Human rights and conflict resolution have been traditionally perceived as two separate fields, with contradictory principles and conflicting approaches toward achieving peace. This essay aims to understand these two fields in a more integrative way, showing how a human rights perspective can enrich the theory and practice of conflict resolution. It clarifies the main characteristics of a human rights approach to conflict resolution and identifies a set of human rights standards guiding its implementation: a normative legal framework; structural conditions for (...) peace; participation and inclusion; and accountability and redress. The essay also briefly applies a human rights approach to the Colombian peace process and to the Oslo Accords between Israel and the Palestine Liberation Organization. The conclusion addresses one of the main criticisms of this approach and its principal challenges. (shrink)

Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply with (...) some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)

People implicitly associate positive ideas with their dominant side of space and negative ideas with their non-dominant side. Right-handers tend to associate “good” with “right” and “bad” with “left,” but left-handers associate “bad” with “right” and “good” with “left.” Whereas right-handers' implicit associations align with idioms in language and culture that link “good” with “right,” left-handers' implicit associations go against them. Can cultural conventions modulate the body-specific association between valence and left-right space? Here, we compared people from Spanish and Moroccan (...) cultures, which differ in the strength of taboos against the use of the left hand, and therefore in their preference for the right. Results showed stronger explicit associations between space and valence in Moroccan participants than in Spaniards, but they did not show any increased tendency for right-handed Moroccans to associate “good” with “right” implicitly. Despite differences in cultural conventions between Spaniards and Moroccans, we find no evidence for a cross-cultural difference in the implicit association between space and valence, which appears to depend on patterns of bodily experience. The concepts of “good” and “bad” are associated with right and left space. Individuals tend to associate good things with the side of their dominant hand, where they experience greater motor fluency, and bad things with their nondominant side. This mapping has been shown to be flexible: Changing the relative fluency of the hands, or even observing a change in someone else's motor fluency, results in a reversal of the conceptual mapping, such that good things become associated with the side (...) of the nondominant hand. Yet, based on prior studies, it is unclear whether space–valence associations were determined by the experience of fluent versus disfluent actions, or by the mere expectation of fluency. Here, we tested the role of expected fluency by removing motor execution and perceptual feedback altogether. Participants were asked to imagine themselves performing a psychomotor task with one of their hands impaired, after which their implicit space–valence mapping was measured. After imagining that their right hand was impaired, right-handed participants showed the “good is left” association typical of left-handers. Motor imagery can change people's implicit associations between space and emotional valence. Although asymmetric motor experience may be necessary to establish body-specific associations between space and valence initially, neither motoric nor perceptual experience is needed to change these associations subsequently. The mere expectation of fluent versus disfluenct actions can drive fluency-based effects on people's implicit spatialization of “good” and “bad.” These results suggest a reconsideration of the mechanisms and boundary conditions of fluency effects. Introdução: As aulas virtuais se tornaram o principal meio de ensino das instituições educacionais diante da pandemia, e essa mudança repercutiu diretamente na autoestima dos estudantes e consequentemente nos rendimentos acadêmicos. Objetivo: avaliar a autoestima dos estudantes de enfermagem em contexto pandêmico. Metodologia: Trata-se de um estudo descritivo, com uma abordagem quantitativa. A coleta e análise de dados se deu a partir da escala de autoestima de Rosenberg (The Rosenberg Self-Esteem) e de instrumento complementar desenvolvido pelos autores. A pesquisa foi (...) realizada no Centro de Educação e Saúde da Universidade Federal de Campina Grande, com 155 estudantes do Curso de Bacharelado em Enfermagem. Resultados: Dentre os participantess, 60,7% apresentam valores que indicam uma autoestima diminuída de modo geral. Os números indicam que a maioria absoluta apresentava uma baixa autoestima, decorrente do período vivenciado na pandemia, com uma pontuação entre 7 e 12 no escore, o que representa 89,7% dos entrevistados. Isso mostra que o desgaste vivenciado pelos estudantes durante esse tempo é presente e notório. Conclusão: A baixa autoestima está presente entre os estudantes, como mostram os resultados obtidos através dessa pesquisa, que podem sugerir que essa autoestima diminuída seja advinda do período vivenciado pela pandemia. This study aimed to determine the predictive character of organizational socialization and occupational positive mental health on organizational commitment in higher education teachers. A sample of 279 teachers from higher education institutions who signed an informed consent form was used. Fifty-four point five percent of the participants were women, with a mean age of 44.05 years. The participants completed the Organizational Socialization Inventory, the Positive Occupational Mental Health Questionnaire and the Organizational Commitment Scale, and for data analysis descriptive statistics, correlation (...) analysis and multiple linear regression with stepwise method were applied, entering each dimension of organizational commitment separately as a dependent variable. As a result, moderate to weak correlations were identified between the study variables, and it was found that the final models indicate that the future perspectives and socio-affective dimensions predict affective commitment by 38%; that future perspectives, spirituality and age predict normative commitment by 22.8%; and that the future perspectives dimension predicts commitment of continuity by 9.2%. It is concluded that teachers’ expectations about their development in the institution, as well as their interactions at the socio-affective and spiritual level with the work context, are factors that partially influence their attachment to the educational organization. El trabajo continúa con datos biobibliográficos del historiador, matemático y astrólogo Ibn Qunfuḏ al-Qusanṭīnī , autor de un comentario a la Urŷūza de (...) Ibn Abī l-Riŷāl dedicado a Abū Bakr b. Abī Muŷāhid Gazī Ibn al-Kās, visir de los sultanes meriníes Abū Fāris y Abū Zayyān . La obra parece haber sido redactada durante el breve reinado de este último y antes de la deportación del dedicatario a Mallorca en 1375. Se analiza el contenido del comentario, las fuentes citadas en el mismo, las técnicas astrológicas utilizadas tanto por Ibn Qunfuuḏ como por Ibn Abī l-Riŷāl y el uso, por parte del comentarista de un zīŷ derivado del de Ibn Isḥāq. El artículo termina con un comentario detallado de los horóscopos contenidos en la obra de los que uno corresponde al equinoccio vernal del año 571 de JC, en el que se produjo una conjunción de Saturno y Júpiter que anunció el advenimiento del Islam, mientras que los once restantes constituyen una historia astrológica del Marruecos meriní entre 1348 y 1366. En la serie de frags. 11-17 del Protréptico Aristóteles presenta un extenso argumento, cuyo hilo conductor es su noción de phýsis. Se trata de un argumento progresivo en el cual Aristóteles traza una relación entre phýsis y techné, cuyo objetivo es concluir la relevancia de recibir educación filosófica y filosofar.En este trabajo, nuestro objetivo es analizar este argumento atendiendo a sus supuestos ontológicos y epistemológicos. Para ello, dividiéremos el trabajo en dos partes: en la primera haremos un análisis muy escueto (...) de cómo Jámblico cita el Protréptico de Aristóteles, en función de que es la fuente mediate la cual accedemos al argumento aquí estudiado; en la segunda, nos detendremos en el análisis del argumento propiamente dicho. RESUMEN Sobre la filosofía es una obra exotérica que se conserva de forma fragmentaria. Se cree que tenía tres libros. En los dos primeros Aristóteles habría realizado un compendio sobre las diferentes concepciones de la filosofía y su respectivo objeto; en el tercero habría presentado sus propias concepciones sobre los temas abordados en los libros precedentes. Los escasos fragmentos conservados y la disparidad de las fuentes por las cuales estos son transmitidos representan una dificultad para establecer cuáles son esas (...) concepciones. En este sentido, en este trabajo intentaremos demostrar que en Sobre la filosofía Aristóteles presentaba muchas de las tesis vinculadas con la concepción de la filosofía primera como el estudio de los primeros principios y causas. Para ello nos centraremos en el análisis de los fragmentos 8b, 16, 17, 27a y27b. El examen de estos fragmentos a la luz del resto del corpus nos permitirá demostrar que en Sobre la filosofía Aristóteles identifica la sabiduría con el conocimiento, los principios y las causas. ABSTRACT On Philosophy is an exoteric work that is preserved in a fragmentary mode. It is assumed that it had three books. In the first two, Aristotle would have made a compendium of the different conceptions of philosophy and its respective object. In the third book he would have presented his own conceptions on the topics approached in the previous books. The few preserved fragments and the disparity of the sources by which they are transmitted represent a difficulty for establishing which would have been these conceptions. In this sense, in this paper we will try to demonstrate that in On philosophy Aristotle presented many of the theses related to the conception of the first philosophy as the study of the first principles and causes. With this end, we will focus on the analysis of the fragments 8b, 16, 17, 27a y27b. The examination of these fragments in light of the rest of the corpus will allow us to demonstrate that in On philosophy Aristotle have identified wisdom with the knowledge of these principles and causes. Con base en la hipótesis de que las leyes son fuentes de legitimación de las relaciones de dominación existentes en las sociedades capitalistas, aunque contradictorias, y que en este contexto, el abogado como especialista en el manejo de la ley, tiene una mayor importancia, en este artículo analizo los discurso políticos y legales de los abogados que han actuado y/o actuan en la asesoría jurídica de la entidad oficial que representa a empleadores rurales en el Brasil, denominada “Confederação de (...) Agricultura e Pecuária do Brasil” (CNA). En particular, examinaré la retórica y los argumentos de sus principales demandas (laborales y fundiárias) en la coyuntura de la globalización neoliberal, que tuvo inicios a media-dos de 1980. Resumen A pesar de que uno de los objetivos del planteamiento platónico en República acerca de la formación del carácter de los guardianes es la critica, la censura y el destierro de los poetas y de la poesía mimética como "recurso pedagógico" por su inutilidad como fuente de conocimiento, Platón admite la introducción de cierto tipo de poesía dentro de su programa educativo. No es, entonces, adecuado extender a todo el pensamiento platónico una tesis exclusiva del libro X, porque Platón (...) mismo reconoce una modalidad de mimesis que sobrevive a la censura.Despite the fact that one of the objectives of the platonic approach in Republic about guardians' character education is to criticize, censure, and exile the poets and the mimetic poetry as a "pedagogic resource" due to their uselessness as a source of knowledge. Plato admits the introduction of certain kind of poetry in his educational program. It is not then appropriate to apply a thesis that is exclusive of the X book to all platonic thought since Plato himself recognizes a modality of mimesis which survives to censure. (shrink)

En el presente trabajo de homenaje al Profesor Julio De Zan, me concentro en su crítica al realismo moral. En su libro, La ética, los derechos y la justicia, Julio De Zan niega que existan en el ámbito moral propiedades naturales o metafísicas. Para comprender su crítica, propongo una reconstrucción conceptual de los presupuestos filosóficos que existen para su rechazo del realismo moral. Con este propósito, mi propuesta de reconstrucción conceptual consiste en complementar la ética del discurso defendida (...) por Julio De Zan, relacionando su propuesta con dos complementos filosóficos: por un lado, con el rechazo hacia el realismo moral realizado por Ronald Dworkin en su libro Justicia para erizos; por otro lado, con el rechazo hacia el realismo moral dirigido por Christine Korsgaard en su libro Las Fuentes de la Normatividad. Aunque los tres filósofos mantienen diferencias relevantes, mantienen también un rechazo al realismo moral basado en ciertos parecidos de familia. (shrink)

Julio Cortázar had the personal as well as the literary ability of remaining young. It was the combination of a nimble mind, the experimental quality of his narrative, and the uncanny resilience of his lean figure to the routine ravages of time (he looked a good 25 (...) years younger than his age). El artículo contextualiza e investiga los detalles del «Mes de Reflexión Episcopal» organizado por el Departamento de Pastoral de Conjunto del Celam en julio de 1971, que reunió providencialmente varios obispos, algunos de los cuales no estuvieron en la II Conferencia General tres años antes, y que darían testimonio del espíritu de Medellín hasta el martirio o hasta una muerte trágica en cumplimiento de su misión: Oscar Arnulfo Romero, Juan Gerardi Conedera, Gerardo Valencia Cano y Raúl Zambrano Camader. El (...) encuentro se describe a partir de la revisión documental de las actas y de los pocos informes impresos. La tesis central del artículo es que el diálogo informal entre obispos, teólogos y otros expertos en el «Mes de Reflexión Episcopal» es fuente de propuestas novedosas para una Pastoral de Conjunto, contra la clericalización y el autoritarismo en la Iglesia latinoamericana. What distinguishes evils from ordinary wrongs? Is hatred a necessarily evil? Are some evils unforgivable? Are there evils we should tolerate? What can make evils hard to recognize? Are evils inevitable? How can we best respond to and live with evils? Claudia Card offers a secular theory of evil that responds to these questions and more. Evils, according to her theory, have two fundamental components. One component is reasonably foreseeable intolerable harm -- harm that makes a life indecent and (...) impossible or that makes a death indecent. The other component is culpable wrongdoing. Atrocities, such as genocides, slavery, war rape, torture, and severe child abuse, are Card's paradigms because in them these key elements are writ large. Atrocities deserve more attention than secular philosophers have so far paid them. They are distinguished from ordinary wrongs not by the psychological states of evildoers but by the seriousness of the harm that is done. Evildoers need not be sadistic:they may simply be negligent or unscrupulous in pursuing their goals. Card's theory represents a compromise between classic utilitarian and stoic alternatives (including Kant's theory of radical evil). Utilitarians tend to reduce evils to their harms; Stoics tend to reduce evils to the wickedness of perpetrators: Card accepts neither reduction. She also responds to Nietzsche's challenges about the worth of the concept of evil, and she uses her theory to argue that evils are more important than merely unjust inequalities. She applies the theory in explorations of war rape and violence against intimates. She also takes up what Primo Levi called "the gray zone", where victims become complicit in perpetrating on others evils that threaten to engulf themselves. While most past accounts of evil have focused on perpetrators, Card begins instead from the position of the victims, but then considers more generally how to respond to -- and live with -- evils, as victims, as perpetrators, and as those who have become both. The opportunities to become a good person are not the same for everyone. Modern European ethical theory, especially Kantian ethics, assumes the same virtues are accessible to all who are capable of rational choice. Character development, however, is affected by circumstances, such as those of wealth and socially constructed categories of gender, race, and sexual orientation, which introduce factors beyond the control of individuals. Implications of these influences for morality have, since the work of Williams and Nagel in the seventies, (...) raised questions in philosophy about the concept of moral luck. In The Unnatural Lottery, Claudia Card examines how luck enters into moral character and considers how some of those who are oppressed can develop responsibility. Luck is often best appreciated by those who have known relatively bad luck and have been unable to escape steady comparison of their lot with those of others. The author takes as her paradigms the luck of middle and lower classes of women who face violence and exploitation, of lesbians who face continuing pressure to hide or self-destruct, of culturally Christian whites who have ethnic privilege, and of adult survivors of child abuse. How have such people been affected by luck in who they are and can become, the good lives available to them, the evils they may be liable to embody? Other philosophers have explored the luck of those who begin from privileged positions and then suffer reversals of fortune. Claudia Card focuses on the more common cases of those who begin from socially disadvantaged positions, and she considers some who find their good luck troubling when its source is the unnatural lottery of social injustice. This paper explores the ethical dilemma of conflicting loyalties found in whistleblowing. Central to this dilemma is the internal/external disclosure dichotomy; disclosure of organisational wrongdoing to an external recipient is seen as disloyal, whilst disclosure to an internal recipient is seen as loyal. Understanding how the organisation and society have dealt with these problems over the last 30 years is undertaken through an analysis of Vandekerckhove’s project, which seeks to place the normative legitimisations of whistleblowing legislation and organisational whistleblowing policies (...) within a globalisation semantic able to contain this conflict between society and the organisation. This project fails, it is argued, because of Vandekerckhove’s particular understanding of the organisation as an autopoietic system, i.e. an operationally closed system. A case is made to understand organisations as complex systems, i.e. operationally open systems. Critical Complexity theory sees the identities of systems and components as coterminous. In the context of the organisation, this means that the identities of the corporation and its corporate members arise and die together. The whistleblower’s disclosure reconfigures the organisation by forcing the organisation to open up and make its boundaries flexible, making the designation ‘internal’ or ‘external’ to the organisation, and, therefore, who qualifies as a recipient of a disclosure of wrongdoing, flexible. The organisation is restrained from retailing against the whistleblower, because its identities are coterminous. Furthermore, as the disclosure cannot be categorically defined as either internal or external, the question of whether an external disclosure can qualify as an act of organisational loyalty becomes moot. The texts of the Bible treasure a high amount of theatrical potential. Thus, the book of Job constituted the basis of the Theatrum Mundi . Nevertheless, the Jewish and Christian conception of the world and history, despite its tragedies and Passions, is far removed from Greek tragedy. The figure of Job constitutes a contrast to the tragic in King Lear . An exorcistic formula from the Bible appears in Hamlet, Macbeth, and in plays of the Faustian theme –El mágico prodigioso (...) and Marlowe’s and Goethe’s Fausts –, as well as, surprisingly, in Don Quixote and in many other plays where the devil appears on stage. OscarWilde’s Salome finds inspiration in the language of Song of Songs and of apocalyptic prophecies. Rituality and sacredness are common to the Bible and theatre in the quest for representation of the invisible through the visible. (shrink)

What distinguishes evils from ordinary wrongs? Are some evils unforgivable? How should we respond to evils? Card offers a secular theory of evil--representing a compromise between classic utilitarian and stoic approaches--that responds to these and other questions.

This essay argues that current advocacy of lesbian and gay rights to legal marriage and parenthood insufficiently criticizes both marriage and motherhood as they are currently practiced and structured by Northern legal institutions. Instead we would do better not to let the State define our intimate unions and parenting would be improved if the power presently concentrated in the hands of one or two guardians were diluted and distributed through an appropriately concerned community.

In this contribution to philosophical ethics, Claudia Card revisits the theory of evil developed in her earlier book The Atrocity Paradigm, and expands it to consider collectively perpetrated and collectively suffered atrocities. Redefining evil as a secular concept and focusing on the inexcusability - rather than the culpability - of atrocities, Card examines the tension between responding to evils and preserving humanitarian values. This stimulating and often provocative book contends that understanding the evils in terrorism, torture and genocide enables (...) us to recognise similar evils in everyday life: daily life under oppressive regimes and in racist environments; violence against women, including in the home; violence and executions in prisons; hate crimes; and violence against animals. Card analyses torture, terrorism and genocide in the light of recent atrocities, considering whether there can be moral justifications for terrorism and torture, and providing conceptual tools to distinguish genocide from non-genocidal mass slaughter. This book presents a conceptual mapping of supererogation in the analytic moral philosophical tradition. It first asks whether supererogation can be conceptualised in the absence of obligation or duty and then makes the case that it can be. It does so by enlisting the resources of the continental tradition, specifically using the work of Emmanuel Levinas and his notion of infinite responsibility. In so doing the book contributes to the ongoing efforts to create a common ethical terminology between the analytic (...) and continental traditions within moral philosophy. Supererogatory actions are praiseworthy actions that go ‘beyond duty’, and yet are not blameworthy when not performed. In responding to this paradox, moral philosophy either brackets or attempts a reductionism of supererogation. Supererogation is epitomised in the paradigmatic figures of the saint and hero. Yet, most would agree that emulating these figures is too morally demanding. We rightly ask: where does moral obligation end? Is it even possible, or desirable to demarcate such a boundary?
