Slavery and slave trade gave birth to racism and society has been struggling towards its prevention and possible elimination with little success. Martin Luther King Jr wrote in his letter from the Birmingham jail: “Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny.” Until this undeniable fact is understood and emphasized our contemporary society is heading towards a state of an uncontrollable wildfire of anarchy. It (...) is obvious that all fingers are not equal but that does not negate the fact that all men irrespective of colour or race are created equal—configured with brain, flesh, water, and blood. Racial discrimination is a moral and systemic sin that must be confronted and vehemently condemned. The main thrust of this paper is to expose various forms of racial discrimination ravaging the contemporary society with a view to postulating ideas geared towards its prevention and possible elimination. Relying on observational and historical methods, relevant data required will be elicited. The paper identified among other things that racism is resurging in the 21st century to a threatening dimension that if a coordinated action is not urgently taken, it will result into an uncontrollable wildfire of anarchy. The Tallan people got a social-cultural development in the north of the Inca EMPIRE. It was abruptly interrupted by Francisco Pizarro and his peninsular army in 1532.Because of this historical event, a new socio-economic and political-cultural structure emerge in Piura. Piura was first Spanish city founded in south America this cultural collision caused the necessity of a new nation where the indigenous and European races converges and we are their heirs.

An important challenge when creating automatically processable laws concerns open-textured terms. The ability to measure open-texture can assist in determining the feasibility of encoding regulation and where additional legal information is required to properly assess a legal issue or dispute. In this article, we propose a novel conceptualisation of open-texture with the aim of determining the extent of open-textured terms in legal documents. We conceptualise open-texture as a lever whose state is impacted by three types of forces: internal forces (the (...) words within the text themselves), external forces (the resources brought to challenge the definition of words), and lateral forces (the merit of such challenges). We tested part of this conceptualisation with 26 participants by investigating agreement in paired annotators. Five key findings emerged. First, agreement on which words are open-texture within a legal text is possible and statistically significant. Second, agreement is even high at an average inter-rater reliability of 0.7 (Cohen’s kappa). Third, when there is agreement on the words, agreement on the Open-Texture Value is high. Fourth, there is a dependence between the Open-Texture Value and reasons invoked behind open-texture. Fifth, involving only four annotators can yield similar results compared to involving twenty more when it comes to only flagging clauses containing open-texture. We conclude the article by discussing limitations of our experiment and which remaining questions in real life cases are still outstanding. (shrink)

Our proposal is that the (...) story is a clear reference of a very commonplace Jewish ritual of laying “tefillin”, i.e. phylacteries containing certain commandments and to be affixed to one’s head and arm every morning, and that such preoccupation of ensuring the transmission of the law by physical inscription unto the mind and the flesh. Teilhard de Chardin developed an evolutionary vision of our planetary future, currently developing from a sphere of life, or biosphere towards a sphere of mind, or noosphere. As a visionary, Teilhard was not only on the brink of formulating the internet, but he also anticipated current academic efforts to understand globalization, as well as human, cultural and technological evolution. However, his ideas are sources of enduring controversies in both scientific and theological circles. Here I uncover some of the core reasons (...) why his ways of thinking and writing are often problematic, and propose a way forward. This note aims to introduce Teilhard’s central article about the noosphere, but can also be read as an independent introduction to Teilhard’s system of thought. The Coronavirus Disease 2019 pandemic, now a global health crisis, has surprised health authorities around the world. Recent studies suggest that the measures taken to curb the spread of the COVID-19 outbreak have generated issues throughout the population. Thus, it is necessary to establish and identify the possible risk factors related to the psychosocial and psychophysiological strain during the COVID-19 outbreak. The present extensive literature review assesses the social, psychological, and physiological consequences of COVID-19, reviewing the impact of quarantine measures, (...) isolation, vast human loss, social and financial consequences in the family’s economies, and its impact on the psychological health of the population. We also discussed the effect of psychophysiological factors, considering the impact of physical inactivity and modifications in nutritional habits, at psychological and physiological levels. The present review includes an actualized to date bibliography, articles for which were methodologically analyzed to verify they met the standards of quality and scientific accuracy. Authors understand the pandemic as a multifactorial event for which only a profound and extensive analysis would lead to better compression and efficient intervention in the near future. (shrink)

The authors of the first constitutions of the Spanish-American world, in New Granada, were also scientists who published articles on geography, natural history, political economy, population or medicine. From this observation, the article seeks to show how these scholars understood how to apply the new naturalistic knowledge to the regeneration of society in their constitutional work. This ambition entailed the need to destroy the supposedly artificial and despotic hierarchies of the Ancien Régime, based on the genealogical transmission of dignities and (...) infamy, in order to replace them with others that were "natural". This device did not mean the constitutional triumph of equality, since, to take up a formula of Madame de Staël, equality before the law would mean nothing other than the reestablishment of natural inequalities. The article firstly deals with the works of the Enlightenment of New Granada and of Baron Humboldt to understand the assumptions of their naturalistic anthropology on the "American man", which later served to think, in revolutionary times, about certain political topics such as federalism, the rights of man and the limits of citizenship. It ends with a re-reading of the Discurso de Angostura by showing how this naturalistic knowledge, influenced Bolívar's constitutionalist thought. (shrink)

Psychologists have emphasized children's acquisition of information through firsthand observation. However, many beliefs are acquired from others' testimony. In two experiments, most 4yearolds displayed sceptical trust in testimony. Having heard informants' accurate or inaccurate testimony, they anticipated that informants would continue to display such differential accuracy and they trusted the hitherto reliable informant. Yet they ignored the testimony of the reliable informant if it conflicted with what they themselves had seen. By contrast, threeyearolds were less selective in trusting a reliable (...) informant. Thus, young children check testimony against their own experience and increasingly recognise that some informants are more trustworthy than others. (shrink)

Thanks to his unsurpassed eye and his fearless willingness to take a stand, Clement Greenberg (1909 1994) became one of the giants of 20th century art criticism a writer who set the terms of critical discourse from the moment he burst onto the scene with his seminal essays Avant Garde and Kitsch (1939) and Towards a Newer Laocoon (1940). In this work, which gathers previously uncollected essays and a series of seminars delivered at Bennington in 1971, Greenberg provides his most (...) expansive statement of his views on taste and quality in art, arguing for an esthetic that flies in the face of current art world fashions. Greenberg insists despite the attempts from Marcel Duchamp onwards to escape the jurisdiction of taste by producing an art so disjunctive that it cannot be judged that taste is inexorable. He argues that standards of quality in art, the artist's responsibility to seek out the hardest demands of a medium, and the critic's responsibility to discriminate, are essential conditions for great art. The obsession with innovation the epidemic of newness leads, in Greenbergs view, to the boringness of so much avant garde art. He discusses the interplay of expectation and surprise in aesthetic experience, and the exalted consciousness produced by great art. Homemade Esthetics allows us particularly in the transcribed seminar sessions, never before published to watch the critics mind at work, defending (and at times reconsidering) his theories. Intellectual character education has been primarily expressed in terms of educating for intellectual virtues (EFIV). This aim of teaching intellectual virtues has received some challenges, such as how it fails to articulate adequate action guidance through exemplarist pedagogy, and how it neglects the pervasiveness of intellectual vice among students. To respond to these challenges, this paper considers the aim of educating against intellectual vices (EAIV) – teaching students not to develop intellectual vices or weakening those that they have already developed (...) – which comes with the emergence of vice epistemology. More specifically, I look at how negative epistemic exemplars can be used as a classroom strategy for EAIV, and demonstrate how this could address the aforementioned weaknesses of EFIV. (shrink)

In this paper, we point out that explainability is useful but not sufficient to ensure the legitimacy of algorithmic decision systems. We argue that the key requirements for high-stakes decision systems should be justifiability and contestability. We highlight the conceptual differences between explanations and justifications, provide dual definitions of justifications and contestations, and suggest different ways to operationalize justifiability and contestability.

A sample of 703 Spanish psychologists completed an online survey containing 114 behaviors related to professional practice in different areas. The aim of the study was to learn which professional behaviors create ethical dilemmas most often for psychologists and how they respond to these issues. Findings suggest that psychologists who have actually faced a particular dilemma are less strict on judging the inappropriateness of a possible ethical transgression than those psychologists who have not experienced it. Philosophy lacks criteria to evaluate its philosophical theories. To fill this gap, this essay introduces nine criteria to compare worldviews, classified in three broad categories: objective criteria (objective consistency, scientificity, scope), subjective criteria (subjective consistency, personal utility, emotionality), and intersubjective criteria (intersubjective consistency, collective utility, narrativity). The essay first defines what a worldview is and exposes the heuristic used in the quest for criteria. After describing each criterion individually, it shows what happens when each of them is violated. From the (...) criteria, it derives assessment tests to compare and improve different worldviews. These include the is-ought, ought-act, and is-act first-order tests; the critical and dialectical second-order tests; the mixed-questions and first-second-order third-order tests; and the we-I, we-it, and it-I tests. The essay then applies these criteria and tests to a concrete example, comparing the Flying Spaghetti Monster deity with Intelligent Design. For another application, it draws more general fruitful suggestions for the dialogue between science and religion. (shrink)

Much of the recent scholarship on the problem of political accountability in Africa leans toward the proposition that it is largely a post-colonial phenomenon that was caused by the destruction of the democratic institutions that were inherited by Africa's political elites. By replacing the democratic institutions they inherited from European colonial powers with quasi-democratic and downright despotic structures, it is argued that African elites became increasingly unaccountable and, in the process, destroyed their otherwise robust economies and impoverished the vast majority (...) of their citizens. In reality, however, the problem of political accountability in Africa is far more complex than that in its origins, character and manifestations. This paper critically examines notions and models of political accountability to demonstrate that the sources of the problem of accountability in Africa are both domestic and external. I argue that, contrary to widespread perception that African states suffer from impunity and lack of accountability, African governments have demonstrated a remarkable degree of responsiveness or accountability in their external relations while remaining virtually unaccountable to their own citizens. Therefore, the solution to the problem of political accountability in Africa should include a combination of internal reforms as well as the concerted support of the international community to generate a robust and sustained demand for accountability of African governments to their citizens. Identifying, locating and interpreting both what is present and what is not present in theory and data lies at the core of scientific practice. Most experienced researchers know that social reality and psychological phenomena cannot always be apprehended directly, and that the forces that shape them must often be inferred rather than positively demonstrated. Yet, the important analytical problems raised by “absence” have rarely occupied the centre stage in professional journals. The aim of this paper is to sensitise researchers to (...) the problem of absence. It considers the various guises in which absences may appear, their repercussions in the research process, and the solutions that researchers have used to render absences visible. The paper focuses on the issue of absence as it appears in theory and research on social representations. A typology of absence, structured in terms of the research process, is proposed. The typology is intended purely as a heuristic tool. It identifies and discusses forms of theoretical, methodological, empirical and analytical/interpretive absences. This typology is used to explore forms of absence and their interrelationships throughout the research process in three studies on social representations. The discussion as a whole contributes to reaffirming the radical character of the theory of social representations by stressing how the latter locates the space of explanation at the interface between individual and collective representations, between social and cognitive processes, between intentional and non-conscious dynamics, and between material and symbolic realities. There’s something paradoxical with a person saying ‘I am humble’; it doesn’t seem so humble to self-attribute humility in general, and intellectual humility in particular. In light of the recent interest in educating for intellectual virtues, this paradox has interesting implications to educating for intellectual humility. In particular, one might wonder how a teacher can be a model of intellectual humility to her students. If a teacher says something like ‘Here’s me being an exemplar of intellectual humility’, the paradox above (...) takes on a pedagogical angle. In this paper, I analyze the paradoxes in self-attributing and learning intellectual humility using three different accounts of this virtue, before proceeding to untangle what could be called the ‘Modeling Paradox’ of teaching intellectual humility and figure out whether this virtue can be non-problematically demonstrated to one’s students. Using Demographic and Health Survey datasets from Ghana and Nigeria, this study examined whether the protective effects of breast-feeding are greatest where the poorest sanitation conditions prevail. It was found that mixed-fed infants aged between 0 and 11 months tend to have a higher risk of diarrhoea than fully breast-fed children, while the risk of diarrhoea among weaned infants is twice that of mixed-fed infants. The probit regression models employed in the analysis were used to predict the probability of diarrhoea (...) associated with each breast-feeding pattern for both ‘poor’ and ‘good’ sanitation areas. It was found that the risk of diarrhoea among mixed-fed infants in the poor sanitation areas tends to be high while the same risk among fully breast-fed infants tends to be minimal. In essence, the health risks of mixed feeding are real, particularly for infants aged less than 7 months, and are even worse for those weaned before 6 months of age. (shrink)

Algorithmic decision making is used in an increasing number of fields. Letting automated processes take decisions raises the question of their accountability. In the field of computational journalism, the algorithmic accountability framework proposed by Diakopoulos formalizes this challenge by considering algorithms as objects of human creation, with the goal of revealing the intent embedded into their implementation. A consequence of this definition is that ensuring accountability essentially boils down to a transparency question: given the appropriate reverse-engineering tools, it should be (...) feasible to extract design criteria and to identify intentional biases. General limitations of this transparency ideal have been discussed by Ananny and Crawford :973–989, 2018). We further focus on its technical limitations. We show that even if reverse-engineering concludes that the criteria embedded into an algorithm correspond to its publicized intent, it may be that adversarial behaviors make the algorithm deviate from its expected operation. We illustrate this issue with an automated news recommendation system, and show how the classification algorithms used in such systems can be fooled with hard-to-notice modifications of the articles to classify. We therefore suggest that robustness against adversarial behaviors should be taken into account in the definition of algorithmic accountability, to better capture the risks inherent to algorithmic decision making. We finally discuss the various challenges that this new technical limitation raises for journalism practice. (shrink)

In the last 25 years, several philosophers and scientists have challenged the historical consensus that nonhuman animals cannot be moral agents. In this article, I examine this challenge and the debate it has provoked. Advocates of animal moral agency have supported their claims by appealing to non-rationalist accounts of morality and to observations of animal behavior. Critics have focused on the dangers of anthropomorphism and have argued that we cannot know animals’ states of mind with any certainty. Despite the strengths (...) of the arguments for animal moral agency, the critics’ skeptical counter-challenges seem to bring this debate to a stalemate. However, I suggest that recent philosophical work focusing on personal experiences with animals may reveal a way to dissolve skeptical concerns and offer new insights about the role of animals in morality. From the 1981 “Sexuality and Solitude” to the 1982 “Le combat de la chasteté” to the 1984 History of Sexuality, Volume 2, Michel Foucault’s published works have long recognized the influence of the historian of late antiquity, Peter Brown. With the 2018 publication of Foucault’s draft of Les Aveux de la chair (Confessions of the Flesh) bearing no mention of Brown, the depth of this influence requires further elaboration. Despite Brown not appearing in the “Index of Modern Authors,” Confessions of (...) the Flesh reflects Foucault’s debt to Brown for his readings of Augustine of Hippo and his conceptualizations of sexuality and subjectivity. Analyzing archival evidence alongside biographical narratives helps us better understand Brown’s vital influence as Foucault was shifting his History of Sexuality project, his archival practices, and his genealogy of subjectivity. Appreciating the textual and conceptual engagement between Foucault and Brown thus illuminates not only Confessions of the Flesh as Volume 4 in the History of Sexuality series but also the conceptual and methodological developments of both scholars in their disciplinary intersections. The overlap between virtue epistemology and the philosophy of education has been dominated by discussions of the epistemic qualities of good learners, that is, the intellectual virtues that must be nurtured in students. Not much has been said about the epistemic qualities of good teachers expressed in virtue-theoretic terms. This paper offers a preliminary account of such qualities, which are designated as pedagogical virtues. I use Battaly's pluralist conception of intellectual virtue as a starting point, then describe a pedagogical virtue (...) as an intellectual virtue with an other-regarding success or motivational component. I end with an elucidation of the pedagogical versions of two mainstream intellectual virtues, perseverance and inquisitiveness. (shrink)

“Logic and Agon” is the text of a lecture given in Rome in 1958 by the German philosopher and mathematician Paul Lorenzen. In this inaugural text are laid the foundations of the dialogic logic, which represents an alternative approach to the question of meaning and logical truth, based on a dynamic formalism. Through the enrichment of the standard approach to logic with original tools, it allows a philosophical explanation of the foundations of the concept of formal validity. Clément Lion (...) proposes an unpublished French translation of this text as well as a presentation, in which he tries to show that the initial ambition of Paul Lorenzen was not so much to propose a new logical formalism as to question in principle any enterprise based on the use of such a formalism. In _Rawlsian Political Analysis: Rethinking the Microfoundations of Social Science, _Paul Clements develops a new, morally grounded model of political and social analysis as a critique of and improvement on both neoclassical economics and rational choice theory. What if practical reason is based not only on interests and ideas of the good, as these theories have it, but also on principles and sentiments of right? The answer, Clements argues, requires a radical reorientation of social science from the idea of interests (...) to the idea of social justice. According to Clements, systematic weaknesses in neoclassical economics and rational choice theory are due to their limited model of choice. According to such theories in the utilitarian tradition, all our practical decisions aim to maximize the satisfaction of our interests. These neo-utilitarian approaches focus on how we promote our interests, but Clements argues, our ideas of right, cognitively represented in principles, contribute independently and no less fundamentally to our practical decisions. The most significant challenge to utilitarianism in the last half century is found in John Rawls’s _Theory of Justice _and _Political Liberalism_, in which Rawls builds on Kant's concept of practical reason. Clements extends Rawls's moral theory and his critique of utilitarianism by arguing for social analysis based on the Kantian and Rawlsian model of choice. To illustrate the explanatory power of his model, he presents three detailed case studies: a program analysis of the Grameen Bank of Bangladesh, a political economy analysis of the causes of poverty in the Indian state of Bihar, and a problem-based analysis of the ethics and politics of climate change.
