This article considers Hugo Grotius’s ideas on a specific topic of commercial law, analysing his position and potential contributions to early modern Dutch insolvency legislation. It might be questioned how ‘Hollandic’ Grotius’s interpretations of legal solutions for insolvency as presented in the Inleidinge tot de Hollandsche Rechts-Geleerdheid actually were. Grotius’s treatment of cessie van goede is relatively strict, whereas compositions are hardly mentioned. A rather different image rises from his later work. Here, Grotius displays a more radical view, in specific (...) cases allowing the sovereign to interfere in private property rights and to restructure debts for the common good. It is an intriguing question if and to what extent these ideas can be related to contemporary Dutch insolvency practices. (shrink)

The present research investigated the use of counter-stereotypical pictures as a strategy for overcoming spontaneous gender stereotypes when certain social role nouns and professional terms are read. Across two experiments, participants completed a judgment task in which they were presented with word pairs comprised of a role noun with a stereotypical gender bias (e.g., beautician) and a kinship term with definitional gender (e.g., brother). Their task was to quickly decide whether or not both terms could refer to one person. In (...) each experiment they completed two blocks of such judgment trials separated by a training session in which they were presented with pictures of people working in gender counter-stereotypical (Experiment 1) or gender stereotypical roles (Experiment 2). To ensure participants were focused on the pictures, they were also required to answer four questions on each one relating to the character’s leisure activities, earnings, job satisfaction, and personal life. Accuracy of judgments to stereotype incongruent pairings was found to improve significantly across blocks when participants were exposed to counter-stereotype images (9.87%) as opposed to stereotypical images (0.12%), while response times decreased significantly across blocks in both studies. It is concluded that exposure to counter-stereotypical pictures is a valuable strategy for overcoming spontaneous gender stereotype biases in the short term. (shrink)

There is a balance between the amount of (weak) indestructibility one can have and the amount of strong cardinals. It’s consistent relative to large cardinals to have lots of strong cardinals and all of their degrees of strength are weakly indestructible. But this necessitates the destructibility of the partially strong cardinals. Guaranteeing the indestructibility of the partially strong cardinals is shown to be harder. In particular, this work establishes an equiconsistency between: 1.a proper class of cardinals that are strong reflecting (...) strongs; and2.weak indestructibility for (κ+2)-strength for all cardinals κ in the presence of a proper class of strong cardinals.These have a much higher consistency strength than: 3.weak indestructibility for all degrees of strength for a proper class of strong cardinals.This discrepancy holds even if we weaken (2) from the presence of a proper class to just two strong cardinals. (2) is also equivalent to weak indestructibility for all λ-strength for λ far beyond (κ+2); well beyond the next measurable limit of measurables above κ, but before the next μ that is (μ+2)-strong.One direction of the equiconsistency of (1) and (2) is proven using forcing and the other using core model techniques from inner model theory. Au cours des deux dernières décennies, les études sur Stanley Milgram ont connu une véritable renaissance interdisciplinaire, qui a conduit à modifier profondément le débat sur ces expériences de psychologie sociale parmi les plus controversées du xxe siècle. L’intérêt considérable pour les conditions expérimentales de ses travaux constitue une nouvelle perspective, qui a des implications pour la philosophie de la psychologie sociale. L’ontologie sociale (ou ontologie historique), de différents styles, peut mettre en lumière les caractéristiques contingentes de l’« obéissance à (...) l’autorité» et d’autres expériences classiques de la psychologie sociale nord-américaine. Dans ce numéro de Philosophia Scientiæ consacré à Milgram, ma contribution consiste à montrer comment une approche empirique de l’interaction sociale peut aider à éclairer – « à partir de la base» -– les relations de pouvoir dans le laboratoire de Milgram, ainsi que les résistances à la poursuite de l’expérience. Tout d’abord, je présente le pouvoir comme une caractéristique multidimensionnelle de la sociabilité humaine, en soulignant son aspect performatif. Dans le laboratoire, les sujets jouant le rôle des Enseignants sont contraints à exercer leur pouvoir de différentes façons très contrastées, soit en exerçant ce pouvoir sur l’Apprenant (en se conformant à la volonté de l’expérimentateur), soit contre l’expérimentateur (c’est-à-dire en lui résistant). Deuxièmement, je propose que, comme la moralité, le pouvoir au sens performatif peut être compris à l’aide de la distinction entre premier-plan et arrière-plan (dans le vocabulaire Gestaltiste, la distinction figure/fond), les deux aspects du phénomène étant empiriquement fondés, et orientés vers les pratiques concrètes des agents en interaction. Troisièmement, je précise la notion de pouvoir performatif, en relation avec la pratique de ceux qui, parmi les sujets en position d’Enseignants, s’opposent à la continuation de l’expérience. En conclusion, l’article illustre la valeur de l’analyse éthnométhodologique conversationnelle, en tant que style d’ontologie sociale adapté tant à l’étude des relations de pouvoirs, à celle des prétentions à la connaissance en psychologie sociale, qu’à la reconstruction des présupposés de la psychologie sociale nord-américaine classique. ABSTRACT Because of the existence of severely defective humans it is commonly held that whatever consideration is due to all humans is also due to many other animals, and that therefore speciesism, or the readiness to prefer the interest of humans to those of other animals, is unjustified. After criticism of this reasoning a ‘naturalised’ speciesism, acknowledging, for example, the affinities between species, is articulated and defended. A key to this defence is the separation of the task of specifying morally (...) significant differences between humans and other animals from the task of justifying the extension of consideration to defective humans. The conclusion is that more traditional vices than speciesism are chiefly to blame for the shabby treatment of animals by humans. (shrink)

She redeploys their work, together with other key philosophers including Bergson, Lacan, Deligny and Ruyer, to create new concepts including geophilosophy, the artmachine, the ritornello, schizoanalysis and the machinic assemblage.

The giving of reasons is a way of making sense of what we do, both to ourselves and to others. Three kinds of reason are distinguished: reasons for doing something, reasons to do something, and reasons why we do something. Following a suggestion of Bernard Williams, it is argued that reasons for doing something must key into our actual or potential motivational repertoire. Environmental commitment is a case in point. By inviting us to “regard” land as a community, for example, (...) Aldo Leopold is attempting to promote such commitment by inviting us to share his motivational repertoire. Alternative attempts that appeal to features such as intrinsic value, a caring ethic, and the requirements of human flourishing are briefly discussed but are found wanting. The chapter concludes with a sketch of how environmental commitment might be more effectively keyed into our quest for meaning. (shrink)

Jakob von Uexküll’s (1864-1944) account of Umwelt has been proposed as a mediating concept to bridge the gap between ecological psychology’s realism about environmental information and enactivism’s emphasis on the organism’s active role in constructing the meaningful world it inhabits. If successful, this move would constitute a significant step towards establishing a single ecological-enactive framework for cognitive science. However, Uexküll’s thought itself contains different perspectives that are in tension with each other, and the concept of Umwelt is developed in representationalist (...) terms that conflict with the commitments of both enactivism and ecological psychology. One central issue shared by all these approaches is the problem of how a living being experiences its environment. In this paper, we will look at Uexküll’s reception in French philosophy and highlight the different ways in which the concept of Umwelt functions in the work of Georges Canguilhem, Maurice Merleau-Ponty, and Gilles Deleuze. This analysis helps clarify different aspects of Uexküll’s thought and the deeper philosophical implications of importing his concepts into embodied cognitive science. This paper is part of a recent trend in which enactivism engages with continental philosophy in a way that both deepens and transcends the traditional links to phenomenology, including most recently the thought of Georg W. F. Hegel and Gilbert Simondon. However, no more than a brief outline and introduction to the potentials and challenges of this complex conceptual intersection can be given here. Our hope is that it serves to make more explicit the philosophical issues that are at stake for cognitive science in the question of experienced environments, while charting a useful course for future research. Holland “Survivors of the Abortion Holocaust”: Children and Young Adults in the Anti-Abortion Movement During the last three decades of the twentieth century, children across the United States regularly encountered adults who both hailed them as survivors of a holocaust and pleaded with them not to perpetrate one. These adults were not talking about (...) war, at least not in a traditional sense. They were talking about legal abortion. Children and young adults often heard this pitch in school presentations like one made in the mid-1970s by a California anti-abortion group, United Parents Under God, in which pictures of aborted fetuses (whose “feet will never kick a football... run on a playground... or play hopscotch”) and their imagined lost life stories were the centerpiece. Next to pictures of aborted fetuses were pictures of two prematurely born infants of color (the only people of color in the presentation) who were supposedly in danger under Roe v. Wade. With murder hovering in the air, activists asked their teen audience, “Is someone you love next?” According to these California anti-abortion activists, young people were physically and intellectually vulnerable to pro-choice views because they inhabited “atheistic” classrooms “where evil can no longer be called ‘evil.’” “You are quite literally ‘trapped’ in a completely ‘pagan’ situation in our secular society and schools and we must reach you anyway we can,” they continued. In the so-called “pro-life” worldview, liberals were brainwashing children and young people through the media, public schools, and many other institutions. Jennifer L. Holland 75 “Women’s liberal abortion speakers,” political scientists, “who typically work for the STATE” and for whom the “ends justify the means,” and new “secular-science textbooks”—all were trying to frighten teenagers to “into killing [their] OWN OFFSPRING,” activists said. Anti-abortion women, “ordinary women... who LOVE you” according to the California presentation, sought to protect children while feminist “witches... distort [ed] God’s purposes of sexuality.”1 In order to counteract what they viewed as corruption, anti-abortion activists had to wage a counter -battle, politicizing children in order to make them innocent again. In practice, that meant bringing the abortion wars—with their attendant graphic imagery and discussions of immorality, murder, and “holocausts ”—into the haven of childhood. From the movement’s early days, anti-abortion activists waged their fight in the name of innocent young people; abortion, they said, was a genocide of children. While these activists were certainly not the only US movement to use the supposed vulnerability of children to elicit public support for their cause, they also did something different. For the anti-abortion movement, children and young adults were more than just endangered innocents; they were also potential perpetrators. Young people, it seemed, were more liberal than their elders, having allegedly been reared in and indoctrinated by liberal culture. They seemed, in short, to be a potentially pro-choice generation. Thus, adult activists spoke more to and about young people at the end of the century. Adults needed young people to speak for fetuses as “Survivors of the Abortion Holocaust,” but they also needed to convert and save America through them. The anti-abortion narrative of childhood vulnerability offered the restoration of social hierarchies as a solution to the problem of abortion. It was “women’s liberal abortion speakers” and feminist “witches” who were the sources of societal indoctrination. As psychoanalysis becomes more and more important to literary studies and the accompanying literature bulks larger and larger, students often feel overwhelmed, not knowing where to turn for readings that will open up the subject. A trenchant epilogue defends the psychological approach, suggesting which points in psychoanalytic theory will work for literary critics, and which will not. This letter responds to the article “On the Authority of Advance Euthanasia Directives for People with Severe Dementia: Reflections on a Dutch Case,” by Henri Wijsbek and Thomas Nys, in the September‐October 2022 issue of the Hastings Center Report.

Information is clearly vital to public health, but the acquisition and use of public health data elicit serious privacy concerns. One strategy for navigating this dilemma is to build 'trust' in institutions responsible for health information, thereby reducing privacy concerns and increasing willingness to contribute personal data. This strategy, as currently presented in public health literature, has serious shortcomings. But it can be augmented by appealing to the philosophical analysis of the concept of trust. Philosophers distinguish trust and trustworthiness from (...) cognate attitudes, such as confident reliance. Central to this is value congruence: trust is grounded in the perception of shared values. So, the way to build trust in institutions responsible for health data is for those institutions to develop and display values shared by the public. We defend this approach from objections, such as that trust is an interpersonal attitude inappropriate to the way people relate to organisations. The paper then moves on to the practical application of our strategy. Trust and trustworthiness can reduce privacy concerns and increase willingness to share health data, notably, in the context of internal and external threats to data privacy. We end by appealing for the sort of empirical work our proposal requires. (shrink)

Recent investigations on how people derive meaning from language have focused on task‐dependent shifts between two cognitive systems. The symbolic (amodal) system represents meaning as the statistical relationships between words. The embodied (modal) system represents meaning through neurocognitive simulation of perceptual or sensorimotor systems associated with a word's referent. A primary finding of literature in this field is that the embodied system is only dominant when a task necessitates it, but in certain paradigms, this has only been demonstrated using nouns (...) and adjectives. The purpose of this paper is to study whether similar effects hold with verbs. Experiment 1 evaluated a novel task in which participants rated a selection of verbs on their implied vertical movement. Ratings correlated well with distributional semantic models, establishing convergent validity, though some variance was unexplained by language statistics alone. Experiment 2 replicated previous noun‐based location‐cue congruency experimental paradigms with verbs and showed that the ratings obtained in Experiment 1 predicted reaction times more strongly than language statistics. Experiment 3 modified the location‐cue paradigm by adding movement to create an animated, temporally decoupled, movement‐verb judgment task designed to examine the relative influence of symbolic and embodied processing for verbs. Results were generally consistent with linguistic shortcut hypotheses of symbolic‐embodied integrated language processing; location‐cue congruence elicited processing facilitation in some conditions, and perceptual information accounted for reaction times and accuracy better than language statistics alone. These studies demonstrate novel ways in which embodied and linguistic information can be examined while using verbs as stimuli. (shrink)

The theories of reproduction that emerged at the end of the eighteenth century exhibited a range in experimental thinking about concepts of gender and sexuality. This essay focuses on the work of a writer who proposed an unusual alternative to polarity-based ideas of reproduction. Johann Wilhelm Ritter was a physicist and friend to the German Romantics and someone whose writing also shares many interests with German Naturphilosophie. The essay discusses how, inspired by ideas from the alchemical tradition, Ritter challenged conventional (...) thinking about reproduction in two significant ways: by linking it to the idea of rotation, and by using the figure of the androgyne to understand reproductive models in terms of triads, rather than oppositional pairings. A further objective of this essay is to consider which aspects of the alchemical tradition proved the most useful for Ritter’s experimental thinking and to show how he integrated them with reflections on contemporary scientific developments around 1800. Although accountability lies at the heart of the “doing gender” perspective, it has received surprisingly little attention from gender scholars. In this article, I analyze the different ways that scholars have conceptualized accountability. I propose a synthesis of these various understandings, and demonstrate the utility of this conceptualization with examples from my research on feminist self-defense training. This analysis sheds light on both the workings of accountability and the process of change in gender expectations and practices. The phrase 'beyond historicism' is usually associated with Bielefeld historians like Hans Ulrich Wehler and Jürgen Kocka, who attempted to turn the study of history into a social science, but a better candidate would be the sociologist Niklas Luhmann, who happened to teach as well in Bielefeld during the 1970's and 1980's. Luhmann had little affinity with the project of his colleagues from the history department. He took the opposite view that the social sciences suffered from a naive enlightenment view (...) and should become more history minded. Like the historicists of the early nineteenth century Luhmann was indirectly inspired by the philosophy of Leibniz. Although Luhmann's theory of social systems may seem miles away from the daily interests of most historians, it can be interpreted as an Aufhebung of historicism. This will be demonstrated for two important concepts, the autopoietic system which incorporates the historicist notion of individuality and the concept of second order observation which can be read as an abstract redescription of what historicists meant by the historical method. Spiders have always fascinated humankind as whilst they are often reviled, their product, the web and its silk, are commonly viewed in awe. As such, silks’ material properties and the fear and fascination surrounding the animals that spin it are seen to play an important role in the development of many cultures and societies. More recently this is even more so with the formalization of this inspiration in scientific and technical communities through biomimetics. The aim of this work is to (...) reflect on the beginnings of our relationship with silk and discuss concepts associated with spider silks and webs in ancient Greek and Roman times whilst comparing this with our current understanding of the field. In this way, ancient texts, namely Greek and Latin ones, are found to intersect with modern advanced disciplines, ranging from architecture to medicine to physics. This allows us not only to understand how natural observation has evolved from antiquity to today, but also how such a highly interdisciplinary research network has been spun by some shared conceptual threads. It is sometimes held that rules of inference determine the meaning of the logical constants: the meaning of, say, conjunction is fully determined by either its introduction or its elimination rules, or both; similarly for the other connectives. In a recent paper, Panu Raatikainen argues that this view—call it logical inferentialism—is undermined by some “very little known” considerations by Carnap (1943) to the effect that “in a definite sense, it is not true that the standard rules of inference” themselves suffice (...) to “determine the meanings of [the] logical constants” (p. 2). In a nutshell, Carnap showed that the rules allow for non-normal interpretations of negation and disjunction. Raatikainen concludes that “no ordinary formalization of logic [... ] is sufficient to ‘fully formalize’ all the essential properties of the logical constants” (ibid.). We suggest that this is a mistake. Pace Raatikainen, intuitionists like Dummett and Prawitz need not worry about Carnap’s problem. And although bilateral solutions for classical inferentialists—as proposed by Timothy Smiley and Ian Rumfitt—seem inadequate, it is not excluded that classical inferentialists may be in a position to address the problem too. This paper examines the relation between philosophy and literature through an analysis of claims made by Martha Nussbaum regarding the contribution novels can make to moral philosophy. Perhaps her most controversial assertion is that some novels are themselves works of moral philosophy. I contrast Nussbaum’s view with that of Iris Murdoch. I discuss three claims which are fundamental to Nussbaum’s position: the relation between writing style and content; philosophy’s inadequacy in preparing agents for moral life because of its reliance on (...) rules; and the usefulness of the moral work engaged in by readers of novels. The evaluation of these claims requires a discussion of the nature of philosophy. I find that Murdoch and Nussbaum agree on the ability of literature to contribute to moral understanding, but disagree on the issue of what philosophy is. Therefore, they disagree on the question of whether certain works of fiction are also works of philosophy. I argue that the task Nussbaum assigns philosophy is too broad. Through the use of critical and reflective methods, philosophy should examine and sort moral claims. Literary, philosophical and religious texts contribute to moral eduction; keeping them separate helps us appreciate their distinct contributions, as well as respect their distinct aims and methods. Therefore, I conclude that Nussbaum’s inclusion of certain novels in philosophy cannot be sustained. (shrink)

The view of Karl Marx as “revolutionary” endorsing a violent overturn of the capitalist system is not only standard textbook fare filtering through to popular opinion, but also often found in professional accounts. The perspective on Marx as “revolutionary” is unconvincing. Marx’s evolutionism, insofar as it relates to prominent features of advanced capitalism, implies a powerful laissez-faire bias reflecting primarily concern lest reformist measures to correct perceived injustices in the capitalist-exchange system assure its permanence, but also price-theoretic arguments for non-intervention. (...) Secondly, Marx’s evolutionism extends to the stage following a proletarian political takeover, and includes allowance for a residual capitalist sector, for income inequality, and even for compensation of expropriated property owners. And, thirdly, the proletarian takeover itself might, for Marx, occur by way of democratic voting enabled by extensions of the franchise accorded by the capitalist state itself responding to pressures generated by capitalist development. These three themes render the evolutionist perspective overwhelming. (shrink)

Was Malthus a ‘Utilitarian’? This apparently simple-minded question is justified by on-going debate in the secondary literature. For example, in his study, The Classical Economists, D. P. O'Brien maintains that ‘only the two Mills, apart from Bentham himself, were really Utilitarians’. Against this we have the view of Lord Robbins that ‘We get the picture badly out of focus if we conceive that reliance on the principle of utility was confined to Bentham and his immediate circle.’ In this paper we (...) shall demonstrate the justice of the Robbins perspective with specific reference to the population issue. Modality is a category of linguistic meaning having to do with the expression of possibility and necessity. A modalized sentence locates an underlying or prejacent proposition in the space of possibilities. Sandy might be home says that there is a possibility that Sandy is home. Sandy must be home says that in all possibilities, Sandy is home. The counterpart of modality in the temporal domain should be called “temporality”, but it is more common to talk of tense and aspect, the (...) prototypical verbal expressions of temporality. Together, modality and temporality are at the heart of the property of “displacement” that enables natural language to talk about affairs beyond the actual here and now. (shrink)

This paper presents a sequential search model where consumers look for several products and multiproduct …rms compete in prices. In such a multiproduct search market, both consumer behavior and …rm behavior exhibit di¤erent features from the single-product case: a consumer often returns to previously visited …rms before running out of options; and prices can decrease with search costs and increase with the number of …rms. The framework is then extended in two directions. First, by introducing both single-product and multiproduct searchers, (...) the model can explain the phenomenon of countercyclical pricing, i.e., prices of many retail products decline during peak-demand periods. Second, by allowing …rms to use bundling strategies, the model sheds new light on how bundling a¤ects market performance. In a search environment, bundling tends to reduce consumer search intensity, which can soften competition and reverse the usual welfare assessment of competitive bundling in a perfect information setting.
