La France a toujours promu outre-mer une construction du genre fort différente de celle qui avait cours en métropole. Que ce soit pendant l'esclavage (1635-1848), pendant la période de la citoyenneté coloniale (1848-1938) ou bismarckienne (1938-1963), il n'y a pas eu de soutien au modèle de l'homme-pourvoyeur, sans qu'il y ait de prise en compte du maintien d'un modèle polygamique. What are the relationships between historians and the sounds produced in the spaces and times they study? This article stresses the absence of historiographical interest in noise, due to the silence of the archives regarding matters of sound. It reviews the attempts at devising sonograms of historical periods, such as the eighteenth century. It highlights daily sounds and noises and it seeks out their traces in the domains of work, economy, religion, politics and royalty. Churches and hospitals, in particular, were (...) home to harrowing sounds. Voices are also important data for historical enquiry, such as children's voices, peddlers’ tunes and street songs. L’enfant se trouve « placé » dans une famille d’accueil suite à des défaillances parentales graves qui produisent des effractions dans le psychisme de l’enfant. Ces effractions fragilisent le rapport à la Loi, aux interdits et laissent le champ pulsionnel se débrider sans limite. « L’anarchie », comme en témoigne l’omniprésence du qualificatif « anarchique » dans De l’absurdité sur des échasses, est essentielle pour comprendre le chemin argumentatif développé dans la critique benthamienne des droits de l’homme. C’est seulement à partir d’elle qu’apparaissent clairement les différents pans de cette critique, mais surtout son ordre et son sens déterminés par ce qui vaut comme le fondement de toute la critique, la théorie des fictions. Une fois reconnue l’importance de ce fondement, alors la continuité et (...) la systématicité de la critique comme la propension dévastatrice de cette argumentation se déploient entièrement, et devient cette « machine de guerre » contre les droits de l’homme. « L’anarchie » est bien le fil directeur de la critique, en tant qu’elle est le moyen et la fin même de la Déclaration des droits de l’homme pour Bentham. Dans tous les pays et particulierement en Europe, les citoyens, les magistrats et les juristes en general deplorent la complexite normative. Comment traiter la complexite des normes a prendre en compte dans toutes les decisions fondees sur la regle de droit? Depuis une quinzaine d'annees, l'etude des systemes complexes a fait de grands progres tant du point de vue des methodes que de la modelisation. L'approche politique et l'approche scientifique semblent a priori eloignees, mais elles convergent sur l'interet de prendre (...) en compte un objet nouveau: la complexite des systemes. Ces systemes font emerger de nouvelles proprietes, non observables au niveau des elements constitutifs, par une dynamique difficilement previsible, et rendent vaine toute analyse en sous-systemes plus simples. Pour la premiere fois, des specialistes des systemes complexes, des juristes, des philosophes, des experts de l'action publique et de l'evaluation des lois conjuguent leurs reflexions pour depasser les problematiques de la simplification et proposent des concepts et des outils totalement nouveaux pour comprendre et traiter de facon simple l'inevitable complexite du droit. In this article, I defend the idea that Bentham's international political theory entails a cosmopolitan dimension. First, I explain that Bentham rejects two pillars of internationalism, namely, the sovereign's unconstrained autonomous power and authority in international politics, and the legal and moral personality of the state in the international realm. This critique leads Bentham to construct a complex international political theory which places the issue of states’ responsibility at its centre. Bentham's international theory articulates a minimalist international system of cooperation (...) between states and an institutional model of public officials’ responsibilities that together play the crucial role in securing the greatest happiness of the greatest number in the world. In this last part, I explain how Bentham's international political theory relies heavily on the responsibilities of states, a set of responsibilities that encompasses both national and cosmopolitan responsibilities that public officials in each state hold. Neonatal behavioral data support the argument that multiple relations exist between vision and touch. Looking at an object triggers the motion of a neonate's arm and hand towards it. A textured surface that is seen can be recognized tactilely, but not a volumetric shaped object in cross-modal transfer tasks. These data are supported by adult neuroimaging data.

Pharmaceutical industry marketers are confronted with specific ethical issues linked to the tension between the economic interest being pursued and the health mission of this sector. Indeed this dual mission could be problematic for them when the two objectives contradict each other. We use the concept of moral dissonance to examine how marketers in the pharmaceutical industry perceive the profit/health tension inherent in their sector and how they deal with it. Based on narratives of 18 marketers working in the pharmaceutical (...) sector, our qualitative study identifies ethical conflicts of varying intensity that generate differing degrees of moral dissonance among marketers. To cope with this moral dissonance, they use the following strategies: (1) minimize the sensitivity of their activity; (2) invoke the benefits to patients; and (3) avoid behaviors that conflict with their values. In “Wheeler and Thompson’s Appeal: refounding utilitarianism through equality between men and women?”, Benjamin Bourcier studies this Appeal in which, in response to James Mill’s article On Government, Anna Wheeler and William Thompson offer a radical critique of utilitarian thought, but also of Mill’s political exclusion of women and legitimization of patriarchy. In this chapter, Benjamin Bourcier argues that Bentham’s politics of global commerce evolved from enlightenment cosmopolitanism aspirations to gradually integrate several features of an economic imperialist model. Bentham’s series of writings on colonial and commercial projects share a relative similarity with the British imperial ideology of his time. Observing that Bentham’s politics of global commerce is not perfectly coherent, Bourcier interrogates how these changes reveal a close historical and conceptual relation between enlightenment cosmopolitan ideas on commerce and the (...) burgeoning development of British imperial ideology. Alors que plus d’un siècle sépare Thomas Hobbes (1588-1679) et Jeremy Bentham (1748-1832), leurs philosophies respectives entretiennent des rapports étroits qui, bien qu’ils aient souvent retenu l’attention des historiens de la philosophie et commentateurs, n’ont jamais été étudiés spécifiquement. On cherche ici à pallier ce manque par une étude des rapports entre Hobbes et Bentham dans le champ de la philosophie politique, juridique et morale. On espère ainsi expliquer les points communs, influences, réappropriations, différences et oppositions existant entre ces deux (...) pensées et contribuer par là à faire mieux comprendre leur rôle dans l’histoire de la philosophie moderne anglaise. Souvent délaissée, la pensée politique de l’international chez Hobbes et Bentham recèle plus de points communs qu’on ne pourrait le penser. Pour reconstruire philosophiquement cette pensée, en s’attachant plus spécifiquement au rapport entre économie et politique, on explique d’abord leur commune opposition aux colonies et aux politiques étrangères bellicistes. On montre ensuite comment ils comprennent le commerce international, l’économie et le marché en relation avec l’État, et enfin qu’on ne saurait constituer une théorie politique internationale assurant la sécurité, la paix (...) et la prospérité qui soit autonome et séparée de la théorie de l’État. This article takes issue vigorously with what it argues are the disempowering effects of Judith Butler's more recent work, for transgendered people in particular and accordingly for the queer movement in general. In so doing it contests the way in which the reception of Butler's work in France has been mediated by a transphobic psychoanalytic establishment and attacks Butler for playing along with their self-interested political agenda by retelling, in Paris, for their ears, an anecdote of a savoury encounter with (...) a transgendered interlocutor in a subcultural queer space in San Francisco. L’histoire officielle de la discipline veut que la psychologie sociale française, née et morte aussitôt à la fin du XIXe siècle, ait connu une longue éclipse pour renaître seulement dans les années 1950 sous influence américaine. Cette disparition dans la première moitié du XXe siècle serait due à la domination de la sociologie durkheimienne qui passe pour être hostile à la psychologie. Cet article remet en cause cette vision traditionnelle. Il montre que la sociologie durkheimienne s’est elle-même définie comme une (...) psychologie collective et qu’elle a su, à partir des années 1910 environ, ouvrir un véritable dialogue avec les psychologues au sein de l’université. L’idée durkheimienne que les catégories les plus fondamentales de la pensée sont déjà des constructions sociales provoqua chez les psychologues une véritable petite révolution intellectuelle. Elle les obligea en effet à sortir du champ étroit de la psychophysiologie qu’avaient promu depuis 1870 les fondateurs tels Taine et Ribot, en réaction contre le spiritualisme. Cette nouvelle psychologie sociale a influencé la plupart des grands psychologues de l’époque (Blondel, Dumas, Janet, Meyerson, Wallon), mais le temps et les hommes lui ont manqué pour s’institutionnaliser. De fait, elle disparaît avec la mort de ses principaux artisans (Blondel et Halbwachs) et l’oubli parfois volontaire pratiqué par leurs successeurs. (shrink)

The representation of knowledge in the law has basically followed a rule-based logical-symbolic paradigm. This paper aims to show how the modeling of legal knowledge can be re-examined using connectionist models, from the perspective of the theory of the dynamics of unstable systems and chaos. We begin by showing the nature of the paradigm shift from a rule-based approach to one based on dynamic structures and by discussing how this would translate into the field of theory of law. In order (...) to show the full potential of this new approach, we start from an experiment with NEUROLEX, in which a neural network was used to model a corpus of French Council of State decisions. We examine the implications of this experiment, especially those concerning the limits of the model used, and show that other connectionist models might correspond more adequately to the nature of legal knowledge. Finally, we propose another neural model which could show not only the rules which emerge from legal qualification (NEUROLEX's goal), but also the way in which a legal qualification process evolves from one concept to another. The contributions made by British intellectuals to modern internationalInternational political thought have been at the centre of several debates in recent decades in disciplines such as international relations.

Ma première rencontre avec David Lieberman date de 2014. A l’initiative de mon co-directeur de thèse Malik Bozzo-Rey, David Lieberman avait été invité à participer à mon comité de suivi de thèse. Il avait lu les quelques pages présentant les avancées de mes recherches et sa participation à ce comité comme ses commentaires avaient été très soutenant et généreux. La suite de ma recherche doctorale a largement été nourrie par ses travaux et n’ont pas cessé de l’être depuis. La grande (...) force et l'originalité de David a été l'inflexion qu'il a porté à la division entre ce qui relève de la philosophie politique et de la philosophie du droit chez Bentham. Il développe une interprétation ‘politique’ de la philosophie de Bentham en se concentrant sur l’idéal de codification et il voit dans ce thème et cet objet ce qui orchestre la continuité des écrits de Bentham des années 1780 à ceux de 1832. The object of this article is to return to the critique formulated by queer post feminism of the use of the paradigm of « male domination » — a use made by both Bourdieu and some renaturalising currents within feminism. Equally, we look at different queer strategies to escape from this paradigm, and see how it is possible to resist the dominant sex / gender system. A reductive vision of the power of gender often goes hand in hand with a (...) renaturalisation of « masculine » and «feminine » genders and serves as a block on the sexual politics that make up feminisms. We emphasise the limits believed to have been imposed by Bourdieu in diffusing a blocked description of « male domination ». We critique equally the limits of certain feminist currents, which, by developing a monogendered vision of gender oppositions, have made of the entrance of gender, a unique entrance point - hegemonic one might say - and have, therefore, led sexual politics to make numerous simplifications and exclusions. The strategies proposed by queer post feminism, to counter the effects of the renaturalising seizure of « male domination », as well as those of totalisation and the universalising unification of those feminists which are neither revolutionary, nor abolitionist, nor dialectical, are drawn from a modest but multiple micropolitics, and prescribe a salutary deontologisation of the « subject Woman of feminism ». Deux livres récents d’introduction à la pensée de Jeremy Bentham, ceux de Michael Quinn et de Jean-Pierre Cléro, font apparaître des pistes nouvelles (autour de la théorie du gouvernement pour le premier, du langage et des fictions pour le second) pour découvrir l’actualité de cette pensée.

Les avancées rapides dans les technologies numériques ont considérablement changé et amélioré la façon dont les données, informations et outils peuvent être diffusés, gérés, utilisés et réutilisés dans la recherche, et ont créé de nouvelles opportunités pour accélérer le progrès dans la science et l’innovation. Ces développements sont principalement dus au large mouvement formel ou informel de la peer production et à la diffusion globale de l’information mobilisant la coopération de communautés distribuées œuvrant dans des environnements en réseaux. Les initiatives (...) comme celle de Science Commons s’appuient sur un modèle économique de la science évoluant dans un environnement numérique et plus précisément sur un socle de partage et d’échange entre communautés de pairs comme modalité de production. Beaucoup d’autres initiatives de ce type sont en cours . Nous avons choisi Science Commons, dont l’objectif, au-delà de la communication scientifique, vise à accélérer la traduction des données en découverte – en débloquant tous les verrous y compris juridiques qui empêchent que la société bénéficie plus rapidement des résultats scientifiques. La philosophie et les outils pratiques de Science Commons seront décrits comme constitutifs d’une approche résolument ouverte de la connaissance scientifique, dans la lignée de la déclaration de Berlin .Rapid advances in the digital technologies have profoundly changed and improved the way in which data, information and tools can be disseminated, managed, used and re-used in research, and have created new opportunities to speed up progress in science and innovation. These developments are mainly due to an emerging broader movement in support of formal and informal « peer production » and global dissemination of information drawing on the cooperation of distributed science and knowledge communities working in open networked environments. Initiatives like the Science Commons rely on an economic model where science evolves in a digital environment, and more specifically on sharing and exchanges between peer communities as a basis for production. Many other initiatives of this kind are under way . We have chosen the Science Commons, whose objective, over and above scientific communication, is to speed up the translation of data into discovery by removing all barriers, including legal obstacles, that prevent society from enjoying the benefits of scientific results as quickly as possible. The philosophy and practical tools of the Science Commons are described as making up a resolutely open approach to scientific knowledge, as recommended by the Berlin Declaration. (shrink)

Marquée à juste titre par le mouvement des Annales, l’historiographie française a intériorisé lidée qu’avant 1929 dominait ce que Henri Berr avait stigmatisé sous le nom d’ « histoire traditionnelle » : une histoire politique et individualiste ne tenant pas compte des déterminations collectives, sociales ou mentales. La fameuse Introduction aux études historiques de Langlois et Seignobos (1898) serait l’expression de ce «positivisme» qu’aurait initié Gabriel Monod, fondateur de la Revue historique en 1876. Cette vision traditionnelle de l’histoire de la (...) discipline est globalement remise en cause dans cet article qui montre que les années 1870-1930 sont au contraire un moment central dans l’historiographie tant au plan institutionnel qu’au plan intellectuel, qui nous intéresse surtout ici. C’est en effet dès cette époque que s’est cristallisée laspiration à faire de l’histoire une science sociale, ce qui se comprend aisément dès lors qu’on contextualise cette histoire et que l’on replace cette discipline dans l’ensemble du champ des sciences sociales. Les années 1890–1914 voient même se développer fortement une histoire économique et une histoire sociale. 1929 apparaît alors moins comme une révolution que comme une accélération dans une direction déjà marquée. Chr. als wahrscheinlichstes Datum für Psaumis’ Olympiensieg mit dem Maultiergespann, der den Anlass für das Epinikion bildete. Als nicht haltbar erweist sich hingegen die von LIANA LOMIENTO in einem Aufsatz aus dem Jahr 2000 vorgeschlagene Datierung des Liedes ins Jahr 488 v. Chr.

L'article examine si une approche typiquement sciences info-com , et une approche typiquement psychologique , peuvent avoir des interfaces, des concepts partagés, des raisonnements communs ou encore des espaces de coopération. Cette réflexion s'appuie sur la présentation concrète de pratiques communicationnelles managériales, décrites, puis analysées successivement, par les deux approches théoriques. Les conclusions de l'article rejoignent les conclusions de Th. Kuhn: il s'agit de deux visions scientifiques qui n'ont rien en commun et qui se situent dans deux mondes « incommensurables (...) ». Les possibilités de dialogue qui existent doivent servir, non pas à trouver des «métissages» conceptuels, mais à alimenter une concurrence scientifique pour la finesse de la compréhension des phénomènes.This article examines the question of whether an approach typically grounded in information and communication sciences , and if a typically psychologistic approach , can have shared interfaces and concepts, common lines of reasoning and spaces of cooperation. This reflexion is backed up by a concrete presentation of management communicational practices which are described and then analysed using the two theoretical approaches. The conclusions of this article are along the same lines as Th. Kuhn conclusions: these are two scientific visions which are unsconnected and which are in two "unmeasurable" worlds. Any possibilities for dialogue must not be used to find conceptual "crossbreeding" but to foster scientific competition aimed at improveing the finesse of how we understanding phenomena. (shrink)
