There is a tendency to associate intelligence with speed. ‘Quick’ is a synonym for clever and suggests intellectual ability. ‘Slow’, by contrast, implies a want of intelligence, even stupidity. The slow child in the class is the one who is ‘behind’, the one who must ‘catch up’ with the others. This is symptomatic of a wider stress in our culture on getting things done quickly and ‘saving time’. It seems that fear of time running out often compels us into running (...) after it. As scholars envision a new regulatory or statutory neurorights schema it is important to imagine unintended consequences if reforms are implemented before their implications are fully understood. This paper critically evaluates provisions proposed for a new Chilean Constitution and evaluates this movement against efforts to improve the diagnosis of, and treatment for, individuals with disorders of consciousness within the broader context of disability law, international human rights, and a capabilities approach to health justice as advanced by Amartya Sen and Martha (...) Nussbaum. Framed in this way, any neurorights regime would need to satisfy several criteria. First it would be obliged to balance both positive and negative rights in the furtherance of human capabilities. Second, it would need to be future oriented and informed about the science it sought to regulate and not fall prey to science fiction fantasies that remain ungrounded in reality. Third, it would need to be specific and avoid generalizations that would lead to conceptual confusion and litigation that could delay scientific progress. Finally, it would need to harmonize novel neurorights with long-established norms in international disability and human rights law. A failure to meet these criteria will destine any novel neurorights regime to the periphery. At this juncture Chile’s nascent constitutional venture into neurorights fails to satisfy these criteria. While there yet may be a role for a more capacious and bivalent articulation of neurorights that account for capabilities and precedent, the current Chilean neurorights reforms are vague and premature. As such they should undergo additional scholarly scrutiny and should not be adopted by other jurisdictions. (shrink)

En principe, remplacer la variante de Laplace de la pré-détermination par une prédétermination prévisible permet de rendre scienti-fique, donc réfutable, le déterminisme « scientifique ». Popper a affirmé qu’il l’avait réfuté. Maintenant, un système métaphysique peut avoir une extension – au sens mathématique – qui le rend explicatif et testable. The event of the Cross is the historical coming of mankind’s freedom before God, freedom to believe or not to believe, to exist with God or without God. This freedom is the very gift of faith and salvation offered to all those who live according to the gratuitousness of love. In revealing that God is love, the Cross proclaims that gratuitousness is his being in itself and for itself at the same time as his being “for us”. To a certain extent, they keep on with Kant’s or Husserl’s tradition. None of them was in fact able to take care of historicism in the contingent and moving constitution of our intellectual capacities. In these conditions, no sense at all can be found in science. Quoi de commun entre l'espoir fou d'Antonin Artaud de "guérir la vie" en transgressant les frontières de la rationalité occidentale, et la tentative d'Emmanuel Lévinas de fonder l'éthique sur le visage de l'autre pour subvertir la tyrannie de l'universel et de l'impersonnel? Quoi de commun entre la temporalité anhistorique de l'Islam et l'espoir militant d'une libération des femmes qui ouvre une autre Histoire? Dans le choc des réflexions aux prises avec l'inattendu, dans l'irruption des conjonctures inquiétantes, ces effets de brisures, ces fractures du temps, ne contredisent pourtant pas un souffle d'irréversible, qui confirme ce que les pensées de l'Histoire et leur foi dans l'avenir ont pressenti. Pour lui, la formation de ce savoir moderne a procédé d'un effort continu qui a tour à tour été mené par les divers groupes composant l'humanité. Tannery, en revanche, est très préoccupé par les ruptures et les crises, qui peuvent être à l'origine de la disparition de pans entiers du savoir, mais aussi d'intenses périodes de création. The term 'implicit bias' has very swiftly been incorporated into philosophical discourse. Our aim in this paper is to scrutinise the phenomena that fall under the rubric of implicit bias. The term is often used in a rather broad sense, to capture a range of implicit social cognitions, and this is useful for some purposes. However, we here articulate some of the important differences between phenomena identified as instances of implicit bias. We caution against ignoring these differences: it is likely (...) they have considerable significance, not least for the sorts of normative recommendations being made concerning how to mitigate the bad effects of implicit bias. In our papers on the rationality of magic, we distinghuished, for purposes of analysis, three levels of rationality. First and lowest (rationalitYl) the goal directed action of an agent with given aims and circumstances, where among his circumstances we included his knowledge and opinions. On this level the magician's treatment of illness by incantation is as rational as any traditional doctor's blood-letting or any modern one's use of anti-biotics. At the second level (rationalitY2) we add the element of rational thinking (...) or thinking which obeys some set of explicit rules, a level which is not found in magic in general, though it is sometimes given to specific details of magical thinking within the magical thought-system. It was the late Sir Edward E. Evans-Pritchard who observed that when considering magic in detail the magician may be as consistent or critical as anyone else; but when considering magic in general, or any system of thought in general, the magician could not be critical or even comprehend the criticism. Evans-Pritchard went even further: he was sceptical as to whether it could be done in a truly consistent manner: one cannot be critical of one's own system, he thought. On this level (rationalitY2) of discussion we have explained (earlier) why we prefer to wed Evans Pritchard's view of the magician's capacity for piece-meal rationality to Sir James Frazer's view that magic in general is pseudo-rational because it lacks standards of rational thinking. À travers l’importance accordée au concept d’« humanisme évangélique » dans Dieu qui vient à l’homme, J. In the twentieth century it has been approached mainly through a historical perspective. But this tradition has not really been studied by fundamental theology. The aim of this article is to fill a certain gap in the assessment of relativism by drawing on Joseph Ratzinger’s (1927–2022) criticism of the normative transformation since Kant. During the Enlightenment, Natural Law was doubted as a cultural feature of Christianity that had no bearing on pluralist society. Consequently, this jurisprudential tradition underwent de-Hellenization and branched out in radical directions, the most decisive of which was Kant’s post-metaphysical system of natural values. Positivism and German Idealism attempted to restore (...) the unity of philosophy that Kant’s philosophy had disrupted. Yet even more influentially, in the nineteenth and twentieth centuries it was Marxism that relativized the doxological aspect of normativity by emphasizing the importance of praxis. Since philosophy became neither an exact science as Kant had conceived it to be, nor a practical programme for social justice as Marxism had promised, the Existentialists, and particularly Sartre, advocated a more radical philosophy of freedom. Ratzinger argues that despite the nuances of post-Kantian philosophy, Positivism, Existentialism, and Marxism failed to comprehend the human condition and that the positivist method resulted in an overwhelming relativism that has reduced normativity to a matter of correct procedures rather than regarding it as the foundation of the inviolable dignity of the human being. Gary Becker and others have done important work to broaden the content of self interest, but have not departed from seeing rationality in terms of the exclusive pursuit of self-interest. One reason why committed behavior is important is that a person can have good reason to pursue objectives other than self interest maximization (no matter how broadly it is construed). Indeed, one can also follow rules of behavior that go beyond the pursuit of one's own goals, even if the goals (...) include non-self-interested concerns. By living in a society, one develops possible reasons for considering other people's goals as well, which takes one beyond an exclusive concentration on one's own goals, not to mention the single-minded pursuit of one's own self interest. The recognition of other people's goals may be a part of rational thought. If rational behavior may depart from the relentless pursuit of one's own goals, commitment has to be important in a theory of rationality. Furthermore, seeing the role of commitment in human behavior can have explanatory importance in allowing us to understand behavior patterns that are hard to fit into the narrow format of contemporary rational choice theory. According to agent-based approaches to virtue ethics, the rightness of an action is a function of the motives which prompted that action. If those motives were morally praiseworthy, then the action was right; if they were morally blameworthy, the action was wrong. Many critics find this approach problematically insensitive to an act’s consequences, and claim that agent-basing fails to preserve the intuitive distinction between agent- and act-evaluation. In this article I show how an agent-based account of right action can be (...) made sensitive to an act’s consequences. According to the approach which I defend, an action is right just in case it realizes an agent’s morally praiseworthy motive. Conversely, an action is wrong just in case it realizes a morally blameworthy motive. Specifying act-evaluation in terms of the realization, rather than the expression, of an agent’s motives allows an agent-based approach to distinguish between agent- and act-evaluation. This is because an agent may act from a morally praiseworthy motive, but fail to realize that motive. Her action will therefore not have been the right one, despite its being the expression of morally praiseworthy motives. (shrink)
