Testing this ?common understanding? by the facts of human nature and community, this article examines the substratum of my good, good of others, idea of good community, of common cause in (...) it, of shared responsibility for it, of consequent debt of all to whole, and of human freedom and capacity to estimate and pay on a basis to be examined in Area B projected. ?Elementary freedom? depends on capacity for truthful purpose and for independent judgment, ?ultimate freedom? on a determined truthful purpose coupled with adequacy of ideas for interpretation of entire experience. This paper applies an approach that the author calls Subjective Personal Introspection to the self-reflective examination, inward-looking understanding, and impressionistic evocation of his own consumption experiences as the keeper of a kitten named Rocky Raccoon. Three-dimensional photographs in the form of stereo pairs provide corroborative evidence for the interpretations suggested. In this reflexive, anecdotal, narrative account, Rocky the Cat emerges as a focal point in the author's experiential consumption.

In our strife to express the meanings of moral terms, we have neglected the one transparently built?in meaning: ?A man ought to keep his promises? could mean ?A man owes it to other men to keep his promises. Such is his debt and duty ? just what is due or owed?. This proposal is supported by the evidence of major languages of the world, ancient and modern, in all of which identical or closely related words serve to express (...) both the idea of material debt and that of moral obligation. But on study the revealing model and analogue of ?moral debt? is found, not in debts of exchange, the simplest and most obvious class of debts, but in debts of shared responsibility. Working from such models we conclude that ?A ought to do X? means X is part of A's share in the cost of the good community, the common cause and stake of all mankind? (shrink)

In his presidential address (American Philosophical Association, Western Division), William Frankena sets himself against the relativist and irrationalist drift of our time in asserting that ?It is of the essence of a normative judgment to claim that it is justified, rational or valid?, and that fully informed men of reason will ultimately agree about value questions. Applauding the return to reason, this note finds a need for further clarification on the definition of normative terms, the justification of normative judgments, the (...) basis of obligation to be rational, and on the promise of agreement among men of reason in axiology. These three papers present a quite diverse and complementary set of answers to the question, “Why Sexuality Matters to Philosophy.” They show the ways in which sexuality as an issue may be of interest to philosophers working on a wide range of questions. The theme of sexuality appears as both subject matter and context for the development of scientific theories of human behavior, as a pervasive dimension of the representation of everyday life, and as a social phenomenon raising important questions (...) bearing on the implications of equal citizenship for persons of different genders and sexualities. Sexuality reveals itself as implicated in epistemology and philosophy of science, aesthetics and ethics, political philosophy and jurisprudence. Sexuality as a subject matter provides rich examples for extending the treatment of quite traditional problems. At the same time, by identifying sexuality as a fundamental human phenomenon, fraught with normative implications and closely linked to emotional and bodily life, these papers show how thinking about sexuality may also act to unsettle and redefine certain important areas of philosophical inquiry. One of the largely untapped potentials of Sausserian semiotics is the ability it provides to examine shifts in the cultural meanings attached to objects and ideasacross time. To explore this potentiality, we trace the intertextual evolution of one of the most enduring mythic figures, the vampire. Our analysis begins with ancient texts and moves forward in time to contemporary cinematic and televised depictions of the vampire. We document the deployment of the vampire as a vehicle carrying oppositional meanings as it (...) moves through various eras. For example, vampires may connote both racism and racial resistance, homophobia and gay acceptance, women’s subjugation and women’s empowerment. By using the vampire to mediate contested, liminal regions of cultural discourse, storytellers have constructed increasingly complex and multivocal portraits of this figure. At present, vampire narratives have come to resemble an alternative universe of human morality and behavior, complete with family structures, emotional depth, and interpersonal conflicts. (shrink)

Prior research indicates that managers’ dark personality traits increase their tendency to engage in disruptive and unethical organizational behaviors including accounting earnings management. Other research suggests that the prevalence of dark personalities in management may represent an accidental byproduct of selecting managers with accompanying desirable attributes that fit the stereotype of a “strong leader.” Our paper posits that organizations may hire some managers who have dark personality traits because their willingness to push ethical boundaries aligns with organizational objectives, particularly in (...) the accounting context where ethical considerations are especially important. Using several validation studies and experiments, we find that experienced executives and recruiting professionals favor hiring a candidate with dark personality traits into an accounting management position over an otherwise better-qualified candidate when the hiring organization faces pressure to manage earnings. Our results help to illuminate why individuals with dark personality traits may effectively compete for high-level accounting positions. (shrink)

Judges are typically tasked to consider sentencing benefits but not costs. Previous research finds that both laypeople and prosecutors discount the costs of incarceration when forming sentencing attitudes, raising important questions about whether professional judges show the same bias during sentencing. To test this, we used a vignette-based experiment in which Minnesota state judges reviewed a case summary about an aggravated robbery and imposed a hypothetical sentence. Using random assignment, half the participants received additional information about plausible negative consequences of (...) incarceration. As predicted, our results revealed a mitigating effect of cost exposure on prison sentence term lengths. Critically, these findings support the conclusion that policies that increase transparency in sentencing costs could reduce sentence lengths, which has important economic and social ramifications. Over the last few decades, neuroimaging techniques have transformed our understanding of the brain and the effect of neurological conditions on brain function. More recently, light-based modalities such as functional near-infrared spectroscopy have gained popularity as tools to study brain function at the bedside. A recent application is to assess residual awareness in patients with disorders of consciousness, as some patients retain awareness albeit lacking all behavioural response to commands. Functional near-infrared spectroscopy can play a vital role in identifying these (...) patients by assessing command-driven brain activity. The goal of this review is to summarise the studies reported on this topic, to discuss the technical and ethical challenges of working with patients with disorders of consciousness, and to outline promising future directions in this field. This response chooses as the sole topic for its concern the central question ‘how can Husserl's approach to consciousness be used to inform cognitive science?’ This paper is a response to the papers on phenomenology, in particular the one by Varela. The response makes brief comments on Husserl's phenomenology and the breadth of cognitive science is alluded to as well as its wide spectrum of phenomena. The authors are agreed that there could be a Husserlian cognitive science, but it would (...) take some compromises from both traditions. In general we find that there is some good neuroscience in Varela's approach, but he mixes the contradictory perspectives of natural science and Husserl's phenomenology without explaining or mentioning the major problems which could be entailed by this. We are engineers, and our view of consciousness is shaped by an engineering ambition: we would like to build a conscious machine. We begin by acknowledging that we may be a little disadvantaged, in that consciousness studies do not form part of the engineering curriculum, and so we may be starting from a position of considerable ignorance as regards the study of consciousness itself. In practice, however, this may not set us back very far; almost a decade ago, Crick wrote: (...) 'Everyone has a rough idea of what is meant by consciousness. It is better to avoid a precise definition of consciousness because of the dangers of premature definition. Until the problem is understood much better, any attempt at a formal definition is likely to be either misleading or overly restrictive, or both'. This seems to be as true now as it was then, although the identification of different aspects of consciousness by Block has certainly brought a degree of clarification. On the other hand, there is little doubt that consciousness does seem to be something to do with the operation of a sophisticated control system, and we can claim more familiarity with control systems than can most philosophers, so perhaps we can make up some ground there. We describe here recent work on the molecular genetics of mitosis in the filamentous fungus Aspergillus nidulans. Aspergillus is one of three simple eukaryotes with powerful genetic systems that have been used to analyze mitosis. The modern molecular biological techniques available with this organism have made it possible to use mutations to identify genes and proteins that play an important role in mitosis. Three Aspergillus genes that affect mitosis are described. One gene, nimA, is specifically expressed late in the cell (...) cycle and codes for a putative protein kinase that induces mitosis, even in cells blocked in S‐phase. The second gene, bimG, codes for a putative phosphatase that interacts functionally with the nimA kinase. The third gene, bimE, codes for a protein that suppresses mitosis during interphase, apparently by keeping nimA turned off. None of these genes appear to be similar to any of the genes affecting mitosis that have been characterized in other eukaryotes, but rather appear to be elements of a system that prevents mitosis from occurring during interphase. Light plays a significant role in health and illness. In changing historical circumstances, light continues to evoke and to express significant issues of value.

In face of the multiple controversies surrounding the DSM process in general and the development of DSM-5 in particular, we have organized a discussion around what we consider six essential questions in further work on the DSM. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM – whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part 1 of this article took up the first two questions. Part 2 took up the second two questions. Part 3 now deals with Questions 5 & 6. Question 5 confronts the issue of utility, whether the manual design of DSM-III and IV favors clinicians or researchers, and what that means for DSM-5. Our final question, Question 6, takes up a concluding issue, whether the acknowledged problems with the earlier DSMs warrants a significant overhaul of DSM-5 and future manuals. As in Parts 1 & 2 of this article, the general introduction, as well as the introductions and conclusions for the specific questions, are written by James Phillips, and the responses to commentaries are written by Allen Frances. Scaffolds are fundamental to many cellular signaling pathways. In this essay, a novel class of scaffolds are proposed, whose action bears striking resemblance to kinetic proofreading. Commonly, scaffold proteins are thought to work as tethers, bringing different components of a pathway together to improve the likelihood of their interaction. However, recent studies show that the cytoskeletal scaffold, anillin, supports contractile signaling by a novel, non‐tethering mechanism that controls the membrane dissociation kinetics of RhoA. More generally, such proof‐reading‐like scaffolds are distinguished (...) from tethers by a rare type of cooperativity, manifest as a super‐linear relationship between scaffold concentration and signaling efficiency. The evidence for this hypothesis is reviewed, its conceptual ramifications are considered, and research questions for the future are discussed. (shrink)

The modernist “biomedical model” offers an inadequate understanding of illness. At the same time, some of the conceptual constructs that are offered to supplement the biomedical model are carelessly employed. Much that is said and written about empathy and healing, in particular, fails to reflect the historical and critical self‐awareness of postmodern thinking at its best.

The increasing availability of passively observed data has yielded a growing interest in “data fusion” methods, which involve merging data from observational and experimental sources to draw causal conclusions. Such methods often require a precarious tradeoff between the unknown bias in the observational dataset and the often-large variance in the experimental dataset. We propose an alternative approach, which avoids this tradeoff: rather than using observational data for inference, we use it to design a more efficient experiment. We consider the case (...) of a stratified experiment with a binary outcome and suppose pilot estimates for the stratum potential outcome variances can be obtained from the observational study. We extend existing results to generate confidence sets for these variances, while accounting for the possibility of unmeasured confounding. Then, we pose the experimental design problem as a regret minimization problem subject to the constraints imposed by our confidence sets. We show that this problem can be converted into a concave maximization and solved using conventional methods. Finally, we demonstrate the practical utility of our methods using data from the Women’s Health Initiative. (shrink)

The dominant social scientific approach to studying judicial behavior treats judges as strategic actors pursuing their political preferences under institutional constraint. The intellectual roots of this rational choice approach are in American law’s long but sporadic engagement with pragmatist ideas. This article challenges that approach: a fully pragmatist account of judicial action provides a better description of the intellectual and social work of judging, and better explains how judges reach a decision in difficult cases that most affect the development of (...) law and its relationship to society. The article argues that the foundational intellectual problem for appellate judges is how to define the legal questions presented in a case. Definitions of legal questions arise from the interplay of habitual and creative action in the local social context of an appeals court. Professional and local interpretive habits and legal forms ordinarily do a great deal to define the key questions, which are not strictly determined when a case comes before a court. Unscripted small group interactions at oral arguments also figure in question definition; oral arguments are most important in the rare but legally important cases where habitual practices alone are insufficient to delimit the legal question judges must answer. Supported by extensive interviews with federal appeals judges and clerks, the article illustrates judges’ creative, interactional efforts to define an answerable question in a major asylum case decided in the Seventh Circuit Court of Appeals. Building from this case, the article describes the factors that shape judicial question definition, and describes the conditions when creative judicial action is likely to be most prominent. We discuss some recent work by Tim Maudlin concerning Black Hole Information Loss. We argue, contra Maudlin, that there is a paradox, in the straightforward sense that there are propositions that appear true, but which are incompatible with one another. We discuss the significance of the paradox and Maudlin's response to it.
