical collection of wax moulages, currently off-staged in the storage facilities in the university where I work, to think about the matter of human remains. Rather than seeing the gross pathology moulages as inert teaching resources, I propose they are agential assemblages, entangled in which are human remains, and that they can be included amongst the dead. I consider their capacity to perform pastpresence work, a particular kind of work of the dead that (...) foregrounds erasures, such as the erasure of the many confined women suffering from syphilis whose bodies were used to cast moulages. This article considers how such pastpresence work might help us be response-able for uncared-for remains, such as the remains of “disappeared” women and infants who died in so-called Mother and Baby Homes, which have reappeared at the center of contemporary Irish public life. At a time when moulages are being reexhibited in museums internationally, I speculate about whether and how the collection might be restaged to perform subversive and utopian pastpresence work, destabilizing the erasures of conventional narratives of medicine and contributing to the crafting of a new and more careful order of things. The burden of the present essay is to argue in favor of a proposition which is obviously true: that hypothesis choice in science is largely a rational procedure. This proposition needs arguing for because there is no philosophical theory, generally accepted as adequate, which explains why science is, or explains how science can be, rational. The main obstacles to an acceptable philosophical theory on this matter are the problems of induction . These problems seem to tell us that no amount (...) of evidence can in any way raise the probability or increase the rational believability of any hypothesis not implied by the evidence. The approach taken here is to give up on solving the problems of induction and to attempt to explain scientific rationality on some other basis. There are three main elements of this theory: rational hypothesis choice is explicated as rational acceptance of hypotheses, rather than belief; pragmatic criteria are employed to limit--always tentatively--the hypotheses under consideration; choice among hypotheses is to be made in accordance with rules that have the following property: if the true hypothesis is under consideration, then the probability of choosing the true hypothesis is greater than 0.5. Such rules correspond to what are called hypothesis testing situations in statistics. The theory is illustrated and developed through a number of examples. (shrink)

Increasingly, ethical concerns are being raised regarding bioenergy production. However, the ethical issues often do not stand out very clearly. The aim of the present paper is to improve on this situation by analyzing the bioenergy discussion from the perspective of land use. From this perspective, bioenergy production may give rise to ethical problems because it competes with other forms of land use. This may generate ethical problems mainly for two reasons. First, bioenergy production may compete, directly or indirectly, with (...) food production; and as consequence the food security of poor people may be adversely affected (social aspects arguments). Secondly, the production of bioenergy may directly or indirectly lead to deforestation and other changes of land use that have a negative effect on greenhouse gas emissions (environmental arguments). So from this perspective the main challenge raised by bioenergy production is to secure responsible land use. The purpose of the paper is not to advocate, or promote, a specific ethical position on bioenergy, but to structure the main arguments found. The paper falls in two parts. One part addresses social aspects arguments for using agricultural land for bioenergy—where food insecurity, malnourishment, and significant food poverty are the main concerns. The second part scopes environmental implications—notably greenhouse gas emissions impact, as affected by deforestation and other (indirect) land-use changes. Alongside showing some of the current dilemmas presented by wider land-use changes, arguments are analyzed from two ethical angels: a consequentialist and a deontological. (shrink)

The idea that acquired brain injury (ABI) caused by stroke, hemorrhage, infection or traumatic insult to the brain can result in post-traumatic growth (PTG) for individuals is increasingly attracting psychological attention. However, PTG also attracts controversy as a result of ambiguous empirical findings. The extent that demographic variables, injury factors, subjective beliefs, and psychological health are associated with PTG following ABI is not clear. Consequently, this systematic review and meta-analysis explores the correlates of variables within these four broad areas and (...) PTG. From a total of 744 published studies addressing PTG in people with ABI, eight studies met inclusion criteria for detailed examination. Meta-analysis of these studies indicated that growth was related to employment, longer education, subjective beliefs about change post-injury, relationship status, older age, longer time since injury, and lower levels of depression. Results from homogeneity analyses indicated significant inter-study heterogeneity across variables. There is general support for the idea that people with ABI can experience growth, and that various demographics, injury-related variables, subjective beliefs and psychological health are related to growth. The contribution of social integration and the forming of new identities post-ABI to the experience of PTG is explored. These meta-analytic findings are however constrained by methodological limitations prevalent in the literature. Clinical and research implications are discussed with specific reference to community and collective factors that enable PTG. (shrink)

Particular social aspects of the nature of science, such as economics of, and entrepreneurship in science, are understudied in science education research. It is not surprising then that the practical applications, such as lesson resources and teaching materials, are scarce. The key aims of this article are to synthesize perspectives from the literature on economics of science, entrepreneurship, NOS, and science education in order to have a better understanding of how science works in society and illustrate how such a synthesis (...) can be incorporated in the practice of science education. The main objectives of this article are to argue for the role and inclusion of EOS and entrepreneurship in NOS and re-define entrepreneurship in the NOS context; explore the issues emerging in the “financial systems” of the Family Resemblance Approach to NOS and propose the inclusion of contemporary aspects of science, such as EOS and entrepreneurship, into NOS; conceptualize NOS, EOS, and entrepreneurship in a conceptual framework to explain how science works in the society; and transform the theoretical knowledge of how science operates in society into practical applications for science teaching and learning. The conceptual framework that we propose illustrates the links between State, Academia, Market and Industry. We suggest practical lesson activities to clarify how the theoretical discussions on the SAMI cycle framework can be useful and relevant for classroom practice. In this article, science refers to physics, chemistry, and biology. However, we also recommend an application of this framework to other sciences to reveal their social-institutional side. (shrink)

COVID-19 created a transformational shift in the working environment for much of the labour force, yet its impact on workers is unclear. This study uses longitudinal data to examine the wellbeing of 621 full-time workers assessed before and during the first lockdown in the United Kingdom. We employ fixed effects analyses to investigate the impact of the restrictions and mandatory homeworking on cognitive, emotional, and psychological wellbeing. Within the sample, the rate of full-time homeworking increased from 2 to 74% between (...) waves. We identify significant changes in 9 of the 15 measures assessed, with a general pattern of improvements in wellbeing during lockdown. Overall levels of stress, self-rated mental health, positive emotions and life and job satisfaction are not adversely affected by the restrictions. There is a reduction in the burnout symptoms of disengagement and exhaustion and in the frequency with which negative emotions are experienced at work. Workers feel more autonomous, closer to their co-workers, and more attached to their organisations. However, homelife satisfaction declines. These findings highlight the possibility that the COVID-19 pandemic and large-scale transition to homeworking was associated with unchanged or improved worker wellbeing. This study has important implications for governments and employers regarding a global shift to homeworking. (shrink)

Karl Marx, philosopher of praxis — the theorist who rejected both the utopian socialists and the utopian putschists because of his core concept of the self-development of the working class through its own struggles. Was Marx necessarily limited because he lived and wrote in the nineteenth century – limited, not because capitalism was as yet ‘immature’, but because the proletariat was? Felton Shortall proposes that, able to observe neither the struggles for workers’ councils and Soviets nor ‘the limitations of (...) the workers’ council form of organisation’ as revealed by revolutionary experiences such as the ‘refusal to work’, Marx could not proceed beyond the dialectic of capital. Although studies of Kierkegaard's interactions with the public press of his time have largely focused on his dispute with the satirical newspaper, Corsaren, in this paper I examine his first engagement with the press—a mostly anonymous newspaper dispute with the Danish social activist, Orla Lehmann, about the freedom of the press in Denmark—as a lens through which to understand his thoughts on the press in (...) general, on anonymous authorship in the newspapers and otherwise, and the ethical and religious significance Kierkegaard sees in the methods we employ, including anonymity, when we engage one another in public writings. Tem como contexto o Brasil atual, em seus circuitos helênicos e disposições modernas. O Brasil dos fluxos da máquina antropológica ocidental. Entretanto, é também uma escritura a contrapelo, de um Brasil contemporâneo inatual, rodeado por existências virtuais que habitam a orla marginal das falas essenciais. Fora do sentido e da univocidade de um conservadorismo colonial travestido nas roupas do Estado, o inatual é não-oficial (aquele que diz “preferiria não” à ordem), um acidente que irrompe em veredas multivocais nos sulcos (...) escriturais do ofício e, em contingentes toares, aquebrantam as barreiras da língua universal. To evaluate sustainable practices in the production of meals: the use of water and energy, the presence of chemical products, the generation of organic and inorganic residues and criteria related to the purchase of food. Methods: This cross-sectional study was carried out from October 2015 to January 2016. The convenience sample consisted of 20 commercial self-service restaurants of varied gastronomy in the city of Santos-SP, of which 10 were located in the region of Orla and 10 downtown. Information was (...) obtained by means of the application of a structured checklist based on the recommendations of the American Dietetic Association (ADA) and an interview. Results: In the descriptive data analysis, we observed a greater number of sustainable actions in the region of Orla, corresponding to 75% (n=12) of the sixteen items evaluated, which are evidenced in the questions that refer to the sustainable use of water 100% (n=4) and electrical energy: 100% (n=3), adequate management of organic and inorganic waste: 66,66% (n=2) and rationality in aspects related to economy: 66,66% (n=2). Conclusion: Sustainability in the production of meals involves a set of practices, which were observed more expressively in the Orla region. (shrink)
