This is a lucid and comprehensive introduction to, and critical assessment of, Ronald Dworkin's seminal contributions to legal and political philosophy. His theories have a complexity, originality, and moral power that have excited a wide range of academic and political thinkers, and even those who disagree with him acknowledge that his ideas must be confronted and given serious consideration. His enormous output of books and papers and his formidable profusion of lectures and seminars throughout the world, in addition to his (...) teaching duties at Oxford and New York University, have made him a giant figure in contemporary thought. In short, Dworkin's theory of law is that the nature of legal argument lies in the best moral interpretation of existing social practices. His theory of Justice is that all political judgements ought to rest ultimately upon the injunction that people are equal as human beings, irrespective of the circumstances in which they are born. Dworkin does not fit into an orthodox category. his theory of law is radical in that it sees legal argument primarily about rights yet conservative in seeing it as constrained by history. He is libertarian both in valuing ambition and in asserting a right to pornography, yet socialist in believing that no person has a right to a greater share of resources than anyone else. in particular, he advocates a system that would tax people on the resources they accumulate solely through their talent alone. Because Dworkin writes for a number of audiences - sometimes the general public, sometimes academic lawyers, sometimes philosophers and economists - it is often difficult to identify the different strands of his thought. The book aims to make his theories clear and accessible and to give an overall picture of his thinking that is sympathetic yet rigorously argued. (shrink)

These excellent volumes show both the strengths and weaknesses of contemporary and serious Dworkin scholarship . Mostly the articles are new, although Susan Hurley's paper in the Hershowitz volume was first published in 1990. As to be expected with work on Dworkin, the division between political and legal theory is not distinct because – as is well-known – he integrates moral problems of politics both into the choice of legal theory and legal argument itself. But, some issues may be separated (...) and since there are excellent essays on both equality of resources and the relevance of ‘intrinsic’ values, I have separated my discussion into the two heads of ‘legal theory’ and ‘political theory’. Work on his political theory is not as advanced as it is on his legal theory and so I have largely directed my attention to the latter. I conclude that the most profitable work with Dworkin's legal theory lies in exploring the idea of the ‘interpretive concept’ and its connection with moral ideals, and in assessing the moral weight of integrity, particularly against the ideals of justice and fairness. Almost all the essays on legal theory show awareness of difficulties concerning these two issues although no one takes on interpretivism directly . However, Stephen Perry and Dale Smith in the Hershowitz volume and Sanford Levinson in the Ripstein volume push the boundaries some way with integrity. (shrink)

This article theorises how home altars can support healing, individuation and personal transformation. It is informed by theory pertaining to Jungian sandplay therapy and Donald Winnicott’s ideas about transitional space and the holding environment. The methodology is grounded in a critical reflexive autobiographical approach that illustrates how altarplay can support the practitioner when negotiating a difficult shift from Christian to postchristian space.

This article defends the conclusion that the soccer World Cup in Qatar should not be boycotted by rich countries from the Global North. This conclusion is underpinned by considerations about the economic background conditions in guest workers’ home countries. Three arguments are considered for the view that the World Cup should be boycotted. It is argued that each of these arguments is unsound. Section 7 contains a discussion of an argument for a boycott that centers on the process through which (...) Qatar was awarded the World Cup. This argument is rejected. The article lists several ways in which guest workers in Qatar are wronged, but this fact about how guest workers are treated does not justify a boycott by rich countries from the Global North. IMAGINING and remembering, two of the most frequent and fundamental acts of mind, have long been unwelcome guests in most of the many mansions of philosophy. When not simply ignored or over-looked, they have been considered only to be dismissed. This is above all true of imagination, as first becomes evident in Plato’s view that the art of making exact images tends to degenerate into the making of mere semblances. Kant, despite the importance he gives to imagination in the first (...) edition of The Critique of Pure Reason, nevertheless considers images to be lowly "monograms" that are unruly and thus untrustworthy. In more recent times, Sartre, who is nearly as ambivalent as Kant on the subject, has stressed imagination’s "essential poverty"—its character as "debased thought"—while Ryle, in covert counterpoint, has attempted to conceive imagining as parody and pretense: as mere make-believe. But the speaker is patently drawing a contrast not between ‘real fish’ and something that resembles fish, as LSJ (...) would have it, but between a type of fish that any sensible person would buy for dinner, should the opportunity arise, and radishes, which are edible but unexciting fare. So too at Macho 28–32, when King Ptolemy's guests were served a variegated rockfish, three κωβιοί cut into steaks, and καράβων … ἀληθινῶν —literally ‘real crayfish’—they were astonished and delighted. The reaction suggests that the banqueters were happy because the crayfish Ptolemy served matched the quality of the other seafood he set before them, not because the king had declined to deceive them. A special issue of Philosophical Studies containing selected papers from the 1999 meeting of the Pacific Division American Philosophical Association (Elizabeth S. Radcliffe, guest editor).

The purpose of this study was to build upon previous ethical research; thereby, advancing the hospitality industry's understanding of ethical decision making in lodging operations. In particular, this study reviewed: (a) the primary normative ethical precepts (i.e., egoism, benevolence, and principle) used as a criterion in ethical decision making, and (b) the predominant locus of analysis (e.g., individual, local, or cosmopolitan referent sources) used in applying ethical precepts to ethical decisions.The sample consisted of 500 lodging operations as randomly abstracted from (...) the 1994 Hotel Travel Index produced by Reed Travel. The researcher selected full service, limited service, or as rooms-only lodging operations throughout the United States. A full service property offered guest rooms, meeting rooms, and food and beverage services. A limited service property offered a continental breakfast, small meeting facilities, and guest sleeping rooms. A rooms-only property only offered guest rooms. This purposive sampling process resulted in 198 usable surveys. (shrink)

Domination and Sabotage is the fifth in a series of shorter works that have issued from his seminars at the University of Padua, all (...) published by Feltrinelli in the well-known series Opuscoli marxisti and all treating of the relation between advanced industrial society and proletarian revolution. The tract has enjoyed an extraordinarily wide circulation and has been hailed as a new Communist Manifesto. Its particular focus is on the question of Marxist method, and within that question its chief interest for the present reviewer is the secularized religious motif that runs through Negri’s thought. The idea behind this special theme journal issue was to continue the work we have started with the INBIOSA initiative (www.inbiosa.eu) and our small inter-disciplinary scientific community. The result of this EU funded project was a white paper (Simeonov et al., 2012a) defining a new direction for future research in theoretical biology we called Integral Biomathics and a volume (Simeonov et al., 2012b) with contributions from two workshops and our first international conference in this field in 2011. The initial impulse (...) for this effort was given a year earlier by a publication of one of the guest editors of this issue (Simeonov, 2010) in this journal. This time we wish to provide a broader forum and more space to elaborate in detail some of the most interesting concepts we have encountered in our discussions, as well as to invite some new contributions of particular interest in the field. Another goal we had in mind was to collect and review as many provocative perspectives as possible on the same key topic we are interested before making a decision to follow a more focused notion that would lead to a funded research program. Therefore we welcomed the generous suggestion of Professor Denis Noble, FRS, who is also editor of this journal to prepare a special theme issue entitled: “Can biology create a profoundly new mathematics and computation?” It has taken a while to invite and collect the contributions. Most of them had a couple of revision cycles and adjustments after having been thoroughly discussed with colleagues, incl. the editors of this issue. We think that the result we have obtained at the end is a satisfactory one, since we succeeded to integrate a diversity of original, but sometimes controversial and mutually excluding concepts organized within chapters of a self-contained volume. The task of compiling all this was not easy at all. Despite our efforts to position the articles of different authors and themes in a way allowing their easy comprehension and relation to each other within the individual chapters, some of them still require a sort of introduction to dissolve possible ambiguities. This is what we are going to do in the following few paragraphs with the hope that the reader (and some of the authors) would excuse our failures. (shrink)

Continuing the exploration of a theme that has figured prominently in previous issues of this journal, articles translated for the present issue illuminate various aspects of the fate of philosophy in twentieth-century Russia. The development of philosophy in Russia has encountered extraordinary institutional obstacles for nearly two centuries. Following the Decembrist Revolt of 1825, the tsarist authorities banned the teaching of philosophy in university classrooms as a potential source of revolutionary ideas. The ban was partially modified in 1863 only to (...) permit commentary on certain specified texts of ancient philosophy and was not lifted until 1889. During the 1920s, the Bolsheviks in authority gradually enforced increasingly strict ideological controls on the teaching and publishing of philosophy, so that by the early 1930s no doctrine other than the Marxist-Leninist orthodoxy could be taught or advocated in print. Since our visual perception of physical things essentially involves our identifying objects by their colours, any theory of visual perception must contain some account of the colours of things. The central problem with colour has to do with relating our normal, everyday colour perceptions to what science, i.e. physics, teaches us about physical objects and their qualities. Although we perceive colours as categorical surface properties of things, colour perceptions are explained by introducing physical properties like reflectance profiles or dispositions to (...) cause certain experiences in normal human perceivers. Hence, it seems as if colours as they are experienced by us have no place in the physical world, because they are fundamentally different from the properties which we ascribe to physical objects in scientific accounts of colour perceptions.
