This paper seeks to counter the argument that since Aquinas’s natural law obligations necessarily presuppose the ability of practical reason to prescribeand proscribe for the sake of eudaimonia, it is irrational in cases of inescapable suffering to characterize any natural law obligation as indefeasible. Four possiblerebuttals of this argument from suffering are examined; but only three are judged successful. Their key premises are that, as Aristotle and Aquinas pointed out, this life’s eudaimonia is defined in terms of human nature and (...) not in terms of individual psychological conditions, e.g., suffering; that suffering does not negate the rationality of hoping for attaining eudaimonia in the future; and that suffering necessarily precludes neither the virtuous acts that per se constitute this life’s eudaimonia nor the love that enables one to experience eudaimonic joy. The crisis of democracy unfolding in the United States was identified by John Paul II as due to misunderstanding the relationship of truth and freedom. This crisis has grown worse due to a libertinism that sees objective moral truths as impositions on both free choice and fulfilling relationships, that identifies self-fulfillment with a self-creation in which one creates one’s own values, that seeks to build democracies apart from moral objectivity, and that dismisses the relevance of God for living well. I (...) argue that democracy cannot survive these libertine errors and that they cannot be successfully countered by utilitarianism, Rawls’s political liberalism, or democratic proceduralism. Survival requires adopting the Thomistic personalism formulated by Aquinas and developed by Karol Wojtyła as indispensable for understanding those lived experiences through which one encounters the ethical moment of self-determination, achieves moral objectivity, avoids loneliness by loving truly, and seeks—via collaboration with women exercising their feminine genius for discerning the welfare of others—the common good, without which democracies collapse into atheistic tyranny. The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, and (...) futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. Futility disputes are increasing and courts are slowly abandoning their historical reluctance to engage these contentious issues, particularly when confronted with inappropriate surrogate demands for aggressive treatment. Use of the judicial system to resolve futility disputes inevitably brings media attention and requires clinicians, hospitals, and families to debate these deep moral conflicts in the public eye. A recent case in Minnesota, In re Emergency Guardianship of Albert Barnes, explores this emerging trend and the complex responsibilities of clinicians and hospital administrators (...) seeking to replace an unfaithful surrogate demanding aggressive therapy. Use of the courts requires the coordinated commitment of significant institutional resources, management of intense media scrutiny and individual and organizational courage to enter the unpredictable world of litigation. Given the dearth of legislative guidance on medical futility, individual clinicians and institutions will continue to bear the difficult responsibility for resolution of individual futility disputes. The Barnes case illustrates how one institution successfully used the judicial system to replace an unfaithful surrogate, cease the provision of inappropriate aggressive care, and stimulate a community dialogue about appropriate care at the end of life. The continuing clash of ethical titans resounds with the cries of utilitarianism, virtue ethics, hedonism, rational egoism, emotivism, deontology, universal prescriptivism, rational contractarianism, and non-cognitivism. This fray is predicated upon each combatant assuming that his truth is complete and exclusive of all others and that his predecessors have been refuted. But are these assumptions true? Is it not possible that each has indeed grasped something true: the necessity of pursuing the greatest good for the greatest number in political action; the (...) indispensability of virtues; the ethical relevance of personal happiness; the goodness of pleasure and self-love; the priority of moral duty over inclinations; the universality of moral norms; and the importance of feelings in living the ethical life? And is it not possible that this fray is merely an historical artefact arising from the widespread—albeit uncritical—belief that Hume, Kant, and Moore destroyed the viability of eudaimonistic teleology, especially as expressed by Aristotle and Aquinas? If these possibilities are real, perhaps the rediscovery of ethical eudaimonia would include currently factional insights in such a way as to resolve on-going perplexities and provide a basis for a peaceful settlement. Aquinas argues that love of others depends on whether the other is seen as a person like oneself or as a tool of gratification. The former grounds love-of-friendship (altruistic love), the latter love-of-concupiscence. Seeing the other as a person like oneself enables one to love the other as another self, thereby, basing altruism ultimately on self-love.

Aquinas does not argue that natural inclinations per se suffice for moral absolutes, but rather that they suffice to make their objects known as self-evidently good for persons. Acting for the contrary of a natural inclination thereby harms persons and is contrary to the Bonum Precept (Good is to be done and pursued; evil is to be avoided). Acting for a self-evident good, however, becomes morally obligatory only when indispensable.

The movement of families around the world is becoming increasingly common, whether involuntarily or voluntarily . Though one of the effects of globalization is the growing number of professional parents whose occupation causes them to move their families around the world on a fairly regular basis, little is known of the effects of such global mobility on the children. This paper describes a small‐scale study undertaken with 120 globally mobile Botswana‐based children between 9 and 11 years of age, which explored (...) their perceptions of what it means to belong to a home country. Mary Taylor, Charlotte Bront"e's closest and lifelong friend, did indeed fulfill Bront"'s prediction in both her life and her writings. Recently, however, the authenticity of Taylor's feminist classic, Miss Miles, has been put into question. A controversy is now raging among experts and scholars of Victorian fiction over the true authorship of Miss Miles. Did Mary Taylor labor over this novel from her early womanhood until the end of her life, and offer it as her last great act (...) of friendship to women? Or is it the last work of Charlotte Bront"e, taken from her home to prevent its destruction, then published posthumously under Taylor's name? Regardless of its authorship, Miss Miles is a passionate and compelling novel, well deserving of its literary status on its own terms, and fascinating as a part of the Bront"e world. In this, the only edition of Miss Miles available, Taylor breaks with tradition by creating a profoundly feminist and morally intense novel which depicts female friendships as sustaining life and samity through the vicissitudes of Victorian womanhood. Set in the small Yorkshire village of Repton against the backdrop of starvation in the wool districts and the rise of Chartism in the 1830s, this extraordinary work chronicles the lives of four socially disparate women as they learn to find their own voices and support one another. Taylor's own courage and allegiance to her friends is wonderfully reflected in each of these individually ambitious women, while the novel's emphasis on the healing power of women's friendships echoes the relationship between Bront"e and Taylor herself. Originally published in 1890, Miss Miles continues to stand as an eloquent polemic in favor of a women's personal obligation to support herself. It is a classic that will delight all lovers of fine literature. (shrink)

La vida entera de muchos ensayistas transcurre sin dar jamás con un tema. Este ensayo no sólo se topa con un tema, sino que incluso se da el lujo de aprovecharlo. El tema es la felicidad. Sin embargo, La herida de Spinoza es un libro de ?losofía, no de autoayuda. Parte de algunas conclusiones recientes de la neurología, en particular de las investigaciones de Antonio Damasio acerca de la impertinencia de la secular división entre mente y cuerpo. El propio Damasio (...) vincula sus investigaciones con las ideas que Spinoza expuso en su Ética. Para Damasio, la tranquila aceptación de la muerte, una de las señas de identidad de la ética de Spinoza –de hecho, la «herida» de Spinoza–, resulta «irritante». Ese comentario de Damasio parece inocuo, pero para Vicente Serrano no lo es, sino que apunta a una especie de «desajuste», a una extraña incomprensión de la diferencia última de la ética spinozista. A partir de ahí el autor no se propone criticar solamente esa y otras lecturas de Spinoza, sino que plantea además una amplia crítica a la modernidad, y también a la posmodernidad. La herida de Spinoza se convierte entonces en una revisión de la historia entera de la ?losofía en esa zona en que ética y metafísica (u ontología) se superponen. Aunque el proyecto parece apabullante, el autor se asegura de estar bien equipado. Por una parte suprime el aparato académico, lo que le permite ser más breve y directo, y por otra echa mano de una erudición notable y, sobre todo, de una capacidad absolutamente inusual de explicación. Si hubiera que buscar parangones a esa capacidad, no quedaría más remedio que acudir a Rüdiger Safranski. El autor, sin embargo, no hace biografías, ni siquiera historia de la ?losofía como tal, sino que intenta ?losofar de la mano de los más grandes pensadores de la historia. El ensayo se completa con la inclusión de una pieza maestra: los afectos. Los afectos serían la respuesta posible de la ?losofía al problema de la biopolítica. La progresión de la modernidad no sólo implica la desaparición de la naturaleza, sino la sustitución absoluta de los afectos por la voluntad (de voluntad). Si la vuelta a la naturaleza es imposible, e incluso indeseable –dado que la naturaleza no fue nunca más que una metáfora–, Serrano se inspira en Foucault para proponer una «vuelta» a los afectos como la pieza fundamental que cierra la reflexión sobre el poder. «Un ensayo en el sentido más ágil del término, obra a mitad de camino entre lo reflexivo y lo literario… Bien pensado y bien escrito, muchísimo más de lo que se ha vuelto habitual en nosotros» (Gabriel Albiac, Leer). «La cuestión de fondo teórica –a qué responde la religión y qué problemas de comprensión existencial atiende o atendía– es algo mucho más complejo y creo que más apasionante. Educators and students alike face an enormous number of new fields of study and new medical technologies. Health care professionals and institutions are also facing new challenges in the form of shrinking economic resources, and the AIDS epidemic. They must (...) also respond to increased patient participation in health care decisions, and public concern about abortion and euthanasia. These challenges to the health care professional have compelled educators to accommodate ethics within their already overcrowded curriculum. Those same dilemmas have influenced health care institutions to become active in health care ethics education.Medical ethics education gained a foothold in the United States during the late 1960s, when the medical schools of Pennsylvania State University, the University of Florida, and the State University of New York at Stonybrook established programs in the humanities (Pellegrino 1982). In 1978 Robert Veatch noted that formal teaching in medical ethics was rare; most institutions that taught medical ethics used "informal instruction in the apprenticeship mode" (Veatch 1978). However, by 1982 a survey by the American Medical Association (AMA) revealed that all but one of the 127 medical schools had courses that included medical ethics. Thirty eight of these had medical ethics as a required course (Pellegrino 1985). And by 1989, 43 of the 127 medical schools had separate courses in medical ethics, while 100 covered medical ethics within required courses. Medical ethics is now an accepted part of medical curriculum, though it is not fully mature, and its future remains somewhat unclear (Miles 1989).The evolution of ethics in the nursing curriculum has essentially mirrored that of the medical curriculum. A 1977 survey of baccalaureate nursing programs revealed that only 7 percent of nursing programs required courses in ethics [End Page 171] (Aroskar 1977). A decade later a second survey of undergraduate programs identified 85 percent of responding nursing schools as teaching nursing ethics either in separate ethics courses or within other required courses (Cassells and Redman 1989).Though the precise future of health care ethics may be unpredictable, there is little thought that the role of ethics will diminish in importance as the 21st century approaches. Ethics is seen as part of a larger plan to develop and enhance the health professional's human values, social conscience, and interpersonal skills. "This broader effort derives from concerns about the personal attributes and humanistic sensitivity of physicians, the recent overly 'scientized' trend in premedical education, the selection of medical students, and the socialization and cynicism engendered by medical education" (Miles 1989, p. 705).While nearly every medical and nursing school in the United States now teaches ethics in one form or another, the degree to which ethics is integrated into the curriculum varies from school to school. Emérita Quito was the first woman from the Philippines to complete a Ph.D. in Philosophy. Her early Scholastic training as an undergraduate was at the University of Santo Tomas expanded to include phenomenology and existentialism during her graduate studies at major European universities. Upon returning home she began to focus on the idea of developing a methodology for investigating indigenous Filipino philosophy. How does one reveal the concepts and principles underlying the belief systems within a country that has suffered a (...) thousand years of occupation by foreign forces, that speaks with hundreds of different dialects across more than seven thousand islands spread across more than one hundred thousand square miles? Instead, we should agree on criteria of procedural justice and reach decisions whose justification lies in how (...) they are arrived at, rather than any direct ethical justification on the ground of substantive moral principles. In this polemical article, I argue that this amounts to a serious dereliction of intellectual duty on the part of the bioethics community. Our role in these settings is to produce and defend the best substantive arguments we can. Failing to do this makes bioethicists at best redundant and at worst leads us to seriously defective conclusions. The argument is illustrated by analysis of the ethical frameworks for resource allocation under the UNAIDS ‘3 by 5’ programme and for pandemic influenza planning. Discussion of Wittgenstein's Tractatus is currently dominated by two opposing interpretations of the work: a metaphysical or realist reading and the 'resolute' reading of Diamond and Conant. Marie McGinn's principal aim in this book is to develop an alternative interpretative line, which rejects the idea, central to the metaphysical reading, that Wittgenstein sets out to ground the logic of our language in features of an independently constituted reality, but which allows that he aims to provide positive philosophical insights into (...) how language functions. McGinn takes as a guiding principle the idea that we should see Wittgenstein's early work as an attempt to eschew philosophical theory and to allow language itself to reveal how it functions. By this account, the aim of the work is to elucidate what language itself makes clear, namely, what is essential to its capacity to express thoughts that are true or false. However, the early Wittgenstein undertakes this descriptive project in the grip of a set of preconceptions concerning the essence of language that determine both how he conceives the problem and the approach he takes to the task of clarification. Nevertheless, the Tractatus contains philosophical insights, achieved despite his early preconceptions, that form the foundation of his later philosophy. -/- The anti-metaphysical interpretation that is presented includes a novel reading of the problematic opening sections of the Tractatus, in which the apparently metaphysical status of Wittgenstein's remarks is shown to be an illusion. The book includes a discussion of the philosophical background to the Tractatus, a comprehensive interpretation of Wittgenstein's early views of logic and language, and an interpretation of the remarks on solipsism. The final chapter is a discussion of the relation between the early and the later philosophy that articulates the fundamental shift in Wittgenstein's approach to the task of understanding how language functions and reveal the still more fundamental continuity in his conception of his philosophical task.
