Everyone knows that Emerson was a moralist, but what does that really mean? Although Grotius never formulated a complete, comprehensive constitutional theory, traces of such a theory can be found in many of his writings not explicitly devoted to constitutional law. Punishment even plays an important role in his books on war, since to punish transgressions of the law is ranked among the just causes of war.Given the fact that a state may (...) punish transgressions of the law – transgressions by individuals within and even outside the state, but also transgressions of the law by other states – the question may arise concerning the origin of such a right to punish. It will be shown that Grotius did not give the same answer to this question in his various works. As the right to punish is concerned, we find a theory that seems to be akin to the one of John Locke in the De iure praedae, one akin to the theories of the Spanish late-scholastics in De satisfactione and De imperio, and a theory coming close to what Thomas Hobbes had said on the ruler's right to punish in the De iure belli ac pacis.Of course, Grotius can only have been familiar with the theory of the Spanish late-scholastics, since those of Locke and Hobbes were still to be written by the time Grotius had passed away. As a result of the political developments in the young and struggling Dutch Republic, Grotius experienced the lack of, and the need for juridical protection of some basic rights against infringements by the government. The privileges, taken for fundamental laws, did not provide this protection sufficiently. After he himself had been prosecuted, Grotius falls back on Holland's division of powers to secure the compliance of these rights.

In the years 1777–1778 four volumes were published under the title Legal Observations on Several Dark and Until Now Unverified Sections of the Introduction. The volumes were composed by a society of young legal practitioners from The Hague, the most famous among them being Joannes van der Linden. By then Grotius’s Introduction to the Jurisprudence of Holland was still the cornerstone of the law of Holland and around the year 1800 it would become the fundament for attempts to codify this (...) law. Today the Legal Observations can function as entrance to the historical sources of the law of Holland as described by Grotius and developed further after publication of his Introduction. (shrink)

Although relatively much has been said and written already on civilian based defence, one hardly can deny that there has been not much of an increase in our understanding of this particular alternative security concept. Hence, in the present article an attempt is made to trace the factors, which are to be held responsible for this rather striking case of theoretical stagnation. The main argument boils down to the assertion that, up till now, to much energy has been invested in (...) normative analysis and polemics. Together with the reality of a very restricted research capacity, this has led to an almost complete neglect of scientific research proper.Indeed, in the existing litterature it is hard to find any serious effort at theoretical articulation. One will search in vain for explicit stated modeis, testable hypotheses as welt as elaborated research strategies. Little wonder then, that hitherto scientific progress has been wanting. Accordingly, it is argued that to bring about any positive change in this respect in the future, a mere upgrading of the actual research capicity - as is so often advocated - wilt not suffice. Real progress is only to be expected, if more work is made of basic research. (shrink)

Francis Bacon (1561-1626) was een belangrijk Engels staatsman en invloedrijk humanistisch filosoof. Zijn publicaties liggen aan de oorsprong van onze moderne visie op het wetenschappelijk onderzoek. Toch is hij vandaag weinig bekend: in overzichtswerken komt hij nauwelijks aan bod en er verschijnt relatief weinig over hem. Dit boek brengt Bacons ideeën opnieuw voor het volle voetlicht. Bacon schreef toegankelijke teksten: essays, manifesten voor een nieuwe wetenschap en zelfs een fictief verhaal over een ideale kennismaatschappij. Zijn stijl was helder en vaak (...) aforistisch, met bondige en sprankelende zinnen die we vandaag zonder dralen zouden retweeten. Dit eigenzinnige boek bespreekt de belangrijkste juridische, filosofische en wetenschapsethische inzichten van Bacon, verweven met diens intrigerende levenswandel. Zijn uitspraken zijn door de auteur gemoderniseerd en voorgesteld als tweets. Bacons beschouwingen zouden ook vandaag wel eens het verschil kunnen maken in de wetenschappelijke wereld die stilaan in het slop raakt door de vermarkting van de universiteit. (shrink)

Propositions are posited to perform a variety of explanatory roles. One important role is being what is designated by a dedicated linguistic expression like a "that"-clause. In this paper, the case that propositions are needed for such a role is bolstered by defending that there are other expressions dedicated to designating propositions. In particular, it is shown that natural language has anaphors for propositions. Complement "so" and the response markers "yes" and "no" are argued to be such expressions.

Background Notwithstanding the need to produce evidence-based knowledge on medications for pregnant women, they remain underrepresented in clinical research. Sometimes they are excluded because of their supposed vulnerability, but there are no universally accepted criteria for considering pregnant women as vulnerable. Our aim was to explore whether and if so to what extent pregnant women are vulnerable as research subjects. Method We performed a conceptual and empirical analysis of vulnerability applied to pregnant women. Analysis A conceptual analysis supports Hurst's definition (...) of vulnerability. Consequently, we argue that pregnant women are vulnerable if they encounter an identifiably increased likelihood of incurring additional or greater wrong. According to the literature, this increased likelihood could exist of four alleged features for pregnant women's vulnerability: informed consent, susceptibility to coercion, higher exposure to risk due to lack of knowledge, vulnerability of the fetus. Discussion Testing the features against Hurst's definition demonstrates that they all concern the same issue: pregnant women are only vulnerable because a higher exposure to risk due to lack of scientific knowledge comprises an increased wrong. Research Ethics Committees have a responsibility to protect the vulnerable, but a higher exposure to risk due to lack of scientific knowledge is a much broader issue and also needs to be addressed by other stakeholders. Conclusions The only reason why pregnant women are potentially vulnerable is to the extent that they are increasingly exposed to higher risks due to a lack of scientific knowledge. Accordingly, the discussion can advance to the development of practical strategies to promote fair inclusion of pregnant women in clinical research. (shrink)

In Belgium, as in most countries, each Minister or Secretary is assisted by a limited number of trusted collaborators who constitute the Ministerial Office.The article is an attempt to shed a light on the Chief Ministerial Officer who is the closest collaborator of the Minister.In order to show the role of the Chief Ministerial Officer, the article first describes the tasks, powers and composition of the Ministerial Office to proceed to a more extensive analysis of the functions, the appointment of (...) the Chief Ministerial Officer, and the question whether he can exercise executive power.The most important tasks of the Chief Ministerial Officer are: organization and coordination of the Office and its activities, acting as a «Liaison-Officer» with the Minister, passing on of information, exercising of a form of internal, political and administrative control.The article closes with some more personal remarks, pointing out a few guidelines which a Chief Ministerial Office, should keep in mind. One of the key concepts of Paul Ricoeur’s hermeneutics is the notion of distanciation. In this article we show that Ricoeur introduces this notion as a correction of Heidegger’s focus on being-in and Gadamer’s emphasis on belonging . Ricoeur argues that distanciation does not lead to the uprooting of our belonging to a tradition. Rather, distanciation is an integral part of the dynamics that constitutes tradition. We discuss the different senses in which Ricoeur understands distanciation as a positive and productive (...) aspect of tradition. In particular, we discuss the ontological aspect of distanciation. In his discussion of both the long way of hermeneutics and the creative dimension of distanciation in fiction, Ricoeur argues that it is distanciation that opens up the possibility of understanding our own being-in-the-world. This involvement of distanciation in the disclosure and understanding of being allows us to show that distanciation determines what “kind” of being is understood: what is interpreted in hermeneutics and disclosed in poetics is never being as such, but “being-interpreted” and “being-as,” respectively. This leads us to a description of the difference between Ricoeur’s and Heidegger’s thought concerning the ontological dimension of their hermeneutics. (shrink)

Verhack's book De mens en zijn onrust. Over het raadsel van de beweging seeks to develop a metaphysics after the 'end of metaphysics'. Such a metaphysics not only has to take into account Nietzsche's and Heidegger's radical critiques of metaphysics. It also has to avoid the soteriological strategies of traditional metaphysics by searching for a transcendent meaning, to which our finite and resdess human existence is pointing from the inside. Yet in which direction does our human existence transcend itself? By (...) comparing Verhack's answer to this question with Thomas Aquinas' discussion of the desiderium naturale Dei, it is argued that Verhack's post-metaphysical metaphysics is based on a spiritualistic outlook on life. From this line of argument it is shown that this metaphysics threatens to perpetrate the verysame soteriological strategies it tried to avoid, and to pass over the meaning and bearing of 'the end of metaphysics'.
