This paper investigates the semantics of measure phrases in Japanese. Based on new data, we argue that the interpretation of measure phrases in Japanese is sensitive to scale structure such that (i) measure phrases are introduced by a degree morpheme that selects only for gradable predicates whose scale contains a minimal element (i.e., a lower closed scale) and (ii) violations to this restriction are repaired via coercion, which forces a comparative interpretation with a contextually determined standard and hence (...) a minimal element. We compare the Japanese facts to data in other languages and argue that the requirement of having a minimal element is not specific to Japanese, but universal. We show that languages may vary in how they deal with potential violations of this universal constraint, including coercion of a contextually recoverable derived minimal element (Japanese), ungrammaticality (e.g., Spanish, Korean, Russian), and a hybrid system of ungrammaticality for some adjectives and allowed constraint violation for others (e.g., English, German, Italian). Modeling legal argumentation is one of the most important research in AI and Law, and a lot of models have been proposed. However, most research has not treated value judgement and debate. In this paper, we introduce a legal reasoning model which covers various aspects of legalreasoning such as making argument, selecting argument and debate.Furthermore, we present how criminal law is described and reasoned inthis model.

The essence of human being resides not only in his/her brain, but also in every part of the body, therefore, the idea that brain-death equals human death can not be true in a certain context. This study introduces an enigmatic construction in Japanese called chūshakuteki nibun-renchi ‘annotative dual-clause juxtaposition’ (ADCJ), exemplified below: Hiro wa, dare ni au no ka, resutoran o yoyakushita. top who dat meet nmlz int restaurant acc reserved Lit. ‘Hiro, (I wonder) who (he) will meet, reserved a restaurant.’ This construction is ubiquitous and yet little known even in Japanese linguistics circles. Because the matrix predicate of ADCJ cannot semantically accommodate such a component as dare ni au no ka ‘who (...) (he) will meet’ above, this paper argues that ADCJ is parenthetical, a construct that should be recognized as an essential element of verbal communication and, in turn, a determining factor in how utterances are to be formed and interpreted. This construction is dissimilar to any other type of parentheticals hitherto reported in the literature. What is so special about it is its merger of portraying two situations through abduction and expressing the entire circumstance in a single communicative unit. For example, in the above example, the parenthetical element explains why the speaker wishes to convey the matrix statement. From an interactional perspective, the primary function of ADCJ is to highlight the speaker’s intellectual and communicative involvement in the depicted scene. This style of communication, when compared with an ‘objective’ and apathetic description, is likely to induce more earnest reactions from the hearer or reader and, consequently, promote a more favorable continuation of the conversation or reading. This paper advocates a wide-ranging examination of thetical grammar (Kaltenböck et al. 2011), for which detailed analyses of constructions such as ADCJ that traditional syntactic/semantic theories cannot capture are indispensable. Japanese bioethics has created a variety of important ideas that have not yet been reflected on mainstream bioethics discourses in the English-speaking world, which include “the swaying of the confused self” in the field of feminism, “inner eugenic thought” concerning disability, and “human relationship-oriented approaches to brain death.” In this paper, I will examine them more closely, and consider what bioethics in Japan can contribute to the development of an international discussion on philosophy of life.

Since World War II Japanese artists have employed two seemingly contradictory ways of working, using aesthetics, materials, artistic methods technologies, and approaches that are either radically innovative and wildly experimental, or traditional/classical. Many other artists, however, in a move that seems paradoxical. have combined the two to explore the new themes of the post-atomic period. Three narrative works dealing with the effects of the World War II war effort and the atomic bombings that ended them, Yasunari Kawabata’s novel The (...) Sound of the Mountain (1952), Rio Kishida’s avant-garde play Thread Hell (1984), and the film Barefoot Gen (Hadashi no Gen), directed by Mori Masaki and written by Keiji Nakazawa (Masaki and Nakazawa 1983), exemplify this third approach. Set in the pre-War textile industry that enabled the War, during the atomic bombings, and the post-War American Occupation, all three explore the experience not only of the horrific objective effects of war but of the Japanese experience of psychic numbing, which damages the person’s sense of self and their sense of agency—their ability to act effectively in the world. All three utilize classical aesthetics to provide aesthetic experiences, for their readers/viewers, to make the experience of the work tolerable, and for their characters—to demonstrate the roles of positive aesthetic experience in making life worth while and in grounding a renewed sense of personal identity and selfhood in a self that has been shattered through trauma. Japanese conversations are known to contain a large amount of unexpressed information. When a speaker speaks with elliptical information, he or she assumes that the addressee will understand what is not overtly expressed based on the knowledge that is supposed to be shared textually, personally or culturally. The addressee, on the other hand, must determine what is not being expressed overtly using such shared knowledge. At the heart of this kind of communication is the existence of trust assumed among (...) the interlocutors. Using the term ‘entrustment’, we will examine how one particular Japanese formulaic construction, [Noun yo Noun], ‘It’s Noun, you know, Noun’, indexes mutual trust to manage conversational interaction. We will argue that this meta-pragmatic awareness needs to be recognized beyond surface interactional patterns identified in conversation. (shrink)

When we mention keywords— for instance, intuition of essence, intentionality, inner time-consciousness, rigorous science, natural attitude, phenomenological reduction, transcendental phenomenology, noesis-noema, my living body, genetic phenomenology, empathy, intersubjectivity, life-world, and so on—which keywords should we use when talking about the influence (...) Husserl’s phenomenology had on Japanese philosophy? But we should also ask the following question as well: Which of Husserl’s texts could be available for scholars of Japanese philosophy? Interestingly, there were few works, beyond attending Husserl’s lectures, that one could access, because he only published six books and six articles while he was alive. After Husserl died in 1938, many manuscripts were rescued from the Nazi’s hands and placed at Leuven University in Belgium where the Husserl Archive was first established. The manuscripts were edited and published as Husserliana beginning in 1950 (which now has 42 volumes). Given this, we can think of Husserl’s work as consisting of two periods: the period before and the period after the publication of Husserliana.I myself am interested in the problem of “intersubjectivity” within Husserl’s phenomenology. It is on the one hand the problem of “other-experience (Fremderfahrung)”—i.e., “how I experience the other”—which is the problem of other-experience in the empirical dimension. But it is on the other hand the problem of “intersubjective constitution”—i.e., “how the objective world is the correlate of intersubjective constitution through other-experience,”1 which is the problem of how the other participates in the transcendental dimension. It is characteristic of Husserl’s phenomenology that these two problems are discussed together inseparably. [End Page 1]The manuscripts on the problem of “intersubjectivity” from 1905 to 1935 are collected in volumes XIII to XV of Husserliana. Although the fifth meditation of Cartesian Meditations (first published in French translation in 1931) is often mentioned as the representative work on this theme, it is no more than the tip of the iceberg after Husserl struggled for many years on this problem. The genesis of this theme in the manuscripts dates back to 1905 when terms such as “other” (ein Anderer) and “foreign” (fremd) appeared in manuscript 1, or terms such as “empathy” (Einfühlung) and “intersubjective” appeared in manuscript 2. Husserl wrote later that he had discussed this theme to a relatively large extent in the lecture Fundamental Problems of Phenomenology (Hua XIII) in 1910–1911. In the period of 1905–1910, after the “problem of intersubjectivity” was first introduced, we can also find the idea of “phenomenological reduction” appear for the first time in the literature. Morisato's stated objective in the introduction is (a) to investigate the possibility of comparative philosophy through William Desmond's metaxological way of thinking, and (b) to examine how the "absolute dialectic" in Tanabe Hajime's metanoesis can help us understand the relationship between one framework of thinking and another (p. 16). Morisato's book proceeds in five parts. Part One orients the reader to the scope of the project through an overview of comparative philosophy and its methodological frameworks--namely, the metaxological methodology of William Desmond, which deals importantly with the (modern) predicament of religion as expressed in the "transcendental univocity" of the Kantian system; and the metanoetic methodology of Tanabe Hajime, which deals importantly with the issue of "rational progress" in Hegelian dialectic. Yet each intellectual framework deals with both Kant's and Hegel's systems. Part Two addresses what the problem of religion in Kantian and Hegelian philosophy is in more detail. Part Three, "Metaxology and the Problems of the Philosophy of Religion," and Part Four, "Metanoetics and the Problems of the Philosophy of Religion," offer a more detailed account concerning how Desmond's and Tanabe's philosophies tackle conceptual problems in modern philosophy of religion. Morisato's conclusion follows from these along with an endnotes section, bibliography, and index.According to Morisato, overcoming the problem of comparative philosophy--i.e., the "philosophical problem of comparing two systems of thinking rooted in different cultural and intellectual contexts" (p. 22)--means, at least in part, clarifying the extent to which philosophers of different culturalintellectual contexts and backgrounds share, as "kindred spirits" or as "intellectual companions," a consonance of thought regarding their philosophical perspectives. William Desmond (1951–present) is a Catholic philosopher who currently holds the David R. Cook Chair in Philosophy at Villanova University. He has worked extensively on metaphysics, ontology, philosophy of religion, aesthetics, and German idealism. Tanabe Hajime (1885–1962) was a Japanese philosopher of the Kyoto school and is perhaps most well-known for his Philosophy as Metanoetics. Morisato does a commendable job elucidating issues in modern systems of religion, which have undoubtedly been influenced by Kant's and Hegel's systems. As it concerns Kant, contemporary philosophy of religion still struggles with the claims of transcendental idealism, particularly its reduction of religious belief to mere postulates of practical reason. And as it concerns Hegel, what seems to be an unending, "progressive" self-return of dialectical monism has deeply influenced the way, and manner, in which religious adherents deal with societal views of the individual and individuals' views of society. By this token, Morisato's attempt to get beyond the so-called "extirpation" of the source of religious truth as the "creative power behind our understanding of reality and our existence" is refreshing, to say the least (p. 46). In what follows, I offer a relatively brief overview of Morisato's book and conclude with a reflection on the text.Morisato's critique of the Kantian and Hegelian systems begins with the argument that Kantian transcendental univocity implies that reason's autonomy, as dictates of the moral law as absolute duties, not only precedes divine legislation, but becomes one with it or else is reduced to it. ABSTRACT This paper draws upon transitivity and Appraisal within Systemic Functional Linguistics to study the traumatic discourse of Nanjing Massacre in Chinese Mainland’s and Japan’s history textbooks. Through corpus analysis, this research finds that the Chinese discourse mainly uses effective process, relational process, verbal process to construe Japan’s victimizering experience and China’s victimhood, and employs negative Affect, opposite values of Judgment, negative Appreciation, Expand, Raise and Sharpen to construct a critical voice for the Japanese army and a sympathic tone (...) for the Chinese. By contrast, the Japanese discourse largely uses pseudo-effective and middle processes, mental and existential processes to cover up Japan’s victimizering experience, and employs negative Judgment, positive Appreciation, Contract and Raise to construct an almost uncritical voice for the Japanese army and the massacre. The difference in the representation and evaluation of Nanjing Massacre results from the politics of official memories in both countries. As China endeavors to strengthen its patriotic education by using Nanjing Massacre as an ideological weapon for national solidarity, Japan expedites its nationalist historiography move to recreate its normal national image by marginalizing the massacre. A translation of a Japanese text written by philosopher Tosaka Jun in 1935, at the moment the country had begun to embark upon a course of fascist authoritarianism that led to war and total destruction. Titled The Japan Ideology, the text purposely recalls its derivation and kinship with Marx and Engels's The German Ideology and expands on the role played by philosophic idealism in preparing the population for both the new politics of fascism and the demands of the eventual (...) war it brought. In its penetrating analysis of the relationship between philosophy and the formation of ideology in a politically critical and crucial historical time, this foundational work in the Japanese Marxist tradition remains accessible and timely, speaking forcibly to conditions that continue to persist in Japan and everywhere in today's world. This book analyzes this situation by showing how anthropological knowledge is produced, disseminated, and consumed on a global scale.

Japanese conversational data reveal that Japanese speakers produce, and recipients orient to, smaller units of talk than what the conventional notion of a `turn constructional unit' represents. Unlike TCUs, such units may be grammatically, prosodically and pragmatically incomplete and may happen on the sub-phrasal level of discourse, as Japanese conversationalists prosodically break up even a single semantic constituent with the insertion of an interactional particle. In this article, I give numerous examples of how such practices of separating (...) a segment of talk are not random but are precisely embedded in the sequential organization of talk that participants co-create. I argue that such segmentation contributes to the interactional co-construction of a turn so as to highlight specifically a `move' Within the larger action that is implemented by the TCU. Doing so thereby provides opportunities for the participants to deal with local contingency problems without changing the global level of the pragmatic work of the turn. (shrink)

A Japanese rock garden is open to visitors, speaking to each in a language he or she can understand. As such, it is a site of languages—that is, a site that is open to the languages of each and every visitor. Thus, it is also a site that may be said to speak the language of each and every visitor. To speak to each visitor in his or her own language, it also may be said to carry the potential (...) to speak any of these languages. As such, it is a place of memory. It is also a place pregnant with unborn languages. It, in itself, serves as its own midwife, giving birth to any of these languages. To visit a Japanese rock garden is to bring this possibility to fruition. To be visited is to visit the visitor. It cannot be visited without it visiting the visitor. The visitor already harbors the possibility of being visited by it, a possibility that is born during the visit. What I discuss in this paper is the possibilities associated with a phenomenological visit to a Japanese rock garden. Here, at this garden, phenomenology is conceived, midwifed, and birthed. It is also preserved here. A phenomenological visitor to such a place finds himself or herself already ahead of himself or herself, yet, at the same time, not ahead of himself or herself. Therefore, this chapter constitutes a discussion of the paradoxical nature of such a visit and the paradoxical nature of the garden, itself. One discovers that, in visiting, one is visited. Moreover, the garden turns out to be one of self-discovery. What is gardened in this garden is the gardening of self, a self that is at home in not being at home, a paradoxical mode of being. Japanese agricultural scholarship reached its peak in the Tokugawa period (1603-1868). Most of its representative works were imbued with the Chinese metaphysical doctrine of yin-yang-wu-hsing. They used the ideas of yin-yang, wu-hsing, yun-ch'i, hexagrams, and feng-shui extensively to develop their views and to explain various practices. There were two different attitudes towards Chinese concepts among Tokugawa scholars. Some regarded Chinese ideas as universal principles, and faithfully introduced them to Japan, whereas some were faced with the problem of national identity (...) and attempted to accommodate Chinese metaphysical principles to Japanese agriculture. This article examines the adoption of the yin-yang-wu-hsing doctrine in Tokugawa agriculture through a careful and critical textual study of several major Tokugawa writings. (shrink)
