The following text is a translation of Semyon Frank’s “L’intuition fondamentale de Bergson” published in Henri Bergson: Essais et témoignages inédits, edited by Albert Béguin and Pierre Thévenaz, Neuchâtel: Éditions de la Baconnière, 1941. In this article, Frank addresses Bergson’s notion of intuition, his anti-intellectualism, his mysticism, his closeness to Lebensphilosophie, the notion of lived experience, the distinction between intuition as pure contemplation and intuition as living knowledge, the distinction between cognition of the atemporal essence of reality and cognition (...) of the world of becoming, pragmatism, the disinterested and open intuitive spiritual attitude vs the utilitarian attitude of social groups closed in on themselves, the transrational vs the irrational, spiritual life, psychic life, the Absolute, and the temporal flux. The article contains criticisms of Bergson on the issues of time and intuition: the durée, the intuitive time, is incomprehensible without an atemporal foundation. Therefore, according to Frank, Plato was correct—contra Bergson—to define time as the moving image of eternity. And, if there is such an atemporal foundation, then, contrary to what Bergson seems to think, intuition as living knowledge cannot be the sole mode of intuition. Moreover, unlike what Bergson appears to think, an intuition of the Absolute would be an intuition of the transrational rather than of the irrational. In The Twentieth-Century Humanists from Spitzer to Frye, William Calin examines the contributions of eight scholar-critics who produced their most important work between the mid-1930s and the early 1960s, before the advent of contemporary critical theory. Five are from Continental Europe. Leo Spitzer, Robert Curtius and Erich Auerbach were German-language students of Romance literatures, while Albert Béguin and Jean Rousset, both speakers of French, were leading figures of the Geneva school. Here the philosopher and physicist David Z Albert argues, among other things, that the difference between past and future can be understood as a mechanical phenomenon of nature and that quantum mechanics makes it impossible to present the entirety of what can be said about the world as a narrative of “befores” and “afters.”.

This book is an attempt to get to the bottom of an acute and perennial tension between our best scientific pictures of the fundamental physical structure of the world and our everyday empirical experience of it. The trouble is about the direction of time. The situation (very briefly) is that it is a consequence of almost every one of those fundamental scientific pictures--and that it is at the same time radically at odds with our common sense--that whatever can happen can (...) just as naturally happen backwards. Albert provides an unprecedentedly clear, lively, and systematic new account--in the context of a Newtonian-Mechanical picture of the world--of the ultimate origins of the statistical regularities we see around us, of the temporal irreversibility of the Second Law of Thermodynamics, of the asymmetries in our epistemic access to the past and the future, and of our conviction that by acting now we can affect the future but not the past. Then, in the final section of the book, he generalizes the Newtonian picture to the quantum-mechanical case and (most interestingly) suggests a very deep potential connection between the problem of the direction of time and the quantum-mechanical measurement problem. Abstract:Therapeutic misconception (TM)—when clinical research participants fail to adequately grasp the difference between participating in a clinical trial and receiving ordinary clinical care—has long been recognized as a significant problem in consent to clinical trials. We suggest that TM does not primarily reflect inadequate disclosure or participants’ incompetence. Instead, TM arises from divergent primary cognitive frames. The researchers’ frame places the clinical trial in the context of scientific designs for assessing intervention efficacy. In contrast, most participants have a cognitive frame (...) that is personal and focused primarily on their medical problems. To illustrate this, we draw on interview material from both clinical researchers and participants in clinical trials. We suggest that reducing TM requires encouraging subjects to adjust their frame, not just add information to their existing frame. Charles Sanders Peirce is generally regarded as the founder of pragmatism, and one of the greatest ever American philosophers. Peirce is also widely known for his work on truth, his foundational work in mathematical logic, and an influential theory of signs, or semiotics. This paper challenges the traditional assumption that descriptive and prescriptive sciences are essentially distinct by presenting a study on the implicit normativity of the production and presentation of biomedical scientific facts within evidence-based medicine. This interdisciplinary study serves as an illustration of the potential worth of the concept of implicit normativity for bioethics in general and for integrated empirical ethics research in particular. It demonstrates how both the production and presentation of scientific information in an evidence-based decision-support contain implicit presuppositions (...) and values, which pre-structure the moral environment of the clinical process of decision-making. As a consequence, the evidence-based decision support did not only support the clinical decision-making process; it also transformed it in a morally significant way. This phenomenon undermines the assumption within much of the literature on patient autonomy that information disclosure is a conditional requirement before patient autonomy even starts; patient autonomy is already influenced during the production and presentation of information. These results imply an increased responsibility of those who produce and present evidence-based facts(i.e. scientists in general and physicians in particular). The insights of this study not only involve a different focus on both theory and practice of patient autonomy and informed consent, but they also call for a broader scope of morality than does traditional empirical research in bioethics. The concept of implicit normativity within integrated empirical ethics research calls for a strong cooperation between bioethicists and descriptive scientists, i.e., a cooperation that goes beyond the discipline-specific epistemic values and that takes place during all phases of the research process. Debates over the reality of race often rely on arguments about the connection between race and science—those who deny that race is real argue that there is no significant support from science for our ordinary race concepts; those who affirm that race is real argue that our ordinary race concepts are supported by scientific findings. However, there is arguably a more fundamental concern here: How should we define race concepts in the first place? The reason I claim that this definitional (...) question is more fundamental is that our handling of the underlying definitional problem often determines the scientific support our ordinary race concepts need, and importantly the likelihood of finding such support. In short, the defini- tional question, “How do we define race?” often undercuts the question of whether race is scientifically meaningful. (shrink)

Modern Social Contract Theory provides an exposition and evaluation of major work in social contract theory from 1950 to the present. It locates the central themes of that theory in the intellectual legacy of utilitarianism, particularly the problems of defining principles of justice and of showing the grounds of moral obligation. It demonstrates how theorists responded in a novel way to the dilemmas articulated in utilitarianism, developing in their different approaches a constructivist method in ethics, a method that aimed to (...) vindicate a liberal, democratic and just political order. A distinctive feature of the book is its comparative approach. By placing the works of Barry, Buchanan and Tullock, Harsanyi, Gauthier, Grice, Rawls, and Scanlon alongside one another, similarities and differences are brought out, most notably in the way in which principles are derived by each author from the contractual construction as well as the extent to which the obligation to adopt those principles can be rationally grounded. Each theory is placed in its particular intellectual context. Special attention is paid to the contrasting theories of rationality adopted by the different authors, whether that be utility theory or a deliberative conception of rationality, with the intention of assessing how far the principles advanced can be justified by reference to the hypothetical choices of rational contracting agents. The book concludes with a discussion of some principal objections to the enterprise of contract theory, and offers its own programme for the future of that theory taking the form of the empirical method. We develop an exact truthmaker semantics for permission and obligation. The idea is that with every singular act, we associate a sphere of permissions and a sphere of requirements: the acts that are rendered permissible and the acts that are rendered required by the act. We propose the following clauses for permissions and obligations: -/- - a singular act is an exact truthmaker of Pφ iff every exact truthmaker of φ is in the sphere of permissibility of the act, and (...) -/- - a singular act is an exact truthmaker of Oφ iff some exact truthmaker of φ is in the sphere of requirements of the act. -/- We show that this semantics is hyperintensional, and that it can deal with some of the so-called paradoxes of deontic logic in a natural way. Hermann Grassmann's ideas on the nature and foundations of mathematics were published as an integral part of his mathematical treatise, the Ausdehnungslehre, in 1844. In spite of its notoriously obscure style we can better understand the work if we view it as an expression of the dialectical philosophy of his mentor, the theologian F. Schleiermacher. The relation to Schleiermacher is presented here through an analysis of the principal ideas of the Ausdehnungslehre.

In my paper, I develop a phenomenological and pragmatist reflection on the fragility of liberal democracy’s moral foundations in times of war. Following Judith Shklar’s conception of the “liberalism of fear”, the legitimacy of the liberal-democratic order is seen as grounded in experiences of suffering caused by political violence. It is also assumed that the liberalism of fear delivers an adequate conception of the normative foundations of the European project. With the help of phenomenologists such as Edmund Husserl, Maurice Merleau-Ponty (...) and Michel Henry, the paper ants to philosophically deepen the liberalism of fear by outlining a theory of “pathic evidence” as a normative foundation and the concept of a common “flesh of the political” as a shared moral sensitivity that sets boundaries to political conflict as well as the political imaginary, excluding what I call the production of “monumental meaning”. It then examines the question which political conditions are needed for this evidence to become a shared, communal criteria of ethical thought, and considers inner and outer challenges to the transmission and reproduction of this evidence in time, drawing especially on John Dewey’s ideas of democratic communication and social intelligence. In the current war, the following problem appears as crucial for the “soul” of European democracies which are confronted with the need to respond to Russia’s attack: How can a political morality grounded in pathic evidence be sustained, once it is challenged by an aggressor who, out of cultural and political reasons, shows a higher level of toleration towards violence? Besides aggression from an external foe, there are also temporal dynamics that further the loss of the inhibiting force of pathic evidence from the inside. As it shall be argued, boredom can be such a factor. The paper concludes by drawing conclusions for the current war in Ukraine. (shrink)

Hans Albert is the leading critical rationalist in the German-speaking world and the main critic of the hermeneutic tradition. He is well-known for applying the idea of critical reason to various kinds of human practice, including economics, politics, and law. But he has also improved on Popper's methodology by introducing the idea of rational heuristics. This collection of essays presents the core of his work on epistemology, philosophy of the social sciences, philosophy of religion, and philosophy of law. Versammelt sind Beiträge zur Volksbildung im Roten Wien, zu Architektur und Stadtplanung, zu neuen Diskursen in der Psychoanalyse oder zur Neuorientierung Musils nach 1918, die später (...) zu seinem epochalen Roman »Der Mann ohne Eigenschaften« führen wird. The study examines the argumentative competencies of people with Asperger syndrome (AS) and compares this with those of normal – or what are called neurotypical (NT) – subjects. To investigate how people with AS recognise, evaluate and engage in argumentation, we have adapted and applied the empirical instrument developed by van Eemeren, Garssen and Meuffels to study the conventional validity of the pragma-dialectical freedom rule (van Eemeren, Gars- sen & Meuffels 2003a; 2003b; 2005a; 2005b; van Eemeren & Meuffels, 2002). Our (...) paper begins with some background information on Asperger syndrome and how it impacts upon communication and argumentation; then it addresses the research questions and methods used; thirdly, it presents some initial findings; finally, it will conclude with some im- plications for those people with AS, for those they come into contact with and for the pragma-dialectic model in general. This report is about ethical thinking in the field of health and health care. But it is no abstract philosophical tract. It is designed to be of practical help to those struggling with the complex questions of allocating resources in health care and to encourage a wider involvement at all levels in health debates. The questions it raises stimulate new thinking about today's institutional structures. As we proceeded with our work, we became aware that it is easier to state problems (...) than to solve them. However, we were also aware of the opposite danger of oversimplification implicit in the view that there was a moral calculus to which decisionmakers could turn when they were confronted by an ethical problem in the allocation of resources, and which would yield mechanical solutions to human problems.
