To prove the equivalence one must start with one side, and the earlier-later side seems, for starting with, logically the clearer. The equivalence is provable on reasonable definitions of ‘past’, ‘present’ and ‘future’ in terms of the earlier-later structure of time. McTaggart's attempted distinction between the past-present-future A series and the earlier-later B series, as though they were rivals for the structure of time, is based on an unexamined, and false, assumption. The equivalence shows they are not rivals; they are (...) quite consistent with each other. A very serious consequence is that all subsequent argument, from the A side or the B, however sophisticated, is flawed to the extent that it accepts McTaggart's false distinction. (shrink)

A propositional logic is defined which in addition to propositional language contains a list of probabilistic operators of the form P ≥s (with the intended meaning ‘‘the probability is at least s’’). The axioms and rules syntactically determine that ranges of probabilities in the corresponding models are always finite. The completeness theorem is proved. It is shown that completeness cannot be generalized to arbitrary theories.

The development and management of the Covid-19 outbreak in the Netherlands is described. The “intelligent lockdown” was aimed at minimizing new infections and limiting the number of deaths, while keeping the economy running as much as possible. Changes in consumer behavior, exit strategy, and lessons learned are considered.

It is necessary to take into account that every ontology and also every scientific system draws a picture of the World according to the abstractions and presuppositions which were accepted, consciously or unconsciously, during the construction of the system. That is why Aristotle, Hegel, and the paraconsistent logics gave us different world views. On the basis of contemporary logics, including paraconsistent logics, we can better understand what the objects of the Aristotelian logic are, what are the presuppositions used in it, (...) what are the meanings of its terms and how their meaning was changed when used in other theories. En este trabajo se estudia si, según Kierkeggard, el conocimiento de la propia intimidad humana es natural o exclusivamente sobrenatural. Se concluye que, aunque tal punto no sea explícito en los textos del pensador danés, ya que admite que la relación del hombre con Dios es en exclusiva sobrenatural, por medio de la fe, y que esta no es cognoscitiva porque acepta que Dios está detrás del absurdo, por consiguiente, según él no cabe antropología filosófica como ciencia. In this paper, (...) we examine whether knowledge of our own human intimacy is natural or exclusively supernatural, as Kierkegaard proposes. We conclude that, even though this idea is not explicit in his writings, he admits that man's relationship with God is exclusively supernatural through faith, and that faith is not cognitive because it accepts that God is behind the absurd; hence, philosophical anthropology is not possible as a science. This essay, as the title suggests, is not just a reply to Richard Ashcraft -- although it is certainly that too. Its intention is to say something about the political theory of Locke, about his historical context and about the methodological question of contexts in general. About his political theory, I want to make two or three main points which, I think, have important consequences for our understanding of Locke: that he both appropriates and, on critical issues, deliberately neutralizes the (...) radical �discourses� of his time -- so that, for example, he adopts Leveller premises to arrive at something more like Cromwell's (or even more conservative) conclusions; and that he deprives these radical discourses of their most democratic implications less by excluding people from membership in the political nation than by restricting the rights of membership itself. This means, among other things, that the relevant debate is not the one that has so preoccupied Locke scholars -- namely, the controversy about who is a �freeman� or who belongs to the �people�. The decisive question is rather what political rights the �people� have. (shrink)

This article examines how multiculturalism has overflowed from its governmental and policy articulations into Canadian society and culture more broadly. In doing so, it brings together three fields of research that are often separated and disarticulated from each other. Firstly, it draws on oft-overlooked archival material from agencies, departments and ministries of anti-racism, heritage, human rights, immigration, labour, multiculturalism, race relations, settlement and the status of women between 1971 and 2001. Secondly, it engages with the political and academic careers of (...) “immigrant women” who navigated the credentialism, anti-intellectualism and “shy elitism” that courses through official and corporate forms of multiculturalism, and were recognized by prize-giving institutions for their contributions to Canadian society. Finally, it thinks with and through Black Atlantic intellectuals and an “anti-hierarchical tradition of thought that probably culminates in C.L.R. James’s idea that ordinary people do not need an intellectual vanguard to help them to speak or to tell them what to say”. (shrink)

The modern doctrine of the “fresh start” reflects the differences between the past paradigm of punishment of the insolvent person and the current focus on the economic effectiveness and activeness. Global practice in the field of insolvency shows that the “limited liability rule” is eminently effective in the economic and social perspective. The appending threat of abuse and misapplication of the system might be neutralized through the legal regulation of prevention and rehabilitation means, which are analyzed in this article. The (...) aim of this research is to: 1) present a summary of the paradigm of bankruptcy of natural persons; 2) evaluate the categories of prevention and rehabilitation means set in the Lithuanian concept of the bankruptcy of natural persons; 3) identify the physical factors affecting the bankruptcy of natural persons; 4) provide a conceptual model of rehabilitation after bankruptcy and insolvency prevention measures have been implemented in the field of bankruptcy of natural persons. The article deals with a study of a distinct criminal punishment established in the Criminal Code and the Code of Punishment Enforcement of the Republic of Lithuania—restriction of liberty, as an alternative to imprisonment. Without investigating extensively the course of development of this penalty, in the article it is sought to overview the development trends of restriction of liberty; analyse the problems of enforcing this penalty and suggest measures to eliminate them; investigate whether the legal regulation of Lithuania is in (...) line with the provisions of the main international instruments relating to non-custodial sanctions (1990 United Nations Standard Minimum Rules for Non-custodial Measures (the so-called Tokyo Rules), Recommendation R (92) 16 of the Committee of Ministers of the Council of Europe to Member States on the European rules on community sanctions and measures, Recommendation Rec (2000) 22 of the Committee of Ministers of the Council of Europe to Member States on improving the implementation of the European rules on community sanctions and measures); review the progressive legal regulation of restriction of liberty in place in individual states and provide a comparison between the national and foreign experience in relation to the penalty of restriction of liberty. In addition, the article offers guidelines for the improvement of the legal regulation and implementation of the legal institute of restriction of liberty. (shrink)

M. Römeris’s constant endeavour and experience were gained from his studies in the various universities of different countries. Presiding over eminent experts and established professors-educationalists of his day aided in M. Römeris’s mastery of pedagogics.One of the most fundamental academic provisions of M. Römeris was that the relations between university professors and students had to be built on mutual respect and reliance. In his belief, the professor is obligated to earn the respect and the fondness of students through his valuable (...) work, both as a scholar and as a human being. M. Römeris rendered this exclusive consideration in the study process during his lectures. In his belief, a lively speech could never be replaced by books. Even having given lectures for the same course of Constitutional Law for years, M. Römeris used to prepare for the lectures very thoroughly, constantly, and improved and updated them. De esta manera se podrá analizar algunos conceptos que lo comprenden: luz y su antítesis noche; así como también detenerse en la formulación de los términos ojos-visión; lo cual nos remitirá a la pregunta, ¿qué es lo que se ve? y/o ¿quiénes contemplan a Dios como El (...) es? De este modo, la contemplación en la obra del Niseno obtendrá alcances significativos desde una lectura antropológica cristiana.This paper intends to highlight, from Gregory of Nyssa’s In Canticum canticorum, the author’s journey around the issue of mystic vision. In this way, some of his concepts can be analyzed: light and its antithesis night, along with making a stop in the formulation of the terms eyes-vision, which will lead us to the question, what is that which is seen? and/or, who contemplates God as He is? The present article offers three critiques of the universal basic income guarantee (BIG) proposal discussed by Standing in this volume. First, there is a fundamental tension between the way income in a monetary production economy is generated, the manner in which BIG wishes to redistribute it, and the subsequent negative impact of this redistribution on the process of income generation itself. The BIG policy is dependent for its existence on the very system it wishes to undermine. Second, the macroeconomic effects (...) of BIG on contemporary economies that use modern money are destabilizing. The job guarantee (JG), by contrast, stabilizes both the macro-economy and the currency while helping transform the nature of work itself. Finally, the employment safety-net in Standing’s piece is not an accurate representation of the modern JG proposals – a confusion which this paper aims to remedy. (shrink)

The paper deals with the issue of tying (as well as bundling) practices which are applied by dominant undertakings and which, under certain circumstances, can be considered as abuses of a dominant position. The authors describe the concept of tying, indicate its types, and reveal its economic aspects, since all these issues have a certain impact on the legal assessment of tying practices. The authors conclude that the European Commission (the Commission) and the European Community (EC) courts have usually been (...) too formalistic and unreasonably hostile to tying practices and have not paid due attention to the impact of tying on competition and the beneficial features of tying. Thus certain cases have frequently and rather easily been treated as abuses of a dominant position. A more realistic and effect-based approach was taken by the Commission and the courts in the Microsoft case, where certain criteria for the assessment of tying were formulated. Still, the Microsoft case reflects a rather strict attitude towards tying practices, especially in technological tie-ins. (shrink)

Criminal liability of legal entities was legitimized in the Republic of Lithuania eight years ago, and in the ruling of the Constitutional Court of 8 June 2009, a conclusive confirmation on its accordance with the Constitution was made. It should be noted that the extension of the concept of criminal offense subject has received considerable attention of Lithuanian scientists. It was obvious that this penal law novel would cause many problems and, surely, it has become a reason of many doubts (...) in the judicial practice. However, despite the fact that a fairly broad scientific analysis of the topic under consideration has been made, none of the Lithuanian authors has ever addressed the issue regarding the sources of the criminal liability of legal entities.
