Mi meta en este trabajo es proponer un nuevo tipo de argumento en defensa del ideal deliberativo de reciprocidad de justificación —que fue inicialmente introducido por el liberalismo político de John Rawls—. Dicho argumento aspira a demostrar que, aun cuando aceptemos la hipótesis de que un grupo de ciudadanos dispone de una justificación pública apropiada para creer que determinada doctrina comprehensiva es verdadera o correcta, existen razones morales fundamentales para rechazar la pretensión de que el estado pueda estar justificado para (...) actuar sobre la base de esas creencias cuando las esencias constitucionales o cuestiones de justicia básica se encuentran en juego. El debate entre liberalismo y perfeccionismo ha sido uno de los ejes centrales de la Filosofía política durante los últimos veinte años. Este libro aspira a analizar críticamente y, en última instancia, a ofrecer una defensa del núcleo conceptual de la posicíon liberal. A lo largo del trabajo, se examina y discute una amplia serie de argumentos propuestos por filósofos contemporáneos "Rawls, Larmore, Barry, Kymlicka, Nagel y Ackerman, entre otros" en defensa de la neutralidad estatal. A su vez, se desarrollan (...) dos líneas de argumentacíon en defensa de las posiciones liberales que pretenden superar las falencias analizadas a lo largo del libro. La meta del primer argumento es demostrar que quien acepte las ideas fundamentales de la cultura política de las democracias contemporáneas deberá aceptar también las ideas básicas del liberalismo. Su punto de partida es una formulacíon del ideal ético-político de igual respeto por las personas y una reinterpretacíon y ampliacíon de lo que Rawls ha denominado las "cargas del juicio". El segundo argumento toma como punto de partida una idea arraigada en la tradicíon de pensamiento liberal: la necesidad de reconocer la falibilidad humana y sus consecuencias políticas y morales. El argumento combina la apelacíon a una premisa falibilista con una distincíon entre razones para afirmar una creencia y razones para estar justificado a actuar a partir de ella en contextos en los que cometer un error acarrearía un daño grave a terceros. Sobre esta base, se señala una serie de ventajas de las políticas que satisfacen los requisitos de justificacíon neutrales frente a las políticas perfeccionistas. (shrink)

El presente artículo propone algunas objeciones contra la concepción deliberativa de la democracia desarrollada por Carlos Nino. El blanco central de las objeciones es la tesis del filósofo argentino según la cual el valor del debate democrático derivaría, fundamentalmente, de sus virtudes epistémicas, es decir, de su capacidad para elevar las probabilidades de que el sistema político tome las decisiones correctas. Se cuestiona el modo en que el autor presenta su propuesta como una forma de superar las deficiencias que presentarían (...) las concepciones de John Rawls y Jürgen Habermas en el campo de la epistemología moral. Se intentará demostrar que el modelo de deliberación defendido por Nino no resulta aplicable a un contexto de pluralismo razonable filosófico, religioso y moral como el que resulta característico de las democracias liberales contemporáneas. Por último, se ofrece el esbozo de una concepción alternativa, práctica y moral, no epistémica, del valor de los procedimientos democráticos y de la naturaleza de la legitimidad política. This paper posits some objections against the deliberative conception of democracy developed by Carlos Nino. According to Nino, the value of democratic deliberation lies, basically, in its epistemic virtues. Public deliberation increases the probability that the political system will arrive at the correct decisions. We shall argue that the Argentinean philosopher fails to prove that his proposal is a solution to purported weaknesses in John Rawls’ and Jürgen Habermas’ positions in the field of moral epistemology. We shall try to demonstrate that the conception of deliberation posited by nino cannot be applied successfully in the context of moral, philosophical or religious reasonable pluralism that characterizes liberal contemporary democracies. Finally, we offer an outline of an alternative conception -practical and moral, non epistemic- of the value of democratic procedures and about the nature of political legitimacy. (shrink)

La meta del presente artículo es probar que existen contextos de acción en los que tiene lugar una escisión entre el conocimiento moral de los sujetos y la justificación, también moral, de sus acciones. Para que ello ocurra, según sostendremos, deben darse al menos dos condiciones: el costo de actuar sobre la base de creencias falsas debe ser muy elevado para el bienestar de los afectados y la probabilidad de que tal resultado se produzca efectivamente, aunque baja, debe ser significativa (...) o no trivial. Sostendremos que la escisión entre conocimiento y justificación de la acción referida tiene importantes consecuencias para la estructura de la deliberación moral. This paper is aimed at proving that in certain contexts of action there may be a cleavage between the moral knowledge of an agent and the moral justification of her actions. I will argue that this is so when two conditions obtain: first, acting on the basis of false beliefs may end-up being very costly in terms of the welfare of those affected; and second, even if low, the probability of such negative upshots are significant or not trivial. I shall claim that this cleavage between knowledge and justification of actions has important consequences for the structure of moral deliberation. (shrink)

La meta del presente artículo es defender la tesis de que la aceptación de las ideas fundamentales del liberalismo político no conducen necesariamente a una concepción de la justicia global minimalista como la que desarrolló John Rawls en The Law of Peoples. Sostendré, contra lo que el filósofo explícitamente afirma, que las democracias liberales contemporáneas pueden apelar públicamente, en la esfera política global, a los ideales igualitarios y a una concepción robusta de los derechos humanos como justificación de ciertos aspectos (...) de su política exterior. Intentaré demostrar que ello no resulta incompatible con el requisito de asumir una posición de tolerancia y de respeto con las naciones que suscriben mayori-tariamente formas de vida y sistemas de creencias incompatibles con algunos de los valores liberales más significativos. The purpose of the following article is to sustain the view that accepting the basic notions of political liberalism does not necessarily lead to a minimalistic concept of global justice as that developed by John Rawls in The Law of Peoples. In opposition to his explicit opinion, I shall hold that -within the global political field- contemporary liberal democracies can publicly hold egalitarian ideals and a robust conception of human rights in order to justify some of the features of their foreign policy. I shall try to demonstrate that this is not incompatible with the required tolerance and respect toward nations that conspicuously embrace ways of life and belief systems incompatible with some of the most relevant liberal values. En A Letter Concerning Toleration John Locke argumenta en favor de la tolerancia religiosa afirmando que el Estado no puede mejorar la vida de las personas forzándolas a vivir de acuerdo con creencias que ellas no suscriben. Más recientemente, Ronald Dworkin y Will Kymlicka han desarrollado argumentos similares. En el caso del primero, contra ciertas políticas paternalistas; en el del segundo, en apoyo de la tesis liberal de la neutralidad estatal. Mi propósito en el presente artículo es analizar la plausibilidad (...) de dichos argumentos concebidos como una defensa de la tesis de la neutralidad estatal. Intentaré demostrar que ambas versiones del argumento fracasan. En la sección II, cuestionaré la capacidad de los argumentos para respaldar las conclusiones que aspiran establecer, sin objetar la plausibilidad de las premisas involucradas. En la sección III, desarrollaré tres objeciones contra la concepción del bienestar crítico que constituye el corazón de ambas versiones del argumento. ABSTRACT The supporters of political liberalism hold that the exercise of political power is legitimate only when it is justified by public reasons acceptable to all citizens, independently of the religious, philosophical, or moral doctrine they adhere to. In John Rawls' view, satisfying this conception of legitimacy makes it necessary to appeal to "political conceptions of justice" when attempting to publicly justify actions by the State. The article sets forth a new type of argument in favor of Rawls' position. The requirement of mutual justification (MJ) is one or the fundamental ideas shared by some of the most influential deliberative theories of democracy. The aim of the present paper is to defend the plausibility of MJ against two possible objections. The first one states that MJ involves the commitment to a controversial conception of the notion of justification, which is incompatible with what is commonly understood by the epistemic justification of a belief. El costo de tomar una decisión sobre la base de las creencias falsas varía en diferentes contextos de acción. En algunos casos el costo del error podría ser muy alto para el bienestar de los agentes afectados y en otros casos muy bajo. El contraste entre estos dos tipos de contextos ha sido recientemente objeto de atención en la epistemología. Mi objetivo en este trabajo es extender el análisis de algunas de las implicaciones de ese contraste al campo moral. En (...) particular, defenderé la tesis de que existen casos en los que un sujeto puede saber faliblemente que un curso de acción es el mejor desde una perspectiva moral y no estar, sin embargo, justificado a actuar sobre la base de ese conocimiento en el contexto en que se encuentra, dado el elevado costo que tendría que ese juicio fuese falso. Por lo tanto, en esos casos, existiría una brecha entre los conceptos de conocimiento moral y justificación moral de la acción. (shrink)

From the point of view of political liberalism, one of the main features of “reasonable” people consists in accepting that the firm adhesion to a comprehensive conception of good, the certainty of dealing with a true conception , does not offer a sufficient justification to the intention of promoting it by means of the power of the State. Now, how is this liberal position founded? My aim in this paper is to offer an argument for it. To do so, I (...) will start analysing some aspects of Rawls´conception of “reasonable person” and the difficulties derived from this conception, particularly enlightened by the objections formulated to it by Leif Wenar and Eduardo Rivera López. I will propose an alternative argument to the presented ones, departing from two premises: 1) a political principle of equality and free consensus and 2) a practical interpretation of the burdens of judgement. In “Democracy and Deliberation: Two Models of Public Justification”, Mariano Garreta Leclercq presents an interesting argument in favor of what he calls “the common ground” conception of justification, as against the “standard” conception of justification. In this note I present an objection to that argument. More precisely, I point out a tension between two statements of that argument: 1) There is no right to decide for others; and 2) the margin of error in moral issues is very (...) considerable. I say that, if we are committed to the statement that the margin of error is very considerable in moral issues, so we cannot be convinced that there is no right to decide for others, because it is a moral principle in itself. The French historian Auguste Bouché-Leclercq made major contributions to our knowledge of the Hellenistic period. A member of the Académie des Inscriptions et Belles-Lettres, he was also made an officer of the Légion d'Honneur. Bouché-Leclercq is also considered the first modern historian of astrology: he had developed a long-lasting interest in divination during his extensive researches on ancient Greek civilisation. This field had not been considered worthy of serious scholarly study until he published his Histoire de la divination (...) dans l'antiquité between 1879 and 1882. L'Astrologie grecque, first published in 1899, is another important work, still referred to today. Bouché-Leclercq looks back to the oriental roots of Greek astrology. He delves into the specific influence of the zodiac signs, and explains how the celestial sphere was divided in order to draw horoscopes. According to the deductivist view of mathematics which became the rule during the nineteenth century, formal proofs working with symbolic formulas replaced the intuitive knowledge that used to be gained by the step-by-step construction of geometric fgures and diagrams. Twentieth century epistemological refection on symbolic formulas and formal proofs, however, took them to be diagrams respectively exhibiting formal relations and transformations. The claim was also made that, for such diagrams to be proofs, temporal displays of transformations—and of other speech acts—were (...) required. By returning to the signifcant elements of contemporary theories of mathematical proofs, we will here show how these proofs came to be a matter for semiotics and pragmatics as much as for formal logic. Once this is done, we will provide a few arguments against the standard objections to the ability of diagrams to present temporal order or perform speech acts. (shrink)

The Somatic Mutation Theory has been challenged on its fundamentals by the Tissue Organization Field Theory of Carcinogenesis. However, a recent publication has questioned whether TOFT could be a valid alternative theory of carcinogenesis to that presented by SMT. Herein we critically review arguments supporting the irreducible opposition between the two theoretical approaches by highlighting differences regarding the philosophical, methodological and experimental approaches on which they respectively rely. We conclude that SMT has not explained carcinogenesis due to severe epistemological and (...) empirical shortcomings, while TOFT is gaining momentum. The main issue is actually to submit SMT to rigorous testing. This concern includes the imperatives to seek evidence for disproving one’s hypothesis, and to consider the whole, and not just selective evidence. (shrink)

The use of conventional manufacturing methods is mainly limited by the size of the production run and the geometrical complexity of the component, and as a result we are occasionally forced to use processes and tools that increase the final cost of the element being produced. Additive manufacturing techniques provide major competitive advantages due to the fact that they adapt to the geometrical complexity and customised design of the part to be manufactured. The following may also be achieved according to (...) field of application: lighter weight products, multimaterial products, ergonomic products, efficient short production runs, fewer assembly errors and, therefore, lower associated costs, lower tool investment costs, a combination of different manufacturing processes, an optimised use of materials, and a more sustainable manufacturing process. Additive manufacturing is seen as being one of the major revolutionary industrial processes of the next few years. Additive manufacturing has several alternatives ranging from simple RepRap machines to complex fused metal deposition systems. This paper will expand upon the structural design of the machines, their history, classification, the alternatives existing today, materials used and their characteristics, the technology limitations, and also the prospects that are opening up for different technologies both in the professional field of innovation and the academic field of research. It is important to say that the choice of technology is directly dependent on the particular application being planned: first the application and then the technology. (shrink)

We argue for an intimate relation between semantic externalism and semantic deference and propose a typology of speakers’ metasemantic views as revealed by their deferential attitudes. Building on this typology, we then offer a classification of metasemantic disagreements understood as verbal disputes between speakers who (consciously or unconsciously) hold divergent metasemantic views about the same word. In particular, we distinguish lower-order metasemantic disagreements between speakers who disagree on the exact source of meaning determination for a word yet agree on the (...) kind of deferential attitude this word is liable to, from higher-order metasemantic disagreements between speakers who do not even agree on the suitable kind of deferential attitude. We demonstrate the fruitfulness of our classification through the concrete implications it has for conceptual engineering. (shrink)

In this study, we examine the influence of senior leadership on firms’ corporate social responsibility. We integrate upper echelons research that has investigated either the influence of the CEO or the top management team on CSR. We contend that functional experience complementarity between CEOs and TMTs in formulating and implementing CSR strategy may underlie differentiated strategies in CSR. We find that when CEOs who have predominant experience in output functions are complemented by TMTs with a lower proportion of members who (...) have experience in output functions, there is a pronounced effect on the community, product, and diversity dimensions of CSR. In turn, when output-oriented CEOs are complemented by output-oriented TMTs, we observe an effect on the employee relations dimension of CSR. Interestingly, we find no influence of CEO-TMT complementarity on the environment dimension of CSR. In general, our empirical results support the relevance of the interaction between CEOs and their TMTs in defining their firms’ CSR profile. (shrink)

First published in 1917 and 1918, with a second edition in 1946, this is the first English translation of Santi Romano's classic work, L'ordinamento giuridico. The main focus of The Legal Order is the notion of institution, which Romano considers to be both the core and distinguishing feature of law. After criticising accounts of the nature of law centred on notions of rule, coercion or authority, he offers a compelling conception, not merely of law as an institution, but of the (...) institution as 'the first, original and essential manifestation of law'. Romano advances a definition of a legal institution as any group who share rules within a bounded context: for example, a family, a firm, a factory, a prison, an association, a church, an illegal organisation, a state, the community of states, and so on. Therefore, this understanding of legal institutionalism at the same time provides a ground-breaking theory of legal pluralism whereby 'there are as many legal orders as institutions'. The acme of a jurisprudential current long overlooked in the Anglophone environment, The Legal Order not only proposes what Carl Schmitt described as a 'very significant theory', but, more importantly, it offers precious insights for a thorough rethinking of the relationship between law and society in today's world. Transhumanism is a scientific and philosophical movement that proposes to overcome, through new technologies, the restrictions imposed on us by our biological condition. Some transhumanists assume that the struggle against natural limits could lead to a radical change in our body or even to its replacement. Other authors, such as Nicholas Agar, propose a moderate enhancement that does not exceed the framework of what we understand to be human. In this article, I will offer a plausible interpretation of the project (...) of human enhancement from a Thomistic perspective. To carry out my analysis, I will focus on three fundamental metaphysical and anthropological questions: How do advocates of radical enhancement understand the relationship between limits, imperfections and evils in human nature? How is this relationship understood from moderate positions? And Is any of these proposals compatible with Aquinas’ anthropology? I will conclude that the identification of limits with imperfections and evils assumed by radical positions is incompatible with Aquinas’ anthropology. Nevertheless, this does not entail that any bio-modification is unacceptable. Aquinas’ peculiar metaphysics, together with its anthropology in which the natural, the supernatural and the preternatural realms intertwine, can offer an interesting framework to assess the human enhancement project. Con estas palabras se inicia una relación educativa entre Virgilio y Dante que manifiesta de manera concreta una visión sobre el maestro de permanente validez y actualidad. El viaje de Dante permite descubrir en la Divina Comedia la existencia de unos principios universales que fundamentan la acción del maestro. No obstante, dichos principios no son del todo originales, sino que permiten evidenciar la influencia que Tomás de Aquino ha ejercido en Dante. El Aquinate (...) no solo es mencionado en el Paraíso en los cantos X al XIV, sino que los principios pedagógicos tomistas, especialmente los contenidos en la Suma de Teología, informan la relación concreta entre los dos poetas. En este estudio intentaremos explicitar la visión del maestro propuesta por Dante, a la vez que se buscará mostrar que Tomás de Aquino es la fuente principal de la que Dante se nutre para labrar esa específica relación entre maestro y discípulo. El presente artículo se propone cotejar dos lecturas antimodernas de Platón y la tradición platónica, la de Joseph de Maistre (1753-1821) y la de Joris-Karl Huysmans (1848-1907) que resultan a la vez complementarias e inversas. Estas apropiaciones, que abren y cierran el siglo XIX, expresan el auge y el declive del “platonismo romántico”. De Maistre recurre intensamente a los diálogos de Platón, a los que cita, comenta, traduce y reescribe, así como a diversos textos del neoplatonismo antiguo y de la (...) tradición platónica moderna. Por su parte los textos de Huysmans, en particular _À rebours_ (1884), la novela más representativa de la sensibilidad decadente, expresa la crisis de ese platonismo romántico, tal como se advierte en cuestiones tales como el nihilismo, el recurso a la figura del simulacro y el replanteo del tópico del andrógino. El platonismo y su crisis interrogan la temporalidad histórica, desde la aceleración revolucionaria hasta la decadencia finisecular. (shrink)

In developed countries, companies are now substantially reliant on the skills and abilities of their leaders to tackle a variety of complex issues. There is a growing consensus that leadership development training and assessment methods should adopt more holistic methodologies, including those associated with the emotional and neuroendocrine aspects of learning. Recent research into the assessment of leadership competencies has proposed the use of objective methods and measurements based on neuroscience. One of the challenges to be faced in the development (...) of a performance-based methodology to measure leadership skills is how to generate real-life situations with triggers that allow us to study management competencies under controlled laboratory conditions. A way to address this question is to take advantage of virtual environments to recreate real-life situations that might arise in performance-based assessments. We propose virtual reality (VR) as a very promising tool to observe various leadership related behavioral patterns during dynamic, complex and realistic situations. By seamlessly embedding assessment methods into virtual learning environments, VR can provide objective assessment methods with high ecological validity. VR also holds unlimited opportunities for leadership training providing subjects with intelligent tutoring systems that adapts situations in real time according to the observed behaviors. (shrink)

Different cell lineages growing in microgravity undergo a spontaneous transition leading to the emergence of two distinct phenotypes. By returning these populations in a normal gravitational field, the two phenotypes collapse, recovering their original configuration. In this review, we hypothesize that, once the gravitational constraint is removed, the system freely explores its phenotypic space, while, when in a gravitational field, cells are “constrained” to adopt only one favored configuration. We suggest that the genome allows for a wide range of “possibilities” (...) but it is unable per se to choose among them: the emergence of a specific phenotype is enabled by physical constraints that drive the system toward a preferred solution. These findings may help in understanding how cells and tissues behave in both development and cancer. In microgravity, cells undergo spontaneous and reversible transitions between different phenotypes. In the absence of physical constraints, living systems could yield bi-stable decisions. On the contrary, physical ‘boundaries’ constrain cells to acquire only a specific configuration by selecting and shaping different gene expression patterns provided by the intrinsic genetic stochasticity. Ionizing radiation is present in various situations in the contemporary world. Defining the quantities and units for this field is a complex scientific task, especially the quantities used in radiological protection (RP) to estimate the damage caused to individuals exposed to radiation (detriment). This article highlights the lack of consensus in the scientific RP community regarding the quantities and units employed in practice from the perspective of the philosophy of science. The basic concepts related to the system of quantities are (...) presented, followed by the problems and criticisms addressed by experts in the field. Several reasons for these problems are identified. The article discusses the scant interest on the part of philosophy of science in RP. The philosophy of science is still dominated by an analytical–conceptual perspective that pays little attention to the actual influence of certain structures better understood when considered from the institutional viewpoint, which is here exemplified by the International Commission on Radiological Protection (ICRP) and the International Atomic Energy Agency (IAEA).
