Gustav Radbruch war Deutschlands beruhmtester Rechtsphilosoph im 20. Jahrhundert. Seine gehaltvollen, aber auch spannungsreichen Schriften pragen die deutschsprachige Rechtsphilosophie bis heute. Im Zentrum von Radbruchs Lehre steht sein neukantianisch gepragter Rechtsbegriff, der im Laufe der Zeit eine Reihe von Veranderungen erfahren hat. Die Beitrage in diesem Band sind Radbruchs Rechtsbegriff im Allgemeinen und den Wandlungen dieses Rechtsbregriffs im Besonderen gewidmet. Nach der orthodoxen Lesart vertrat Radbruch vor dem Kriege eine rechtspositivistische Lehre, wurde unter dem Eindruck der nationalsozialistischen Grauel jedoch zum (...) Naturrecht bekehrt. Zunehmend wird gesehen, dass diese 'Bekehrungsthese' zu Ungereimtheiten fuhrt. Verschiedene Beitrage dieses Bandes betonen demgegenuber die Kontinuitat nichtpositivistischer Elemente in der Entwicklung von Radbruchs Rechtsbegriff. The Challenge of the Exception is the key that unlocked the ideas of Carl Schmitt, a leading political theorist and jurist who influenced the thoughts of, among others, Hannah Arendt, Carl Joachim Friedrich, Otto Kirchheimer, Hans Morgenthau, Franz Neumann, and Leo Strauss. Professor Schwab clearly articulates Schmitt's key concepts and relates their centrality to politics and the state, to the political theory of liberalism, democracy and authoritarianism, and to international relations. When Schwab treats Schmitt's interpretations of constitutional questions, (...) for example, he shows how political theory in Germany is inextricably linked with constitutional law, legal theory, and the country's history. Not content to merely deal with Schmitt's profound contributions to twentieth-century thought, Schwab devotes considerable space to the unconscionable compromises that he made with the Third Reich. This, however, failed to help him become the political and legal theorist of Hitler's Germany. Schwab shows how the new Schmitt was suspect from the beginning and, by 1936, Schmitt the hunter had become Schmitt the hunted. Schwab's presentation of the multifaceted Carl Schmitt exposes the reader to a truly interdisciplinary excursion into the humanities and social sciences. (shrink)

The objective of this article is to contribute to an understanding of Hannah Arendt’s special place in present-day political theory by means of a contrast between her Origins of Totalitarianism and four important political science studies of National Socialism and totalitarianism, three written by authors who shared the status of involuntary emigrant with Arendt, that are offered as constituting the original context of her work. A critical appreciation of the seminal works by Ernst Fraenkel, Franz L. Neumann, Sigmund (...) class='Hi'>Neumann, and Carl Joachim Friedrich and Zbigniew Brezinski, with special emphasis on questions of method, opens the way to a reconsideration of the distinctly philosophical character of Arendt’s work, and its shocking challenges to the scientific orientations of political science. Es ist mir eine grosse Genugtuung, die vorliegende Sammlung von Ar­ beiten eines Autors einzufuhren, der es verdient hatte, dass seine philo­ sophischen Schriften schon Hingst ihren Weg zum Verleger gefunden hatten. Da Dr. Frederick Neumann aber, nach seiner Auswanderung nach Amerika, seine ganze Zeit seinen Theologiearbeiten in englischer Sprache gewidmet hatte, war es seiner Witwe, Edith Neumann, be­ schieden, dieselben erst nach seinem Tode an wiirdiger Stelle zu ver­ offentlichen. Ich selbst bin die Witwe seines Freundes Philip (...) Merlan, der, wie ich, diese Arbeiten unseres Studienkameraden aus der Wiener Universitats­ zeit ungemein hochgeschatzt und Frederick Neumann immer zur Aus­ gabe seiner J ugendschriften zugeredet hat. Frederick Neumann ist am IO. Januar I899, in Wien, geboren und hat, wahrend und nach Beendigung seiner Studienzeit, bei Gomperz, Husserl und Heidegger gearbeitet. Er ist spater seiner eigenen Ge­ dankenrichtung gefolgt und hat gehofft einmal, in Musse, seine philo­ sophischen Arbeiten, moglicherweise in kompletterer Fassung, dem Druck zu ubergeben. Sein Interesse fur Religionsphilosophie und Theologie leitete ihn fruh zur praktischen Seelsorge und, im Jahre I938, zur Ordination als Minister der "Congregational Union of England and Wales." Nach vielseitiger Tatigkeit als Pfarrer und Lehrer, wurde er, nach seiner Auswanderung nach Amerika, Pastor der Bushwick A venue Congrega­ tional Church in Brooklyn, New York und in den letzten sechs J ahren seines Lebens ubte er, als "Visiting Professor" der Hartford Seminary Foundation, einen besonderen Einfluss auf einen grossen Kreis von Student en und Kollegen aus. Les rituels sont les synapses dans le tissu culturel d'où sont issus les éléments qui gouvernent la vie en commun et la communication des êtres humains. Il en est ainsi depuis le commencement de toute société humaine. Mais ce n'est qu'au XX siècle que se manifeste un véritable intérêt pour le fonctionnement et l'importance culturelle des rituels. Il s'agit d'un tournant inspiré par les théories des ethnologues, et placé sous le signe du cultural turn et du performative turn du XX (...) siècle. On se détourne alors des pratiques jusque-là en vigueur de l'abstraction et de la représentation. Or, depuis le «Banquet» de Platon et l'instauration de la «Cène» chrétienne, l'un des rituels les plus importants est l'acte socialement codé de l'ingestion de nourriture, le repas. Avec l'Eat art dont il est le concepteur, Daniel Spoerri a repris ce thème et contribué, par le truchement du rituel piège, à poser un regard neuf sur l'acte de manger au XXe siècle. Tel que Spoerri le met en scène, le «rituel piège» attire l'attention sur le rôle de fondation de sens que joue le rituel dans la culture. Mais il fait apparaître également que les rituels se transforment en pièges idéologiques où tombe quiconque les prend « à la lettre » ou comme des évidences. Spoerri est un des artistes du XX et de ce début du XXI siècle qui, par le biais de leur art, rendent compte de la double fonction du rituel dans la culture: d'une part, le rituel maintient en vie le processus culturel; d'autre part, il est producteur d'idéologies qui font passer des mythes politiques pour naturels, prenant au piège consommateur de nourriture et consommateur d'art tout à la fois.Rituals are the synapses in the cultural fabric which has produced the elements that govern the coexistence and communication of human beings. This is so since the beginning of human society. But it is only 20th century that demonstrates a genuine interest in the operation and cultural importance of rituals. It is a milestone inspired by the theories of ethnologists, and placed under the sign of the cultural turn and performative turn of the twentieth century. It then turns practices far into force of abstraction and representation. However, since the "Banquet" of Plato and the establishment of the "Last Supper" Christian, one of the most important rituals is the act socially coded ingestion of food, meal. Eat with the art of which he is the designer, Daniel Spoerri took up this theme and contributed through the ritual trap, put a new perspective on the act of eating in the twentieth century. Spoerri as the stages, the "ritual trap" draws attention to the role of Foundation meaningful ritual plays in the culture. But it also shows that the rituals are transformed into ideological traps which falls whoever takes "the letter" or as evidence. Spoerri is one of the artists of the 20th and the beginning of the 21st century, through their art, reflect the dual role of ritual in culture: on the one hand, the ritual keeps life the cultural process, on the other hand, it is a producer of ideologies that pass for political myths natural trapping consumer food and consumer of art at the same time. The article resumes the discussion on the relation of absolute music and language. Firstly, a critical look is taken at the two current theses: that music bears no meaning, or rather, that music is meaningful analogue to language. The second step describes the concept that processes conferring meaning upon music do not differ from corresponding processes regarding language. In a further step, however, the case is made that the structure of sound concatenations follows different principles concerning music on the one (...) hand and language on the other, so that ›meaning‹ should be considered as a separate category with regard to music and language. Finally, the article tries to shed a new light on the particular affinity of the language of poetry to music. (shrink)

This paper seeks to examine the relation between Kant’s aesthetic theory and the philosophy of Enlightenment. My study will focus on two central aspects from the Critique of Judgment: In connection with the Analytic of the Sublime, I will argue that Kant’s discussion of the concept enabled the development of the opinion that experiencing the specifically modern artistic beauty works as a means to equip us with an awareness of ourselves as beings equipped with reason. The second aspect I want (...) to discuss is that of the aesthetic ideas. I will show that in the Third Critique, the idea of experiencing artistic beauty functions as a compensation for the pressure of rationality that sets in together with modernity in the 18th century. Es besteht kein Mangel an ausgezeichneten Werken zur Logik und zur Ontologie. Allerdings wird in ihnen in der Regel weder die Logik ontologisch voraussetzungslos entwickelt noch die Ontologie in einem ausreichenden Zusammenhang mit der Logik entfaltet. An dieser Stelle mochte die Untersuchung ansetzen. Sie versucht Logik und Ontologie unter syntaktischen, semantischen und pragmatischen Gesichtspunkten darzulegen, indem sie auf der einen Seite ontologische Setzungen, die bei der Entfaltung der Logik in der Regel vorgenommen werden, vermeidet und auf der anderen Seite logische (...) Zusammenhange, die bei der Entfaltung der Ontologie in der Regel ungenutzt bleiben, heranzieht. (shrink)

Behaviour is a key term in Plessner’s philosophical biology and anthropology. »Eccentric positionality« means the embeddedness of all human modes of be- haviour in the spectrum of animal behaviour (centric positionality) and at the same time the evoulutionary emergence of original patterns of human behaviour (via eccentricity). This paper aims at showing that if one considers Plessners main oeuvres rather systematically than chronologically they can be seen as exemplary realisations of Plessner’s theory of behaviour.

Reading Kleist’s Verlobung in St. Domingo« and Benjamin’s »Zur Kritik der Gewalt«, this paper proceeds from the novel’s problematic of immanence and violence to Benjamin’s question, whether violence has a linguistic structure – and whether ›pure‹ or ›divine violence‹ can rupture immanence. In this sense, Benjamin’s ›violence‹ leads back to Kleist’s and to an analysis of both as transcending effects of language.

De Dreu and Gross argue that only asymmetric games allow the motives underlying defense and attack to be disentangled. However, the Prisoner's Dilemma Game Alt matrix, a modified symmetric PDG, also allows these motives to be disentangled. Studies using the PDG-Alt matrix produced findings contradicting a central claim of De Dreu and Gross.

Um Erfahrungen machen zu können, gilt es nach Kant, «Erscheinungen zu buchstabieren, um sie als Erfahrungen lesen zu können». Dabei droht eine doppelte Erfahrungsunfähigkeit. Einerseits werden Erscheinungen mit Erfahrungen verwechselt, wie in der Legasthenie Buchstaben mit dem Wortsinn. Andererseits glaubt man, Erfahrungen machen und dabei die Erscheinungen übergehen zu können, wie beim Lesen, das nicht mehr auf die Buchstaben achtet. Die Erfahrung ist immer dann bedroht, wenn die Wechselbeziehung zwischen Sinn und Sinnlichkeit aus dem Gleichgewicht gerät, wenn die Sinnlichkeit des (...) Subjektes oder die Verstandestätigkeit des Subjektes überbetont wird. Wie Kant und die Marburger Neukantianer mit der Problematik umgehen, ist Gegenstand der vorliegenden Untersuchung. (shrink)

Bd. 1. Kunst als Lehre vom "Begriff" und von der "Neuen Unmittelbarkeit".

Leistungssportlerinnen, die in populären Sportarten erfolgreich sind, kommen in den Genuss hoher Einkommen und großen sozialen Ansehens. Gleichzeitig ist ihr Erfolg von Voraussetzungen abhängig, die zu einem signifikanten Teil von ihrem Genotyp bestimmt werden. Diesen Sportlern werden also durch gesellschaftliche Prozesse substantielle Vorteile aufgrund von Eigenschaften zuteil, auf deren Vorhandensein sie keinen Einfluss haben. Wir untersuchen, wie wir vor dem Hintergrund verschiedener Gerechtigkeitsvorstellungen mit diesem Phänomen umgehen sollten. Wir argumentieren, dass die konsistente Berücksichtigung von Intuitionen zur gerechten Güterverteilung an Wettkämpferinnen (...) eine deutliche Ausweitung des Einsatzes von Wettkampfklassen erfordert. Die bestehenden Ungleichverteilungen lassen sich nicht allein mit Verweis auf ein Recht auf Selbsteigentum rechtfertigen. Sie verursachen auch keine Verbesserungen der Lage von besonders schlecht gestellten Individuen im Wirkungsbereich des Leistungssports, auf die zugunsten ihres Weiterbestehens verwiesen werden könnte. Trotz des erheblichen Aufwandes und der deutlichen Veränderungen im Charakter des Leistungssports, die mit der vorgeschlagenen Differenzierung von Wettkampfklassen einhergingen, ist diese Maßnahme geboten.
