Abstract A fundamental question for the ethical foundations of public health concerns the moral justification for limiting or overriding individual liberty. What might justify overriding the individual moral claim to non-interference or to self-realization? This paper argues that the libertarian justification for limiting individual (...) liberty known as the ‘harm principle’ or the ‘Millian paradigm’ is inadequate as a basis of public health ethics and policy. But simply pitting some collectivist value or utilitarian criterion over against individual liberty is not theoretically satisfactory, either. John Stuart Mill himself was not a Millian, in this sense, and his utilitarianism does not pit itself against individual liberty as a situation of balancing conflicting values. A reconsideration of Mill, particularly in light of the later work of Berlin on liberty, points toward a conception of relational liberty that is crucial for public health ethics because it contains within itself the basis for its own moral limitation. In this paper I consider several versions of the argument from evil against the existence of a God who is omniscient, omnipotent and wholly good and raise some objections to them. Then I offer my own version of the argument from evil that says that if God exists, nothing happens that he should have prevented from happening and that he should have prevented the brutal rape and murder of a certain little girl if he exists. Since it was not prevented, (...) God does not exist. My conclusion rests on the claim that no outweighing good was served by allowing that murder, or any other instance of comparable evil, to occur. I take up the objection that my argument moves illicitly from apparently pointless suffering to the claim that there is reason to believe that there is pointless suffering. I offer an example to show that the existence of apparently pointless suffering counts to some extent against the existence of God and to show that no basic belief that God exists that rests on certain sorts of grounds can remain justified in the face of apparently pointless suffering. The brain and body need to adapt constantly to changing social and physical environments. A key mechanism for this adaptation is the ‘stress response’, which is necessary and not negative in and of itself. The term ‘stress’, however, is ambiguous and has acquired negative connotations. We argue that the concept of allostasis can be used instead to describe the mechanisms employed to achieve stability of homeostatic systems through active intervention (adaptive plasticity). In the context of allostasis, resilience denotes the ability (...) of an organism to respond to stressors in the environment by means of the appropriate engagement and efficient termination of allostatic responses. In this review, we discuss the neurobiological and organismal factors that modulate resilience, such as growth factors, chaperone molecules and circadian rhythms, and highlight its consequences for cognition and behavior. ABSTRACT:Democracy—as a form of governance, a moral community, and a way of life—is under great stress. The prospects for democracy and bioethics are linked because bioethics relies on an open society and a democratic cultural environment in order to flourish. For its part, democracy can be restored and strengthened by widespread cultural and psychological support for the values of mutual recognition, equal dignity and respect for persons, and solidarity, interdependence, and the common good. Promoting values such as these is in (...) keeping with the founding vision of bioethics, which was a civic vision. At the present time, bioethics can and should continue to be a bioethics for democracy by engaging directly in civic learning and civic place-making. Forces including extreme economic inequality, cultural polarization, and the monetizing and privatizing of persons as commodities are undermining the forms of moral recognition and mutuality upon which democratic practices and institutions depend. These underlying factors, together with more direct modes of political corruption, manipulation, and authoritarian nationalism, are undoing Western democracies. This essay identifies and explores some vital underpinnings of democratic citizenship and civic learning that remain open to revitalization and repair. Building care structures and practices from the ground up (...) and developing inclusive and egalitarian modes of solidarity in a pluralistic society are the focus of discussion. The essay argues that solidarity and care are essential relationships and practices of moral recognition upon which democratic political agency and freedom rest. The social‐relational lifeworld and the democratic lifeworld are interdependent. Democratic citizenship is itself a relational practice that supports other practices. Democratic governance properly carried out fosters an underlying social solidarity and care and in turn draws moral and political legitimacy upward from them. (shrink)

The concept of consensus is often appealed to in discussions of biomedical ethics and applied ethics, and it plays an important role in many influential ethical theories. Consensus is an especially influential notion among theorists who reject ethical realism and who frame ethics as a practice of discourse rather than a body of objective knowledge. It is also a practically important notion when moral decision making is subject to bureaucratic organization and oversight, as is increasingly becoming the case in medicine. (...) Two models of consensus are examined and criticized: pluralistic consensus and overlapping consensus. As an alternative to these models, the paper argues that consensus refers to the dialogic aspects of a broader normative conception of democratic moral agency. When the preconditions for that dialogic democratic practice are met, consensus has a justificatory role in ethics; when they are not, consensus, as distinct from mere agreement, does not emerge and can have no moral authority. Rorty’s Philosophy and the Mirror of Nature hoped that the profession of philosophy would collapse, that philosophy’s style of reasoning would be transformed, and that analytic philosophy would be overturned. This essay looks at the 40 years since the book’s publication, and argues that the discipline has become more professionalized, that its style of reasoning is the same, and that analysis still flourishes.

Many philosophers believe that the traditional problem of our knowledge of the external world was dissolved by Wittgestein and others. They argue that it was not really a problem - just a linguistic `confusion' that did not actually require a solution. Bruce Aune argues that they are wrong. He casts doubt on the generally accepted reasons for putting the problem aside and proposes an entirely new approach. By considering the history of the problem from Descartes to Kant, Aune shows (...) that analogous arguments create difficulties for the contemporary philosophical consensus. He makes it clear that the problem remains acute, particualarly for our understanding of scientific evidence. Standard models of statistical explanation face two intractable difficulties. In his 1984 Salmon argues that because statistical explanations are essentially probabilistic we can make sense of statistical explanation only by rejecting the intuition that scientific explanations are contrastive. Further, frequently the point of a statistical explanation is to identify the etiology of its explanandum, but on standard models probabilistic explanations often fail to do so. This paper offers an alternative conception of statistical explanations on which explanations of the frequency of (...) a property consist in the derivation of that frequency from a statistical specification of the mechanism by which instances of the relevant property are produced. Such explanations are contrastive precisely because they identify the determinate causal etiologies of their explananda. (shrink)

The further development of public health ethics will be assisted by a more direct engagement with political theory. In this way, the moral vocabulary of the liberal tradition should be supplemented—but not supplanted—by different conceptual and normative resources available from other traditions of political and social thought. This article discusses four lines of further development that the normative conceptual discourse of public health ethics might take. The relational turn. The implications for public health ethics of the new ‘ecological’ or ‘relational’ (...) interpretation that is emerging for concepts such as agency, self-identity, autonomy, liberty and justice. Governing the health commons. The framework of collective action problems is giving way to notions of democratic governance and management of common resources. The concept of membership. Membership is specified by the notions of equal respect and parity of voice and agency. The concept of mutuality. Mutuality is specified by the notions of interdependent concern and care. (shrink)

Continuing his quest to bring American philosophy back to its roots, Bruce Wilshire connects the work of such thinkers as Thoreau, Emerson, Dewey, and James with Native American beliefs and practices. His search is not for exact parallels, but rather for fundamental affinities between the equally "organismic" thought systems of indigenous peoples and classic American philosophers. Wilshire gives particular emphasis to the affinities between Black Elk’s view of the hoop of the world and Emerson’s notion of horizon, and also (...) between a shaman’s healing practices and James’s ideas of pure experience, willingness to believe, and a pluralistic universe. As these connections come into focus, the book shows how European phenomenology was inspired and influenced by the classic American philosophers, whose own work reveals the inspiration and influence of indigenous thought. Wilshire’s book also reveals how artificial are the walls that separate the sciences and the humanities in academia, and that separate Continental from Anglo-American thought within the single discipline of philosophy. In light of recent doctrinal changes, we examine the confused state of U.S. insider trading law, identifying gaps that permit certain market participants to trade on the basis of material nonpublic information, and contrast U.S. insider trading doctrine with the European approach. We then explore the ethical implications of the status quo in the U.S., explaining why the dominant legal justifications for prohibiting classical insider trading and misappropriation—the fiduciary duty and property rights theories—fail to account for the wrongfulness of insider (...) trading by eavesdroppers and certain tippees. We refute common arguments for legalizing insider trading, including arguments that insider trading is a victimless crime and that the practice promotes efficiency. We explain why insider trading constitutes the moral wrong of cheating, grounding our theory in the legitimate expectations of market participants. Having considered Kantian deontology in other work, we find that virtue ethics theory offers a helpful albeit rough framework for assessing the morality of insider trading independent of its legality. We also find that social contract theories, with norms of equality of opportunity and moral desert, provide a compelling ethical basis for retaining, clarifying and broadening current legal prohibitions against insider trading. I explore how the "synthesis of history and nature" that defines the Anthropocene might signal the advent of the “new mythology” Schelling hoped would emerge from his Naturphilosophie. The epistemological dimension of this new mythology is to be understood through Schelling’s idea of Mitwissenschaft, in which humanity is the essential active agent in the reflexive system of the world. Such an inquiry derives not from a sentimental longing for an enchanted world, but from the impending “annihilation of nature” Schelling foresaw (...) in 1804. The resulting organic episteme introduces a new realism in which nature, because absolute, becomes normative. (shrink)

This essay introduces a special report from The Hastings Center entitled Democracy in Crisis: Civic Learning and the Reconstruction of Common Purpose, which grew out of a project supported by the John S. and James L. Knight Foundation. This multiauthored report offers wide‐ranging assessments of increasing polarization and partisanship in American government and politics, and it proposes constructive responses to this in the provision of objective information, institutional reforms in government and the electoral system, and a reexamination of cultural and (...) political values needed if democracy is to function well in a pluralistic and diverse society. The essays in the special report explore the norms of civic learning and institutions, social movements, and communal innovations that can revitalize civic learning in practice. This introductory essay defines and explains the notion of civic learning, which is a lynchpin connecting many of the essays in the report. Civic learning pertains to the ways in which citizens learn about collective social problems and make decisions about them that reflect the duties and responsibilities of citizenship. Such learning can occur in many social settings in everyday life, and it can also be facilitated through participation in the processes of democratic governance on many levels. Civic learning is not doctrinaire and is compatible with a range of public goals and policies. It is an activity that increases what might be called the democratic capability of a people. (shrink)

Two main questions are addressed: (1) What standard defines the nonmoral good for humans, the prudentially rational life? (2) How is this standard applied in guiding and in assessing lives? The standard presented is “The Worthwhileness Principle,” which asserts that if one’s life situation is sufficiently fortunate, the aim is to maximize worthwhileness, the net balance of benefits over costs; but if one’s life situation is chronically, and substantially unfortunate, the aim is to minimize nonworthwhileness, the net balance of costs (...) over benefits. The principle is based on a two-sided, positivity and negativity, or cost-and-benefit-centered viewpoint, rather than a one-sided, good-centered viewpoint. Specifically, it includes negative ends, harms to be avoided, negative means, resource costs to be minimized, and negative luck, misfortune, unfortunate lives.Regarding the second question, the standard is applied prospectively in guiding lives and activities by means of prudential deliberation, prudential habits, and prudential spontaneity. It is applied retrospectively in assessing whole or partial lives using the Worthwhileness Scale. (shrink)

While many books focus on the broader socially ethical topics of widening participation and promoting equal opportunities, this unique book concentrates specifically on the lecturer's professional responsibilities. Bruce Macfarlane analyzes the pros and cons of prescriptive professional codes of practice employed by many universities and proposes the active development of professional virtues over bureaucratic recommendations. The material is presented in a scholarly yet accessible style and case examples are used throughout to encourage a practical, reflective approach.

We highlight exclusionary practices in management research, and demonstrate through example how a more inclusive management literature can address the unique contexts of persons with disabilities, a group that is disadvantaged in society, globally. Drawing from social psychology, disability, self-employment, entrepreneurship, and vocational rehabilitation literatures, we develop and test a holistic model that demonstrates how persons with disabilities might attain meaningful work and improved self-image via self-employment, thus accessing some of the economic and social-psychological benefits often unavailable to them due (...) to organizational-employment barriers. Our longitudinal study provides evidence of the self-image value of ‘doing’ in self-employment, highlighting the potential to reduce stigma and improve generalized self-efficacy and self-esteem. Implications for self-image theory, entrepreneurship training and development, and public policy related to persons with disabilities are discussed. (shrink)

The current paradigm in medicine generally distinguishes between genetic and environmental causes of disease. Although the word paradigm has become a commonplace, the theories of Thomas Kuhn have not received much attention in the journals of medicine. Kuhn's structuralist method differs radically from the daily activities of the scientific method itself. Using linguistic theory, this essay offers a structuralist reading of Thomas Kuhn's The Structure of Scientific Revolutions. Our purpose is to highlight the similarities between these structuralist models of science (...) and language. In part, we focus on the logic that enables Kuhn to assert the priority of perception over interpretation in the history of science. To illustrate some of these issues, we refer to the distinction between environmental and genetic causes of disease. While the activity of scientific research results in the revision of concepts in science, the production of significant differences that shape our knowledge is in part a social and linguistic process. In this paper, I wish to consider Watsuji Tetsuro's (1889?1960) concept of climate (fudo), and consider whether it contributes anything to the relationship between climate change and ethics. I will argue that superficially it seems that fudo tells us little about the ethics of climate change, but if considered more carefully, and through the lens of thinkers such as Deleuze and Heidegger, there is ethical insight in Watsuji's approach. Watsuji's major work in ethics, Rinrigaku, provides concepts such as between-ness and (...) trust that enable his philosophy of climate to move from a theory of national characters (as Fudo is often seen to be) to an approach to living well within one's milieu.
