In this qualitative study, we aimed to identify and compare the ethical problems perceived by physicians and nurses in intensive care units at Baskent University hospitals in Turkey. A total of 21 physicians and 22 nurses were asked to describe ethical problems that they frequently encounter in their practice. The data were analyzed using an interactive model. The core problem for both physicians and nurses was end-of-life decisions (first level). In this category, physicians were most frequently concerned with euthanasia while (...) nurses were more concerned with do-not-resuscitate orders (second level). At the third level, we saw that almost all of the participants’ responses related to negative perceptions about euthanasia. Communication and hierarchical problems were the second most reported main category. Nurses were more likely to cite problems with hierarchy than physicians. At the third level, a large percentage of nurses described communication problems with authority and hierarchical problems with physicians. In the same category, physicians were most often concerned with communication problems with patients’ relatives. The ethical problems were reported at different frequencies by physicians and nurses. We asked the participants about ethical decision-making styles. The results show that nurses and physicians do not follow a systematic pattern of ethical decision making. (shrink)

This article places the textual production of classical Islamic law in its proper historical context. It does so by examining a transcript of an eleventh-century oral debate, or disputation, between the Shafiʿi and Hanafi jurists Abū al-Ṭayyib al-Ṭabarī and Abū al-Ḥasan al-Ṭāliqānī on the subject of the pre-emptive expiation for broken oaths. The comparison between the disputation transcript and al-Ṭabarī’s lengthy legal manual al-Taʿlīqa al-kubrā reveals that the complexity and argumentative detail of disputations far exceeded jurists’ writings. Even the lengthiest (...) legal manuals of the time are shown to be highly summarized accounts of juristic thought. The article explains how these summaries were essential to the proper training of jurists in the age of ijtihād: jurists were expected to learn these summaries before exploring the law in greater depth through disputations. These disputations were rarely recorded in writing, and few survive. The disparity between the oral and written legal discourse of jurists leads to a disquieting conclusion: much of the thought that produced classical legal opinions is lost to us today. We are therefore left with access to an attenuated version of classical law. (shrink)

On avait pourtant compris très tôt, à commencer par Leibniz, les solides attaches de celle-ci avec la pensée judéo-arabe. Cela n’entame pas le moindrement son originalité. Bien au contraire, Hegel en fait la condition de toute entreprise philosophique. Et l’islam, malgré l’évidente antipathie que lui porte Spinoza, pourrait y trouver comme un dialogue avec lui-même.

This study seeks to explore the major errors that frequently emerge when novice translators translate technical texts, namely legal documents released by the Department of Lands and Survey in Jordan. The goal behind this investigation is to improve legal translation training, develop students’ drafts based on the types of their mistakes, and deliver a message to curricula designers in the field of legal translation. To this end, 20 Jordanian novice translators (MA students) are chosen from two private universities to translate (...) three legal documents from Arabic into English. The main findings revealed that different problems emerged, namely the participants’ inability to translate near-synonym technical terms, grammatical problems, and stylistic problems at both lexical level and sentence level. These findings are hoped to be insightful for both learners and teachers. A number of pedagogical recommendations are proposed by the researchers to develop learners’ competence and reach a professional level and open the venue for trainers to achieve advances in the quality of the target text and in the translation teaching–learning process. The paper deals with the study of the existence of weak positive solutions for a new class of the system of elliptic differential equations with respect to the symmetry conditions and the right hand side which has been defined as multiplication of two separate functions by using the sub-supersolutions method.

On July 5, 2021, Algeria celebrated the fifty-ninth anniversary of her independence. The eight-year war, which broke out on November 1, 1954, cost the country much blood and resulted in 1.5 million deaths. This article looks at this page of history. My objective is to show why the Algerians took up arms, and to reexamine the conflict between the French philosopher Jean-Paul Sartre and the Algeria-born philosopher Albert Camus in light of the War of Independence. I argue that the friendship (...) between the two philosophers can be seen as one casualty of this war, a friendship that had no chance of surviving given their different approaches to justice. Whereas for Sartre, justice was in no manner exclusive of freedom; for Camus, it was all that the Arabs needed, any demand for freedom being solely the work of a few militants “without any political culture.”. This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. The book concludes with some brief remarks on contemporary approaches to analogy in Common and Civil Law and also to parallel reasoning in general. (shrink)

İbn Sînâ, sonrakilerden bazılarının kâide-i vâhid veya “bir kuralı” (BK) olarak adlandırdığı şeyin sıkı bir savunucusudur. BK’nın ana fikri şunu ifade etmektedir: Birden, doğrudan, yalnızca bir ortaya çıkar. İbn Sînâcı bu kuralın ikincil literatürdeki tartışması genellikle onun hususi bir uygulama alanı yani, sudûr meselesiyle sınırlıdır. Sonuç itibarıyla, BK’nın ne anlama geldiği ve İbn Sînâ’nın onu neden savunduğu kesin değildir. Bu yazıda ben bu meseleyi iki şey yaparak çözmeye çalışmaktayım: Bunlardan biri tasavvur, diğeri ise tasdik açısındandır. İlkin, sadece BK’nın terimlerinin, yani (...) onun özne ve yükleminin ne anlama geldiğini açıklamaktayım. Bunu yaparken, BK’nın dar ve geniş anlamları arasında ayırım yapmakta ve İbn Sînâcı bakış açısından BK’nın kapsamının geniş olduğunu; bunun ise BK’nın fail nedenliğin temel ilkesi olduğu anlamına geldiğini göstermekteyim. Bu sebepledir ki, farklı bağlamlarda önemli felsefî tezleri inşa etmede bu kurala başvurulmuştur. İkinci olarak, İbn Sînâ’nın el- Mübâhasât’ta BK’na dair sunduğu argümanı değerlendirmekteyim. In this study, the preface and introduction of Ibn Juzay’s book at-Tasheel li ‘ulȗmi’t-tanzeel, have been examined in terms of his approach to style and methodology problems in commentary.Ibn Juzay, whose first works included useful topics and ashes; wrote two loyalties, a lexicon, later in which the meanings of the words frequently mentioned in the Qur'an were compiled; thus, he gave information about his style and methodology; In introduction of his book, he explained the underlying reasons to write his book (...) at-Tasheel. That his intention to do so, first of all is to reveal the importance of style and methodology in commentary and then to guide the reader on how to be read this concise work. In this context, he suggested some of the works of the classical commentary corpus, sometimes by giving a name, but in a more uncharacterized and criticism of how to overcome these suggestions about the problematic, so that he wanted to give a healthy perspective for those interested in academic commentary and plain readers. The importance of the article is also due here. In the article, a descriptive language is used in a style that is turned from the scientific personality to the conclusions of commentary; then a general evaluation has been made with an analysis-critic-axis approach. As a result, it has been determined that some commentators, especially the general principles regulating the science of commentary relations with other sciences, have some style and procedural errors.
