Today, liberals face a predicament: how to defend liberal principles, when adherence to them seems to constitute a fatal disadvantage against unprincipled opponents. The challenge is not new. In the early years of the twentieth century, liberalism was attacked, by critics on both the right and, especially, the left for being hypocritical, naïve, irresponsible, and impotent. It couldn't, for example (anti-liberalists thought), address the acute inequality of imperial rule, racial segregation, and socio-economic poverty. These issues of social justice it (...) was claimed by critics required a politics marked by an uncompromising commitment to ultimate ends, and an unrelenting use of power. Faced with such sentiments and the practical successes of anti-liberal ideologies (i.e. Fascism, Nazism, and Communism) liberals felt pressure to silence their scruples and doubts, and embrace the confidence, ruthlessness, and intransigence exhibited by their opponents. But doing so seemed tantamount to abandoning liberal hopes for, and commitments to, human freedom and all they valued in the first place. In Liberalism for Dark Times, Cherniss tells the story of the liberal response to this challenge in the twentieth century. Through a close study of five leading intellectuals engaged in these debates-Max Weber, Raymond Aron, Albert Camus, Reinhold Niebuhr, and Isaiah Berlin-Cherniss reconstructs a distinctive, neglected strand of liberal thought. This strand defines and defends liberalism as a political ethos: a complex of dispositions, temperament, and sensibility and style-which include skepticism; openness to experience; and careful, discriminating judgment-that shape how individuals make choices, meet challenges, understand and pursue possibilities, and conduct themselves toward others in the course of political struggle. For Manent, a discussion of liberalism encompasses the foundations of modern society, its secularism, its individualism, and its conception of rights. The frequent incapacity of the morally neutral, democratic state to further social causes, he argues, derives from the liberal stance that political life does not serve a higher purpose. The author traces the liberal stance to Machiavelli, who, in seeking to divorce everyday life from the pervasive influence of the Catholic church, separated politics from all notions of a cosmological order. What followed, as Manent demonstrates in his analyses of Locke, Hobbes, Rousseau, Guizot, and Constant, was the evolving concept of an individual with no goals outside the confines of the self and a state with no purpose but to prevent individuals from dominating one another. Weighing both the positive and negative effects of such a political arrangement, Manent raises important questions about the fundamental political issues of the day, among them the possibility of individual rights being reconciled with the necessary demands of political organization, and the desirability of a government system neutral about religion but not about public morals. A new history of liberalism which argues that liberalism has been predicated on definite morality and should be viewed as an attempt to encompass both fear and hope. Liberalism, argues Alan Kahan, is the search for a society in which people need not be afraid. Freedom from fear is the most basic freedom. If we are afraid, we are not free. These insights, found in Montesquieu and Judith Shklar, are the foundation of liberalism. What liberals fear (...) has changed over time (revolution, reaction, totalitarianism, religious fanaticism, poverty, and now populism) but the great majority of liberal thinkers have relied on three pillars to ward off their fears and to limit the concentrated power that causes fear: freedom, markets, and morals, or, to put it another way, politics, economics, and religion or morality. Most liberal thinkers emphasize one or two pillars more than another, but it is typical of liberalism down to the Second World War to rely on all three, although there were always minority voices who preferred to stand on only one leg. After WWII, "thin" procedural/market liberals, who wanted to strip any moral or religious basis or purpose from liberalism, dominated "thick" liberal moralists, who thought liberalism needed a moral basis and/or goal. It is the political contention of this book that liberalism is most convincing as program, language, and social analysis when it relies on all three pillars, and that the relative weakness of liberalism at the end of the twentieth century had much to do with neglect of the moral pillar of liberalism. Its historical contention is that for much of the past two centuries it did rely on all three pillars. But Kahan also argues that liberalism is not only a party of fear. It is also a party of hope, or the party of progress. Many of the contradictions typical of liberalism derive from the seemingly contradictory effort to encompass both hope and fear. If in case of conflict fear often trumps hope for liberals (loss aversion applies in politics as much as in economics), and utopia is subject to indefinite postponement, progress in personal autonomy and development has always been at the heart of liberalism. Liberals typically support their hopes on the same three pillars of freedom, markets, and morals which they use to ward off their fears. Nevertheless, in one respect those historians and political theorists who identify liberalism with laissez-faire economics are not wrong. It is characteristic of liberalism then that it bases its hopes not on the state but on civil society, which for liberals is the common source of a free politics, a free market, and of morals. Taking its distance from classical liberalism, political liberalism seeks to avoid controversial metaphysical assumptions by starting from institutional features of modern polities. Political liberalism also extends the limits of liberal toleration by envisioning societies that it considers nonliberal but decent. This article is concerned with the relationship between these two dimensions of political liberalism, specifically as they are instantiated in the work of John Rawls. I show that these two dimensions are in tension with each other. (...) Put simply, if political liberalism is institutional, then decent societies are impossible. Decent societies are only conceivable within the ahistorical realm of values—a realm that Rawls sometimes slips into, even though its avoidance is central to political liberalism’s claim of distinctiveness. Rawls’s appeal to hypotheticals to defend his account of decent societies only serves to mask this tension and to foreclose important avenues of inquiry about the non-Western world. I also deploy throughout the article archival material that evinces Rawls’ concern with ethnocentrism but also the difficulties he faced in coming up with an adequate account of non-Western societies. On the argument I offer here, this intractability is to be expected, since Rawls did not recognize that the problems with his account were not purely philosophical, but in fact, sociological, political, and historical. In this book, Kukathas critically examines the nature and coherence of Hayek's defense of liberal principles, attempting both to identify its weaknesses and to show why it makes an important contribution to contemporary political theory. Kukathas argues that Hayek's defense of liberalism is unsuccessful because it rests on presuppositions which are philosophically incompatible. In his (...) view, the unresolved dilemma of Hayek's political philosophy is how to mount a systematic defense of liberalism if one emphasizes the limited capacity of human reason. Hayek's social philosophy, he argues, offers a significant theory of the nature of social processes, and is therefore an important account of how this must constrain our choice of political principles. This essay reviews the main themes and ideas of a couple of recent books on liberalism written by two intellectual historians, Alan S. Kahan and Nathaniel Wolloch.Their books shed fresh light on the internal diversity and complexity of the liberal tradition, especially in relation to the Radical and Moderate Enlightenment as well as the French Revolution. Wolloch and Kahan show that many of the ideas and aims of the Radical Enlightenment ended up being implemented by thinkers who belonged to (...) the tradition of moderate liberalism. This essay argues that the “republicanism versus liberalism” debate that came to prominence in the 1980s was largely an artificial construction made possible by the recent genealogies of its constituent terms. The first section suggests that the idea of “early modern liberalism” took shape from the 1930s, and identifies three broad schools of thought: Marxist, democratic and classical. Despite their differences, they pioneered a stereotype of “liberalism” that was well established – especially in the United States – (...) by the 1950s. The second section examines the so-called “republican tradition,” arguing it did not acquire that identity until the early 1970s, and that earlier work excavating the “commonwealth tradition” did not intend it as an alternative to liberalism. That only came into focus as a result of Wood’s work. The third section looks at elements of the debate in the 1970s, stressing the attempt to displace Locke and exploring the contribution of Pocock. He increasingly argued for the complex and interwoven nature of both “republicanism” and “liberalism,” partly as a response to revisionist work on the natural law origins of liberalism. "Liberalism" is widely used to describe a variety of social and political ideas, but has been an especially difficult concept for historians and political scientists to define. Burckhardt, Mill, and Tocqueville define one type of liberal thought. They share an aristocratic liberalism marked by distaste for the masses and the middle class, opposition to the commercial spirit, fear and contempt of mediocrity, and suspicion of the centralized state. Their fears are combined with an elevated ideal of human personality, (...) an ideal which affirms modernity. All see their ideals threatened in the immediate future, and all hope to save European civilization from barbarism and militarism through some form of education, although all grow more pessimistic towards the end of their lives. Aristocratic Liberalism ignores the national boundaries that so often confine the history of political thought, and uses the perspective thus gained to establish a pan-European type of political thought. Going beyond Burckhardt, Mill, and Tocqueville, Aristocratic Liberalism argues for new ways of looking at nineteenth-century liberalism. It corrects many prevalent misconceptions about liberalism, and suggests new paths for arriving at a better understanding of the leading form of nineteenth-century political thought. The new Afterword by the author presents a novel description of liberal political language as the "discourse of capacity," and suggests that this kind of language is the common denominator of all forms of European liberalism in the nineteenth century. “Philosophers,” Dewey writes, “are parts of history, caught in its movement; creators perhaps in some measure of its future, but also assuredly creatures of its past”. The question of the philosopher’s embeddedness in either her own or some earlier historical moment constitutes an important theme in Dewey’s account of pragmatism, in particular his account of politics. In lieu of a formal treatise on history, this paper focuses on Dewey’s claims about history as they are enacted in his political analyses. Drawing (...) on texts such as Liberalism and Social Action and Freedom and Culture as well “The Role of Philosophy in the History of Civilization”, I hope to elucidate in greater depth the function and meaning of the term “historic relativity” as a central concept in Dewey’s philosophy of history. Further, I evaluate Dewey’s criticisms of both classical liberalism and Marxism on historical grounds, where he employs what I call political obsolescence claims. From these texts I reconstruct and critically assess what I refer to as Dewey’s implicit philosophy of history. I conclude that the presuppositions of Dewey’s political reconstruction represent the very mode of uncritical historical reproduction which his philosophy ostensibly cautions against. To suggest one possibility for addressing these tensions, I gesture toward non-coincidence as a critical historical category through which we might articulate the historic present with the hope of transforming it. The contest between “Lockeian liberalism” and “classical republicanism” as explanatory frameworks for the intellectual history of the American Revolution, and therefore of the present-day United States, has been one of the longest running and most distinguished in recent U.S. historiography. It also has major implications for the history of political thought in the North Atlantic Anglophone world more widely. Yet this debate was merely suspended when it was held to have ended in an ill-defined compromise. Although some U.S. historians (...) expressed doubts and qualifications, attention in U.S. historiography moved on to other themes while leaving the initial problem unsolved. This article reopens the question; it suggests that a historicization of both these two categories is now both possible and necessary, and that their supersession will advance understanding of the Revolution. It seeks to help solve this problem by the same means that the debate began: that is, by re-establishing a link between U.S. and U.K. historiographies. (shrink)

Baruch de Spinoza (1632-1677)--often recognized as the first modern Jewish thinker--was also a founder of modern liberal political philosophy. This book is the first to connect systematically these two aspects of Spinoza's legacy. Steven B. Smith shows that Spinoza was a politically engaged theorist who both advocated and embodied a new conception of the emancipated individual, a thinker who decisively influenced such diverse movements as the Enlightenment, liberalism, and political Zionism. Focusing on Spinoza's Theologico-Political Treatise, Smith argues that Spinoza (...) was the first thinker of note to make the civil status of Jews and Judaism (what later became known as the Jewish Question) an essential ingredient of modern political thought. Before Marx or Freud, Smith notes, Spinoza recast Judaism to include the liberal values of autonomy and emancipation from tradition. Smith examines the circumstances of Spinoza's excommunication from the Jewish community of Amsterdam, his skeptical assault on the authority of Scripture, his transformation of Mosaic prophecy into a progressive philosophy of history, his use of the language of natural right and the social contract to defend democratic political institutions, and his comprehensive comparison of the ancient Hebrew commonwealth and the modern commercial republic. According to Smith, Spinoza's Treatise represents a classic defense of religious toleration and intellectual freedom, showing them to be necessary foundations for political stability and liberal regimes. The political philosophy of liberalism was first formulated during the Enlightenment in response to the growth of the modern nation-state and its authority and power over the individuals living within its boundaries. Liberalism is now the dominant ideology in the Western world, but it covers a broad swathe of different (and sometimes rival) ideas and traditions and its essential features can be hard to define.

The unfortunately vast history of paternalism in both medicine and clinical research has resulted in perpetually increasing respect for patient autonomy and free choice in Western health care systems. Beginning with the negative right to informed consent, the principle of respect for autonomy has for many patients evolved into a positive right to request treatments and expect accommodation. This evolution of patient autonomy has mirrored a more general social attitude of market liberalism where increasing numbers of patients have come (...) to embody the role of the “consumer.” This paper explores this transformation and critiques the current way in which respect for patient autonomy is put into practice. Ultimately, this paper concludes that the consumer view of patient autonomy is dysfunctional. Moreover, this paper argues that, based on the inherent goals of medicine, some form of paternalism is required in any meaningfully therapeutic relationship. (shrink)

Review of Duncan Bell, Reordering the World: Essays on Liberalism and Empire, Princeton University Press 2016.

Public reason liberalism demands that political decisions be publicly justified to the citizens who are subjected to them. Much recent literature emphasises the differences between the two main interpretations of this requirement, justificatory and political liberalism. In this paper, I show that both views share structural democratic deficits. They fail to guarantee political autonomy, the expressive quality of law, and the justification to citizens, because they allow collective decisions made by incompletely theorised agreements. I argue that the result (...) can only be avoided by changing public reason’s role in collective decision-making. Instead of incompletely theorised agreements, we should demand agreement both on the public reasons themselves and on the other premises that justify political decisions. In this way, it is always possible to point to a procedure-independent reason that justifies democratic decisions, and the reasoning of the state is public and contestable. Finally, I explain how this, in turn, implies that only political liberalism can be rescued—by accepting what I will call strong political liberalism. Modifying justificatory liberalism in the necessary way will inevitably open the door to an objectionable form of perfectionism. (shrink)

In this volume, prominent political theorist Michael Zuckert presents an important and pathbreaking set of meditations on the thought of John Locke. In more than a dozen provocative essays, many appearing in print for the first time, Zuckert explores the complexity of Locke's engagement with his philosophical and theological predecessors, his profound influence on later liberal thinkers, and his amazing success in transforming the political understanding of the Anglo-American world. At the same time, he also demonstrates Locke's continuing relevance in (...) current debates involving such prominent thinkers as Rawls and MacIntyre. Zuckert's careful reconsideration of Locke's role as "launcher" of liberalism involves a sustained engagement with the hermeneutical issues surrounding Locke, an innovator who faced special rhetorical needs in addressing his contemporaries and the future. It also involves highlighting the novelty of Locke's position by examining his stance toward the philosophical and religious traditions in place when he wrote. Zuckert argues that neither of the dominant ways of understanding Locke's relations to his predecessors and contemporaries is adequate; he is not well seen as a follower of any orthodoxy nor of any anti-orthodoxy of his day, either philosophical or theological. He found a path to innovation that was philosophically radical but which was also able to connect with prevailing and accepted traditions. That allowed him to exercise a practical influence in history rarely, if ever, matched by any other philosopher. Zuckert illustrates that influence by showing how William Blackstone used Lockean philosophy to reshape the common law and how the Americans of the eighteenth century used Lockean philosophy to reshape Whig political thought. Zuckert argues that Locke's philosophy has continuing philosophic and political force, a proposition he demonstrates by arguing that Locke presents a form of political philosophy superior to that of the liberal theorists of our day and that he has solid rejoinders to contemporary critics of liberalism. Contemporary political philosophers are often uncomfortable with the notion that a conception of the good life can be developed out of liberalism. Liberalism, they say, should remain neutral out of respect for pluralism. Early liberals of the nineteenth century, however, understood their project as a vindication of the good life, along with a diagnosis of what threatens it. This article attempts to build a conception of the good life from liberal values and sensibilities, yet not run afoul of (...) the need to respect pluralism. Was liberalism really an outdated ideology in post-1945 European political systems, as claimed by some scholars? The great success of socialism on one side and various forms of Christian Democracy on the other could make that claim appear reasonable. In fact a closer view shows how postwar constitutions in some countries presented once again fundamental liberal values, reformulated in different words. In this paper I propose an approach to thinking about religion and politics that should inform how we think about liberalism and religion. I also consider how the conception of political authority defended by the prominent Muslim public intellectual Abdullahi Ahmed An-Na’im is a paradigm example of liberalism. In Part I I consider two approaches to religion and politics. According to the reductionist view, whether values that are central to a religious tradition can be reconciled to liberalism (...) is more a matter of doctrine than practice. By contrast a non-reductionist approach emphasizes that the relationship between political and religious values is influenced by a number of variables in addition to religious doctrine, including ethnicity, historical memory, political economy, and local politics. On this view, the path between religious and political convictions is anything but a straight line. In Part II I examine central arguments in An-Na’im’s work that are central to his version of liberalism, with a focus on liberty of conscience and religious freedom. To illustrate An-Na’im’s liberalism I focus on examples of claims about morality and theology, politics, and history. I conclude in Part III by considering how An-Na’im’s position is one example of what we would expect from a non-reductionist understanding of religion and politics. (shrink)

An exploration of the theories, histories, practices, and contradictions of liberalism today. What does it mean to be a liberal in neoliberal times? This collection of short essays attempts to show how liberals and the wider concept of liberalism remain relevant in what many perceive to be a highly illiberal age. Liberalism in the broader sense revolves around tolerance, progress, humanitarianism, objectivity, reason, democracy, and human rights. Liberalism's emphasis on individual rights opened a theoretical pathway to (...) neoliberalism, through private property, a classically minimal liberal state, and the efficiency of “free markets.” In practice, neoliberalism is associated less with the economic deregulation championed by its advocates than the re-regulation of the economy to protect financial capital. Liberalism in Neoliberal Times engages with the theories, histories, practices, and contradictions of liberalism, viewing it in relation to four central areas of public life: human rights, ethnicity and gender, education, and the media. The contributors explore the transformations in as well as the transformative aspects of liberalism and highlight both its liberating and limiting capacities. The book contends that liberalism—in all its forms—continues to underpin specific institutions such as the university, the free press, the courts, and, of course, parliamentary democracy. In The System of Liberty: Themes in the History of Classical Liberalism, George H. Smith focuses his thematic approach regarding the study of classical liberal political philosophy on both natural-rights philosophers, in what Smith deems the “Lockean Paradigm,” and nineteenth-century utilitarian liberals. Smith does not merely provide an overview of the history of this theory—rather, he attempts to discover how and why liberal theory had faced major challenges in the nineteenth-century with regard to both its theoretical foundations and its (...) level of public support. Concluding, along with Herbert Spencer, that following positive results in innovation and in the economic sphere, which were achieved through the reduction of government power, “most people, seeing that these beneficial results had something to do with government, failed to differentiate between the repeal of onerous laws and the passing of new laws” (p. 213), Smith attempts to discover why liberals were unsuccessful in clai. The book comprises seven interconnected essays that aim to enrich our understanding of Mill's thinking and his political liberalism as a historically determined narrative. It does so by drawing on recent historiographical debates, the theoretical assumptions of the "New History of Political Thought" and conceptual history. Sharing common methodological ground, the different chapters elaborate on questions concerning the relevance of historical texts for our present understanding of Mill's thoughts and how to study them as embedded in their social and (...) political context. Thus, the book examines a variety of textual sources, gravitating around the study of a selection of concepts and a number of prominent intellectuals, which contributes to the formation of a picture of Mill's intellectual milieu and historical background.
