El autor trata de hacer balance, treinta años después, de lo que ha significado en el panorama del pensamiento jurídico la aparición de la Teoría del Derecho (Legal Theory, Rechtstheorie). El autor estudia los supuestos y razones del nacimiento de la Teoría del Derecho, como intento de superación de las limitaciones e insuficiencias del iusnaturalismo, del iuspositivismo y de su Teoría General del Derecho, así como de la Filosofía del Derecho postpositivista. Tras analizar el programa de la Teoría del Derecho (...) en sus direcciones anglosajona (Legal Theory) y alemana (Rechtstheorie), el autor hace un juicio de sus resultados (aportaciones e insuficiencias), postulando la posibilidad y necesidad de una Teoría Fundamental del Derecho que se configuraría como una ontología jurídica integral (material y formal al mismo tiempo). Elementos criticos de la filosofía de la existencia.--Marx; o, La crítica como fundamento.

Kalinowski conceives metaphysics as a set of propositions which can be axiomatized. This paper exposes the typical rules of an axiomatic system comparing them with the metaphysical system developed by Kalinowski. These rules are linguistic rules, but also admission-rules and transformation-rules. They always refer to the metaphysical propositions (wich are first or second propositions, as it is usual in logical systems). This paper tries to evaluate Kalinowski's attempt.

Findings suggest a positive impact of bilingualism on cognition, including the later onset of dementia. However, it is not clear to what extent these effects are influenced by variations in attentional control demands in response to specific task requirements. In this study, 20 bilingual and 20 monolingual older adults performed a task-switching task under explicit task-cuing vs. memory-based switching conditions. In the cued condition, task switches occurred in random order and a visual cue signaled the next task to be performed. (...) In the memory-based condition, the task alternated after every second trial in a predictable sequence without presenting a cue. The performance of bilinguals did not vary across experimental conditions, whereas monolinguals experienced a pronounced increase in response latencies and error rates in the cued condition. Both groups produced similar switch costs and mixing costs, but bilinguals produced them with lower response latencies. The cognitive benefits of bilingualism seem not to apply to executive functions per se but to affect specific cognitive processes that involve task-relevant context processing. The present results suggest that lifelong bilingualism could promote in older adults a flexible adjustment to environmental cues, but only with increased task demands. However, due to the small sample size, the results should be interpreted with caution. (shrink)

The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. This paper presents an analysis of the new teaching methodologies in times of confinement due to the pandemic caused by Covid-19. Theoretical tools aimed at making explicit the injustices suffered by certain socially disadvantaged groups might end up serving purposes which were not foreseen when the tools were first introduced. Nothing is inherently wrong with a shift in the scope of a theoretical tool: the popularization of a concept opens up the possibility of its use for several strategic purposes. The thesis that we defend in this paper is that some public figures cultivate a public persona for whom the conditions of (...) the notion of testimonial injustice might be taken to apply, and this situation is exploited to their advantage, as a means to advance their political agendas. More specifically, they take advantage of this to generate situations of crossed disagreements, which in turn foster polarization. (shrink)

Understanding what motivates employees is essential to the success of organizational objectives. Therefore, properly capturing and explaining the full range of such motivations are important. However, the classical and most popular theories describing employee motives have neglected, if not omitted entirely, the importance of the ethical and spiritual dimensions of motivation. This has led to a model of a person as self-interested, amoral, and non-spiritual. In this paper, we attempt to expose this omission and offer a more complete taxonomy of (...) motivations which include these dimensions. Although more work will need to be done to fully develop the ethical and spiritual dimensions of motivation, the expanded taxonomy will provide the foundations and serve as a guide for such further research. Furthermore, this new categorization of motivations brings out the full dimensions of being human, which promises to lead to improved management practices with regard to employees and foster greater human flourishing in the workplace. The way digital information technologies work and, more specifically, the possibilities for action that technological devices offer to us affect our processes of political belief formation. In particular, there seems to be a close connection between our digital affordances and the increase of the sort of polarization that threatens the proper functioning of democracy. In this paper, we analyze whether the type of polarization linked to the use of digital technologies, and which endangers the health of public deliberation, has to (...) do with the adoption of beliefs whose contents are increasingly extreme—extremism—or, on the contrary, has more to do with increasing our credence in the core beliefs of our political identity—radicalism. Bernardo de Monteagudo en su texto: Diálogo entre Atahualpa y Fernando VII en los Campos Eliseos, parte de una crítica a las atrocidades llevadas a cabo por los españoles contra los americanos en la Conquista –atrocidades que sobrepasan las llevadas a cabo por Napoleón contra Fernando VII–, para proponer una integración social y cultural que movilice a los pueblos latinoamericanos a la independencia del colonialismo español. Sin embargo, su propuesta no reivindica al indígena, sino que su imagen es usada por (...) el escritor como símbolo de una Latinoamérica que se limita a los criollos. Es decir, el indígena quedará, luego de las independencias latinoamericanas, en una situación similar a la colonial, sólo que ahora bajo el dominio de los criollos. De igual manera, esto nos puede suceder en nuestra realidad bogotana: pensar que Latinoamérica, y especialmente Colombia, se reduce a los Andes, a las ciudades del interior, excluyendo así al Caribe. En este escrito se presenta el proyecto de traducción y edición de los Fragmentos sobre estética. Una selección crítica a partir de los Apuntes de Lecciones sobre Antropología de Kant. A partir de un estudio histórico-volutivo sobre el desarrollo de su proyecto estético desde 1770 a 1790, se han seleccionado y traducido los textos sobre estética contenidos en el volumen 25 de la edición de la Academia. En el presente escrito se defiende la pertinencia de estos materiales para una comprensión (...) histórica de la génesis y formación de la Crítica del Juicio, en el contexto general de la reflexión de Kant sobre los problemas y temas de tipo sistemático que afectan a la fundamentación crítica de la racionalidad. This paper deals with the role played by the imagination in the Transcendental Deduction argument from Kant’s Kritik der reinen Vernunft, and it is focused specially on the differences between the 1781 edition and the 1787 edition. My aim is to put into question the starting point of Heidegger’s interpretation as he presented in Kant und das Problem der Metaphysik. In contrast I will provide a construal of both editions, according to which it is actually in the second edition where (...) Kant reached a proper understanding of the autonomy of imagination in the argument. If the first edition bestowed such an important role on this faculty, it is because Kant had not still distinguished sharply between the subjective and the objective dimensions of its activity in the process of knowledge, as it is remarkably revealed if one pays a close attention to 1780s Kant’s “aesthetic project”. Whereas in the 1787 edition Kant is only centred on the determining activity of imagination qua transcendental, as long as the Deduction is to prove merely the objective validity of knowledge. Against Heidegger, I claim that such exclusion of the subjective and sensible dimension of imagination in the Kritik der reinen Vernunft is due to the fact that in 1787 Kant had found a new place to tackle this question within the general framework of the critical foundation of metaphysics, namely, the Kritik der Urteilskraft. This paper reports on a study of the largest Spanish corporations concerning the status of corporate ethics policies. The research project, the first of its kind in Spain, has two parts. First, the types of formal documents the companies use are analysed, including those dealing with ethical values or norms. Three groups of companies are distinguished: the first group has no formal documents dealing with ethical values, and the reasons given for not having any ethical statement are discussed. A second (...) group has one document mentioning ethical values (generally the vision and/or mission statement), and a third group has in place two or more documents (one generic and the other more detailed, such as a code of conduct). The findings show that the latter group is more proactive than the former in implementing measures for promoting business ethics throughout the organisation. In the second part of the research, the study analyses the differences between companies whose headquarters are in Spain, Europe and USA regarding the arguments, the focus and the practices used to formalise business ethics. In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account of dignity as high rank provides (...) an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. San Pedro de Alcántara destaca por su vida de profundización en la vida contemplativa y mística. Un ejemplo palpable de esta actitud la encontramos su Tratado de Oración y Meditación. En esta reflexión realizamos una lectura filosófica de un párrafo de la meditación del primar día de esta obra alcantarina. Desde la antropología existencial, el autor del Tratado nos invita a la contemplación de uno mismo, para llegar a la trascendencia y la alteridad que deja su huella en lo más (...) profundo del ser personal. Saint Pedro of Alcántara stands out for his enthusiasm for a comtemplative and mystical life. A very good instance of his disposition towards this can be found in his “Tratado de Oración y Meditación”. In this reflection we can interpret philosophically a paragraph from this particular work, which deals with meditation on the first day, that is to say, on Monday. By means of existential anthropology, the author invites us to look thoroughly into ourselves so that we can reach a transcendental state which will mark our inner self. (shrink)
