The fusion of law and equity in common law systems was a crucial moment in the development of the modern law. In this volume leading scholars assess the significance of the fusion of law and equity from comparative, doctrinal, historical and theoretical perspectives.

Many, and perhaps most, American philosophers will, if pressed, say that they are pragmatists. What they typically mean by this is that they think there is some class of philosophical questions that can’t be answered philosophically. If you don’t think that in the end philosophical arguments can possibly settle metaphysical questions, pragmatism is an appealing response. Pragmatism becomes a kind of default position which one reverts to when one removes a topic from the list of topics that can be reasonably (...) addressed using philosophical methods. When Richard Rorty characterized himself as a pragmatist, he meant that he was in favor of removing topics from philosophy on a wholesale basis, which implied for him the end of philosophy at least as traditionally conceived. Philosophical students of pragmatism weren’t very happy with this formulation, not so much for its conclusions, but because it omitted the content of the default that John Dewey himself had in mind, namely something like the scientific method, or the scientific method understood and generalized as something like an experimental approach. The people who thought Rorty had travestied pragmatism focused, correctly, on the difference in their attitudes toward science. Patrick Baert has written a very interesting textbook on the philosophy of social science which winds up embracing at least the term pragmatism and reflecting on Rorty in a way that arrives at a novel position. As his concluding argument is the most original part of the book and the one that is most relevant in this setting, I shall confine my comments to the question of what both a pragmatist approach to social science and to a “philosophy” of social science might be, and further confine it to the Deweyan and Rortyian variations on this general theme. In The Construction of Social Reality, John Searle expends an argument left undeveloped in Speech Acts about the nature of the rules which underlie and constitute social life. It is argued in this review that one problem for this account was its apparent incompatibility with connectionism. They cannot be rules shared in the head, so to speak. He now understands our relation to these rules not as one of simple internalization but of skillful accustoming. But this makes appeal to (...) rules unnecessary and makes noncollective solutions appealing to overt beliefs rather than tacit rules more plausible. (shrink)

To the first, Schindler replies (in section 3) that Murray’s juridical approach necessarily entails what Servais Pinckaers, O.P., called the “freedom of indifference,” Murray’s denials of relativism notwithstanding. Although gender differences in attitudes toward animal research have been reported in the literature for some time, exploration into the nature of these differences has received less attention. This article examines gender differences in responses to a survey of attitudes toward the use of animals in research. The survey was completed by college students and consisted of items intended to tap different issues related to the animal research debate. Results indicated that women were more likely than men to support tenets (...) of the animal protection movement. Likewise, women were more likely than men to favor increased restrictions on animal use and were more concerned than men about the suffering of research animals. Analysis of item contents suggested that women endorsed items reflecting a general caring for animals, were more willing than men to make personal sacrifices such as giving up meat and medical benefits in an effort to protect animals, and were more likely than men to question the use of animals in research on scientific grounds. Men, on the other hand, tended to emphasize the potential benefits arising from the use of animals in research. (shrink)

Darwinism, Democracy, and Race examines the development and defence of an argument that arose at the boundary between anthropology and evolutionary biology in twentieth-century America. In its fully articulated form, this argument simultaneously discredited scientific racism and defended free human agency in Darwinian terms. The volume is timely because it gives readers a key to assessing contemporary debates about the biology of race. By working across disciplinary lines, the book's focal figures--the anthropologist Franz Boas, the cultural anthropologist Alfred Kroeber, the (...) geneticist Theodosius Dobzhansky, and the physical anthropologist Sherwood Washburn--found increasingly persuasive ways of cutting between genetic determinist and social constructionist views of race by grounding Boas's racially egalitarian, culturally relativistic, and democratically pluralistic ethic in a distinctive version of the genetic theory of natural selection. The great logician Gottlob Frege attempted to provide a purely logical foundation for mathematics. His system collapsed when Bertrand Russell discovered a contradiction in it. Thereafter, mathematicians and logicians, beginning with Russell himself, turned in other directions to look for a framework for modern abstract mathematics. Over the past couple of decades, however, logicians and philosophers have discovered that much more is salvageable from the rubble of Frege's system than had previously been assumed. A variety of repaired systems have been (...) proposed, each a consistent theory permitting the development of a significant portion of mathematics. This book surveys the assortment of methods put forth for fixing Frege's system, in an attempt to determine just how much of mathematics can be reconstructed in each. John Burgess considers every proposed fix, each with its distinctive philosophical advantages and drawbacks. These systems range from those barely able to reconstruct the rudiments of arithmetic to those that go well beyond the generally accepted axioms of set theory into the speculative realm of large cardinals. For the most part, Burgess finds that attempts to fix Frege do less than advertised to revive his system. This book will be the benchmark against which future analyses of the revival of Frege will be measured. (shrink)

A revisionist account of how philosophical induction was conceived in the ancient world and how that conception was transmitted, altered, and then rediscovered. I show how philosophers of late antiquity and then the medieval period came step-by-step to seriously misunderstand Aristotle’s view of induction and how that mistake was reversed by humanists in the Renaissance and then especially by Francis Bacon. I show, naturally enough then, that in early modern science, Baconians were Aristotelians and Aristotelians were Baconians.

This is the first in-depth critical appraisal in English of the political, legal, and cultural writings of Carl Schmitt, perhaps this century's most brilliant critic of liberalism. It offers an assessment of this most sophisticated of fascist theorists without attempting either to apologise for or demonise him. Schmitt's Weimar writings confront the role of technology as it finds expression through the principles and practices of liberalism. Contemporary political conditions such as disaffection with liberalism and the rise of extremist political organizations (...) have rendered Schmitt's work both relevant and insightful. John McCormick examines why technology becomes a rallying cry for both right- and left-wing intellectuals at times when liberalism appears anachronistic, and shows the continuities between Weimar's ideological debates and those of our own age. Scientific authorship has become a contested terrain in contemporary science. Based on a survey of authors across fields, we measure the likelihood of specialist authors : people who only made specialized contributions, such as data, materials, or funding; and “nonauthor collaborators” : those who did significant work on the project but do not appear as authors, across different research contexts, including field, size of the project team, commercial orientation, impact of publication, and organization of the collaboration. We find that guest (...) and ghost authors are common, with about one-third of publications having at least one specialist author and over half having at least one nonauthor collaborator. We see significant cross-field variations in both overall rates and types of specialist authors and nonauthor collaborators. We find there are generally fewer specialist authors among highly cited papers and more graduate student nonauthor collaborators in single location projects. The results suggest authorship practices vary across fields, and by project characteristics, complicating the use of authorship lists as a basis for evaluation. We discuss implications of these findings for interpreting author lists in the context of science policy. (shrink)

Medical necessity (claiming that a medical intervention or care is – at minimum – reasonable, appropriate and acceptable) depends on empirical evidence and on the interpretation of that evidence. Evidence and its interpretation define the standard of care. This commentary argues that both the evidence base and its interpretation are currently weak gatekeepers. Empirical meta-research suggests that very few medical interventions have high quality evidence in support of their effectiveness and very few of them also have relatively thorough assessments of (...) their potential harms. Therefore, evidence on the risk-benefit ratios carries almost always very large uncertainty. Arbitration about medical necessity is thus left to the interpretation process. Professional guidelines are notoriously unreliable and biased in this regard. Regulatory approval ends up being the key arbitrator, but over the years the regulatory process has been subverted. Regulatory approval currently does not mean that an intervention has a favourable risk-benefit ratio, but simply that it can be marketed, sold and made profit from. The process leads to a tragedy of commons where the final victim is society at large: medical necessity is invoked as an alibi for medicine to absorb societal resources. (shrink)

The increasingly pervasive practice of veiling among Muslim women has stimulated a great deal of scholarly investigation and debate. This study brings empirical evidence to bear on current debates about the meaning of the veil in Islam. This article first examines the conflicting meanings of the veil among Muslim religious elites and Islamic feminists. Although the dominant gender discourse among Muslim elites strongly favors this cultural practice, an antiveiling discourse promulgated by Islamic feminists has gained ground within recent years. This (...) study then examines how these discursive disputes affect gender identity negotiation among veiled and unveiled Muslim women living in Austin, Texas. Interviews with these women highlight how their gender identities reproduce and reformulate existing Muslim gender discourses. Special attention is paid to the subjective disparities and points of congruence between both groups of respondents. This study concludes by suggesting avenues for future research on the intersection of gender, religion, and cultural difference. (shrink)

Philosophical defenses of cognitive/evolutionary psychological accounts of racialism claim that classification based on phenotypical features of humans was common historically and is evidence for a species-typical, cognitive mechanism for essentializing. They conclude that social constructionist accounts of racialism must be supplemented by cognitive/evolutionary psychology. This article argues that phenotypical classifications were uncommon historically until such classifications were socially constructed. Moreover, some philosophers equivocate between two different meanings of “racial thinking.” The article concludes that social constructionist accounts are far more robust (...) than psychological accounts for the origins of racialism. By utilizing new information from both clinical and experimental (lesion, electrophysiological, and gene-activation) studies with animals, the anatomy underlying anterograde amnesia has been reformulated. The distinction between temporal lobe and diencephalic amnesia is of limited value in that a common feature of anterograde amnesia is damage to part of an comprising the hippocampus, the fornix, the mamillary bodies, and the anterior thalamic nuclei. This view, which can be traced back to Delay and Brion (1969), differs from other recent models in (...) placing critical importance on the efferents from the hippocampus via the fornix to the diencephalon. These are necessary for the encoding and, hence, the effective subsequent recall of episodic memory. An additional feature of this hippocampalanterior thalamic and the perirhinal–medial dorsal thalamic systems are compromised, leading to severe deficits in both recall and recognition. (shrink)

David Lewis in the short monograph Parts of Classes (PC) undertakes a fundamental re‐examination of the relationship between mereology, the general theory of parts, and set theory, the general theory of collections. Given Lewis's theses, to be an element of a set or member of class is just to have a singleton that is a part thereof. Lewis in PC adds a claim of kind of ontological innocence, comparable to that of first‐order logic, for mereology. The only substantive assumption of (...) plethynticology is that for any condition there are some things such that they are precisely the things for which the conditions hold. All the alternatives, making do with a single domain of individuals, have in common that they involve the axiom of choice. Restated in Hazen's terminology rather than Frege's, the fallback assumption is that there are no more small species than individuals. (shrink)

Richard Rorty reimagined the traditional liberal private-public divide to face contingency. This chapter explains Rorty’s understanding of it as a crucial component of any just and stable political order in the post-secular West. Rorty’s continued defense of the liberal private-public divide has been criticized from the political right and left. His foundation-neutral model is, however, equipped (or can easily be modified) to answer these objections. This volume offers an English translation of John of St. Thomas's Cursus theologicus I, question I, disputation 2. In this particular text, the Dominican master raises questions concerning the scientific status and nature of theology. At issue, here, are a number of factors: namely, Christianity's continual coming to terms with the "Third Entry" of Aristotelian thought into Western Christian intellectual culture - specifically the Aristotelian notion of 'science' and sacra doctrina's satisfaction of those requirements - the Thomistic-commentary tradition, and (...) the larger backdrop of the Iberian Peninsula's flourishing "Second Scholasticism." In this latter context, John of St. Thomas applies the theological principles of Thomas Aquinas to the Scholastic disputes preoccupying Thomist, Franciscan, and Jesuit theologians, such as Cajetan, Bañez, Luis de Molina, Vazquez, Suárez - to name only a few - in a tour de force of theological thinking throughout the entire period of Scholasticism. In the process - and not insignificantly - the status quaestionis of theology's scientific character is clearly framed and answered according to John's satisfaction. Key to John of St. Thomas's resolution of the question is his understanding of the continuity of the power of human reason with the super-intelligibility of divine revelation spelled out in terms of what he calls "virtual revelation." This text presented in this volume is a quintessential example of the deep and abiding harmony that flourished between faith and reason as well as grace and nature within the golden era of Baroque Scholasticism. While we are commonly told that the distinctive method of mathematics is rigorous proof, and that the special topic of mathematics is abstract structure, there has been no agreement among mathematicians, logicians, or philosophers as to just what either of these assertions means. John P. Burgess clarifies the nature of mathematical rigor and of mathematical structure, and above all of the relation between the two, taking into account some of the latest developments in mathematics, including the rise of experimental (...) mathematics on the one hand and computerized formal proofs on the other hand. Along the way, a great many historical developments in mathematics, philosophy, and logic are surveyed. Yet very little in the way of background knowledge on the part of the reader is presupposed. U.S. federal research funding is generally justified by promises of public benefits, but the specific natures and distribution of such benefits often remain vague and ambiguous. Furthermore, the metrics by which outcomes are reported often do not necessarily or strongly imply the achievement of public benefits. These ambiguities and discontinuities make it difficult to assess the public outcomes of federal research programs. This study maps the terms in which the purposes and the outcomes of Advanced Research Projects Agency-Energy -a relatively (...) young and innovatively structured federal research agency-have been discussed and reported. I find that ARPA-E’s creation and funding have been justified with reference to a broad repertoire of economic, environmental, and national security values, but that the agency has been evaluated only through intermediate scientific and economic metrics and study of internal organizational structure. I suggest that these means of assessment elide ARPA-E’s lack of the financial scale, long time horizon, built-in customer, and radical vision which have been historically important to high-impact federal innovation, and I recommend the tracking of metrics more directly related to ARPA-E’s public value purposes as the agency grows older. This discussion illustrates the inadequacy of currently widespread metrics and conventional wisdom for the design and assessment of societally relevant research. (shrink)

Accounts of how the concept of temperature has evolved typically cast the story as ancillary to the history of the thermometer or the history of the concept of heat. But then, because the history of temperature is not treated as a subject in its own right, modern associations inadvertently get read back into the historical record. This essay attempts to lay down an authoritative record not of what people in the past thought about what we call ‘temperature’ but of what (...) they thought about what they called ‘temperature’ (or one of its cognates), from medieval times to today. I find that invention of the thermometer had little impact on the concept of temperature. Much more significant were Fahrenheit’s invention of a reliable instrument and William Thomson’s effort to make a degree of temperature a unit of measure. Overlapping definitions of temperature then emerged in the late nineteenth century, and twentieth-century scientific developments forced physicists to reconsider temperature’s conceptual boundaries. It turns out that the concept of temperature has evolved through stages that correspond to four increasingly sophisticated types of measurement. Its maturation and its maturity shed light on the philosophy of conceptual change. (shrink)
