Evidence for recombination suppression has been identified in linkage studies of several unstable DNA diseases. Also sex‐specific changes in recombination frequency have been detected at the loci of Huntington's disease and myotonic dystrophy. It can be hypothesized that meiotic recombination is regulated by genome‐wide genomic imprinting and that changes in meiotic recombination imply the presence of the genomic imprinting defect. If aberrant recombination at the locus of trinucleotide repeat expansion is verified, new theoretical and experimental opportunities will arise in studies (...) on the role of genomic imprinting in the unstable DNA diseases. In this paper some topics concerning the possibility of describing phenomena of quantum interference in terms of individual particle spacetime trajectories are reviewed. We focus our attention, on the one hand, on the recent experimental advances in neutron and photon interferometry and, on the other hand, on a theoretical analysis of the description of these experiments allowed by stochastic mechanics. It is argued that, even if no conclusive argument is yet at hand in both the theoretical and the experimental fields, (...) the researches of the last 10 years now seem to favor Einstein's and de Broglie's realistic spacetime description and interpretation of quantum mechanics. The present paper deals with an investigation of the conception and development of the idea (principle) of proportionality, the variety of concepts and the procedure for the verification of the principle of proportionality. The genesis of the conception of coercive measures is studied by reviewing the process of the formation of the current principle of proportionality manifested in the historical sources of the law of Prussia, Germany, and the evolution of the principles consolidated in them. Quite often, for one or the other purpose, the fact (or phenomenon) that does not exist is presented to the society or individuals as the real, really existing although it (the fact or phenomenon) simply does not exist in the real life. And often the term “fiction” is used to describe such phenomena. Although fiction is considered an inseparable companion of a social life, the question arises what the actual (true) fiction is and whether the use of it in criminal (...) proceeding does not mean an intentional law maker’s (or the person’s applying the law) fraud, deceit directed towards the addressee of the applicable law. Fiction and its impact on criminal proceedings is analyzed in this article. Features, characterizing fiction are discussed here as well. (shrink)

In this paper the role of the mathematical probability models in the classical and quantum physics is shortly analyzed. In particular the formal structure of the quantum probability spaces (QPS) is contrasted with the usual Kolmogorovian models of probability by putting in evidence the connections between this structure and the fundamental principles of the quantum mechanics. The fact that there is no unique Kolmogorovian model reproducing a QPS is recognized as one of the main reasons of the paradoxical behaviors pointed (...) out in the quantum theory from its early days. The algebraic structure of the 8-spinor formalism is discussed, and the general form of the 8-component wave equation, equivalent to the second-order 4-component one, is presented. This allows a canonical formulation that will be the first stage of the future Clebsch parametrization, i.e., a relativistic generalization of the Bohm-Schiller-Tiomno pioneering work on the Pauli equation.

The introduction by Dirac of a new aether model based on a stochastic covariant distribution of subquantum motions (corresponding to a “vacuum state” alive with fluctuations and randomness) is discussed with respect to the present experimental and theoretical discussion of nonlocality in EPR situations. It is shown (1) that one can deduce the de Broglie waves as real collective Markov processes on the top of Dirac's aether; (2) that the quantum potential associated with this aether's modification, by the presence of (...) EPR photon pairs, yields a relativistic causal action at a distance which interprets the superluminal correlations recently established by Aspect et al.; (3) that the existence of the Einstein-de Broglie photon model (deduced from Dirac's aether) implies experimental predictions which conflict with the Copenhagen interpretation in certain specific testable interference experiments. In this paper the basic aim of the so‐called ‘strong programme’ in the sociology of knowledge is examined. The ‘strong programme’ is considered (and rightly so) as an extreme version of the anti‐realist view of science. While the problem of scientific realism has normally been dealt with from the point of view of the ‘context of justification’ of theories, the paper focuses on the issues raised by law‐discovery. In this context Herbert Simon's views about the existence of a ‘logic of (...) scientific discovery’ are discussed and criticized. The main thesis of the paper is that if the structure of both discovery and prediction is properly understood, then the basic anti‐realist claims become untenable. A fortiori, the ‘strong programme’ appears to be unable to explain some basic features of the structure of science. (shrink)

RESUMO Neste artigo, são rejeitadas duas teses relativamente aceitas a respeito do projeto filosófico tardio desenvolvido por John Rawls. A primeira tese afirma que o objetivo de obras como "O Liberalismo Político" e "Justiça como Equidade: Uma Reformulação" seria o de revisar a natureza do argumento contratualista de Rawls. A segunda, por sua vez, afirma que a principal consequência dessa revisão teria sido certo recuo das implicações igualitárias de sua teoria da justiça original. Procurar-se-á rejeitar ambas as proposições mostrando que (...) "O Liberalismo Político" deve ser entendido como uma teoria acerca do uso legítimo do poder em uma sociedade democrática, e que essa teoria da legitimidade possui consequências distributivas próprias, incompatíveis com teorias liberais convencionais. ABSTRACT The article aims to reject two interrelated theses on the philosophical project carried forward by the late John Rawls. The first thesis states that there is an important change in Rawls' late works such as "Political Liberalism" and "Justice as Fairness: A Restatement" regarding the nature of his theory. Particularly, this change would had brought about a reassessment of Rawls' contractualist argument. The second thesis claims that one of the most important consequences of such reassessment is the retreat from strong egalitarian commitments, as they were present in Rawls' original theory of justice. The article rejects both theses, showing that Political Liberalism can be understood as a theory about the legitimate uses of power in a democratic society and that such new theory of legitimacy brings about distributive consequences by its own that sharply contrast with classical liberal theories. In this paper we reconsider, in the light of the Nelson stochastic mechanics, the idea originally proposed by Bohm and Vigier that arbitrary solutions of the evolution equation for the probability densities always relax in time toward the quantum mechanical density ¦ψ¦2 derived from the Schrödinger equation. The analysis of a few general propositions and of some physical examples show that the choice of the L1 metrics and of the Nelson stochastic flux is correct for a particular class of quantum (...) states, but cannot be adopted in general. This indicates that the question if the quantum mechanical densities attract other solution of the classical Fokker-Planck equations associated to the Schrödinger equation is physically meaningful, even if a classical probabilistic model good for every quantum stale is still not available. A few suggestion in this direction are finally discussed. (shrink)

The article investigates the problem of the truth as the purpose of the criminal procedure, the problem of its cognition. Individuals carrying out criminal procedure activities (including the court) are servants of the procedural form and, at the same time, its hostages, therefore they are unable to approach the objective, absolute truth and should be content with the formal (legal) truth. This position falls under criticism. Attempts to artificial segmentation of the truth to its separate categories or forms are nothing, (...) but justification of the procedural erosion of a certain form. The article offers the opinion that the classical criminal procedure shall establish absolute, not formal (legal) truth. The truth is not only an aspiration of the criminal procedure, but, at the same time, a derivative, regulatory principle, the idea that works only in classical criminal procedure. This principle does not work in quasi-processes, i. e. in those criminal procedure forms that are organically separated from the classical procedure form. (shrink)

Assuming that future experiments confirm Aspect's discovery of nonlocal interactions between quantum pairs of correlated particles, we analyze the constraints imposed by the EPR reasoning on the said interactions. It is then shown that the nonlocal relativistic quantum potential approach plainly satisfies the Einstein causality criteria as well as the energy-momentum conservation in individual microprocesses. Furthermore, this approach bypasses a new causal paradox for timelike separated EPR measurements deduced by Sutherland in the frame of an approach by means of space-time (...) zigzags with advanced potentials. It is finally demonstrated that this inherent quantum causal direct interaction establishes permanent EPR correlations which are always restricted to spacelike separations and are instantaneous only in the center-of-mass rest frame of the two-particle system. This paper discusses the results of the international applied research project ‘UniDiversity – Universities Towards Diversity’ that examined what discriminatory attitudes, beliefs and behaviours based on sexual orientation, gender identity and sex characteristics (SOGISC) exist in the Lithuanian, Greek and Italian academic environment. Specifically, this paper analyses how LGBTI+ individuals conceive of different forms of discrimination in the Lithuanian academic environment. The paper fills the knowledge gap in terms of intolerance and discrimination against LGBTI+ individuals at Lithuanian higher education institutions (...) and provides its theoretical explanation. By focusing on the empirical data collected from survey and focus group interviews, the paper interprets them within the framework of both the sociopolitical context and theoretical debates about heteronormative attitudes. The paper argues that there exists a gap between the declarative openness to LGBTI+ people within Lithuanian universities and persisting stereotypes and discriminatory attitudes towards them. This article analyses implementation of freedom of assembly within Lithuania and in some other States of the European Union. Attention is paid to the differences in the implementation practices for this freedom while analysing probability of restriction of freedom of assembly in the light of legal, political and social factors. The article aims to substantiate that the quality of decision while adopting spreading ideas and expressed views during peaceful meetings, or adopting them later, or dismissing in general, is determined by (...) the democratic society being formed in the state during a particular period. On the other hand, although physical restriction of diffusion of ideas while implementing freedom of assembly is legitimate, it should not become the main control tool, since the development of the state in this direction is absolutely opposite to the expansion of democratic ideas in the society. Legal education should become the priority area of the policy conducted by the state. Particularly since this priority provides the security for the spread of best practices in democratic states, thus laying the grounds for effective prevention of expression of illegal behaviour. Such illegal behaviour may occur in the form of incitement of hatred and aggression in respect of persons who have different faith, race, nation or sexual orientation. The article substantiates that the real challenge faced by the modern democracy is security for practical implementation rather than the formal recognition and regulation of rights and freedoms. It has been found in practice that the implementation of freedom of assembly can be faulty restricted by the procedural justice. After evaluating experience of the States of the European Union and the way in which their national legal system is structured, the recommendations are made enabling a timely dispute settlement concerning the right of assembly, i.e., in order to prevent decision making process from becoming an obstacle for the implementation of freedom of assembly. It is pointed out that settlement of the dispute concerning the permission to hold a peaceful assembly after the date of the assembly is pointless and denies social importance of right of the assembly. Przedmiotem artykułu jest recepcja filozofii Schopenhauera w Czarodziejskiej górze – najbardziej znanej powieści Tomasza Manna. Wpływ Schopenhauera na twórczość Manna jest sprawą znaną i omawianą w różnych kontekstach przez historyków literatury niemieckiej. W tym przypadku relacja głównych protagonistów powieści Hansa Castorpa i Kławdii Chauchat, zostaje przedstawiona jako literacka „ilustracja” doktryny filozofa. Tomasz Mann posługuje się „mistyką ciała” jako próbą doświadczenia Schopenhauerowskiej transcendencji. Analogiczną funkcję w oparciu o estetykę Schopenhauera wypełnia w powieści muzyka. Czarodziejska góra zostaje ukazana jako przykład koncepcji artystycznej (...) wyrosłej z systemu filozofa, choć traktowany jest on raczej jako punkt wyjścia, a nie jako cel. (shrink)

These are: the realm of nature, the realm of rationality and (...) the realm of morality. In each of them there are possible two ways of existence, which the author calls respectively „normality” and „non-normality”. „Normality” and „non-normality” are collective notions, the former referring to ordinary life, devoid of metaphysical dimension and the latter to life that exceeds the phenomenal character of empirical reality. In characteristics of life called non-normality the author shows an optimistic trait of Schopenhauer’s philosophy of a human being. (shrink)

W filozofii od dawna trwa spór dotyczący podstaw moralności. Myśliciele tacy jak Arystoteles, Immanuel Kant, czy John Stuart Mill podstawową funkcję w podejmowaniu decyzji moralnych przypisują rozumowaniu. Z kolei David Hume oraz Artur Schopenhauer podkreślają pierwszoplanowe znaczenie emocji. Celem niniejszego tekstu jest rewizja sentymentalistycznej teorii moralności Hume’a i Schopenhauer’a w perspektywie 1) doniesień z badań analizujących pracę mózgu ludzkiego podczas podejmowania decyzji moralnych 2) roli neuronów lustrzanych 3) obserwacji zachowań empatycznych naczelnych. Badania te wnoszą w obszar etyki nową perspektywę, pozwalającą (...) spojrzeć na problem dotyczący powstania i rozwoju moralności w zupełnie innym świetle. (shrink)
