Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

Clinical red blood cell transfusion guidelines have been widely adopted in clinical practice, resulting in standardized transfusion practices in hospitalized patients with anemia. Standardization of transfusion practice has been welcomed by clinicians and health systems as a mechanism for reducing unnecessary, harmful, and costly practice variation that results in healthcare disparities. However, overzealously applied guidelines can have deleterious consequences for individual patients, ultimately resulting in and/or exacerbating healthcare disparities, rather than resolving them. This article provides empirical examples of the adverse (...) consequences from the well-meaning attempt to standardize transfusion practice based on clinical practice guidelines and discusses the ethical implications of standardized transfusion practice. The practice of surgery requires consideration of a number of specific aspects of clinical medical ethics that are different from those most influential in other areas of medical care. The nature of surgical care alters the sense of responsibility that surgeons feel for their actions and also alters the relationship between surgeons and patients. Because surgical care requires patients to place such great trust in their surgeons, surgical informed consent must emphasize the importance of that trust. Surgeons must use innovative (...) means to solve individual patient problems even if the result is a novel operation. Surgical procedures may be altered due to the unexpected findings in the operating room and therefore surgeons must have considered how to respond in such situations. The future of surgical practice will inevitably lead to increasing ethical concerns in maintaining the ethical dimension of surgery, in allowing autonomy for trainees while maintaining patients’ safety, and in balancing surgical risks of prophylactic surgery with the genetic predisposition to develop cancer. Clinical trials emerged in rapid succession as the COVID-19 pandemic created an unprecedented need for life-saving therapies. Fair and equitable subject selection in clinical trials offering investigational therapies ought to be an urgent moral concern. Subject selection determines the distribution of risks and benefits, and impacts the applicability of the study results for the larger population. While Research Ethics Committees monitor fair subject selection within each trial, no standard oversight exists for subject selection across multiple trials for the same disease. (...) Drawing on the experience of multiple clinical trials at a single academic medical centre in the USA, we posit that concurrent COVID-19 trials are liable to unfair and inequitable subject selection on account of scientific uncertainty, lack of transparency, scarcity and, lastly, structural barriers to equity compounded by implicit bias. To address the critical gap in the current literature and international regulation, we propose new ethical guidelines for research design and conduct that bolsters fair and equitable subject selection. Although the proposed guidelines are tailored to the research design and protocol of concurrent trials in the COVID-19 pandemic, they may have broader relevance to single COVID-19 trials. (shrink)

The commitment of transplant physicians to protect the physical and psychological health of potential donors is fundamental to the process of living donor organ transplantation. It is appropriate that strict regulations to govern an individual’s decision to donate have been developed. Some may argue that adherence to such regulations creates a doctor-patient relationship that is rooted in paternalism, which is in drastic contrast with a doctor-patient relationship that is rooted in patients’ autonomy, characteristic of most other operative interventions.In this article (...) we analyze the similarities between cosmetic plastic surgery and living donor surgery as examples of surgeries governed by different ethical principles. It is interesting that, while the prevailing ethical approach in living donor surgery is based on paternalism, the ethical principle guiding cosmetic surgery is respect for patients’ autonomy. The purpose of this article is not to criticize either practice, but to suggest that, given the similarities between the two procedures, both operative interventions should be guided by the same ethical principle: a respect for patients’ autonomy. We further suggest that if living organ donation valued donors’ autonomy as much as cosmetic plastic surgery does, we might witness a wider acceptance of and increase in living organ donation. The ambition of this article is to propose a way of visualizing the Anthropocene dialectically. As suggested by the Dutch atmospheric chemist Paul Crutzen and the professor of biology Eugene F. Stoermer, the term Anthropocene refers to a historical period in which humankind has turned into a geological force that transforms the natural environment in such a way that it is hard to distinguish between the human and the natural world. Crutzen and Stoermer explain that the Anthropocene has begun after (...) the Holocene, the geological epoch that followed the last ice age and lasted until the industrial revolution. Shannon Shipp argues for the Modified Vendetta Sanction as a method of corporate-collective punishment. He claims that this sanction evades the difficulties of Peter French's Hester Prynne Sanction. In this paper I argue that, though the Modified Vendetta Sanction evades the problems that Shipp poses for it, it fails to evade some of the difficulties that I pose for French's method. Moreover, there are some difficulties that plague the Modified Vendetta Sanction which do not count against the Hester Prynne (...) Sanction. Therefore, if my analysis holds, then Shipp's method neither improves significantly on the Hester Prynne Sanction nor is unproblematic in its own right. The significance of this paper is that it foils yet another attempt by some corporate punishment theorists to establish the plausibility of a method of corporate-collective punishment. (shrink)

This volume features a critical evaluation of the recent work of the philosopher, Prof. Raimo Tuomela and it also offers it offers new approaches to the collectivism-versus-individualism debate. The standard view in social science and philosophy is that lying does not require the liar’s assertion to be false, only that the liar believes it to be false. We conducted three experiments to test whether lying requires falsity. Overall, the results suggest that it does. We discuss some implications for social scientists working on social judgments, research on lie detection, and public moral discourse.

Researchers have debated whether there is a relationship between a statement’s truth-value and whether it counts as a lie. One view is that a statement being objectively false is essential to whether it counts as a lie; the opposing view is that a statement’s objective truth-value is inessential to whether it counts as a lie. We report five behavioral experiments that use a novel range of behavioral measures to address this issue. In each case, we found evidence of a relationship. (...) A statement’s truth-value affects how quickly people judge whether it is a lie. When people consider the matter carefully and are told that they might need to justify their answer, they are more likely to categorize a statement as a lie when it is false than when it is true. When given options that inhibit perspective-taking, people tend to not categorize deceptively motivated statements as lies when they are true, even though they still categorize them as lies when they are false. Categorizing a speaker as “lying” leads people to strongly infer that the speaker’s statement is false. People are more likely to spontaneously categorize a statement as a lie when it is false than when it is true. We discuss four different interpretations of relevant findings to date. At present, the best supported interpretation might be that the ordinary lying concept is a prototype concept, with falsity being a centrally important element of the prototypical lie. (shrink)

In this paper we consider conditional random quantities (c.r.q.’s) in the setting of coherence. Based on betting scheme, a c.r.q. X|H is not looked at as a restriction but, in a more extended way, as \({XH + \mathbb{P}(X|H)H^c}\) ; in particular (the indicator of) a conditional event E|H is looked at as EH + P(E|H)H c . This extended notion of c.r.q. allows algebraic developments among c.r.q.’s even if the conditioning events are different; then, for instance, we can give a (...) meaning to the sum X|H + Y|K and we can define the iterated c.r.q. (X|H)|K. We analyze the conjunction of two conditional events, introduced by the authors in a recent work, in the setting of coherence. We show that the conjoined conditional is a conditional random quantity, which may be a conditional event when there are logical dependencies. Moreover, we introduce the negation of the conjunction and by applying De Morgan’s Law we obtain the disjoined conditional. Finally, we give the lower and upper bounds for the conjunction and disjunction of two conditional events, by showing that the usual probabilistic properties continue to hold. (shrink)

Limited health literacy is a pervasive and independent risk factor for poor health outcomes. Despite decades of reports exhibiting that the healthcare system is overly complex, unneeded complexity remains commonplace and endangers the lives of patients, especially those with limited health literacy. In this article, we define health literacy and describe the empirical evidence associating health literacy and poor health outcomes. We recast the issue of poor health literacy from within the ethical perspective of the least well-off and argue that (...) poor health outcomes deriving from limited health literacy ought to be understood as a fundamental injustice of the healthcare system. We offer three proposals that attempt to rectify this injustice, including: universal precautions that presume limited health literacy for all healthcare users; expanded use of technology supported communication; and clinical incentives that account for limited health literacy. We study probabilistically informative (weak) versions of transitivity by using suitable definitions of defaults and negated defaults in the setting of coherence and imprecise probabilities. We represent p-consistent sequences of defaults and/or negated defaults by g-coherent imprecise probability assessments on the respective sequences of conditional events. Moreover, we prove the coherent probability propagation rules for Weak Transitivity and the validity of selected inference patterns by proving p-entailment of the associated knowledge bases. Finally, we apply our results to study selected probabilistic (...) versions of classical categorical syllogisms and construct a new version of the square of opposition in terms of defaults and negated defaults. We generalize, by a progressive procedure, the notions of conjunction and disjunction of two conditional events to the case of n conditional events. In our coherence-based approach, conjunctions and disjunctions are suitable conditional random quantities. We define the notion of negation, by verifying De Morgan’s Laws. We also show that conjunction and disjunction satisfy the associative and commutative properties, and a monotonicity property. Then, we give some results on coherence of prevision assessments for some families of compounded conditionals; in particular (...) we examine the Fréchet-Hoeffding bounds. Moreover, we study the reverse probabilistic inference from the conjunction Cn+1 of n + 1 conditional events to the family {Cn,En+1|Hn+1}. We consider the relation with the notion of quasi-conjunction and we examine in detail the coherence of the prevision assessments related with the conjunction of three conditional events. Based on conjunction, we also give a characterization of p-consistency and of p-entailment, with applications to several inference rules in probabilistic nonmonotonic reasoning. Finally, we examine some non p-valid inference rules; then, we illustrate by an example two methods which allow to suitably modify non p-valid inference rules in order to get inferences which are p-valid. In this study, we explore the relation between scientific literacy and unwarranted beliefs. The results show heterogeneous interactions between six constructs: conspiracy theories poorly interact with scientific literacy; there are major differences between attitudinal and practical dimensions of critical thinking; paranormal and pseudoscientific beliefs show similar associations ; and, only scientific knowledge interacts with other predictor of unwarranted beliefs, such as ontological confusions. These results reveal a limited impact: science educators must take into account the complex interactions between the dimensions (...) of scientific literacy and different types of unwarranted beliefs to improve pedagogical strategies. Starting from a recent paper by S. Kaufmann, we introduce a notion of conjunction of two conditional events and then we analyze it in the setting of coherence. We give a representation of the conjoined conditional and we show that this new object is a conditional random quantity, whose set of possible values normally contains the probabilities assessed for the two conditional events. We examine some cases of logical dependencies, where the conjunction is a conditional event; moreover, we give the (...) lower and upper bounds on the conjunction. We also examine an apparent paradox concerning stochastic independence which can actually be explained in terms of uncorrelation. We briefly introduce the notions of disjunction and iterated conditioning and we show that the usual probabilistic properties still hold. (shrink)

Metz holds that we can use African communal ethics to constitute global economic practices such as appropriation, production, distribution and consumption in such a way that promotes harmonious relations. In this article, I will show that Metz’s reformist approach to constituting the global economic practices is problematic as it fails to deal with the fundamental problem that pertains to a racialised world order that is structurally configured by coloniality of being. I will show that reformist approaches such as Metz’s use (...) of African communal ethics to constitute global economic practices in a way that promotes harmonious relations are undesirable attempts that are opposed and curtailed by a structural racialised logic/ontology of the world that governs and supervises the evolution of the world economic structures and practices in a way which undermines harmonious relations and in a way which causes economic marginalisation and impoverishment of historically disadvantaged indigenous Africans. Contrario al imaginario político, económico y cultural europeo de fines del siglo XVIII y comienzos del siglo XIX, que vio en la Revolución haitiana un acontecimiento que directa o indirectamente repercute en las transformación geopolítica global, en los discursos abolicionistas y en la flujos comerciales a través del Atlántico, Hegel parece (...) en principio desatender la especificidad del proceso, aunque, como sostenemos en este contexto, es posible rastrear los motivos de una exclusión deliberada que responder a una ideas precisas de libertad y terror que anteceden, y por tanto determinan, el lugar de la Revolución haitiana en la historia mundial. Over and above the modalities with which it is expressed in the domains of Kant’s system, the theme of cosmopolitanism embodies the meaning of a philosophy seen as a plan to build on the connection between man, polis and reason; an essential connection that in human reason identifies not a simple endowment which everyone has by nature but a form of life to be realized in the world, a purpose whose binding strength is only fully expressed in the public dimension.

A standard view in social science and philosophy is that a lie is a dishonest assertion: to lie is to assert something that you think is false in order to deceive your audience. We report four behavioral experiments designed to evaluate some aspects of this view. Participants read short scenarios and judged several features of interest, including whether an agent lied. We found evidence that ordinary lie attributions can be influenced by aspects of audience uptake, are based on judging that (...) the agent made an assertion (assertion attributions), and, at least in some contexts, are not based on attributions of deceptive intent. The finding on assertion attributions is predicted by the standard view, but the finding on intent attributions is not. These results help to further clarify the ordinary concept of lying and shed light on the psychological processes involved in ordinary lie attributions and related judgments. (shrink)

This paper presents an introductory overview of the main issues that the digitalisation of industrial enterprises known as Industry 4.0 raises for social sciences. First, it will show that this technological transition—which, however, is unfinished and is seen to be in continuity with the so-called “third industrial revolution”—cannot be interpreted with reference to a deterministic approach. It can be analysed more usefully as a range of decisions affecting the industrial policies of national states, the conception and design of machines, their (...) adoption in production processes and finally their use by operators. Second, certain aspects of Industry 4.0 of special concern in terms of organisation of work processes will be analysed on various scales. Finally, we will explain various hypotheses that social and economic research is developing with regard to the new technologies’ controversial effects on employment. (shrink)

Thomas Sankara was 33 years old when he seized power in a bloodless coup. During the four years of his governance, he organized adult literacy campaigns and mass vaccination of children, promoted women's rights and fought corruption as well as desertification caused by inappropriate agricultural practices introduced during the colonial period. Within two years, child mortality and illiteracy dropped significantly and vaccination coverage increased. Beyond these quantitative results, Sankara firmly believed that the decolonization of his country started from the formation (...) of the conscience of citizens, from learning to “rely on themselves” – materially and psychologically – and from the abandonment of a logic of technological and financial dependence that generated hunger and debt. To achieve his goals, he launched campaigns to “consume Burkinabè,” to plant trees and preserve rainwater in areas affected by desertification. (shrink)

Abstractabstract:Karl Marx’s acerbic observation in the opening lines of The Eighteenth Brumaire that “all facts and personages of great importance in world history occur the first time as tragedy, the second as farce” may be profitably applied to a reconsideration of literary farce sui generis, a genre represented in this article by a long-neglected work of utopian fiction, Archibald Marshall’s Upsidonia (1915). Although Upsidonia’s current disregard is arguably undeserved, the article’s chief interest is not to reclaim the novel on aesthetic (...) grounds but to illuminate the mechanics of what Marx would call its “serious buffoonery.” In its persistent reversal of capitalist principles and relations, Upsidonia naturally invites readers to revisit Marx, whose mordant gambit may serve as a key to Marshall’s own farcical plot and praxis, rooted in return and repetition, the essential maneuvers of farce itself. We study the decidability problem for metric and layered temporal logics. The logics we consider are suitable to model time granularity in various contexts, and they allow one to build granular temporal models by referring to the "natural scale" in any component of the model and by properly constraining the interactions between differently-grained components. A monadic second-order language combining operators such as temporal contextualization and projection, together with the usual displacement operator of metric temporal logics, is considered, and the theory (...) of finitely-layered metric temporal structures is shown to be decidable.
