The present paper offers a libertarian reading of one of the most important Chinese novels of the twentieth century, The Travels of Laocan, written by Chinese entrepreneur Liu E between 1903 and 1906. I start with an exposition of the ideas associated with the concept of “Asian values,” the evident cultural unviability of this notion, and how “Asian authoritarianism” has been rationalized and justified on the basis of a Hobbesian conception of human nature. Next, I examine Liu E’s life and (...) career as an entrepreneur in a highly interventionist society. Finally, I focus on his magnum opus, The Travels of Laocan, a fictionalized autobiography that explains Liu E’s philosophical and libertarian ideas. (shrink)

El presente artículo tiene como objetivo mostrar, a través de los textos confucianos y de sus intérpretes, cuál ha sido la posición de la mujer en la filosofía china clásica. Se analizará el papel que en las Analectas de Confucio, en los textos rituales, en el “Clásico de Poesía” y en Mencio juega la mujer, así como las interpretaciones que sobre estos pasajes, en ocasiones demasiado escuetos para posicionarse claramente sobre ellos, han realizado los comentaristas, desde la Antigüedad hasta finales (...) de la Época Imperial. Un examen atento mostrará que el confucianismo, a pesar de no preocuparse excesivamente de la cuestión, supo desafiar la “concience collective” y resaltar el papel de la mujer en la historia y en la sociedad. Finalmente, a través de una breve comparación con lo que la filosofía clásica occidental tiene que decir sobre la cuestión del género, se concluirá con unas observaciones sobre el papel del confucianismo en las sociedades modernas asiáticas y su relevancia para la formación de un discurso feminista autóctono. Although Western literature provides a fruitful source of philosophical discussion on the circumstances under which a morally competent agent faces incompatible moral requirements, Sinology has rarely accepted the idea of moral dilemmas in Chinese philosophy in general and Confucianism in particular. The present paper explores moral and morally motivated dilemmas in Liu Xiang’s 劉向 Lienü Zhuan 列女傳 and the (...) philosophical strategies employed for their resolution within the framework of the Confucian tradition, emphasizing similarities with Western traditions such as Greek tragedy or Thomistic philosophy. La actual crisis pedagógica que vive Occidente, constatada por todos aquellos educadores que deben enfrentarse diariamente a unos estándares cada vez más bajos y al consecuente perjuicio en lo que a la autoridad del profesorado se refiere, fue ya profetizada en su momento por Hannah Arendt (“The Crisis in Education”). La educación es uno de los factores más importantes para definir la calidad de vida de un país y, desde esta perspectiva, una crisis educativa es una crisis en todos los (...) ámbitos sociales, económicos y, en última instancia, políticos. El presente artículo intenta exponer cómo la educación y el conocimiento fueron concebidos en la antigüedad a través de dos modelos, Grecia y China, para mostrar así en qué medida los autores clásicos pueden todavía enseñarnos con sentido común a afrontar los problemas metodológicos actuales. Mediante una exposición comparativa, se analizarán las teorías clásicas griegas, así como la epistemología y pedagogía en el confucianismo clásico y tempranomedieval, destacando cómo estos autores confrontaron relativismo, opinión y acumulación vacía de conoci-miento, frente a la búsqueda de la verdad y la selección cuidadosa y científica de saber. En última instancia, destacaremos la necesidad de recuperar nuestra tradición clásica para mantener un nivel educativo adecuado. (shrink)

Neste artigo, apresento a maneira como o filósofo francês Gilles Deleuze aproxima algumas formulações de Michel Foucault das de Friedrich Nietzsche. Procuro evidenciar como essa aproximação cumpre o papel bastante preciso de criticar o niilismo. Assim, o objetivo deste artigo é apresentar, através dessa aproximação, a leitura deleuziana de Nietzsche e de Foucault e mostrar como ela é uma estratégia do filósofo para questionar a estrutura negativa da dialética e do niilismo a que ela está ligada. A fim de realizar (...) o escopo deste artigo, a análise empreendida aqui se concentrou no livro Nietzsche e a filosofia e no artigo “Sobre a morte do homem e o super-homem”. A leitura conjunta desses dois textos de Deleuze permitiu evidenciar que, para ele, o niilismo é o motor da História e que as diferentes formas do niilismo podem ser conectadas a diferentes formações históricas. Além disso, foi possível indicar os elementos que Deleuze evoca para a superar o niilismo a partir de uma afirmação ética. (shrink)

O propósito do presente artigo é analisar o conceito de paz em Rousseau. Para atingir tal objetivo, é preciso ter presente três aspectos imprescindíveis de desenvolvimento: primeiro, o contexto do século XVI e século XVII a partir de dois questionamentos centrais desta época: o crescimento da desigualdade entre os seres humanos e a legitimidade do absolutismo político; segundo, a proposta de paz à Europa elaborada por Abbé de Saint-Pierre; terceiro, o projeto de paz articulado por Rousseau para a Europa.

O intento deste trabalho é refletir sobre a importância da educação para a superação da violência, criando condições para o desenvolvimento de uma cultura da não violência. Em primeiro lugar, defenderemos a ideia da relevância da educação para a paz, apresentando argumentos que sustentam a tese da cultura da paz. Para tanto, em segundo lugar, analisaremos o esboço kantiano À paz perpétua [Zum ewigen Frieden], sobretudo, no que se refere aos seis artigos preliminares e aos três artigos definitivos, a fim (...) de garantir a justiça e a paz na convivência entre os seres humanos, para que, à luz das contribuições kantianas do texto de 1795, seja possível sustentar a fundamentação da urgência da educação para a paz e para a não violência nos dias atuais. O intento do presente artigo é analisar o pensamento de Thomas Hobbes, tendo como textos-base de análise, “Do cidadão” e “Leviatã”, a fim de sistematizar a tese de que, em última análise, a filosofia de Hobbes é a ciência da paz. Trata-se de demonstrar tal propósito em dois momentos. No primeiro momento, mostram-se alguns argumentos de por que Hobbes pode ser considerado um dos autores que melhor concentra o projeto de fundação da política moderna. In this article we assume that the kantian a priori juridical-political theory can be reconstructed according to the a priori synthetic satisfiability proof theory, initially declared in Kritik der reinen Vernunft and extended to practical domain in Kritik der praktischen Vernunft. In particular, it is assumed that the aim to prove that synthetic judgments, such as “this object of external usage is mine”, can a priori invigorate in private law and public law in general – from the determination of their (...) possibility conditions in the executable actions domain by the free human agent – was carried out in Metaphysische Anfangsgründe der Rechtslehre. In what concerns the demonstration of the effectiveness of the law a priori synthetic judgments Kantian theory, i.e., to decide which juridical proposals actually invigorate or not, accepted that this work was not treated on a systematic way by the philosopher Königsberg. There are fragments, spread through many works. Therefore, the task to be developed in this article, aiming to present a field of effectiveness to the law doctrine, is to organize (synthetically) Kant´s statements about politics as a law doctrine exercise, according to the proof theory problems from the a priori synthetic proposals in general. O presente artigo tem o objetivo de analisar como Eric Weil entende a Educação com vistas à compreensão do ser humano no mundo. Pretende-se demonstrar que a Educação Moral, defendida por Eric Weil, é um caminho privilegiado, sine qua non, que auxilia o ser humano no enfrentamento da violência. Evidencia que o educador toma lugar de destaque nessa discussão, pois lhe cabe a responsabilidade de indicar os meios e os caminhos para a universalização, para que a não violência possa subsidiar (...) uma cultura de paz entre os seres humanos. Para tanto, percorre o caminho metodológico fazendo uma abordagem na ampla teoria filosófica de Eric Weil, em especial, nas obras: Lógica da filosofia e Filosofia política, a fim de analisar os pontos mais relevantes para ancorar a concepção de imprescindibilidade da Educação e, também, por sua vez, do educador. Esta pesquisa será eminentemente lastreada por levantamentos bibliográficos nas obras do próprio Eric Weil, bem como nos comentários de alguns de seus comentadores. (shrink)

INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. A fantasiação. E, o respeito de dar a ele assim esses nomes de rebuço, é que é mesmo um querer invocar que ele forme forma, com as presenças! Não seja. Eu, pessoalmente, quase que já perdi nele a crença, mercês a Deus; é o que ao senhor lhe digo, à puridade. Sei que é bem estabelecido, que grassa nos Santos- Evangelhos. Em ocasião, conversei com um rapaz seminarista, muito condizente, conferindo no livro de rezas e revestido de paramenta, com uma vara de maria-preta na mão – proseou que ia adjutorar o padre, para extraírem o Cujo, do corpo vivo de uma velha, na Cachoeira-dos-Bois, ele ia com o vigário do Campo-Redondo... Me concebo. O senhor não é como eu? Não acreditei patavim. Compadre meu Quelemém descreve que o que revela efeito são os baixos espíritos descarnados, de terceira, fuzuando nas piores trevas e com ânsias de se travarem com os viventes – dão encosto. Compadre meu Quelemém é quem muito me consola – Quelemém de Góis. Mas ele tem de morar longe daqui, na Jijujã, Vereda do Buriti Pardo... Arres, me deixe lá, que – em endemoninhamento ou com encosto – o senhor mesmo deverá de ter conhecido diversos, homens, mulheres. Pois não sim? Por mim, tantos vi, que aprendi. Rincha- Mãe, Sangued’Outro, o Muitos-Beiços, o Rasgaem-Baixo, Faca-Fria, o Fancho-Bode, um Treciziano, o Azinhavre... o Hermógenes... Deles, punhadão. Se eu pudesse esquecer tantos nomes... Não sou amansador de cavalos! E, mesmo, quem de si de ser jagunço se entrete, já é por alguma competência entrante do demônio. Será não? Será? De primeiro, eu fazia e mexia, e pensar não pensava. Não possuía os prazos. Vivi puxando difícil de dificel, peixe vivo no moquém: quem mói no asp’ro, não fantaseia. Mas, agora, feita a folga que me vem, e sem pequenos dessossegos, estou de range rede. E me inventei neste gosto, de especular idéia. O diabo existe e não existe? Dou o dito. Abrenúncio. Essas melancolias. O senhor vê: existe cachoeira; e pois? Que o que gasta, vai gastando o diabo de dentro da gente, aos pouquinhos, é o razoável sofrer. E a alegria de amor – compadre meu Quelemém, diz. Família. Deveras? É, e não é. O senhor ache e não ache. Tudo é e não é... Quase todo mais grave criminoso feroz, sempre é muito bom marido, bom filho, bom pai, e é bom amigo-de-seus-amigos! Sei desses. Olhe: um chamado Aleixo, residente a légua do Passo do Pubo, no da-Areia, era o homem de maiores ruindades calmas que já se viu. Me agradou que perto da casa dele tinha um açudinho, entre as palmeiras, com traíras, pra-almas de enormes, desenormes, ao real, que receberam fama; o Aleixo dava de comer a elas, em horas justas, elas se acostumaram a se assim das locas, para papar, semelhavam ser peixes ensinados. Um dia, só por graça rústica, ele matou um velhinho que por lá passou, desvalido rogando esmola. O senhor não duvide – tem gente, neste aborrecido mundo, que matam só para ver alguém fazer careta... Mire veja: se me digo, tem um sujeito Pedro Pindó, vizinho daqui mais seis léguas, homem de bem por tudo em tudo, ele e a mulher dele, sempre sidos bons, de bem. Eles têm um filho duns dez anos, chamado Valtei – nome moderno, é o que o povo daqui agora apreceia, o senhor sabe. Pois essezinho, essezim, desde que algum entendimento alumiou nele, feito mostrou o que é: pedido madrasto, azedo queimador, gostoso de ruim de dentro do fundo das espécies de sua natureza. Em folhas grandes de papel, com capricho tracei bonitos mapas. Ah, não é por falar: mas, desde o começo, me achavam sofismado de ladino. E que eu merecia de ir para cursar latim, em Aula Régia – que também diziam. Tempo saudoso! Inda hoje, apreceio um bom livro, despaçado. Na fazenda O Limãozinho, de um meu amigo Vito Soziano, se assina desse almanaque grosso, de logogrifos e charadas e outras divididas matérias, todo ano vem. Em tanto, ponho primazia é na leitura proveitosa, vida de santo, virtudes e exemplos – missionário esperto engambelando os índios, ou São Francisco de Assis, Santo Antônio, São Geraldo... Eu gosto muito de moral. Raciocinar, exortar os outros para o bom caminho, aconselhar a justo. Minha mulher, que o senhor sabe, zela por mim: muito reza. Ela é uma abençoável. Compadre meu Quelemém sempre diz que eu posso aquietar meu temer de consciência, que sendo bem-assistido, terríveis bons-espíritos me protegem. Ipe! Com gosto... Como é de são efeito, ajudo com meu querer acreditar. Mas nem sempre posso. O senhor saiba: eu toda a minha vida pensei por mim, forro, sou nascido diferente. Eu sou é eu mesmo. Diverjo de todo o mundo... Eu quase que nada não sei. Mas desconfio de muita coisa. Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. In this paper, we argue that lesbian couples who wish to have children who are genetically related to both of them should be allowed access to mitochondrial replacement techniques. First, we provide a brief explanation of mitochondrial diseases and MRTs. We then present the reasons why MRTs are not, by nature, therapeutic. The upshot of the view that MRTs are non-therapeutic techniques is that their therapeutic potential cannot be invoked for restricting their use only to those cases where a mitochondrial (...) DNA disease could be ‘cured’. We then argue that a positive case for MRTs is justified by an appeal to reproductive freedom, and that the criteria to access these techniques should hence be extended to include lesbian couples who wish to share genetic parenthood. Finally, we consider a potential objection to our argument: that the desire to have genetically related kin is not a morally sufficient reason to allow lesbian couples to access MRTs. (shrink)

We argue that the notion of pure sate within Standard Quantum Mechanics is presently applied within the specialized literature in relation to two mutually inconsistent definitions. While the first provides a basis-dependent definition which makes reference to the certain prediction of measurement outcomes, the latter provides a purely abstract invariant definition which lacks operational content. In this work we derive a theorem which exposes the serious inconsistencies existent within these two incompatible definitions of purity.

In this paper we present a new categorical approach which attempts to provide an original understanding of QM. Our logos categorical approach attempts to consider the main features of the quantum formalism as the standpoint to develop a conceptual representation that explains what the theory is really talking about —rather than as problems that need to be bypassed in order to allow a restoration of a classical “common sense” understanding of what there is. In particular, we discuss a solution to (...) Kochen-Specker contextuality through the generalization of the meaning of global valuation. This idea has been already addressed by the so called topos approach to QM —originally proposed by Isham, Butterfiled and D ̈oring— in terms of sieve-valued valuations. The logos approach to QM presents a different solution in terms of the notion of intensive valuation. This new solution stresses an ontological reading of the quantum formalism and the need to restore an objective conceptual representation and understanding of quantum physical reality. (shrink)

The capability approach is gaining momentum as a theory of corporate responsibility and business ethics at a time when the UN Guiding Principles have become a most important framework. A novel approach is now emerging that seeks to understand and specify human rights obligations of businesses within the framework provided by the capability approach. This article partially examines the triad corporate responsibility–human rights–capability approach by exploring the relationship between human rights and capabilities. Thus, it offers conceptual and practical implications for (...) a human rights perspective on corporate responsibility. The bulk of our thesis focuses on studying Nussbaum’s and Sen’s claim that human rights are entitlements to capabilities by means of a discussion of the notion of human dignity. In particular, we show the capability approach’s ability to dissipate theoretical and practical challenges posed by the notion of dignity. This article does not offer a detailed explanation of the implications of our investigation for human rights responsibilities of business. However, an outline of its potential contribution toward unfolding those obligations, conceptually and practically, is provided. (shrink)

News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

Several objections against the morality of researching or employing mitochondrial replacement techniques have been advanced recently. In this paper, I examine three of these objections and show that they are found wanting. First I examine whether mitochondrial replacement techniques, research and clinical practice, should not be carried out because of possible harms to egg donors. Next I assess whether mitochondrial replacement techniques should be banned because they could affect the study of genealogical ancestry. Finally, I examine the claim that mitochondrial (...) replacement techniques are not transferring mitochondrial DNA but nuclear DNA, and that this should be prohibited on ethical grounds. (shrink)

This paper intends to explore an aspect of Blumenberg’s metaphorology as memory of mankind and the ethical commitment derived from it. It is seen as the culmination of the fight that the human being maintains against the senselessness of reality. It manifests itself and it is perceived by a human being as theimmensurability of world time and life time (i.e. that the human being is born and dies), that impedes the human being from having all of the world i.e. the (...) satisfaction of its infinite desires. In the fight against finity technology and money play a vital role. They have in common the power to enable an expansion of human capacities over the boundaries of factual existence: through technology and money the human being can do more or, do the same in less time. That is: tobring closer life time and world time. But in this process the instrumental character of technology and money causes homogenisation in the societies where they thrive. That’s one of the characteristics of globalization. This homogenisation is to be understood as the forgetting of other essential possibilities of the human creation of meaning. Thus, what technological and monetary processes construct on one side, come to be destroyed on the other side. Blumenberg’s metaphorology is the adequate response: it is understood both as the self-consciousness of the process of reason in its making sense of the universe, and as an “ideal store” of everything the human being has come to make in this process. RESUMO Neste artigo, objetivamos explorar os cruzamentos entre as lutas empreendidas por Michel Foucault no início dos anos setenta e o desenvolvimento de conceitos, como os de sobressaber e sobrepoder no curso "Théories et institutions pénales", a fim de entender como a insurreição dos saberes sujeitados, mencionada em "Il faut défendre la société", pode ser também identificada nos movimentos operários e em outras formas de luta, diante do excesso de saber posto ao serviço da concentração e burocratização do poder. Propomo-nos (...) analisar ainda os desdobramentos teóricos da dinástica do saber, tratada em "Théories et institutions pénales" e em passagens de "Dits et écrits", principalmente pela sua diferença em relação à leitura althusseriana do conceito de ideologia. Nesse sentido, pretendemos indicar até que ponto o permanente afastamento foucaultiano do conceito de ideologia no começo dos anos setenta permitiu-lhe isolar a ideia de dinástica do saber como uma primeira delimitação da analítica do poder. ABSTRACT In this paper we aim to explore the intersections between the struggles undertaken by Michel Foucault in the early seventies and the development of concepts such as over-learn and over- power in the course "Théories et Institutions pénales", in order to understand how the insurrection of subjected knowledges, mentioned in "Il faut défendre la société", can also be identified in labor movements and in other forms of clash, before the excessive knowledge put at the service of concentration and bureaucratization of power. We propose further examination on the theoretical developments of the dynastics of knowledge mentioned in "Théories et Institutions pénales" and in passages from "Dits et écrits", mainly because of its difference from Althusser's reading of that ideology concept. We intend to show to what extent the permanent removal of Foucault's ideology concept in the early seventies allowed him to isolate the dynastics of knowledge idea as a first delimitation of the analytics of power.
