P.F. Strawson and his Philosophical Legacy aims to bring out the continuing relevance of Sir Peter Frederick Strawson’s (1919–2006) work for current philosophical debates. It is the first collection of essays published after Strawson’s death that covers the full range of his work. The focus in contemporary work on Strawson is often on his relation to Kant or his paper ‘Freedom and Resentment’. While this volume gives due attention to these topics, it also includes essays on Strawson’s lasting contributions to (...) the philosophy of language, metaphysics, epistemology, perception, moral philosophy, and philosophical methodology. Son expérience de la philosophie diaclectique post-kantienne, en particulier la dérivation du concept de l'espace et de la matière chez Johann Gottlieb Fichte, avait constitué une base dialectique solide pour ses propres études de 1918 en une géométrie purement infinitésimale et la théorie antérieure d'un champ de (...) matière géométriquement unifié (en prolongement du programme Mie-Hilbert). Bien que Weyl se fût alors éloigné des aspects spéculatifs de la philosophie de sa jeunesse et eût montré, en particulier, moins d'enthousiasme qu'auparavant pour Fichte, il nourrissait encore de nombreux doutes sur la base culturelle de la science mathématique moderne et sur son rôle dans la culture matérielle du modernisme de pointe. The fifth section argues that we can resolve this problem by drawing upon Erhard's account of failures of legal recognition. The notion of a ‘clash of civilizations’, which now seems to have become a fashionable cliché, should be discussed in the context of a broader set of questions: the problematic of intercivilizational encounters. This is an important but very underdeveloped part of the research programme now known as civilizational analysis. The article begins with a brief survey of the Indian experience. Indian history includes a long succession of intercivilizational encounters, both those initiated from the West (by Greeks, Muslims and Europeans) (...) and those that brought Indian influence to bear on other regions (as did the spread of Buddhism to East Asia and the ‘Indianization’ of Southeast Asia). These examples serve to sketch a phenomenology of encounters. For a more theoretical approach, the article turns to the work of Benjamin Nelson, who first introduced the concept of intercivilizational encounters. His analyses focus on the encounters that involve contacts or conflicts between the basic ‘structures of consciousness’ that define different civilizations. Such interactions can lead to fusion or to prolonged internal conflicts, but they may also be instructive because of the very absence of significant effects: in the latter case, fundamental blockages to intercivilizational borrowing or engagement are built into the structures of consciousness. For Nelson, the early modern encounter between China and the West was a prime example of that kind. The last part of the article takes the question beyond Nelson’s historical cases and relates it to the advanced phase of modernity, where the dominant type of encounters is three-cornered: it involves Western and non-Western civilizations as well as the new (modern) civilizational patterns adumbrated in the West but open to redefinitions in other contexts. Lectures from the late period of Fichte’s career, never before available in English. Translated here for the first time into English, this text furnishes a new window into the final phase of Fichte’s career. Delivered in the summer of 1812 at the newly founded University of Berlin, Fichte’s lectures on ethics explore some of the key concepts and issues in his evolving system of radical idealism. Addressing moral theory, the theory of education, the philosophy of history, and the philosophy of (...) religion, Fichte engages both directly and indirectly with some of his most important contemporaries and philosophical rivals, including Kant, Schelling, and Hegel. Benjamin D. Crowe’s translation includes extensive annotations and a German-English glossary. J. Hochstrasser. Natural Law Theories in the Early Enlightenment. New York: Cambridge University Press, 2000. Pp. xiii + 246. Cloth, $54.95. In a worthy addition to Cambridge's Ideas in Context series, T. J. Hochstrasser undertakes an excavation. His aim is to provide a description, and to (...) demonstrate the importance within the German Frühaufklärung, of a largely forgotten philosophical approach: eclecticism. Hochstrasser argues that the triumph of Wolffian rationalism in the Protestant universities in the middle of the eighteenth century occluded the importance of eclecticism for Kant, who in turn occluded it for everyone afterward. But the price of forgetting eclecticism is high. Not only are we left with no account--or a skewed account--of the development of German thought from the first stirrings of the Enlightenment to the emergence of the Critical philosophy, but our understanding of the development of the historiography of philosophy is badly compromised. For among their many accomplishments--in natural jurisprudence, in university reform--the eclectics were the first critical historians of philosophy, their distinctive genres being historically aware treatises on natural law and Whig histories of natural jurisprudence. Hochstrasser's study traces the development of eclecticism, from the work of its founders, Samuel Pufendorf and Christian Thomasius, through a devolution in the hands of Thomasius's later disciples, to the eventual oblivion in the middle of the eighteenth century. This review will focus on the beginning of this narrative, as Pufendorf is the leading figure in the book.Eclecticism began with Pufendorf's attempt, in his mature work on natural law, to reconcile his conflicting inheritances from Grotius and Hobbes without simply endorsing the work of either. He was impressed both by Grotius's explanation of the law of nations in terms of human sociability--but also by Hobbes's criticisms of Grotius, rooted in the latter's analysis of the state of nature. At the same time, he wished to reject Grotius's method of induction from sociological observation and Hobbes's minimally constrained voluntarism. Contributing further to his perplexity was his increasing disaffection from the geometric approach he had adopted in his Elementa Jurisprudentiae Universalis.The way out of this impasse, Hochstrasser contends, was revealed to Pufendorf in correspondence with Hermann Conring, the leading constitutional lawyer of his time, and Johann Böcler, Grotius's most erudite commentator. Böcler chastised Pufendorf for his neglect of history, and both of Pufendorf's correspondents pointed out his need for some non-Hobbesian criterion by which he could validate his first principles, whatever they turned out to be. Stung particularly by Böcler's remarks, Pufendorf returned to the Stoics and there discovered a via media between Hobbes's pessimism and Grotius's optimism: a synthesis anticipating Kant's doctrine of "unsocial sociability." For the purposes of Hochstrasser's study, the key aspects of Pufendorf's solution are these: first, it avoids mere voluntarism; second, it does this by means of a moral epistemology that sharply distinguishes natural law [End Page 126] from moral theology; finally, the validating criterion for Pufendorf's first principles is located in critical appropriation of the history of moral philosophy. RedekopScholarly interest in the emergence of a “public sphere” and “public opinion” in eighteenth-century Europe remains strong, and with good reason. The ideological construct of a modern public in Europe “was a characteristic product of the Enlightenment, and it marked one of the critical zones of intersection between Enlightenment discourse and a broad range of socio-economic and (...) institutional changes.” 1 Analysis of the emerging figure of “the public” helps illuminate the relationship between intellectual and material culture, between “Enlightenment” and society. The recognition of the constitutive nature of language and its role in the interplay between “meaning” and “experience” 2 lead one to take seriously terms like “the public” and “public opinion” as important links between linguistic and social domains. Text and context merge into one as social entities like “the public” become rhetorical ones, and vice-versa.Keith Baker, for example, resolves the contextual dimension of “public opinion” in France into the textual one, whereby it emerges as a “rhetorical figure” or “political invention” in the latter decades of the eighteenth century. 3 Others stay closer to the social domain, including the salons of Paris, to look for the emergence of the notion of rational public opinion. 4 Taken together, these are two sides of the same coin—an emerging sphere of “public” discourse carried on by “private” individuals, and a more private sphere in which public discursivity was nurtured. 5 [End Page 81]In this article I explore these themes in a German context, focusing on the writings of Thomas Abbt (1738–66) as an attempt to grapple with the exigencies of German social and intellectual life in a novel fashion. The written word was the primary vehicle available for this simultaneous mo vement of enlightenment and socio-political formation, and Abbt’s works represent an early attempt to inscribe a public sphere—to create a space in which it became possible for individuals to think, talk, and act in reference to a larger socio-political whole. While Prussian patriotism was behind his initial foray into the topic of the public sphere in On Dying for the Fatherland, Abbt’s On Merit reveals an expansion in perspective, and with it the emergence of “the public” as a moral and s ocio-political point of reference. There is a good degree of continuity, however, between the two works, concerned as they are with overcoming the basic German problem of a fragmented public sphere with enlightened arguments designed to lead readers to lo cate themselves and their well-being in an enlarged societal frame.While at least one commentator has argued that Abbt was seeking to write for the common German Volk, 6 his primary audience was clearly that of the middling and higher orders. 7 The general problem Abbt addressed, however, was that of reconciling Enlightenment and reform with the entire spectrum of German society. In their brilliant and thought-provoking book Recognizing Wrongs, John Goldberg and Benjamin Zipursky offer a vindicatory interpretation of the law of torts. As part of this, they offer a justification for what they call the “principle of civil recourse.” This is the principle that “a person who enjoys a certain kind of legal right, and whose right has been violated by another, is entitled to enlist the state’s aid in enforcing that right, or to make demands in response to (...) its violation, as against the person who has violated it.” To defend the principle of civil recourse, Goldberg and Zipursky appeal to three values: equality, fairness, and individual sovereignty. In this essay, we make two critical points. First, we argue that Goldberg’s and Zipursky’s defense errs by omitting a justificatory appeal to our moral rights and duties as part of the normative foundation of the tort law. Second, we argue that Goldberg’s and Zipursky’s arguments do not explain certain institutional features of the tort law, including the fact that legal duties of redress emerge only at the conclusion of court cases and the fact that lawsuits are opted int.o by tort victims who must initiate these actions themselves. To retain what is philosophically valuable in Goldberg’s and Zipursky’s impressive defense of the principle of civil recourse, we conclude with a strategic suggestion on their behalf: they should split their defense of the principle of civil recourse into two parts, with the first part justifying the existence of some institution of civil recourse or other and the second part justifying specific details that this institution should have. This article explores the writings of Ludwig Heinrich Jakob and Johann Benjamin Erhard, two young Kantians who produced original defences of resistance and revolution during the 1790's. Comparing these two neglected philosophers reveals a crucial divergence in the liberal theory of revolution between a perspective that emphasises resistance by the individual and another that emphasises revolution by the nation. The article seeks to contribute to a more nuanced view of the political theory of the German Enlightenment, which (...) has often been presented as excessively obedient to authority.The historian Charles Ingrao repeated a common perception when, in an article on enlightened absolutism, he speculated that, ‘the German's greater acceptance of authority both then and now may be rooted in their own distinctive national culture’. This idea of the obedient German has been promoted especially by those who seek cultural explanations for the authoritarian bent of German society in the 20thcentury. But the idea has a longer history. Herder described Germany as the land of obedience, and Kant wrote that, ‘in keeping with their penchant for law and order, they [the Germans] will rather submit to despotic treatment than venture on innovations ’. By ‘wilful reforms of government’ Kant meant revolution. Madame de Staël later observed that Germans ‘join the greatest boldness of thought to the most obedient character’. As Frederick Beiser has shown, this view, which was repeated by Heine and Marx, came to dominate the historiography. (shrink)

With gratitude for our commentators’ thoughtful and generous engagement with Recognizing Wrongs, we offer in this reply a thumbnail summary of their comments and responses to some of their most important questions and criticisms. In the spirit of friendly amendment, Tom Dougherty and Johann Frick suggest that a more satisfactory version of our theory would cast tort actions as a means of enforcing wrongdoers’ moral duties of repair. We provide both legal and moral reasons for declining their invitation. Rebecca (...) Stone draws a particular link between civil recourse in private law theory and the right of self-defense as recognized in criminal law and moral theory. While we share Stone’s basic inclination, we argue for a different version of the link than the one that she draws. Veronica Rodriguez-Blanco provides a critique of our model of negligence law based on action theory. In response, we explain – in a way that we hope sheds light on debates over moral luck – how it is possible for the law to define negligence such that its commission depends simultaneously on the character of the defendant’s conduct and on the consequences that result from it. Though generally sympathetic to our approach, Stephen Smith faults us for failing satisfactorily to explain important remedial dimensions of tort law. Stubbornly, we insist that we can account for these, and indeed can do so on more satisfactory terms than corrective justice theorists. Finally, Erin Kelly challenges us to consider how our work might inform the analysis of two pressing issues of racial justice: overcriminalization and reparation payments. While we question whether our work to date has as much to offer on these matters as she suggests, we also maintain that the core principle of civil recourse theory – where there is a right there is a remedy – provides grounds for critiquing modern law’s failure to provide adequate accountability when police officers use excessive force against persons of color. Starting from the peculiar tension between figure and writing in Walter Benjamin’s philosophical thought, my contribution aims to define the relevance of manuscripts, schemes, fragments and annotations for the definition of philosophical textuality. Analyzing Benjamin’s writings belonging to this genre, as well as the fragmentary observations belonging to Novalis’ Allgemeines Brouillon and Nietzsche’s Posthumous Fragments, the processual dimension of philosophical thinking will be emphasized. In this theoretical context the processual moment of textuality can be put in tension with (...) the moment defined by the work in its insular completeness. Finally, one wonders if the most appropriate form of philosophical thought in our era of digital production and transmission of knowledge does not really lie in the flow dynamics of textuality. In conclusion, it will remain to be clarified how the autographic moment of philosophy can be thought of in the digital age of knowledge. To this last extent, a good example would be eventually given by Walter Benjamin’s archive in Berlin that contains in fully digitalized form both edited texts and manuscripts. (shrink)

History is not the record of humanity’s progress through otherwise empty time. It is rather to be conceived messianically, i.e., in terms of God’s eschatological promises and the interruptive capacity of dangerous memories of human suffering. This insight is contained in both the historical philosophy of Walter Benjamin and the political theology of Johann Baptist Metz. Metz’s theological categories also contribute an understanding of messianic history that avoids the dualism of Benjamin’s description of history in both messianic (...) and materialist terms. We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

The right temporo-parietal junction (rTPJ) has been associated with two apparently disparate functional roles: in attention and in social cognition. According to one account, the rTPJ initiates a “circuit-breaking” signal that interrupts ongoing attentional processes, effectively reorienting attention. It is argued this primary function of the rTPJ has been extended beyond attention, through a process of evolutionarily cooption, to play a role in social cognition. We propose an alternative account, according to which the capacity for social cognition depends on a (...) network which is both distinct from and in tension with brain areas involved in focused attention and target detection: the default mode network. Theory characterizing the rTPJ based on the area’s purported role in reorienting may be falsely guided by the co-occurrence of two distinct effects in contiguous regions: activation of the supramarginal gyrus (SMG), associated with its functional role in target detection; and the transient release, during spatial reorienting, of suppression of the angular gyrus (AG) associated with focused attention. Findings based on meta-analysis and resting functional connectivity are presented which support this alternative account. We find distinct regions, possessing anti-correlated patterns of resting connectivity, associated with social reasoning (AG) and target detection (SMG) at the rTPJ. The locus for reorienting was spatially intermediate between the AG and SMG and showed a pattern of connectivity with similarities to social reasoning and target detection seeds. These findings highlight a general methodological concern for brain imaging. Given evidence that certain tasks not only activate some areas but also suppress activity in other areas, it is suggested that researchers need to distinguish two distinct putative mechanisms, either of which may produce an increase in activity in a brain area: functional engagement in the task versus release of suppression.
