In this work we study, design, and evaluate computational methods to support interpretation of statutory terms. We propose a novel task of discovering sentences for argumentation about the meaning of statutory terms. The task models the analysis of past treatment of statutory terms, an exercise lawyers routinely perform using a combination of manual and computational approaches. We treat the discovery of sentences as a special case of ad hoc document retrieval. The specifics include retrieval of short texts, specialized document types, (...) and, above all, the unique definition of document relevance provided in detailed annotation guidelines. To support our experiments we assembled a data set comprising 42 queries which we plan to release to the public in the near future in order to support further research. Most importantly, we investigate the feasibility of developing a system that responds to a query with a list of sentences that mention the term in a way that is useful for understanding and elaborating its meaning. This is accomplished by a systematic assessment of different features that model the sentences’ usefulness for interpretation. We combine features into a compound measure that accounts for multiple aspects. The definition of the task, the assembly of the data set, and the detailed task analysis provide a solid foundation for employing a learning-to-rank approach. (shrink)

The paper explores the process of the Czech journalists setting the EU agenda in the media during the ‘hot phase’ of the Czech national parliament election campaigns in 2002, 2006, and 2010. Unlike most studies that concentrated on the media agenda in the European Parliament election campaigns, we focused on periods that were neither strictly key events nor routine, but that were more intensively covered by the media and simultaneously generated more influential political representation defining national political attitudes towards the (...) EU. Articles that referred to the EU during the ‘hot phase’ were content analyzed. The results suggest that in the Czech press, the EU agenda is less and less visible, and, moreover, that it is increasingly negatively framed and reduced to an economic agenda. (shrink)

In his paper the author argues that interdisciplinary research and collaboration between different scientific branches are important in ensuring that research captures the wider picture. The author ascertains common points in history, ethnology, dialectology, and folkloristics by looking at various examples of onomastic research conducted in Slovakia. The research findings are part of broad pan-Slavic research and are important in Slovak Slavistics as well.

This paper compares the four national electronic Identity Management Systems (eIDMS), which have been described in the previous chapters. The section Similarities and differences between four national eIDMS will highlight the differences between these systems conceived as socio-technical systems with regard to the eID itself, the eID cards as tokens, the authentication processes as well as the procedures for distribution and personalisation, the support provided for installing the technology and any provider-related regulation. The section A three-fold path dependency , according (...) to the conceptual framework presented in the introductory chapter to this special issue, compares the new electronic systems with the previous ones in each country, in order to assess the continuation or changes with regard to the organisational, technological and regulatory path of development. The following sections explain the differences between the paths chosen and the path-related changes by analysing the actor constellation of the institutional actors, in particular the policy field and the power structure, as well as the context in which the policy makers made their choices, looking at privacy and Staatsverständnis in particular. Finally the diffusion and usage of the eID function will be compared and analysed, discussing to what extent the new institution has made a contribution to solving the policy problem it was developed for, e.g. providing a stronger authentication in order to meet security concerns regarding e-government and e-commerce transactions and avoiding new privacy infringements. Using grounded theory, the explanations provided have the status of generalisations derived from the four cases. They have to be considered as hypotheses, which will be checked for other countries in the following papers of this special issue. The comparison of the four cases in this article shows a high degree of path dependency. Most of the differences between the new systems are just a continuation of differences between the previous systems although they are to solve the same problem and can draw on the same technologies. But most astonishing is the finding that these differences between the systems do not influence diffusion and use of the eID function in the respective countries. (shrink)

A first comparison of the innovation processes of introducing electronic identities on a national level in Austria, Belgium, Germany and Spain, based on extensive expert interviews with key actors, has been amended by four more country reports from Denmark, Finland, Estonia and Sweden in order to check the validity of generalisations derived from the first four cases. The extended comparison with the four additional countries increases the variance between the eID systems in Europe by showing differing technical and organisational features, (...) such as purely software-based solutions, e.g. in Denmark, or complete outsourcing of the eIDMs, e.g. in Sweden. In the second part of the paper, the conceptual framework of the comparative study, a combination of path analysis, institutional actor theory and policy field analysis will be reflected. It has resulted in a fruitful approach allowing for the explanation of some, but by no means all, of the differences between the national eIDMs in Europe. (shrink)

The present paper attempts to look at on the genealogy of both shared intentionality and collective intentionality, comparing Michael Tomasello’s concept with Max Scheler’s threedimensional concept of intentionality: ens amans, ens volens, ens cogitans, as affective, conative, and cognitive intentionality. I focus on various forms of affective collective intentionality — Schelerian forms of sympathy — to show collective subjectivity from the whole spectrum of emotional intentionality, presented by Scheler’s example of parents standing over the corpse of a child. Even though (...) Tomasello’s works seem to empirically corroborate Scheler’s intuitions about the emotional genealogy of collective intentionality, they will differ in the horizons within they locate intentionality. In the case of the evolutionary psychology of Tomasello, we can talk about the horizon of cooperation, in the case of Scheler’s Scheler’s phenomenology of acts about the horizon of responsibility or co-responsibility, which gives intentionality its unique character. The similarities of both concepts concern the following pillars: 1) genealogy of intentionality covering the dimension of affective intentionality, conative intentionality, and the level of cognitive intentionality; 2) Imitation or, as Scheler would say, following someone. Because a person is recognized by the author of Formalism as an act, or a bundle of acts, the way to understanding and communication with another person is the maieutic coperformance of their acts — i.e., imitation. The maieutic co-execution of acts of others triggers the constitution process of a person, both on an individual and community level. We can speak, in the case of Tomasello, about the ontho- and sociogenetic function of co-executing acts or imitating; however, in the case of Scheler, we are dealing with the clearly axiological nature of such a constitution of both the individual and collective subjectivity ; 3) collaborative engagement as a driving force behind collective intentionality in one case in form of co-responsibility, a nature of a collective person ; in the other case in form of collaboration developing intentionality to various units of community life. This chapter provides an analysis of the long process of introducing an electronic identity for online authentication in Germany. This process is described as a multi-facet innovation, involving actors from different policy fields shifting over time. The eID process started in the late ‘90s in the context of eGovernment and eCommerce with the legislation on e-signatures, which were supposed to allow for online authentication of citizens. When after 5 years it was recognized that this was not the case, a new (...) digital ID card, which had meanwhile been announced, was chosen as token for the eID. This process was dominated by the concerns for visual inspection and border control, including the storage of digital fingerprints. Under the leadership of the Ministry of the Interior (BMI) and technical guidance of the Federal Agency for Information Security (BSI), technical specifications have to a large extent been adopted from the electronic passport, which had been smoothly introduced 2 years before. However, in the legislative process some concern regarding digital fingerprints on the eID card was raised and led to an opt-in solution. In 2009, a bill on the new ID card was passed which regulates the eID function for online authentication as well. This is characterized as a radical innovation by introducing a double-sided, mutual authentication of the citizen and the service provider and implementing the principle of proportionality regarding the access of service providers to data on the chip. At the time of writing, field tests are conducted. Roll-out of the new eID card is to start in November 2010. Therefore no figures about adoption can be provided here. (shrink)

Career shocks are the norm, not the exception. Yet, much of research and counseling on career-development holds unrealistic assumptions of a makeable career. Little is understood about the role of shocks on the career path and how the interplay of individual reactions to shocks shapes careers. The purpose of this study is to provide understanding of responses to different attributes of career shocks and career shocks as antecedents to career and job change. A qualitative approach was chosen and data were (...) obtained from 25 semi-structured interviews with a sample of mid-career individuals who had experienced shocks in their work lives. The analysis was 2-fold and aimed at unearthing of individual responses to shocks and the question of the role of shocks on changes in the career path. Firstly, the analysis of career shocks revealed a pattern of distinct agentic responses in relation to shocks of different attributes. Secondly, from the analysis of shock attributes and corresponding responses over time career changer profiles emerged which differ in regard to career change behavior and magnitude of changes in the career. A process model which depicts how post-shock careers are shaped distinctively in relation to different shock attributes and corresponding responses is presented. This study underlines the importance of understanding the unplannable in career development and shows a variety of options for individuals to develop their careers despite shocks. Limitation stems from the investigation of a sample limited to mid-career individuals. The findings provide a new conceptual lens to theorize and conduct research on career shocks and career changes and facilitate the development of coping strategies for career shocks. The originality lies in the investigation of the momentum of career shocks on career paths with detail to different attributes of career shocks and how they impact the career path. (shrink)

This paper introduces the objectives and basic approach of a collaborative comparative research project on the introduction of national electronic Identity Management Systems (eIDMS) in Member States of the European Union. Altogether eight country case studies have been produced in two waves by researchers in the respective countries, which will be presented in the following articles in this special issue. The studies adopt a common conceptual framework and use the same terminology, which will be presented in this introduction, just as (...) the reasoning for the selection of the particular countries under investigation. The conceptual framework combines elements of actor centred institutionalism with path analysis, looking for path continuation, change or creation in the transition from the previous IDMS to an electronic one and explaining this as choices of actors in certain contexts. Information on the reasons for these choices in the first four cases has been collected from in depth interviews with key actors and in the four other cases from official documents. As the subject of this research is the transition of national identity management systems only countries have been included in which a national ID and a civil registry already exist before the introduction of the electronic elements, thus excluding the UK.
