Maqasid al-Shariah based Islamic bioethics is an Islamic bioethics concept which uses the objectives of the Shariah as its approach in analysing and assessing bioethical issues. Analysis based on maqasid al-Shariah based Islamic bioethics will examine any bioethical issues from three main aspects namely intention, method, and output or final goal of the studied issues. Then, the evaluation will be analysed from human interest hierarchy, inclusivity, and degree of certainty. The Islamic bioethics concept is a manifestation of dynamic Islamic jurisprudence (...) which can overcome new complex and complicated bioethical issues such as tri-parent baby technology issues. Therefore, this article will introduce and explain the concept of maqasid al-Shariah based Islamic bioethics and outline a general guidance of maqasid al-Shariah based Islamic bioethics to determine a maqṣad based on standards of human good or well-being and harm. This work has aimed to investigate the consumers’ green product purchase attitudes and behavioral intention during COVID-19 pandemic. Data was collected through a survey method of 503 consumers in Malaysia. Data were analyzed using the partial least square method. The findings revealed that fear of COVID-19 pandemic has a significant impact on green product behavioral intention. Green product literacy, green product orientation, and social influence have a significant influence on green product purchase attitudes. The results also indicated that consumers’ green (...) product purchase attitudes mediate the effect of green product literacy, green product orientation, and social influence on behavioral intention. The findings of this work will provide strategically relevant references to green marketers and retail managers in the understanding of consumers’ green product purchase attitudes and green product behavioral intention during the ongoing uncertainty of the COVID-19 pandemic. Neuromarketing relies on Brain Computer Interface (BCI) technology to gain insight into how customers react to marketing stimuli. Marketers spend about$750 billion annually on traditional marketing camping. They use traditional marketing research procedures such as Personal Depth Interviews, Surveys, Focused Group Discussions, and so on, which are frequently criticized for failing to extract true consumer preferences. On the other hand, Neuromarketing promises to overcome such constraints. This work proposes a machine learning framework for predicting consumers' purchase intention (PI) and affective (...) attitude (AA) from analyzing EEG signals. In this work, EEG signals are collected from 20 healthy participants while administering three advertising stimuli settings: product, endorsement, and promotion. After preprocessing, features are extracted in three domains (time, frequency, and time-frequency). Then, after selecting features using wrapper-based methods Recursive Feature Elimination, Support Vector Machine is used for categorizing positive and negative (AA and PI). The experimental results show that proposed framework achieves an accuracy of 84 and 87.00% for PI and AA ensuring the simulation of real-life results. In addition, AA and PI signals show N200 and N400 components when people tend to take decision after visualizing static advertisement. Moreover, negative AA signals shows more dispersion than positive AA signals. Furthermore, this work paves the way for implementing such a neuromarketing framework using consumer-grade EEG devices in a real-life setting. Therefore, it is evident that BCI-based neuromarketing technology can help brands and businesses effectively predict future consumer preferences. Hence, EEG-based neuromarketing technologies can assist brands and enterprizes in accurately forecasting future consumer preferences. (shrink)

This study is aimed to identify the relative effect of online review ratings and perceived crowding on purchase intentions of a consumer. Our study also investigated the contingent effect of gender and perceived crowding between the relationship of exogenous and endogenous variables. This study was conducted in the Malaysian restaurant industry. We applied the purposive sampling technique to identify respondents, the mall intercept survey method was used for data collection. Smart PLS software was applied for data analysis. This study demonstrates (...) through its results that online review ratings and perceived crowding have a positive effect on purchase intentions of a consumer. Moreover, if a consumer perceives crowding at a restaurant, this has a positive contingent effect on the relationship between review ratings and purchase intentions. This demonstrates that the consumer is more inclined to choose a restaurant with a high online review rating and has high perceived crowding at some unfamiliar place. Lastly, no evidence is found for the gender difference between review rating and purchase intentions; however, gender shows contingent effect and results confirmed that males preferred more crowded restaurants as compared to females. The science of Kalâm, expressed as Uṣûlü'd-dîn in Islamic thought, is a constructional science. This means that the science of Kalâm has a dynamic structure in social life as well as a theoretical beginning. Kalâm has played an important role in the implementation of the idea of tawhid and the justice-based life that will accompany it by taking into account the historical and geographical heritage of Muslim communities on how to understand the hopes of religion. It is known that the (...) political and social events that took place in Muslim society also took place in the history of Islamic thought as a theological sect in the later historical process. Muslims, part of a geography that has historically been the source of ancient cultures and thoughts, tried to protect the basic hopes of the religion they belonged to while also responding to the accusations of members of different faiths against Islam. Like other Islamic sciences, the science of Kalâm was formed later as a discipline. Depending on the method followed in understanding religious thought, theological sects were formed. Two basic approaches are dominant in the historical process and the general practice of the Muslim society. There is a rational trend that tends to use ta'wil to understand the verse based on nass and those qualified as Ahl-i hadith that do not accept ta'wil except for narration. The supporters of this method will later be described as Mu'tazila. There are dozens of theological sects shaped around these two basic ideas. This historical use of kalâm is rife with contradictions. They take a serious attitude towards those who use the kalâm method of the Ahl-i hadith. Although this is the case, the science of Kalâm as a discipline has played a very fundamental role in the Muslim society from the very beginning to the present. Unfortunately, the constructive function of the Science of Kalâm historically has not been continuous. As in other Islamic sciences, the Science of Kalâm became after a certain time a form of repetition or interpretation of what was written in the past, with commentaries and annotations instead of original copyright works. This naturally caused the Muslim community to imitate the past in every aspect of life and thus not be able to build a future. Muslim scholars have tried to address this over time and across geographies. A part of this early effort was the necessity of reinterpreting Islamic sciences. In the modern period (19th-20th century), a search for innovation has been made in all Islamic sciences. The main purpose of these efforts was the re-evaluation of Islamic sciences in accordance with the conditions of the age. One of those who was a part of this important and meaningful struggle is Fazlur Rahman (d.1988). He criticizes the science of Kalâm as well as other Islamic sciences and make suggestions to make Kalâm gain a dynamic structure. While Fazlur Rahman's criticism of Kalâm is included, the early period criticism of Kalâm will also be briefly mentioned in order to provide a better understanding of the subject. A comparison will be made between the thoughts of those who criticized Kalâm in the early period and those of Fazlur Rahman in the modern period. While there is an opposition to Kalâm in the form of the rejection of the science of Kalâm as a discipline, especially in the thought of Ahl al-Hadith, the science of Kalâm was considered as a constructional science in Fazlur Rahman. In addition to arguing that the Science of Kalâm should be reorganized as a discipline in terms of the method and content, Fazlur Rahman emphasizes the necessity of considering the past as an experience that must be understood according to the conditions of the day. For Fazlur Rahman, one of the reasons made Muslim thought inert is because the discipline of Kalâm does not consider present social life. In the 20th century, with modernism, theological debates gained a new dimension, and developments in all areas of social life gave birth to a brand new culture very different from the past. The Heisenberg-Gabor uncertainty principle defines the limits of information resolution in both time and frequency domains. The limit of resolution discloses unique properties of a time series by frequency decomposition. However, classical methods such as Fourier analysis are limited by spectral leakage, particularly in longitudinal data with shifting periodicity or unequal intervals. Wavelet transformation provides a workable compromise by decomposing the signal in both time and frequency through translation and scaling of a basis function followed by correlation or convolution with (...) the original signal. This study aimed to compare the accuracy of predictive models in mental arithmetic in time and frequency domains. Analysis of the author's response time at mental arithmetic using a soroban was modeled for two periods, an initial period, and a return period both separated by an interval of 370 days. The median response times in seconds was longer for all tasks during the TI compared to the TR period, for addition [CTAdd 62 vs 50 s] and summation [CTSum 68 vs 57 s]. Response times were longer for errors regardless of the study period or task. There was an increasing phase difference for the addition and summation tasks during the TI period toward the end of the series 49.65o compared to the TR period where the phase difference between the two tasks was only 2.05o, indicating that both tasks are likely demonstrating similar learning rates during the latter study period. A comparison between time and time/frequency domain forecasts for an additional 100 tasks demonstrated higher accuracy of the maximum overlap discrete wavelet transform model, where the mean absolute percentage error ranged between 5.48 and 8.19% and that for the time domain models [autoregressive integrated moving average, generalized autoregressive conditional heteroscedasticity ] was 6.16–10.80%. The Theme. Strong forcing axioms like Martin’s Maximum give a reasonably satisfactory structural analysis of $H(\omega _2)$. A broad program in modern Set Theory is searching for strong forcing axioms beyond $\omega _1$. In other words, one would like to figure out the structural properties of taller initial segments of the universe. However, the classical techniques of forcing iterations seem unable to bypass the obstacles, as the resulting forcings axioms beyond $\omega _1$ have not thus far been strong enough! However, (...) with his celebrated work on generalised side conditions, I. Neeman introduced us to a novel paradigm to iterate forcings. In particular, he could, among other things, reprove the consistency of the Proper Forcing Axiom using an iterated forcing with finite supports. In 2015, using his technology of virtual models, Veličković built up an iteration of semi-proper forcings with finite supports, hence reproving the consistency of Martin’s Maximum, an achievement leading to the notion of a virtual model.In this thesis, we are interested in constructing forcing notions with finitely many virtual models as side conditions to preserve three uncountable cardinals. The thesis constitutes six chapters and three appendices that amount to 118 pages, where Section 1 is devoted to preliminaries, and Section 2 is a warm-up about the scaffolding poset of a proper forcing. In Section 3, we present the general theory of virtual models in the context of forcing with sets of models of two types, where we, e.g., define the “meet” between two virtual models and prove its properties.The main results are joint with Boban Veličković, and partly appeared in Guessing models and the approachability ideal, J. Math. Log. 21 (2021).Pure Side Conditions. In Section 4, we use two types of virtual models (countable and large non-transitive ones induced by a supercompact cardinal, which we call Magidor models) to construct our forcing with pure side conditions. The forcing covertly uses a third type of models that are transitive. We also add decorations to the conditions to add many clubs in the generic $\omega _2$. In contrast to Neeman’s method, we do not have a single chain, but $\alpha $ -chains, for an ordinal $\alpha $ with $V_\alpha \prec V_\lambda $. Thus, starting from suitable large cardinals $\kappa <\lambda $, we construct a forcing notion whose conditions are finite sets of virtual models described earlier. The forcing is strongly proper, preserves $\kappa $, and has the $\lambda $ -Knaster property. The relevant quotients of the forcing are strongly proper, which helps us prove strong guessing model principles. The construction is generalisable to a ${<}\mu $ -closed forcing, for any given cardinal $\mu $ with $\mu ^{<\mu }=\mu <\kappa $.The Iteration Theorem. In Section 5, we use the forcing with pure side conditions to iterate a subclass of proper and $\aleph _2$ -c.c. forcings and obtain a forcing axiom at the level of $\aleph _2$. The iterable class is closely related to Asperó–Mota’s forcing axiom for finitely proper forcings.Guessing Model Principles. Section 6 encompasses the main parts of the thesis. We prove the consistency of the guessing principle $\mathrm {GMP}^+(\omega _3,\omega _1)$ that states for any cardinal ${\theta \geq \omega _3}$, the set of $\aleph _2$ -sized elementary submodels M of $H(\theta )$, which are the union of an $\omega _1$ -continuous $\in $ -chain of $\omega _1$ -guessing, I.C. models is stationary in $\mathcal P_{\omega _3}(H(\theta ))$. The consistency and consequences of this principle are demonstrated in the following diagram. We also prove that one can obtain the above guessing models in a way that the $\omega _1$ -sized $\omega _1$ -guessing models remain $\omega _1$ -guessing model in any outer transitive model with the same $\omega _1$, and we denote this principle by $\rm{SGMP}^+(\omega_3,\omega_1)$.In the following diagram, $\mathrm{TP}$ stands for the tree property; $w\mathrm{KH}$ stands for the weak Kurepa Hypothesis; $\mathrm{MP}$ stands for Mitchell property, i.e., the approachability ideal is trivial modulo the nonstationary ideal; $\mathrm{AP}$ stands for the approachability property; $\mathrm {AMTP}(\kappa ^+)$ states that if $2^\kappa <\aleph _{\kappa ^+}$, then every forcing which adds a new subset of $\kappa ^+$ whose initial segments are in the ground model, collapses some cardinal $\leq 2^{\kappa }$. Lincoln and Guba provided some principles and four evaluative criteria called “trustworthiness” to guide social science research naturalistically. However, drawing on Science and Technology Studies (STS) literature, a field engaged with methods and practices of science for several decades, one can argue that this approach is not still fully naturalistic. In this paper, we review Lincoln and Guba’s four criteria of trustworthiness from an STS perspective. In the twenty-first century, the focus of science and technology (S&T) on the human interests and the accessible interests of society, and so the rise of some questions concerning the impact of S&T on social norms, has led to embedding ethical debates in S&T policy-making. The ethics of S&T policy-making, as a representation of the relationship between ethics and S&T policy-making, is a relatively new area of applied and professional ethics that addresses the dilemmas and ethical challenges of the S&T (...) policy-making process. Understanding and recognizing the ethical components of S&T policy-making, one can develop a normative framework to assist policymakers in designing and analyzing ethical policies in the S&T field. The design and development of such a framework is the main purpose of the present study. In this study, the components of the proposed framework for ethical policy-making in S&T, their ethical and policy approaches, as well as their fundamental ethical and policy principles have been identified through studying sources and texts related to meta-ethics, normative ethics, and S&T ethics. Then, these components have been categorized in the form of steps for ethical policy-making using the thematic analysis method. Based on the results of this study, the ethical policy-making steps in S&T include problem identification, information gathering and feeding of the policy process, policy advice and policy formulation, policy implementation, and policy evaluation, which follow 9 ethical principles and 13 policy principles. This article describes a new method of viewing a historical phenomenon based on its social significance. This method enabled the classification and analysis of a group in a context simultaneously and chronologically. Using historical phenomenology, the authors found a polarisation of Chinese Muslims' thoughts and practices in the Indonesian context. As an example, the technique of classification of Islamic thoughts is illustrated to discover Chinese Muslim figures' religious activities. This method allows an improved social investigation to probe deeply into Chinese (...) Muslims' formal religious life. The evaluation of the effectiveness of the new method is confirmed by the calculation of the polarisation of Chinese Muslim religiousness, leading to the fragmentation and diversification of Indonesian Chinese Muslims in the realms of politics, economic practices or Islamic rituals. New research results improve the understanding of how a social history of an ethnicity could grow and assimilate in a context. The assimilation could contribute to religious harmony in such a pluralistic country such as Indonesia and can be used for making better social decisions, especially related to the lives of minorities, who urgently need policymakers and stakeholders to accommodate the rights of those who are still in the process of gaining fairer recognition. CONTRIBUTION: Using historical phenomenology, this article tries to classify and study a group in a setting concurrently and chronologically. An in-depth social inquiry into the formal religious life of Chinese Muslims discovered a calculation of religious Chinese Muslims' polarisation, which led to the dispersion and diversification of Indonesian Chinese Muslims' politics, economic practices and Islamic rituals. New policy proposals can be made by evaluating religious polarisation. (shrink)

Previous studies have shown that sibling conflicts are detrimental to physical and psychological development, as well as long-term human development. Although many studies have discovered relations between parenting style and sibling conflicts, these findings were contentious and did not provide a universal solution. Therefore, the meta-analysis was used as the method to determine the nature and magnitude of the relationships. There were a total of 14,356 participants in the 16 included studies, from which 55 effect sizes were extracted. According to (...) the overall meta-analysis results, authoritative parenting did have the potential to reduce sibling conflicts. Neglectful, inconsistent, indulgent, and authoritarian parenting styles were related to sibling conflicts in a positive way. Moreover, the study investigated the effectiveness of several moderator variables, such as children’s gender, age, region, outcome measure, and publication year. The research indicates that authoritative parenting is a protective factor of sibling conflicts. Moderator analyses found that gender, age, region, outcome measure, and publication year played moderating roles in the relationships. The government of the State of Ohio determined to design several mandatory programs in regular classes to help NRC’s female in mates to prepare themselves upon their release back to the community; one of the programs is Islamic teaching. It is a chance to insert and implement the innovated peaceful Islamic propagation beside the conventional one, especially in western countries like the United States of America. The chance for an innovated dakwah is open upon observing that a lot of non- (...) Muslimah in mates were curious about Islam in an inter-religious meeting. The Arabic script classis not a part of mandatory NRC programs, it is voluntary for non- Muslimin mates designed and implemented by the author. They learn to write and pronounce the Arabic alphabet from “alif’ to ‘ya’ within six weeks. This free class is to support the government programs in order to reduce recidivism among in mates, and upon completing this class they are encouraged to attending the Islamic teaching class. This paper is qualitative research using a sociology approach. The data collection for this research is using participative observation, voluntary interview, and documentation; the collected data were analyzed in the descriptive-qualitative method. The effectiveness and efficacy of the research should be measured in a quantity of non- Muslimah in mates who gradually and peacefully convert to become Muslimah after attending the Arabic script class. The benchmark of effectiveness should be affirmed in mathematic formula i.e. the effectiveness is equal to the number of Muslimah converts divided by the total participant time 100; it is x 100 = 33.33%. Among 9 non- Muslimah participants of free Arabic script class,3 of them converted to be Muslimah. (shrink)

Muhammad Arsyad Al-Banjari who lived from 1710 to 1812 in Borneo, Indonesia, applied a model of integrating uses of the Banjarese tradition into Islamic Jurisprudence based on a dialectical constitution of qiyās, the legal argumentation theory for parallel reasoning and analogy, he learned from the Shāfi‘ī-school of jurisprudence (uṣūl al-fiqh). Our paper focuses in the model of integration proposed and practiced by Al-Banjari, a rational debate grounded on a dynamic view on legal systems. We will illustrate the method with the (...) help of two different kinds of qiyās deployed by Al-Banjari in order to argue for the rejection of some traditional Banjarese offering-rituals for avoiding disease or calamities (manyanggar and mambuang pasilih), and for the acceptance of the use of consuming the traditional drink called lahang made of the juice of sugar-palm. As our dialogical reconstruction shows, the development of the debates, particularly the first one, is quite sophisticated, with a Banjarese opponent that does not surrender easily to the rejection of his use of those rituals. The literature analysing Muslim perspective towards other religions is now quite extensive. However, when it comes to Muslim’s perspective towards Buddhism, the scholarship lags far behind. This article aimed to identify the Muslim views on Buddhism from a theological and philosophical framework. The Muslim views have a different category, on categorising Buddhism, the status of Buddha as a Prophet, and Buddhist as the People of the Book. Each view provides a different framework of Muslim perspective towards Buddhism. From the theological (...) view, one of the outlook is tolerance. Due to the rejection of Buddhist doctrine by most Muslim theologians, Muslims apply tolerance, which is subject to religious freedom stand on, ‘firm in principle, tolerant in attitude’. Tolerance encourages Muslims to adhere to the principles of truth, but does not erode the respect for other religion. While from a philosophical view, it considered Buddhism as a religion from God, as well as other religions. Thus, some Muslim inclusivists and pluralists recognise Buddhism. This research is qualitative. The method used in this research is descriptive-analytic, emphasising content analysis of the data from various books and articles covering Muslim view on Buddhism and the patterns of relations between Islam and Buddhism. Studies suggest the understanding of each framework to encourage Muslims to improve comprehensive interreligious dialogue with Buddhists.Contribution: Religious tolerance, inclusivism, and pluralism is a panacea to inordinate and incessant religious conflict, if given its proper place in Malaysia, it will breed harmony and peace in the society. The COVID-19 pandemic has deeply influenced the tourism and hospitality industry, and it has also reshaped people’s travel preferences and related behaviors. As a result, how prospective travelers perceive travel constraints and their effects on future travel behaviors may have changed to some extent. Besides, such perception arguably varies across gender. Therefore, this research examines the interplay between travel constraints, gender, and travel intentions for facilitating robust tourism recovery by revisiting the Leisure Constraints Model from a gender perspective. Data were (...) collected through a survey from 357 Malaysian prospective travelers. By conducting path analysis and multigroup analysis, it is found that structural and interpersonal constraints impose indirect effects on travel intentions, and gender moderating the effect of structural cost on intrapersonal constraints and effect of intrapersonal constraints on travel intentions. Based on these findings, this research provides theoretical and practical implications into how to adjust their marketing strategies and travel products during the era of “new normal” for tourism policy makers, destination marketers, and related businesses. The standard version of the doctrine of double effect, a significant doctrine in applied ethics particularly medical ethics, not only fails to capture some morally significant components of Aquinas’ view, but it does not resort to proper complementary features in order to accommodate the doctrine to our moral intuitions. We attempt to offer a new formulation of the doctrine incorporating the main components of Aquinas’ view and also to extend the view using some complementary features. The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. Our final words will discuss deontic-modal parallelism in the context of Ibn Ḥazm’s rejection of reasoning by conjecture and what we call “the internalization of nature.”. (shrink)

Muslim communities in the village facing the COVID-19 Pandemic attempts to find refuge from the plague and hope for survival. However, this led to more caution, which may lead to xenophobia. Via ethnography, this study unmasks the xenophobic attitude. This research discusses the root causes of panic in the community so that remedies can be implemented. The research attempts to explain, from a socio-anthropological viewpoint, how people and religious groups in the village perceive the pandemic of COVID-19 based on their (...) belief in their faith and in the science. The research takes place in Cigagak village, an area of approximately 7000 m2 on the outskirts of Bandung of West Java of Indonesia. This study examines the selected respondents from about 190 inhabitants who had close ties to managing places of worship and public places. This study utilises a collaborative self-ethnographic method and qualitative analysis. The influence of COVID-19 has moved to new exclusive and disintegrating practices from the inclusion-cohesive religious tradition. Therefore, this study tries to find out ways on how to reduce exclusive perception and religious practices to a minimum level and how to disappear xenophobia. Amid the COVID-19 Pandemic, inclusive awareness and actions were re-established, and even social cohesiveness was fostered. This study concludes that in its deep conviction nature, theology can change exclusive behaviour to be inclusive if it is based on the religious principles that are raised in response to human events. In this case, the Muslim community in a village can change the fear of COVID-19 pandemic to be a reducer of the panic based on the support of the religious doctrines.Contribution: This article used a collaborative self-ethnography with a religious socio-anthropological viewpoint. This study could help to solve social problems through theological convergence in Islamic milieu, especially that of the government’s formal Islamic organisation and organic Islamic leaders of the society. In this paper, we provide a detailed critical review of current approaches to ecthesis in Aristotle’s Prior Analytics, with a view to motivate a new approach, which builds upon previous work by Marion & Rückert (2016) on the dictum de omni. This approach sets Aristotle’s work within the context of dialectic and uses Lorenzen’s dialogical logic, hereby reframed with use of Martin-Löf's constructive type theory as ‘immanent reasoning’. We then provide rules of syllogistic for the latter, and provide proofs of (...) e-conversion, Darapti and Bocardo and e-subalternation, while showing how close to Aristotle’s text these proofs remain. One of the challenging problems in large scale cyber-argumentation platforms is that users often engage and focus only on a few issues and leave other issues under-discussed and under-acknowledged. This kind of non-uniform participation obstructs the argumentation analysis models to retrieve collective intelligence from the underlying discussion. To resolve this problem, we developed an innovative opinion prediction model for a multi-issue cyber-argumentation environment. Our model predicts users’ opinions on the non-participated issues from similar users’ opinions on related issues using intelligent (...) argumentation techniques and a collaborative filtering method. Based on our detailed experimental results on an empirical dataset collected using our cyber-argumentation platform, our model is 21.7% more accurate, handles data sparsity better than other popular opinion prediction methods. Our model can also predict opinions on multiple issues simultaneously with reasonable accuracy. Contrary to existing opinion prediction models, which only predict whether a user agrees on an issue, our model predicts how much a user agrees on the issue. To our knowledge, this is the first research to attempt multi-issue opinion prediction with the partial agreement in the cyber-argumentation platform. With additional data on non-participated issues, our opinion prediction model can help the collective intelligence analysis models to analyze social phenomena more effectively and accurately in the cyber argumentation platform. The field of enquiry into the phenomenon of language has long been dominated by the Computational-Representational (C-R) theories of language. This seems to be the most natural and plausible state of affairs, given the revolutionary impact that the advent of computers and the emergence of information technology have had in our lives lately. Noam Chomsky’s variant has been the most influential among such theories. However, there are certain conceptual issues pertaining to the very method, object and modality of the Chomskyan (...) project. In the present paper, I will try to locate these issues and contend that they arise from the peculiar conception of human embodiment involved in the propositions forming the Chomskyan scheme of language. They come to light only when engaged closely with from a phenomenological viewpoint. And this will be done in the first part. Once this is done, I will propose an alternative approach towards language, contained in the phenomenological insights on human embodiment and perception of the French phenomenologist Maurice Merleau Ponty. I will also hint at how befitting this alternative scheme is to the connectionist-neural network models of language, which are fast replacing the C–R models lately. (shrink)

Ojectives Low energy hip fractures are one of the greatest causes of morbidity and mortality in orthopaedics. This study aims to evaluate written consent forms with respect to basic standards as set out in the Good Practice in Consent Initiative. In particular the stated risks and benefits of each procedure were assessed. Methods 100 consecutive consent forms were reviewed prospectively. The stated procedure, side and complications were recorded. Appropriate signature and legibility was assessed. 13 consultant orthopaedic surgeons were surveyed to (...) identify what risks and benefits they thought should be stated. Results Of 100 consent forms, 31 were for patients who are unable to consent. All 100 consent forms were correctly filled in with patient details and signed. 98% were legible. All stated the side of the operation. The number of complications listed per form ranged from 4 to 11. Infection, bleeding and thromboembolic complications were stated in the majority of consent forms. In total, 30 different complications were recorded; some were only stated once. Discussion and Conclusions This work suggests consent forms are completed well with respect to patient identifiers, legibility and procedure. The variability of complications stated is vast. We suggest standard pre-printed consent forms containing risks and benefits should be used as this may improve standards of informed consent. Data analysis has become most widespread field of research and it has extended in almost every field of study. Considering the recent trends and developments in the field of communication and information technology, there is a scope of combining the monitoring of substation equipment with big data analysis technology. That will result in an improved data analysis ability, information sharing and utilization rate of monitoring data. In the proposed work, the authors have introduced the big data analysis and its corresponding (...) application in the monitoring of substations. Basic concepts and the procedures of the typical data analysis for general problems are also discussed. As a main part of the paper, different types of distributed data analysis techniques have been proposed, in which two relational online analysis, namely Hive and Impala and one H Base multidimensional online analysis are important. These data analysis techniques are proposed considering the analysis efficiency, storage performance from the business development requirements point of view of the substation. The result obtained depicts that the proposed model has an advantage in storage overhead and roll-up performance, when compared with the traditional method, although the data loading speed is approximately 1.7–1.9 times of the traditional model. The formalism of mathematics has always inspired ontological theorization based on it. As is evident from his magnum opus Being and Event, Alain Badiou remains one of the most important contemporary contributors to this enterprise. His famous maxim—“mathematics is ontology” has its basis in the ingenuity that he has shown in capitalizing on Gödel’s and Cohen’s work in the field of set theory. Their work jointly establish the independence of the continuum hypothesis from the standard axioms of Zermelo–Fraenkel set theory, (...) with Gödel’s result showing their consistency to the affirmative, while Cohen’s showing it to the negative. These results serve as the cornerstone of Badiou’s mathematical ontology. In it, drawing heavily on Cohen’s technically formidable method of forcing, Badiou makes the latter result the key to his defense of the possibility of a faithful tracing of the consequences in the ‘state’ of an ‘event’ by a ‘subject’. Whereas, Gödel’s result based on the assumption of constructability becomes the pivot for criticism of the general philosophical orientation that Badiou calls ‘constructivism’. Viewed from a position internal to mathematical formalism itself, and taking into account the twentieth century developments in the relevant field, Badiou’s stance seems to be neither appreciative of the actual course of such developments, nor just to the philosophical view point that was actually maintained by Gödel. In the present paper, this concern is intended to be substantiated through an exposition of certain facts pertaining to the said developments as well as to Gödel’s philosophical inclinations. The most prominent form of human communication and interaction is speech. It plays an indispensable role for expressing emotions, motivating, guiding, and cheering. An ill-intentioned speech can mislead people, societies, and even a nation. A misguided speech can trigger social controversy and can result in violent activities. Every day, there are a lot of speeches being delivered around the world, which are quite impractical to inspect manually. In order to prevent any vicious action resulting from any misguided speech, the development (...) of an automatic system that can efficiently detect suspicious speech has become imperative. In this study, we have presented a framework for acquisition of speech along with the location of the speaker, converting the speeches into texts and, finally, we have proposed a system based on long short-term memory which is a variant of recurrent neural network to classify speeches into suspicious and nonsuspicious. We have considered speeches of Bangla language and developed our own dataset that contains about 5000 suspicious and nonsuspicious samples for training and validating our model. A comparative analysis of accuracy among other machine learning algorithms such as logistic regression, SVM, KNN, Naive Bayes, and decision tree is performed in order to evaluate the effectiveness of the system. The experimental results show that our proposed deep learning-based model provides the highest accuracy compared to other algorithms. (shrink)

The problem of alienation has come to the focus of philosophical discourse in terms of cogito’s loss of immediacy with the body and intimacy with the world, ever since Descartes—the founding father of modern thought—had his famous meditations. Putting the problem of alienation at the focus of philosophy, how should this human situation be reflected upon and the problem be addressed or dissolved at the least? One thing is clear that the method of enquiry cannot be purely intellectual wherein the (...) subject–object dichotomy has to be rigorously maintained. Rather, it has to turn intuitive at some stage, so that human subjective consciousness could be given its due place in the enquiry and the interplay of it with and the embeddedness of it in the material reality be revealed and accounted for as well. Only such an approach would address the problem at hand. But one cannot remain very optimistic about Western philosophy in this endeavor, due to the reasons to be elaborated in present paper. It is in this context that an enquiry into other philosophical systems becomes relevant. In the Eastern philosophical traditions, the issue at hand is addressed more creatively. Particularly in the Advaita Vedanta school of Indian Philosophy, the problem of alienation is tackled in an original way by elevating altogether the ‘being of man’ to a different level by way of an existential blending of his intellectual and intuitive capacities. Precisely in the Taittiriya Upanishad, man’s true nature is formulated in tune with nature, giving it a unique existential thrust. This conception once elaborated seems to be capable of productively addressing the issue at hand. An attempt will be made in the paper, at elucidating this view. (shrink)

Background: Expenditure on industry products (mostly drugs and devices) has spiraled over the last 15 years and accounts for substantial part of healthcare expenditure. The enormous financial interests involved in the development and marketing of drugs and devices may have given excessive power to these industries to influence medical research, policy, and practice.Material and methods: Review of the literature and analysis of the multiple pathways through which the industry has directly or indirectly infiltrated the broader healthcare systems. We present the (...) analysis of the industry influences at the following levels: (i) evidence base production, (ii) evidence synthesis, (iii) understanding of safety and harms issues, (iv) cost-effectiveness evaluation, (v) clinical practice guidelines formation, (vi) healthcare professional education, (vii) healthcare practice, (viii) healthcare consumer’s decisions.Results: We located abundance of consistent evidence demonstrating that the industry has created means to intervene in all steps of the processes that determine healthcare research, strategy, expenditure, practice and education. As a result of these interferences, the benefits of drugs and other products are often exaggerated and their potential harms are downplayed, and clinical guidelines, medical practice, and healthcare expenditure decisions are biased. Conclusion: To serve its interests, the industry masterfully influences evidence base production, evidence synthesis, understanding of harms issues, cost-effectiveness evaluations, clinical practice guidelines and Healthcare professional education and also exerts direct influences on professional decisions and health consumers. There is an urgent need for regulation and other action towards redefining the mission of medicine towards a more objective and patient-, population- and society-benefit direction that is free from conflict of interests. During my (Hafiz) childhood in Bangladesh, I experienced the negative impact of the educational system. My experiences initiated a process of conscientization leading to values-driven activism through the establishment of Education for Development and Sustainability (EDS), a child-friendly community of practice, with Trine and Alamin. In encounters with Erling and Sigrid, we became aware that our activities were in accordance with action research based on cooperative inquiry (Heron & Reason, 2008). From that point of departure, we developed our own collaborative (...) living theory. In this paper, we explore the research question “How did we become action researchers and what is our driving force?” by using Stoller’s (1989) autobiographical narrative method to analyse selected, lived experiences. Sharing lived experiences and engaging in activism with each other and the EDS children became the base for our conscientization, radical empiricism and contemplating involvement in EDS. Value based activism can create empathic relations and emotions through shared engagement for social justice and the realization that we create a shared reality. Hence, conducting action research with children/youth is in our experience a key to sustainable development. However, to increase the transparency and validity of our research, we needed to explore how our experiences and actions have influenced our values, emotions and decisions to conduct research, our research topic and the research in itself. Therefore, we have engaged co-researchers and participants to critically question the research practice and made it open for discussion and comments in order to see alternative ways of interpreting situations and processes. COVID-19 has caused far-reaching humanitarian challenges. Amongst the emerging impacts of the pandemic is on the dynamics of human trafficking. This paper presents findings from a multi-methods study interrogating the impacts of COVID-19 on human trafficking in Sudan—a critical source, destination, and transit country. The analysis combines a systematic evidence review, semi-structured interviews, and a focus group with survivors, conducted between January and May of 2021. We find key risks have been exacerbated, and simultaneously, critical infrastructure for identifying victims, providing (...) support, and ensuring accountability of perpetrators has been impeded. Centrally, the co-occurrence of the pandemic and the democratic transition undercut the institutional and governance capacity, limiting the anti-trafficking response and exposing already vulnerable groups to increased risks of human trafficking. Findings point to increased vulnerabilities for individuals with one or more of the following identities: migrants, refugees, females, and informal labourers. (shrink)

The term non-governmental organisations (NGOs) has been well-known for the development of human rights, charity works and organisational developments. On the other hand, some NGOs also have their specialised roles to help the community such as in conflict resolution, cultural preservation, policy analysis and information provision. Apart from that, there are many categories of NGOs: Islamic-oriented non-governmental organisation (IONGOs), faith-based organisation (FBO), humanitarian NGOs (HNGOs) and government organised NGOs (GONGOs). However, in this research, the researchers focus on how IONGOs compare (...) with NGOs in assisting the lesbian, gay, bisexual, and transgender (LGBT) community based on four hijrah NGOs: Persatuan Islah Movement, Persatuan Insaf Pahang, Hijrah Republique Network and Usrah Iqrak. These four NGOs were chosen because of their roles in assisting the LGBT community. In this research, the researchers adapt the qualitative research by using a case study method; phenomenological approaches and a document analysis have also been applied as well. The result shows that these four IONGOs are different from the NGOs based on the seven typologies applied: intersection, distinct, substantive, subset, co-existing, atomistic grouping and constitutive. The implications of this article highlight the fact that IONGOs are different from the LGBT NGOs in Malaysia as they focus more on spirituality and an Islamic pathway. Hence, future research should include focus group interviews with all the members in NGOs that assist the LGBT hijrah in the community. Contribution: This study contributes to LGBT hijrah community and its relationship towards the establishment of Islamic-oriented non-governmental organisation (IONGOs). (shrink)

Background: Post-mortem needle biopsies have been used in resource-poor settings to determine cause of death and there is interest in using them in Bangladesh. However, we did not know how families and communities would perceive this procedure or how they would decide whether or not to consent to a post-mortem needle biopsy. The goal of this study was to better understand family and community concerns and decision-making about post-mortem needle biopsies in this low-income, predominantly Muslim country in order to design (...) an informed consent process. Methods: We conducted 16 group discussions with family members of persons who died during an outbreak of Nipah virus illness during 2004-2008 and 11 key informant interviews with their community and religious leaders. Qualitative researchers first described the post-mortem needle biopsy procedure and asked participants whether they would have agreed to this procedure during the outbreak. Researchers probed participants about the circumstances under which the procedure would be acceptable, if any, their concerns about the procedure, and how they would decide whether or not to consent to the procedure. Results: Overall, most participants agreed that post-mortem needle biopsies would be acceptable in some situations, particularly if they benefitted society. This procedure was deemed more acceptable than full autopsy because it would not require major delays in burial or remove organs, and did not require cutting or stitching of the body. It could be performed before the ritual bathing of the body in either the community or hospital setting. However, before consent would be granted for such a procedure, the research team must gain the trust of the family and community which could be difficult. Although consent may only be provided by the guardians of the body, decisions about consent for the procedure would involve extended family and community and religious leaders. Conclusions: The possible acceptability of this procedure during outbreaks represents an important opportunity to better characterize cause of death in Bangladesh which could lead to improved public health interventions to prevent these deaths. Obstacles for research teams will include engaging all major stakeholders in decision-making and quickly building a trusting relationship with the family and community, which will be difficult given the short window of time prior to the ritual bathing of the body. The researchers will be unable to collect data from all possible situations, which will preclude them from answering the study’s research questions in their current form. In light of the enormous number and variety of sampling techniques/methods available, the researcher must be knowledgeable about the differences to select the most appropriate sampling technique/method for the specific study under consideration. Social science researchers will benefit from this study since it will assist them in choosing the most suitable probability sampling technique for completing their research smoothly and successfully. Difficile de trouver auteur mieux placé que Hans-Georg Gadamer (1900-2002) pour présenter à la première personne une rétrospective de la pensée herméneutique. Ce livre est donc celui qu'il faut lire si l'on veut comprendre tout le sens de l'herméneutique et de Vérité et méthode. Gadamer y expose en effet ses inspirations proprement philosophiques comme il ne l'a fait nulle part ailleurs. Il part ici des travaux de jeunesse de son maître Heidegger afin d'introduire à ce qu'il appelle le " tournant (...) herméneutique ", dont son œuvre se veut l'un des aboutissements les plus conséquents. La puissante rétrospective qu'il propose ici nous aide à voir que " la phénoménologie, l'herméneutique et la métaphysique ne sont pas trois points de vue philosophiques différents, mais bien l'expression de ce qu'est la philosophie elle-même ". On peut remettre en question plusieurs schémas conceptuels utilisés par les historiens de l’herméneutique si l’on tient compte de l’histoire de traditions philosophiques qui ne devraient pas être négligées par ceux qui s’attachent à reconstruire le développement des notions et des méthodes herméneutiques. Centré sur la tradition aristotélicienne, cet article a pour but de montrer : 1) qu’entre le Moyen Âge et la Renaissance, le sens du terme latin interpretatio a sensiblement changé ; 2) que l’approche humaniste du corpus aristotélicien (...) se base sur le principe que tout auteur est le meilleur interprète de lui-même ; 3) que ce principe était formulé et discuté dans certains traités, négligés, qui portaient sur l’optima ratio interpretandi Aristotelem et furent publiés par Nuñez en 1554, Pascual en 1591 et Piccart en 1605. Heidegger a indiqué à plusieurs reprises l’importance particulière qu’a eue la doctrine husserlienne de l’intuition catégoriale à l’égard non seulement de son propre parcours philosophique, mais également et de façon plus générale pour la pensée phénoménologique en tant que telle. Comme Husserl l’avait fait avant lui, c’est la fonction méthodologique particulière et le rôle fondateur de la théorie des catégories que l’auteur d’ Être et temps met en avant à chaque fois qu’il revient sur son importance eu égard à la (...) découverte d’un champ d’analyse nouveau pour les recherches philo­sophiques, ouvert par la description phénoménologique. Cet article s’efforcera toutefois de montrer que Heidegger et Husserl ne célèbrent pas l’intuition catégoriale pour des raisons identiques. Derrière leur revendication commune du caractère fondamental et fondateur des analyses consacrées aux catégories dans la 6 e Recherche Logique de Husserl se cache une divergence fondamentale en ce qui concerne le sens de la méthode phénoménologique que cette théorie des catégories est censée fonder. L’analyse de l’usage fait par Husserl et Heidegger de la notion de catégories doit ainsi permettre de mettre en évidence la nature de ce désaccord opposant frontalement leur conception de la phénoménologie. Si l’intuition catégoriale doit constituer le « sol » nécessaire au type particulier d’herméneutique à laquelle doit nous conduire la méthode phénoménologique selon Heidegger, elle représente plutôt pour Husserl la « clé de voûte » garante de la solidité de la description phénoméno­logique des modes d’apparaître des choses, maintenant par-delà le raisonnement analogique qui en avait établi l’existence la tension irréductible devant opposer chez Husserl la sensibilité à l’entendement. Les lectures de Montaigne les plus fréquemment enseignées construisent quelques artefacts (un Montaigne anthropologue, un Montaigne centré sur son « moi », etc.) et soulignent le poids déterminant du contexte et de la biographie dans la production des Essais. Nous souhaitons compléter ces lectures en mettant en œuvre une méthode contextualiste empruntée à l’école de Cambridge : le sens d’une œuvre philosophique est donné par l’intention de l’auteur dans un contexte précis. Cette méthode inverse le statut que nous attribuons d’ordinaire (...) au contexte, celui d’un déterminant de l’œuvre, pour voir plutôt celui-ci comme quelque chose dont le travail d’écriture veut faire un déterminé. Produire un effet dans le contexte : c’est en cela que consiste l’intention performative de l’auteur, c’est-à-dire le sens de l’œuvre. Respecter le sens du texte, c’est donc restaurer la dynamique de l’émergence du sens, autrement dit le processus vivant d’écriture. Pour contribuer modestement à cette tâche, nous allons examiner successivement trois points : l’intention de Montaigne quant à la censure religieuse, son intention épistémique, son intention philosophique. Nous posons autrement dit comme hypothèse que ses pages sur les Indiens du Brésil s’expliquent en vertu de trois décisions latentes : éviter la censure, établir un savoir et exprimer une conception générale de la vie humaine. Le rapprochement des œuvres de Machiavel et de Bodin a déjà une longue histoire, à laquelle l’intention de cet article n’est pas d’ajouter un chapitre : il ne s’agit donc pas de proposer une lecture d’ensemble du rapport entre ces deux auteurs ou entre leurs doctrines générales, mais seulement de mettre en parallèle leurs conceptions d’une certaine méthode pour interpréter les histoires, conceptions qui se laissent lire d’une part dans l’épître dédicatoire et le proemio des Discorsi sopra la prima deca (...) di Tito Livio de Machiavel (ca. 1518) et d’autre part dans l’épître dédicatoire et le proemium de la Methodus ad facilem historiarum cognitionem de Bodin (1566). À un demi-siècle d’écart, ces deux prologues mettent en effet en évidence le caractère indispensable d’un art de la lectio des histoires pour fonder les raisonnements de la science politique, mais ils le font, semble-t-il, en adoptant deux points de vue profondément différents : la nature exacte de cette différence est le véritable objet de cet article. Martial Gueroult est exemplaire parmi les historiens français de la philosophie : ses travaux permettent d’étudier la divergence des dimensions de l’activité d’interprétation (commentaire, méthodologie, fondation). Cet article procède à une lecture de ses monographies emblématiques, essaie de comprendre la limitation du champ de leurs objets, se risque à une critique de l’idéalisme radical pour finalement expliquer que le manuscrit de la Dianoématique n’ait jamais été publié, sans pourtant que son auteur en désavoue l’intention : son principal défaut relevait d’une (...) contradiction théorique.
