In the wake of the Civil War, women’s suffrage activists hoped that the U.S. Congress would meet their demand for enfranchisement. But not only did the Fourteenth Amendment, first introduced in 1865, leave that out, but it introduced an explicit mention of sex into the Constitution for the first time by referring to the rights of “male citizens.” When efforts to change the amendment’s language failed, some within the suffrage movement publicly opposed its ratification. Tensions mounted further when the Fifteenth (...) Thirty-five years ago the editor of a collection entitled Philosophy of Mind could plausibly claim that his selection of a dozen articles was representative of the wide range and vitality of contemporary inquiries. There was no need to categorize; he had chosen articles on the basis of merit, whether or not, in the aggregate, they encompassed the major problems or topics that are the special province of the philosophical study of mind. A 1991 text, on the other hand, offers five (...) major categories, some requiring as many as four subdivisions—obviously in the interest of careful analysis. Yet it is not clear why, for example, “Consciousness, Self and Personhood” should constitute a subset of “The Nature of Mind,” when “Self and Other” occurs as a major category two hundred pages earlier. I am only pointing out the vicissitudes of classification, too little in one case, in the other seemingly too much of a good thing. With these and other collections in mind, one might well conclude that the subject matter of philosophy of mind is too diffuse to allow precise organization and definition. (shrink)

As we write this paper in spring 2008, many are hopeful that November’s election will open the door to some form of comprehensive health care reform. In all likelihood, we will elect a president who has campaigned to a greater or lesser extent on promises of improving access to health care, improving quality, and reducing costs. Equally important, it seems likely that the 111th Congress is preparing to undertake meaningful health care reform. And perhaps most important, despite recent attention to (...) energy issues and the economy, opinion polls consistently show that the American public continues to rank health care as one of the two or three most important domestic issues in the fall elections and supports comprehensive health care reform. The dynamic development of science and technology in the last decades has led to new challenges in jurisprudence. This holds for individual fields of doctrinal law as well as the concerned fields of jurisprudence. It is especially significant for the structure of justice, the efficiency of law as a steering instrument of society, and the empirical conditions of legal responsibility. In a jurisprudential perspective, the philosophy of law is rather engaged with the adaptiveness of its traditional principles and categories or (...) the capacity to come to terms with the new developments and less concerned with concrete matters of law. The paper shows epistemological, methodological and ontological peculiarities of chemistry taken as a classificatory science of materials using experimental methods. Without succumbing to standard interpretations of physical science, chemical methods of experimental investigation, classification, reference, theorizing, prediction and production of new entities are developed one by one as first steps towards a philosophy of chemistry. Chemistry challenges traditional concepts of empirical object, empirical predicate, reference frame and theory, but also the distinction commonly drawn between natural science and technology. The papers vary widely, in scope, quality, approach, doctrinal basis, and subject matter, but the collection as a whole, if a bit bewildering, provides a good survey of the ways in which the philosophy of science is now being practiced and conceived.--V. Kant's epistemology and the Buddhist philosophy are an idealism. But these two different philosophies have in themselves the contradictory element, namely the element of the outer sense of bodies and of the inner mind. Although Kant's transcendental idealism and the school Vijnanavadin (唯識學派) acknowledge only the representations and the consciousnesses., the mind need to be affected by the outer part. In Kant's theoretical philosophy the outer sense of bodies plays an alien role. It stands outside the subject. In spite of (...) this, the subject have to relate itself to the outer element. And in the Buddhism, in order to have consciousnesses, the subject have to be transformed from the fundamental ground, the Alayavijnana (第8 識). But the Alyavijnana need to have a certain moment in order to be transformed. In my paper I have concentrated myself on the problem of relation of the mind to the matter. I have tried to see into the way in which these two philosophies develop this relation. Moreover I am also interested in the problem in relation to the theoretical, practical, and aesthetical fields. Corporate scandals brought the issue of corporate governance to the forefront of the agendas of lawmakers and regulators in the early 2000s. As a result, Congress, the New York Stock Exchange, and the NASDAQ enacted standards to improve the quality of corporate governance, thereby enhancing the quantity and quality of disclosures by listed companies. We investigate the relationship between corporate governance strength and the quality of disclosures in pre- and post-regulation time periods. If cross-sectional differences in corporate governance policies affect (...) the quality of financial disclosures, the quality of information available to analysts varies with such policies. Specifically, higher quality disclosures, produced as a result of strong corporate governance, should lead to more accurate and less dispersed analysts’ forecasts. Our analysis suggests that voluntary implementation of stronger corporate governance enhanced the quality of disclosures in the pre-regulation period; however, exceeding current corporate governance standards does not appear to result in higher quality disclosures post-regulation. These results suggest that SOX and the stronger regulations enacted by U.S. exchanges were effective in reducing variation in the quality of financial information available to investors. (shrink)

I read Stefan Collini’s What are Universities For? last week with very mixed feelings. In the past, I’ve much admired his polemical essays on the REF, “impact”, the Browne Report, etc. in the London Review of Books and elsewhere: they speak to my heart. If you don’t know those essays, you can get some of their flavour from his latest article in the Guardian yesterday. But I found the book a disappointment. Perhaps the trouble is that Collini is too decent, (...) too high-minded, has too unrealistically exalted a view about what actually happens in universities which is too coloured by attitudes appropriate to the traditional humanities. And he is optimistic to the point of fantasy if he thinks that people are so susceptible to “the romance of ideas and the power of beauty” that they will want, or can be brought to want, lots and lots of universities in order to promote the ideas (as if they would suppose that the task of “conserving, understanding, extending and handing on to subsequent generations the intellectual, scientific, and artistic heritage of mankind” was clearly ill-served when there were only forty universities in England, as opposed to a hundred and whatever). This article addresses the possible conditions under which parodies of prayer could emerge and be transmitted in the High and Late Middle Ages. It aims to offer a systematic overview over the different forms of prayer parody in the German-speaking Middle Ages. After some preliminary remarks on definitions I suggest a typology of German-speaking prayer parodies and conclude with some general observations on the possible contexts in which such texts were used.
