This article places the textual production of classical Islamic law in its proper historical context. It does so by examining a transcript of an eleventh-century oral debate, or disputation, between the Shafiʿi and Hanafi jurists Abū al-Ṭayyib al-Ṭabarī and Abū al-Ḥasan al-Ṭāliqānī on the subject of the pre-emptive expiation for broken oaths. The comparison between the disputation transcript and al-Ṭabarī’s lengthy legal manual al-Taʿlīqa al-kubrā reveals that the complexity and argumentative detail of disputations far exceeded jurists’ writings. Even the lengthiest (...) legal manuals of the time are shown to be highly summarized accounts of juristic thought. The article explains how these summaries were essential to the proper training of jurists in the age of ijtihād: jurists were expected to learn these summaries before exploring the law in greater depth through disputations. These disputations were rarely recorded in writing, and few survive. The disparity between the oral and written legal discourse of jurists leads to a disquieting conclusion: much of the thought that produced classical legal opinions is lost to us today. We are therefore left with access to an attenuated version of classical law. (shrink)

This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. The book concludes with some brief remarks on contemporary approaches to analogy in Common and Civil Law and also to parallel reasoning in general. (shrink)

La place de la pensée islamique médiévale dans la genèse de la philosophie de Spinoza a fait l’objet de très peu de recherches. On avait pourtant compris très tôt, à commencer par Leibniz, les solides attaches de celle-ci avec la pensée judéo-arabe. Cela n’entame pas le moindrement son originalité. Bien au contraire, Hegel en fait la condition de toute entreprise philosophique. Et l’islam, malgré l’évidente antipathie que lui porte Spinoza, pourrait y trouver comme un dialogue avec lui-même.

The paper deals with the study of the existence of weak positive solutions for a new class of the system of elliptic differential equations with respect to the symmetry conditions and the right hand side which has been defined as multiplication of two separate functions by using the sub-supersolutions method.

This study seeks to explore the major errors that frequently emerge when novice translators translate technical texts, namely legal documents released by the Department of Lands and Survey in Jordan. The goal behind this investigation is to improve legal translation training, develop students’ drafts based on the types of their mistakes, and deliver a message to curricula designers in the field of legal translation. To this end, 20 Jordanian novice translators (MA students) are chosen from two private universities to translate (...) three legal documents from Arabic into English. The main findings revealed that different problems emerged, namely the participants’ inability to translate near-synonym technical terms, grammatical problems, and stylistic problems at both lexical level and sentence level. These findings are hoped to be insightful for both learners and teachers. A number of pedagogical recommendations are proposed by the researchers to develop learners’ competence and reach a professional level and open the venue for trainers to achieve advances in the quality of the target text and in the translation teaching–learning process. On July 5, 2021, Algeria celebrated the fifty-ninth anniversary of her independence. The eight-year war, which broke out on November 1, 1954, cost the country much blood and resulted in 1.5 million deaths. This article looks at this page of history. My objective is to show why the Algerians took up arms, and to reexamine the conflict between the French philosopher Jean-Paul Sartre and the Algeria-born philosopher Albert Camus in light of the War of Independence. I argue that the friendship (...) between the two philosophers can be seen as one casualty of this war, a friendship that had no chance of surviving given their different approaches to justice. Whereas for Sartre, justice was in no manner exclusive of freedom; for Camus, it was all that the Arabs needed, any demand for freedom being solely the work of a few militants “without any political culture.”. The problem of determining an optimal benchmark to inefficient decision-making units is an important issue in the field of performance analysis. Previous methods for determining the projection points of inefficient DMUs have only focused on one objective and other features have been ignored. This paper attempts to determine the best projection point for each DMU when the inputs and outputs data are in stochastic form and presents an alternative definition for the best projection by considering three main aspects: technical efficient, (...) minimal cost, and maximal revenue as much as possible. Considering the important role of the electricity industry in the economic growth of each country, a practical example has been implemented on 16 regional electricity companies in Iran in 9 consecutive periods. The efficiency score along with the projection points of the three technical models ), cost, and stochastic revenue are compared with the projection point obtained from the model presented in this article, which simultaneously meets these three objectives, showing the improvement of companies’ performance. La préférence accordée à l'islam soufi, islam supposé pacifique, dans sa variante africaine, c'est-à-dire "noire", n'est que le nouvel avatar du primitivisme à l'âge du djihadisme. Le primitivisme, qui a fait de l'Afrique le continent du fétichisme à l'époque de la traite des esclaves, l'a ensuite caractérisé sous la colonisation comme le havre de l'"islam noir" et actuellement comme celui de l'islam soufi... Islam noir, Islam soufi : islams pacifiques? Or, l'Afrique, au cours de son histoire, n'a (...) cessé de résister à ce stéréotype à travers les nombreux djihads intervenus au XIXe siècle ou ceux qui se déroulent actuellement. Tout en soutenant les formes locales de l'islam soufi, en tant que contre-feux à l'islam radical, les pouvoirs africains et les puissances étrangères qui interviennent sur le continent entendent le renforcer en organisant une "déradicalisation" du personnel musulman ouest-africain dans d'autres pays, comme le Maroc, soumis également à la menace salafiste, wahhabite ou djihadiste. L'islam soufi apparaît ainsi, en définitive, comme la variante postcoloniale de l'"islam noir". (shrink)

Este artículo aborda la cuestión de la visibilidad del samā‘ en la literatura de los manāqib, los diccionarios biográficos, los manuales de sufismo y la producción jurídica del Magreb de los siglos VII/XIII a X/XVI. Se examinan las formas atestiguadas de esta práctica, en los madyanī, šāḏilī, rifā‘ī y los ‘Arūsiyya-Salāmiyya, en los círculos literarios de Túnez, Qairawān, el litoral de Ifrīqiya y el área tripolitana. Se explora la gran variedad de posicionamientos de los juristas magrebíes con respecto a esta (...) práctica, así como los intentos de dilucidar, por parte de las autoridades sufíes, los fundamentos escriturales, doctrinales y éticos del ḏikr y el samā‘ que han jalonado los procesos de codificación de estas dos prácticas. A pesar de la desconfianza generada por las «innovaciones», consideradas blasfemas y estigmatizadas por algunos šayjs que recomendaban la supresión de estas prácticas, percibimos más bien una intención de regular, de prevenir, más que de prohibir dichas prácticas. El samā‘, más allá de las palabras utilizadas para designarlo, parece ser una práctica dotada de una gran capacidad de resistencia; su importancia atestigua su resonancia en las experiencias de santidad en el Magreb a lo largo de la Edad Media. Né à Blois en 1886 et enterré au Caire sous le nom d'Abd el-Wâhed Yahiâ en 1951, René Guénon est l'homme par qui le scandale arrive. Il dénonce la décadence de l'Occident moderne, fruit d'une lente dégénérescence de son héritage métaphysique et se tourne, au grand dam des catholiques, vers l'Orient devenu, selon lui, le refuge ultime de la "Tradition". Cette dernière notion, centrale chez Guénon, élève toutes les traditions religieuses de l'humanité au même niveau de transcendance tout en reconnaissant (...) à chacune d'entre elles sa dimension spirituelle spécifique. Un point de vue tout simplement révolutionnaire dans les années 30. Dès lors, il appartient à l'individu de se déterminer spirituellement par un processus de connaissance graduée qui dépasse largement le seul exercice d'un rite religieux. C'est la voie ésotérique par essence, qui suscitera l'émergence à travers le monde (Europe, Etats-Unis, Russie, etc) d'innombrables"chapelles" initiatiques se réclamant de Guénon, avec notamment les groupes soufis dirigés par Schuon, Vâlsan ou Pallavicini. Chose frappante, un lien inextricable s'est peu à peu tissé entre cette perspective ésotérique et l'horizon politique. En témoignent la "spiritualité héroïque" de Julius Evola dans l'Italie des années trente mais aussi les résonances guénoniennes qu'on découvre dans l'engagement politique de Simone Weil ou de Carl Schmitt. Parallèlement à l'activité des revues Le Voile d'Isis/Etudes Traditionnelles, les apports de Mircea Eliade, d'Henry Corbin ou de Raymond Abellio achèvent de perpétuer le rayonnement guénonien, si controversé soit-il. Cette mise en perspective monumentale de l'oeuvre de René Guénon révèle, de manière décisive, une figure cardinale du XXe siècle et dévoile l'étendue de son rôle dans la construction de la pensée occidentale moderne. Nowadays, there is a quite considerable amount of literature on the use of analogy or more generally of inferences by parallel reasoning in contemporary legal reasoning, and particularly so within Common Law. These studies are often motivated by researches in artificial intelligence seeking to develop suitable software-support for legal reasoning. Recently; Rahman/Iqbal/Soufi (2020) developed a dialogical approach in the framework of Constructive Type Theory to what in Islamic Jurisprudence was called qiyās or correlational inferences. In their last chapter the (...) authors suggested that such an approach contributes to the study of patterns of reasoning by precedent cases within contemporary common Law. In the present paper we will further motivate the deployment within Civil and Common Law of the dialogical framework developed in Rahman/Iqbal/Soufi (2020). After a presentation of Scott Brewer's take on analogy within Common Law, that has striking structural similarities to reasoning by precedent case rooted in ratio legis (known in Islamic Jurisprudence as qiyās al-'illa or correlational inference by the occasioning factor), we will illustrate the implementation of the framework with a brief discussion of some cases of legal reasoning based in Spanish Civil Law but where the accent is put in the emerging ruling rather than in the existing of a case as in Common Law. Moreover; quite surprisingly, the case under study suggests that even cases of Law-interpretation fit the argumentation pattern of qiyās al-'illa. A caveat: in the present paper we will focus mainly in discussing the dynamics of the meaning constitution involved rather than in setting the rules of the underlying dialogical framework, the latter is the subject of a follow-up paper. En ville, cette importance donnée à l’ « arrangement » constitue un frein pour les couples souhaitant divorcer. En effet, les élites islamiques s’accordent pour reconnaître que le droit islamique autorise le divorce, tant pour les hommes que pour les femmes, mais dans les faits, elles se refusent à le cautionner. Ceci révèle la force de l’injonction sociale quant au mariage et à la pérennité du couple. (shrink)

The aim of this paper is to identify the position the ru'yat Allāh holds within the curriculum of sciences described by the Iḫwān al-Ṣafa'. Their concept of knowledge is first clarified. The Ihwan use the terminology of rational knowledge to describe items of faith too. But faith is only an introduction to a greater knowledge. Now: is the supreme knowledge to be considered as speculative and theoretical, or are the ḫawciṣṣ, the only ones entitled to the vision of God, eventually (...) obliged to rely on a kind of divine “revelation” or “inspiration”? If the “vision of God” appears beyond any possible connotation of knowledge in “rational” terms, it is unclear, however, whether the Ihwan use the concepts of “revelation” and “inspiration” as a way of explaining in a theological terminology the utmost degree of human knowledge. Moreover, the qualities and moral dispositions attributed to the “Friends of God” remind us of Sufi doctrines. Consequently, the question of the relation between Sufism and imāmite theories could be re-opened: the Iḫwānian definition of the “science of the transcendent” shows that the gnoseological itinerary is not concluded even with the “vision of God.” Cet article vise à identifier la position tenue par la vision de Dieu dans le cadre du curriculum des sciences décrit par les Iḫwān al-Ṣafā'. En premier lieu, leur conception de la connaissance est clarifiée. Les Ihwan utilisent la terminologie de la connaissance rationnelle pour présenter aussi les articles de foi. La question est désormais celle-ci: la connaissance suprême doit-elle être considérée comme spéculative et théorique, ou bien les ḫawīṣṣ, les seuls à avoir droit à la vision de Dieu, sont-ils finalement obligés de se reposer sur une sorte de “révélation” ou “inspiration” divine? Si la vision de Dieu paraît être au delà de toute connotation cognitive en des termes “rationnels,” on ne sait pourtant pas clairement si les Iḫwān utilisent les concepts de “révélation” et “d'inspiration” comme une manière d'expliquer, en termes théologiques, le degré suprême de la connaissance humaine. En outre, les qualités et les dispositions morales attributées aux “Amis de Dieu” nous rappellent les doctrines soufies. Par conséquent, on pourrait rouvrir la question de la relation entre le soufisme et les théories imamites: la définition des Iḫwān de la “science du transcendant” montre que l'itinéraire gnoséologique reste inachevé même avec la “vision de Dieu.”.
