Dynamic Consent is both a model and a specific web-based tool that enables clear, granular communication and recording of participant consent choices over time. The DC model enables individuals to know and to decide how personal research information is being used and provides a way in which to exercise legal rights provided in privacy and data protection law. The DC tool is flexible and responsive, enabling legal and ethical requirements in research data sharing to be met and for online (...) health information to be maintained. DC has been used in rare diseases and genomics, to enable people to control and express their preferences regarding their own data. However, DC has never been explored in relationship to historical collections of bioscientific and genetic heritage or to contexts involving Aboriginal and Torres Strait Islander people.In response to the growing interest by First Peoples throughout Australia in genetic and genomic research, and the increasing number of invitations from researchers to participate in community health and wellbeing projects, this article examines the legal and ethical attributes and challenges of DC in these contexts. It also explores opportunities for including First Peoples' cultural perspectives, governance, and leadership as a method for defining DC on cultural terms that engage best practice research and data analysis as well as respect for meaningful and longitudinal individual and family participation. The right of Australian Indigenous groups to own traditional lands has been a contentious issue in the recent history of Australia. Indeed, Aborigines and Torres Strait Islanders did not consider themselves as full citizens in the country they had inhabited for millennia until the late 1960s, and then only after a long campaign and a national referendum (1967) in favour of changes to the Australian Constitution to remove restrictions on the services available to Indigenous Australians. The concept of terra nullius, (...) misapplied to Australia, was strong in the popular imagination among the descendants of settlers or recent migrants and was not definitively put to rest until the Mabo decision (1992), which also established a firm precedent for the recognition of native title.This path to equality was fraught and made lengthy by the fact that the worldviews of the Indigenous Australians (i.e. Aborigines and Torres Strait Islanders) and the European (mainly British and Irish) settlers were so different, at least at a superficial level, this being the level at which prejudice is typically manifested. One area where this fact is particularly evident is in the area of the conceptualisation of property and especially the notion of land “ownership” and “use”.In this paper, we will focus on these terms, examining the linguistic evidence of some of the Australian languages spoken traditionally by Indigenous Australians as one means (the only one in many cases) of gaining an insight into their worldview, comparing it with that underlying the English language.We will show that the conceptualisations manifested in the two languages are contrasting but not irreconcilable, and indeed the ability of both groups of speakers (or their descendants in the case of many endangered Australian languages) to reach agreement and come to develop an understanding of the other’s perspective is reason for celebration for all Australians. Aboriginal Australians have traditionally enjoyed little protection from the law. The matter of land has been at the heart of white settler/Aboriginal relations since the nation was first founded. It is only recently that recognition has been given to the land rights of Australian indigenous people. This recognition was finally made at the property law level in 1992 through the High Court decision in Mabo v. Queensland (n. 2) ([1992] 175 CLR 1). The 1993 High Court (...) decision in The Wik Peoples v. Queensland ([1996] 71 ALJR 173) reinforced that recognition. It did so through the principle that pastoral lessees' and native title holders' rights might co‐exist except that, in the event of any inconsistency, the pastoralists' rights were to prevail, provided pastoral activity was being pursued. The most recent legal change is the parliamentary revision of the Native Title Act so that the Wik co‐existence principle was put to rest, mainly through permitting the State governments to upgrade pastoral holdings to a form of freehold, thus immunising them from native title claims, and minimising the payment of compensation. In this paper we argue that the country must consider what has been lost in this about‐turn from the recognition of native title to land in Mabo. We argue that the nation must consider the emphases in the Mabo judgments upon the significance of international law and the need for the common law not to be locked into a racist past. From that point, we contend for the need to recognise not only native title to land but what lies beyond that: indigenous political and human rights. (shrink)

Much controversy has existed over the claims of Native Americans and other indigenous peoples that they have a right—based on original occupancy of land, historical transfers of sovereignty, and principles of self-determination—to a political status separate from the states in which they now find themselves embedded. How valid are these claims on moral grounds? -/- Burke Hendrix tackles these thorny questions in this book. Rather than focusing on the legal and constitutional status of indigenous nations within the states now (...) ruling them, he starts at a more basic level, interrogating fundamental justifications for political authority itself. He shows that historical claims of land ownership and prior sovereignty cannot provide a sufficient basis for challenging the authority of existing states, but that our natural moral duties to aid other persons in danger can justify rights to political separation from states that fail to protect their citizens as they should. -/- Actual attempts at political separation must be carefully managed through well-defined procedural mechanisms, however, to foster extensive democratic deliberation about the nature of the political changes at stake. Using such procedures, Hendrix argues, indigenous peoples should be able to withdraw politically from the states currently ruling them, even to the point of choosing full independence. (shrink)

John Kinsella is an important literary witness to the acknowledgement of native title in Australia, and Indigenous rights more generally. His writings also bear witness to continuing forces of resistance to those rights in Australian society. This paper traces Kinsella’s engagement with the Mabo case, the 1992 legal decision that recognised native title as part of Australian law, and rejected the fiction that Australia was terra nullius at the time of British colonisation. Focusing on “Graphology: Canto 5” and other texts, (...) it argues that Kinsella presents a sustained reflection on the implications and the limits of this decision, in law and in wider cultural understandings and practices, through poetic allusions, paratexts and personal commentary. His writing since the mid-1990s reveals an acute awareness of how imported concepts of property and law are concealed within Western poetic traditions such as pastoral. To counter the effects of this ideology, Kinsella interpolates and appropriates terms from the discourse of property law, juxtaposing them against other ways of understanding and living in the land. In several collections, but especially in Jam Tree Gully, he seeks to develop an ethically reflective account of ownership of land taken from others, critiquing the dominant idea of property and articulating an alternative way of living in the land based on co-existence. The rights of the dispossessed traditional owners are central to a new mode of “writing the land.”. (shrink)

The Australian nature conservation movement is effectively entering its second century of existence and this transition has prompted a degree of reflection about the strategies used hitherto. After going through boom years – as part of a broader environmental movement – from the 1970s until the early 1990s, a more difficult political environment in the second half of the 1990s has sparked a semi-public discussion about priorities and future strategies. This article argues that the debate about future conservation strategies needs (...) to tackle two important legacies that have become increasingly problematic: a lingering 'frontier mentality' that fosters a separation between people and 'pristine nature'; and a heavy reliance on scientific expertise and rational arguments for conservation. This dual legacy has blinded the movement to the aesthetic appeal of the romantic philosophical tradition in ecology and the importance of sensuous, embodied experiences of the 'more than human' world. In rethinking the legacy of the romantic philosopher Henry David Thoreau, the article argues for a shift of emphasis from wilderness to wildness in order to bring conservation home to more people. It suggests that we can learn from the ability of Australian Aborigines to listen to the land in order to 'sing up' the stories that are embedded in landscapes. Learning to read and create landscape stories provides creative ways of building more affective bonds between people and the land. Non-rational approaches to nature conservation can help to re-enchant conservation ' work '. (shrink)

In this paper we provide a proof theoretical investigation of logical argumentation, where arguments are represented by sequents, conflicts between arguments are represented by sequent elimination rules, and deductions are made by dynamic proof systems extending standard sequent calculi. The idea is to imitate argumentative movements in which certain claims are introduced or withdrawn in the presence of counter-claims. This is done by a dynamic evaluation of sequences of sequents, in which the latter are considered (...) ‘derived’ or ‘not derived’ according to the content of the sequence. We show that decisive conclusions of such a process correspond to well-accepted consequences of the underlying argumentation framework. The outcome is therefore a general and modular proof-theoretical approach for paraconsistent and non-monotonic reasoning with argumentation systems. (shrink)

In [BAT 00b], the flat Rescher–Manor consequence relations — the Free, Strong, Argued, C-Based, andWeak consequence relation—were shown to be characterized by inconsistency-adaptive logics defined from the paraconsistent logic CLuN. This provided these consequence relations with a dynamic proof theory. In the present paper we show that the detour via an inconsistency-adaptive logic is not necessary. We present a direct dynamic proof theory, formulated in the language of Classical Logic, and prove its adequacy. Justice, Gender and the Politics of Multiculturalism explores the tensions that arise when culturally diverse democratic states pursue both justice for religious and cultural minorities and justice for women. Sarah Song provides a distinctive argument about the circumstances under which egalitarian justice requires special accommodations for cultural minorities while emphasizing the value of gender equality as an important limit on cultural accommodation. Drawing on detailed case studies of gendered cultural conflicts, including conflicts over the 'cultural defense' in criminal law, (...) class='Hi'>aboriginal membership rules and polygamy, Song offers a fresh perspective on multicultural politics by examining the role of intercultural interactions in shaping such conflicts. In particular, she demonstrates the different ways that majority institutions have reinforced gender inequality in minority communities and, in light of this, argues in favour of resolving gendered cultural dilemmas through intercultural democratic dialogue. The effects of colonisation including racism continue to impact negatively on Aboriginal health outcomes, despite being under‐recognised (...) and under‐reported. Many Aboriginal people find hospitals unwelcoming and are reluctant to attend for diagnosis and treatment, particularly with few Aboriginal health professionals employed on these facilities. In this paper, scientific literature and reports on Aboriginal health‐care, methodology and cross‐cultural education are reviewed to inform a collaborative model of hospital‐based organisational change. The paper proposes a collaborative model of care to improve health service delivery by building capacity in Aboriginal and non‐Aboriginal personnel by recruiting more Aboriginal health professionals, increasing knowledge and skills to establish good relationships between non‐Aboriginal care providers and Aboriginal patients and their families, delivering quality care that is respectful of culture and improving Aboriginal health outcomes. A key element of model design, implementation and evaluation is critical reflection on barriers and facilitators to providing respectful and culturally safe quality care at systemic, interpersonal and patient/family‐centred levels. Nurses are central to addressing the current state of inequity and are pivotal change agents within the proposed model. (shrink)

This paper addresses longstanding debates around changing patterns of farm ownership and structure on the North American plains. Over the last 150 years, the agrifood system has been transformed by a process of capitalist penetration through which non-farm capital has appropriated key links in the ‘food chain’. Today, large, often transnational corporations dominate in the provision of farm inputs, as well as in food processing, distribution, and retailing. The paradox for food system scholars has been that primary food production (...) (i.e., farming) has generally remained in the hands of independent, family-based operations, especially in the grains sector. This paradox has generated a substantial literature on the barriers to capitalist penetration in agriculture. I revisit these debates in light of two recent trends. First, I highlight the emergence of a class of farm family entrepreneurs comprised of very large, albeit family-owned, grain farming operations, in Saskatchewan. I provide a case study of a vertically integrated, family-based mega-farm to illustrate. Second, I discuss the implications of the launch of One Earth Farms, a corporate farming entity embodying altogether new strategies of land use, labor, and ownership. Structured as a partnership between a Toronto-based investment firm and nine First Nations bands, One Earth Farms brings together the interests of private investors who increasingly view agriculture as a profitable resource sector, and aboriginal communities hoping to redress the historical marginalization of First Nations farming. I interpret the significance of these new avenues of corporatization for “family farms” and prairie agricultural development. (shrink)

Anticipation is a crucial perceptual-cognitive skill in fast-ball sports, and the effect of high anxiety on performance has attracted more attention from sports psychologists. Related studies mainly focus on the effect of anxiety on influencing processing efficiency and attentional control during information processing in sport. Attentional Control Theory has been supported by several studies. However, these studies have been criticized by the low ecological validity of task design, such as neglecting the dynamic process of anticipation, and inadequate performance analysis, (...) such as analyzing response accuracy and time separately. Using temporal occlusion paradigm, we tested ACT in a dynamic anticipation process. Eighteen skilled and eighteen less-skilled table tennis players were required to anticipate the serves of opponents under dynamic task constraints and anxiety conditions. High cognitive state anxiety decreased processing efficiency for both groups whereas performance effectiveness did not differ. In addition, it negatively affected processing efficiency in early anticipation compared with late anticipation tasks, suggesting that high cognitive state anxiety may have a greater impact on top-down attentional control. Our findings provide support for ACT and show that anxiety impairs anticipation efficiency and performance, possibly due to an ineffectively attentional shift from external kinematic cues to internal long-term working memory. Findings also have implications for the adaptation of attentional strategies and anxiolytic training. (shrink)

In many high-income countries, agricultural land is highly concentrated in a few hands, but detailed knowledge of ownership structures is limited. We examined land ownership structures and agricultural land concentration for the entire state of Brandenburg, Germany (1.3 million ha), using cadastral and company network data. Our aim was to characterise all landowners, analyse the degree of ownership concentration, and examine the role of the largest landowners in more detail. We found a high fragmentation (...) of ownership among 185,000 different owners. Most of the land was owned by individuals not active in agriculture and only a third of the land was owned by farmers and other agricultural actors. Absentee ownership covered a quarter of the land. Ownership concentration was low to moderate in most regions and reached high levels in only a few areas. The largest owners were public institutions, private investors and nature protection institutions. Areas where public institutions owned a lot of land showed high concentrations, but also some areas where private landowners owned a lot of land. In summary, our analysis provides rare information on the concentration of agricultural land ownership in a large region. Such analysis facilitates better justification and design of policies that regulate agricultural land markets. (shrink)

Song in oscine birds relies upon the rare capacity of vocal learning. Transmission can be vertical, horizontal, or oblique. As a rule, memorization and production by a naïve bird are not simultaneous: the long-term storage of song phrases precedes their first vocal rehearsal by months. While a wealth of detail regarding songbird enculturation has been uncovered by focusing on the apprentice, whether observational learning can fully account for the ontogeny of birdsong, or whether there could also be an element of (...) active teaching involved, has remained an open question. Given the paucity of knowledge on animal cultures, I argue for the utility of an inclusive definition of teaching that encourages data be collected across a wide range of taxa. Borrowing insights from musicology, I introduce the Australian pied butcherbird into the debate surrounding mechanisms of cultural transmission. I probe the relevance and utility of mentalistic, culture-based, and functionalist approaches to teaching in this species. Sonographic analysis of birdsong recordings and observational data of pied butcherbird behavior at one field site provide evidence that I assess based on criteria laid down by Caro and Hauser, along with later refinements to their functionalist definition. The candidate case of teaching reviewed here adds to a limited but growing body of reports supporting the notion that teaching may be more widespread than is currently realized. Nonetheless, I describe the challenges of confirming that learning has occurred in songbird pupils, given the delay between vocal instruction and production, as well as the low status accorded to anecdote and other observational evidence commonly mustered in instances of purported teaching. As a corrective, I press for an emphasis on biodiversity that will guide the study of teaching beyond human accounts and intractable discipline-specific burdens of proof. (shrink)

Water has been a critical resource for Anangu peoples across the remote inland for millennia, underpinning their ability to live in low rainfall environments. Anangu biocultural knowledge of kapi developed in complex ways that enabled this resource to be found. Such biocultural knowledge included deep understandings of weather patterns and of species behavior. Kapi and its significance to desert-dwelling peoples can be seen in ancient mapping practices, whether embedded in stone as petroglyphs or in ceremonial song and dance practices associated (...) with the Tjukurpa. While in the past the sustainability of kapi was facilitated by mobility that spread human dependence on this resource across multiple sites, since the 1940s Anangu have been coerced by the settler-colonial state to live a sedentary lifestyle in remote communities such as Haasts Bluff, Papunya and Yuendemu. In many of these communities the supply of kapi is becoming increasingly insecure in terms of viability of supply, cost, quality and threats from mining. This paper provides a brief insight into how kapi has become devalued in the context of contemporary remote communities with particular reference to my area of expertise – Aboriginal identity, well-being and Australian sports. Linguistic justice is concerned with the just way of politically regulating linguistic diversity. Today, the linguistic-justice debate may be differentiated into three different domains: interlinguistic justice, intralinguistic justice, and global linguistic justice. Each of these domains has, to a significant extent, attracted different authors and debates, although the normative system underlying them is structurally similar. This introductory piece aims to provide context for our symposium dedicated to linguistic justice and migration by, first, giving an overview of linguistic justice, second, (...) linking linguistic justice to migration, and, finally, providing an overview of the various papers in the symposium, situating them against the background developed in the first two sections. ‘The Debauched Commons: A Dark Parable’ summarizes issues regarding intellectual property rights and immaterial culture through a nuanced reading of how First Nations Peoples worldwide have been forced by forms of neoliberal-capitalist exploitation of the knowledge commons to ring-fence and/or commodify their lived traditions, in many cases dating back 100,000 years and clearly predating any and all Western (First World) concepts of ownership. The intention of the structuralist-inspired reading of this enforced defensive position is to emphasize and clarify issues (...) concerning prior art and moral rights, two of the most ambiguous and gamed elements of copyright and patent law. Drawing upon the international context of the _Declaration on the Rights of Indigenous Peoples_ (2007) and the _Convention for Safeguarding Intangible Heritage_ (2003), this essay will focus, in part, on the travails of Aboriginals in Australia as representative of First Peoples worldwide and their long-exploited and long-expropriated traditions, inclusive of land, but foremost _lived knowledge_, but also their often compromised position _vis-à-vis_ various Australian state and Commonwealth legislation concerning recognition of their copyright, moral rights, and intellectual property rights. In this complex dance between tradition, heritage, and law, the so-called public domain often also becomes a de facto warehouse for the eventual conversion of intangible rights to collectively held and stored cultural property, which is then leveraged and/or converted to cultural capital by both public institutions and private companies. The primary premise of the analytic to be applied is that commodification of knowledge is more or less co-equal to the digitization of culture and the regimes of expropriation and/or outright theft associated with platform cultures. Platform culture, in turn, implicates otherwise benign, or apparently benign institutions (for example, academia and the art world) claiming to advance understanding and resolution of the twin nemeses of post-contemporary cultural politics—diversity and justice. The subtle machinations of what has come to be called the art-academic industrial complex will thus be analyzed for implicit and explicit practices that are reducible to the appropriation of native rites and rights, and laws and lores, for self-serving reasons inclusive of radical-chic posturing and politically correct tokenism. Despite the many successes of the relativistic quantum theory developed by Horwitz et al., certain difficulties persist in the associated covariant classical mechanics. In this paper, we explore these difficulties through an examination of the classical. Coulomb problem in the framework of off-shell electrodynamics. As the local gauge theory of a covariant quantum mechanics with evolution paratmeter τ, off-shell electrodynamics constitutes a dynamical theory of ppacetime events, interacting through five τ-dependent pre-Maxwell potentials. We present a straightforward solution of the classical (...) equations of motion, for a test event traversing the field induced by a “fixed” event (an event moving uniformly along the time axis at a fixed point in space). This solution is seen to be unsatisfactory, and reveals the essential difficulties in the formalism at the classical levels. We then offer a new model of the particle current—as a certain distribution of the event currents on the worldline—which eliminates these difficulties and permits comparison of classisical off-shell electrodynamics with the standard Maxwell theory. In this model, the “fixed” event induces a Yukawa-type potential, permitting a semiclassical identification of the pre-Maxwell time scale λ with the inverse mass of the intervening photon. Numerical solutions to the equations of motion are compared with the standard Maxwell solutions, and are seen to coincide when λ≳10−6 seconds, providing an initial estimate of this parameter. It is also demonstrated that the proposed model provides a natural interpretation for the photon mass cut-off required for the renormalizability of the off-shell quantum electrodynamics. (shrink)

The pattern, process, and mechanism of residential heterogeneity vary significantly with different geographical scales. However, most traditional methods ignore the checkboard and modifiable areal unit problem, which may cover up the complexity and hierarchy of social space. Taking Hangzhou city as an example, a multiscalar method was proposed based on the information entropy theory to estimate residential heterogeneity and its scale sensitivity. Based on the sixth population census of Hangzhou and the housing price database of 6,536 residential districts from 2008 (...) to 2018, we explore the scale effect and dynamic characteristics of residential heterogeneity. The results of spatial simulation and geostatistical analysis based on Python Spatial Analysis Library module show that the multiscalar algorithm better presents the real segregation pattern than traditional method, which is one of the new models and technologies in urban geography complex system. Exploring residential heterogeneity through multiscalar lens provides an important basis for the gradual and refined urban renewal. (shrink)

The present article provides an analysis of the existing proof systems for dynamic epistemic logic from the viewpoint of proof-theoretic semantics. Dynamic epistemic logic is one of the best known members of a family of logical systems that have been successfully applied to diverse scientific disciplines, but the proof-theoretic treatment of which presents many difficulties. After an illustration of the proof-theoretic semantic principles most relevant to the treatment of logical connectives, we turn to illustrating (...) the main features of display calculi, a proof-theoretic paradigm that has been successfully employed to give a proof-theoretic semantic account of modal and substructural logics. Then, we review some of the most significant proposals of proof systems for dynamic epistemic logics, and we critically reflect on them in the light of the previously introduced proof-theoretic semantic principles. The contributions of the present article include a generalization of Belnap's cut-elimination metatheorem for display calculi, and a revised version of the display-style calculus D.EAK. We verify that the revised version satisfies the previously mentioned proof-theoretic semantic principles, and show that it enjoys cut-elimination as a consequence of the generalized metatheorem. In the context of a covariant mechanics with Poincaré-invariant evolution parameter τ, Sa'ad, Horwitz, and Arshansky have argued that for the electromagnetic interaction to be well posed, the local gauge function of the field should include dependence on τ, as well as on the spacetime coordinates. This requirement of full gauge covariance leads to a theory of five τ-dependent gauge compensation fields, which differs in significant aspects from conventional electrodynamics, but whose zero modes coincide with the Maxwell theory. The pre-Maxwell (...) fields may exchange mass with charged particles, permitting pair annihilation even at the classical level. The total mass-energy-momentum tensor of the fields and particles is conserved. The Green's functions for the fields provide spacelike and timelike support for correlations, as well as lightlike propagation. A τ-integration of the fields—singling out the massless photons—recovers the standard Maxwell theory, which then has the character of an equilibrium limit of the underlying microscopic dynamics. The pre-Maxwell theory also turns out to be the solution of the inverse problem in variational mechanics: it is shown to be the most general local gauge theory consistent with unconstrained commutation relations in four dimensions. Posed in this framework, the extension to n-dimensions, curved background space, and non-abelian gauge symmetry becomes straightforward. (shrink)

Many students ask, 'What is the point of learning formal logic?' This book gives them the answer. Using the methods of deductive logic, Nelson Lande introduces each new element in exquisite detail, as he takes students through example after example, proof after proof, explaining the thinking behind each concept. Shaded areas and appendices throughout the book provide explanations and justifications that go beyond the main text, challenging those students who wish to delve deeper, and giving instructors the (...) option of confining their course to the basics, or expanding it, when they wish, to more rigorous levels. Lande encourages students to think for themselves, while at the same time providing them with the level of explanation they need to succeed. It is a rigorous approach presented in a style that is informal, engaging, and accessible. Students will come away with a solid understanding of formal logic and why it is not only important, but also interesting and sometimes even fun. Through a close study of T. Yunkaporta's 2019’s Sand Talk, this article explores fractal thinking and the pattern of creation in Indigenous cosmology; the role of custodianship in respectful interaction between living systems; alternative Indigenous understandings of nonlinearity, time, and transience; the process-panpsychism and animism present in Indigenous perceptions of cosmos as living Country, illustrated in the Dreaming and Turnaround creation event; the role of embodied cognition and haptic and situated knowledge in Indigenous science; Indigenous holistic reasoning and the mind-body (...) connection; the process-relational metaphysic embedded in ritual and yarning practice; the knowledge encoded in place-based totemic mythology, lore, and ritual; and Indigenous understandings of complex systems as adaptive, self-organizing, and patterned. This article does not offer a process reading of Indigenous thought but rather demonstrates the significant contribution to process metaphysics that may be provided by an Aboriginal Australian perspective. Yunkaporta's text carves out a language of resistance to the McDonaldization of Indigenous research. While historic scholarly engagement with Aboriginal culture has overemphasized content, Yunkaporta demonstrates how this has occurred to the exclusion of the processes of Indigenous knowledge transmission and creation. Yet a process view requires engagement with the how, not only with the what. Such knowledge transmission is discerned in daily lived relationships among land, spirit, and people—binding epistemology to participation in a specific landscape embedded within a living culture. Place-making for Indigenous knowledges requires exploring how Indigenous ways of valuing, knowing, and being, shaped by cultural activities on Country, offer new understandings for Western metaphysics. Multinational enterprises (MNEs) must often address moral conflicts given their responsibilities to meet conflicting demands from diverse stakeholders in transnational operations. Thus, this study constructs a comprehensive theoretical framework to understand the co-evolution between MNEs’ ambidexterity strategies and moral conflicts by incorporating studies on institutional theory and strategic management. Through a longitudinal case study, we find that the balance of three dimensions of ambidexterity strategies influences the content and intensity of MNEs’ moral conflicts by shaping the dual structure of stakeholders (...) from home and host countries. Further, moral conflicts reshape the balance of ambidexterity strategies by the pressure of legitimacy and performance. Hence, to achieve better performance in transnational operations, MNEs must not only pay attention to the contingent ambidexterity strategies in dynamic environments, but also leverage the fitness among different dimensions of ambidexterity strategies. In relativistic classical and quantum mechanics with Poincaré-invariant parameter, particle worldlines are traced out by the evolution of spacetime events. The formulation of a covariant canonical framework for the evolving events leads to a dynamical theory in which mass conservation is demoted from a priori constraint to the status of conserved Noether current for a certain class of interactions. In pre-Maxwell electrodynamics—the local gauge theory associated with this framework —events induce five local off-shell fields, which mediate interactions between instantaneous events, (...) not between the worldlines which represent entire particle histories. The fifth field, required to compensate for dependence of gauge transformations on the evolution parameter, enables the exchange of mass between particles and fields. In the equilibrium limit, these pre-Maxwell fields are pushed onto the zero-mass shell, but during interactions there is no mechanism regulating the mass that photons may acquire, even when event trajectories evolve far into the spacelike region. This feature of the off-shell formalism requires the application of some ad hoc mechanism for controlling the photon mass in two opposite physical domains: the low energy motion of a charged event in classical Coulomb scattering, and the renormalization of off-shell quantum electrodynamics. In this paper, we discuss a nonlocal, higher derivative correction to the photon kinetic term, which provides regulation of the photon mass in a manner which preserves the gauge invariance and Poincaré covariance of the original theory. We demonstrate that the inclusion of this term is equivalent to an earlier solution to the classical Coulomb problem, and that the resulting quantum field theory is renormalized. (shrink)

This book discusses major milestones in Rohit Jivanlal Parikh’s scholarly work. Highlighting the transition in Parikh’s interest from formal languages to natural languages, and how he approached Wittgenstein’s philosophy of language, it traces the academic trajectory of a brilliant scholar whose work opened up various new avenues in research. This volume is part of Springer’s book series Outstanding Contributions to Logic, and honours Rohit Parikh and his works in many ways. Parikh is a leader in the realm of ideas, offering (...) concepts and definitions that enrich the field and lead to new research directions. Parikh has contributed to a variety of areas in logic, computer science and game theory. In mathematical logic his contributions have been in recursive function theory, proof theory and non-standard analysis; in computer science, in the areas of modal, temporal and dynamic logics of programs and semantics of programs, as well as logics of knowledge; in artificial intelligence in the area of belief revision; and in game theory in the formal analysis of social procedures, with a strong undercurrent of philosophy running through all his work.This is not a collection of articles limited to one theme, or even directly connected to specific works by Parikh, but instead all papers are inspired and influenced by Parikh in some way, adding structures to and enriching “Parikh-land”. People are adept at perceiving interactions from movements of simple shapes, but the underlying mechanism remains unknown. Previous studies have often used object movements defined by experimenters. The present study used aerial videos recorded by drones in a real-life environment to generate decontextualized motion stimuli. Motion trajectories of displayed elements were the only visual input. We measured human judgments of interactiveness between two moving elements and the dynamic change in such judgments over time. A hierarchical model was developed to (...) account for human performance in this task. The model represents interactivity using latent variables and learns the distribution of critical movement features that signal potential interactivity. The model provides a good fit to human judgments and can also be generalized to the original Heider–Simmel animations. The model can also synthesize decontextualized animations with a controlled degree of interactiveness, providing a viable tool for studying animacy and social perception. (shrink)

A famous theorem by van der Waerden states the following: Given any finite coloring of the integers, one color contains arbitrarily long arithmetic progressions. Equivalently, for every q,k, there is an N = N(q,k) such that for every q-coloring of an interval of length N one color contains a progression of length k. An obvious question is what is the growth rate of N = N(q,k). Some proofs, like van der Waerden's combinatorial argument, answer this question directly, while the topological (...) proof by Furstenberg and Weiss does not. We present an analysis of (Girard's variant of) Furstenberg and Weiss's proof based on monotone functional interpretation, both yielding bounds and providing a general illustration of proof mining in topological dynamics. The bounds do not improve previous results by Girard, but only—as is also revealed by the analysis—because the combinatorial proof and the topological dynamics proof in principle are identical. A provocative defense of a forgotten Chinese approach to identity and difference Historically, the Western encounter with difference has been catastrophic: the extermination and displacement of aboriginal populations, the transatlantic slave trade, and colonialism. China, however, took a different historical path. In Chinese Cosmopolitanism, Shuchen Xiang argues that the Chinese cultural tradition was, from its formative beginnings and throughout its imperial history, a cosmopolitan melting pot that synthesized the different cultures that came into its orbit. Unlike the West, which (...) cast its collisions with different cultures in Manichean terms of the ontologically irreconcilable difference between civilization and barbarism, China was a dynamic identity created out of difference. The reasons for this, Xiang argues, are philosophical: Chinese philosophy has the conceptual resources for providing alternative ways to understand pluralism. Xiang explains that “Chinese” identity is not what the West understands as a racial identity; it is not a group of people related by common descent or heredity but rather a hybrid of coalescing cultures. To use the Western discourse of race to frame the Chinese view of non-Chinese, she argues, is a category error. Xiang shows that China was both internally cosmopolitan, embracing distinct peoples into a common identity, and externally cosmopolitan, having knowledge of faraway lands without an ideological need to subjugate them. Contrasting the Chinese understanding of efficacy—described as “harmony”—with the Western understanding of order, she argues that the Chinese sought to gain influence over others by having them spontaneously accept the virtue of one’s position. These ideas from Chinese philosophy, she contends, offer a new way to understand today’s multipolar world and can make a valuable contribution to contemporary discussions in the critical philosophy of race. Collectivisation, as a socio-innovation, is an incremental part of history that has much to teach on questions of asset commoning. Such notions can provide renewed perspectives in understanding today’s peer-to-peer (p2p) economy and its influence on housing ownership models, which are constituting new forms of domesticity. This study understands domesticity as processes of collectivisation and de-collectivisation, and questions its conceptualisation as universal and invariant. It compares the transitioning moments by which a new governing body is instituted within recent-historical (...) Chinese-Asian contexts, including mainland China, Taiwan, Hong Kong, and Singapore. These moments were often postcolonial, full of changes, uncertainty, crisis, and anticipation; these contexts were unprecedented in scale, density, and cultural collision; in common, these were junctures of socio-innovation in land distribution that fashioned different forms of citizenry. By looking at these instances of innovation with situated thinking and against their historical–cultural backgrounds, the findings in this study reflect on the design of socio-technological systems, the potential consequences of our design interventions, and what “innovation” may mean given the complexity of transitional challenges. Putting together cosmopolitan and vernacular histories, the historiography presented is a collage of card game narratives, archived posters, news headlines, statistical figures, and literature. This journey through events of socio-innovation from the twentieth century till recent decades reveals how the history of governance has always been a question of cultivating collective actions, one way or another, and today’s p2p economy is simultaneously collectivising and fractionalising such socio-economic exchanges in digital citizenry. We present a Hilbert style axiomatization and an equational theory for reasoning about actions and capabilities. We introduce two novel features in the language of propositional dynamic logic, converse as backwards modality and abstract processes specified by preconditions and effects, written as \({\varphi \Rightarrow \psi}\) and first explored in our recent paper (Hartonas, Log J IGPL Oxf Univ Press, 2012), where a Gentzen-style sequent calculus was introduced. The system has two very natural interpretations, one based on the familiar relational (...) semantics and the other based on type semantics, where action terms are interpreted as types of actions (sets of binary relations). We show that the proof systems do not distinguish between the two kinds of semantics, by completeness arguments. Converse as backwards modality together with action types allow us to produce a new purely equational axiomatization of Dynamic Algebras, where iteration is axiomatized independently of box and where the fixpoint and Segerberg induction axioms are derivable. The system also includes capabilities operators and our results provide then a finitary Hilbert-style axiomatization and a decidable system for reasoning about agent capabilities, missing in the KARO framework. The central feature of traditional Aboriginal religion which is reiterated throughout Australia, in spite of regional variations and the vastness of this continent is the Dreaming and its integral link between humans, land, and all that lives on the land. Variously referred to as Dreamtime, Eternal Dreamtime and, the Law, the Dreaming is the sacred knowledge, wisdom and moral truth permeating the entire beingness of Aboriginal life, derived collectively from Dreaming events performed by the creative ancestors. (...) In this paper I shall review interpretations of this thing called the Dreaming and pursue an alternative one. This alternative is that the Dreaming can be interpreted as a subliminal reality that Aborigines can tap into through various means. As a working paradigm I shall use the theoretical perspectives of Schutz and the mutual tuning‐in relationship, as well as Csikszentmihalyi s notion of "flow." On 1 December 2019, over one hundred Aboriginal nations performed ancestral and creation dances in synchrony across the Australian continent. One of the communities that danced was the Anaiwan nation from the north-eastern region of New South Wales, Australia. Since 2014 I have been working with Anaiwan people in a collaborative activist research project, creating and maintaining an Aboriginal community garden on the fringes of my hometown of Armidale as a site for land reclamation and decolonising, multispecies (...) research. The community garden is adjacent to the site of the old East Armidale Aboriginal Reserve, where over one hundred dispossessed Aboriginal people were forced to live on the municipal town garbage depot in the mid-twentieth century. This paper positions both the Nation Dance 2019 movement, and the Armidale Aboriginal Community Garden, as rhythmic events that activate Aboriginal Law and sovereignty that is held enduring in the land but that has been buried alive by the settler-colonial state. Focusing on the tensions between deep Indigenous ancestral temporality and colonial territoriality, I argue that the emergence of the Anthropocene reveals a dangerous dissonance between the rhythms of Aboriginal Law patterned through present-day Australian environments and the grid-based structures of colonial governance imposed upon them. Drawing on expectancy theory, this study explains how founders’ succession intentions might influence family firms’ environmental environments. Using a nationally representative sample of Chinese private firms, we find that family firms make more environmental investments when founders have succession intentions. We also find that the relationship between founders’ succession intentions and family firms’ environmental investments is negatively moderated by the founders’ subjective social status. Moreover, the results show that, compared with ownership succession intentions, the positive role of founders’ management (...) succession intentions on family firms’ environmental investments is more prominent. This study helps us to better understand the impact of succession intentions on family business decision-making from a psychological perspective. It enriches the research on succession intentions and provides practical implications for family firms’ sustainable development. (shrink)

This thesis provides an analysis of the existing proof systems for dynamic epistemic logic from the viewpoint of proof-theoretic semantics. After an illustration of the basic principles of proof-theoretic semantics, we review some of the most significant proposals of proof systems for dynamic epistemic logics, and we critically reject on them in the light of proof-theoretic semantic principles. The main original contributions of the present thesis are: (a) a revised version of the display-style (...) calculus D.EAK, which we argue to be more adequate from the proof-theoretic semantic viewpoint; the main feature of this revision is that a smoother proof (so-called Belnap-style) of cut-elimination holds for it, which is problematic for the original version of D.EAK. (b) The intro duction of a novel, multi-type display calculus for dynamic epistemic logic, which we refer to as Dynamic Calculus. The presence of types endows the language of the Dynamic Calculus with additional expressivity, and makes it possible to design rules with an even smoother behavior. We argue that this calculus paves the way towards a general methodology for the design of proof systems for the generality of dynamic logics, and certainly for proof systems beyond dynamic epistemic logic. We prove that the Dynamic Calculus adequately captures Baltag-Moss-Solecki's dynamic epistemic logic, and enjoys Belnap-style cut elimination. (shrink)

As concerns heighten over links between biomass production and land grabs in the global south, attention is turning to understanding the role of governance of biofuels systems, whereby decision-making and conduct are not solely determined through government regulations but increasingly shaped by non-state actors, including multi-stakeholder initiatives. Launched in 2005, Bonsucro is the principal MSI that focuses on sustainability standards for sugar and sugarcane ethanol production. Bonsucro claims that because it is free from government interference and draws on scientific (...) metrics, their standards transcend localized, political–economic contexts. In this paper, we illustrate how the local context shapes the prospects for Bonsucro sustainably certified biofuel production in relation to land and water grabs. To accomplish this, our case focuses on Colombia, which has used a range of national policy mandates to establish itself as one of the larger producers of agrofuels in Latin America. We draw on interviews with stakeholders in the sugar and ethanol industries, paired with an examination of Bonsucro principles on land rights and water use, to illustrate how the sugar industry is framing their participation in Bonsucro, and the effects of the increasing intensification of sugarcane for ethanol production on land and water access for communities. We find that within the context of Colombia, efforts such as Bonsucro provide a veil of legitimacy and authority to a system that is premised on deeply entrenched historical patterns of inequitable land ownership patterns and access to natural resources. A combination of epistemic logic and dynamic logic of programs is presented. Although rich enough to formalize some simple game-theoretic scenarios, its axiomatization is problematic as it leads to the paradoxical conclusion that agents are omniscient. A cut-free labelled Gentzen-style proof system is then introduced where knowledge and action, as well as their combinations, are formulated as rules of inference, rather than axioms. This provides a logical framework for reasoning about games in a modular and systematic way, and (...) to give a step-by-step reconstruction of agents omniscience. The principle of publicity is one of the fundamental principles of property law: property rights should be made public in order to inform third parties about the existence of the property right and its holder and thereby to foster legal certainty and efficiency. The publicity of ownership in immovable property is achieved through registration of ownership in the public register. However, the problem arises because of the unavoidable discrepancies between the data contained in the public register and the (...) factual situation. Different states choose different models to solve the practical problems arising out of the aforementioned discrepancies. On the one hand, Lithuania belongs to the group of states that implement the so-called declaratory system of registration, i.e. the transfer of ownership is based on an agreement or other legal grounds and the registration is not mandatory but provides the transfer with a third-party effect. This can be seen as a proof of priority of a factual situation over the registered data. On the other hand, Lithuanian laws provide the data of the register with some positive reliance, i.e. third parties are not only protected from claims arising out of unregistered rights (negative reliance), but they can also rely on the transcripts in the register. This is especially true in the case of bona fide transferee of immovable property which with some minor exceptions acquires ownership even from a non-owner, if the latter honestly relied on the data of the register. This regulatory framework is further adopted and transformed by the case law of the Lithuanian courts. The analysis of the latter shows that courts are inclined to rely more on the factual situation and easily deny the meaning of the registered rights. In various ways, the concept of the bona fide transferee is restricted and there are instances of positive duties ascribed to them. Besides, the existing case law demonstrates equivocal attitude towards the legal effects of registered data. Such tendencies of case law may hinder the rule of positive reliance and cause greater legal uncertainty. (shrink)

In this dissertation we present proof systems for several modal logics. These proof systems are based on analytic (or semantic) tableaux. -/- Modal logics are logics for reasoning about possibility, knowledge, beliefs, preferences, and other modalities. Their semantics are almost always based on Saul Kripke’s possible world semantics. In Kripke semantics, models are represented by relational structures or, equivalently, labeled graphs. Syntactic formulas that express statements about knowledge and other modalities are evaluated in terms of such models. -/- (...) This dissertation focuses on modal logics with dynamic operators for public announcements, belief revision, preference upgrades, and so on. These operators are defined in terms of mathematical operations on Kripke models. Thus, for example, a belief revision operator in the syntax would correspond to a belief revision operation on models. -/- The ‘dynamic’ semantics of dynamic modal logics are a clever way of extending languages without compromising on intuitiveness. We present ‘dynamic’ tableau proof systems for these dynamic semantics, with the express aim to make them conceptually simple, easy to use, modular, and extensible. This we do by reflecting the semantics as closely as possible in the components of our tableau system. For instance, dynamic operations on Kripke models have counterpart dynamic relations between tableaux. -/- Soundness, completeness, and decidability are three of the most important properties that a proof system may have. A proof system is sound if and only if any formula for which a proof exists, is true in every model. A proof system is complete if and only if for any formula that is true in all models, a proof exists. A proof system is decidable if and only if any formula can be proved to be a theorem or not a theorem in a finite number of steps. All proof systems in this dissertation are sound, complete, and decidable. -/- Part of our strategy to create modular tableau systems is to delay concerns over decidability until after soundness and completeness have been established. Decidability is attained through the operations of folding and through operations on ‘tableau cascades’, which are graphs of tableaux. -/- Finally, we provide a proof-of-concept implementation of our dynamic tableau system for public announcement logic in the Clojure programming language. Hetmans’ donations to the Orthodox Church were characteristic of the religious and political culture of the Cossack state already in the era of its emergence in the mid-17th century. In addition to other gifts, hetmans confirmed or provided Orthodox monasteries with land ownership, which was at the center of identity, power, and social prestige. It is clear that certain concrete motives, expectations, and models of behavior stood behind the hetmans’ donations of land. This article suggests considering hetmans’ (...) donations of land to the Orthodox Church as an element of symbolic communication, in which the giver and the recipient interacted, built symbolic communicative ties, and produced centers of communication. The focus is on “communication through donations,” that is, relationships of giving. Religious motivations and the recognition of monasteries as powerful centers of prayer were determinative for the hetmans’ “communication through donations” to the monasteries. The hetmans’ giving land and other real estate to monasteries was based on “piety,” but it was done in the name of Christ-loving rulers. So, in such donations it is quite natural that state interests were prevalent, but also there were complex combinations of religious, social, and political motivations and expectations. These characteristics were evident both in a general sense and in each specific instance of gifting. (shrink)

Aboriginal Australians have an intrinsic relationship to Country, kinship and community. The processes related to colonisation have decimated traditional lifestyles, ecology and even families. The challenge for energy engineers lies in the ability to reconcile the profession of engineering with the contemporary and traditional cultural and physical needs of Aboriginal people. A discussion around Aboriginal peoples’ most deeply held values will be linked to both global and professional ethical canons. This discussion has implications for Aboriginal and (...) Indigenous peoples globally. A fictitious case study—the ‘Warrigal Downs Energy Hub’—provides us with a hypothetical project to which we can link both examples and frameworks. Our team of Aboriginal and non-Aboriginal educators and engineers provides us with a right, wrong and even better way to work sensitively, meaningfully and reciprocally with Aboriginal people in Australia and, indeed, globally. It is the contention of this paper that some progress in alleviating the social and environmental problems which are beginning to face Papua New Guinea can be achieved by supporting traditional Melanesian values through maintaining the customary system of communal land tenure. In accordance with this aim, I will proceed to contrast certain Western attitudes towards individual freedom, selfinterested behaviour, individual and communal interests and private ownership with attitudes and values expressed in the traditional Melanesian approach. In order (...) to demonstrate the latter, I will briefly touch upon the phenomenon of wantokism and indicate how the Melanesian values associated with this concept find their locus in the system of customary communal ownership. Subsequently, I will describe how the emergence of a cash economy and the attachment to Western gadgetry and products have effected injury to the environment and undermined values which have previously maintained Melanesian social cohesion. While admitting that little can be done to eradicate the desire for cash and the products it can buy, I suggest that Melanesian communities and the environment itself would receive more protection if future development in Papua New Guinea embraced a system which incorporated certain of the traditional Melanesian values through the preservation of the communal form of land tenure. Ultimately, I suggest a way in which customary communal land tenure can be integrated into the established Anglo-Australian legal system. (shrink)

Ownership is an important identity marker. It provides people with a sense of autonomy, rootedness and opportunity. This essay examines the oral submissions of civil organisations to the Joint Constitutional Review Committee about the issue of land expropriation without compensation. The discussion pays specific attention to the philosophical understandings of land and identity that emerged during the hearings. Three dominant trajectories came into play, namely land as commodity, land as social space and land as (...) spiritual inheritance. Some submissions espoused more than one view, which indicates that the boundaries between the identified paradigms are permeable. However, even those presentations tended to prioritise one approach above the others. Besides identifying the main approaches to land and identity, this essay also provides an immanent critique of their moral assumptions. In contrast to a transcendental approach, an immanent critique asks questions from 'within' and evaluates paradigms in terms of their plausibility, universal applicability, ethical consistency and moral integrity. This thesis is on information dynamics modeled using *dynamic epistemic logic*. It takes the simple perspective of identifying models with maps, which under a suitable topology may be analyzed as *topological dynamical systems*. It is composed of an introduction and six papers. The introduction situates DEL in the field of formal epistemology, exemplifies its use and summarizes the main contributions of the papers.Paper I models the information dynamics of the *bystander effect* from social psychology. It shows how augmenting the (...) standard machinery of DEL with a decision making framework yields mathematically self-contained models of dynamic processes, a prerequisite for rigid model comparison.Paper II extrapolates from Paper I's construction, showing how the augmentation and its natural peers may be construed as maps. It argues that under the restriction of dynamics produced by DEL dynamical systems still falls a collection rich enough to be of interest. Paper III compares the approach of Paper II with *extensional protocols*, the main alternative augmentation to DEL. It concludes that both have benefits, depending on application. In favor of the DEL dynamical systems, it shows that extensional protocols designed to mimic simple, DEL dynamical systems require infinite representations. Paper IV focuses on *topological dynamical systems*. It argues that the *Stone topology* is a natural topology for investigating logical dynamics as, in it, *logical convergence* coinsides with topological convergence. It investigates the recurrent behavior of the maps of Papers II and III, providing novel insigths on their long-term behavior, thus providing a proof of concept for the approach.Paper V lays the background for Paper IV, starting from the construction of metrics generalizing the Hamming distance to infinite strings, inducing the Stone topology. It shows that the Stone topology is unique in making logical and topological convergens coinside, making it the natural topology for logical dynamics. It further includes a metric-based proof that the hitherto analyzed maps are continuous with respect to the Stone topology. Paper VI presents two characterization theorems for the existence of *reduction laws*, a common tool in obtaining complete dynamic logics. In the compact case, continuity in the Stone topology characterizes existence, while a strengthening is required in the non-compact case. The results allow the recasting of many logical dynamics of contemporary interest as topological dynamical systems. (shrink)

Presently, Australian art histories do not adequately account for the existence of Aboriginal art. They tend to re-present and accentuate European constructions of difference, otherness and isolation, rather than explore sites of intersection or look for similarities. A radical readjustment of perspective is needed in order to address this imbalance. This article suggests that although Smith’s writing on Aboriginal art does not provide a suitable basis for this revision, his evaluation of European visual culture during the early (...) exploration of the Pacific might form a useful starting point for an art historical reassessment of the relationship between Aboriginal and Australian art. We present a dynamic approach to Peirce’s original construal of abductive logic as a logic of conjecture making, and provide a new decidable, contraction-free and cut-free proof system for the dynamic logic of abductive inferences with neighborhood semantics. Our formulation of the dynamic logic of abduction follows the philosophical and scientific track that led Peirce to his late, post-1903 characterization of abductive conclusions as investigands, namely invitations to investigate propositions conjectured at the level of pre-beliefs.

In recent years, new forms of transnational regulation have emerged, filling the void created by the failure of governments and international institutions to effectively regulate transnational corporations. Among the variety of initiatives addressing social and environmental problems, a growing number of certification systems have appeared in various sectors, particularly agrifood. Most initiatives rely on independent third-party certification to verify compliance with a standard, as it is seen as the most credible route for certification. The effects of third-party audits, however, still (...) need to be empirically investigated. This article provides a critical assessment of the notion of ‘evidence’ which is at the heart of auditing practices. It focuses on the case of the Roundtable on Sustainable Palm Oil (RSPO) and fieldwork carried out in Indonesia, the world’s largest producer of palm oil. In this country, some non-governmental organizations decided to participate in the RSPO in order to use this platform to tackle the issue of land conflicts. They managed to include important clauses regarding indigenous and land rights in the RSPO standard. In practice, however, auditors rarely recognize as valid evidence the forms of proof put forward by local communities. As a result, the whole process risks compounding local power imbalances. (shrink)
