The many constraints of outer space experience challenge the human ability to coexist. Paradoxically, astronauts assert that on the international space station there are no conflicts or, at least, that they are able to manage their differences, behavioral as well as cognitive, in full respect of human rights and the imperatives of cooperative living. The question is: Why? Why in those difficult, a-terrestrial, and therefore almost unnatural conditions do human beings seem to be able to peacefully and collaboratively live together? (...) What is there beyond terrestrial boundary conditions that allows for such a result? And what can we learn from the astronauts’ experience about the effectiveness of human rights on Earth? My proposal is that the a-terrestrial dimension deeply alters the mind/body indexical framework and, in this way, disentangles the human inclination to semiosis from the cognitive and behavioral habits of categorization and territorialization inherent in the experience on Earth. If analyzed through the spectrum of an interdisciplinary approach involving anthropology, semiology, law, and human geography, I think that outer space enterprises can offer many insights into the cognitive and ethical/political hindrances to the effectiveness of human rights and their intercultural uses. Meanwhile the compulsive greed for a possessive territorialization of outer space and celestial bodies is growing by leaps and bounds. It haunts and imbues both astropolitics and space law. The astronauts’ semio-anthropological experience of human rights and cooperative coexistence seems to have been left in orbit. The future requires awareness and action by anthropologists, semioticians, cognitive scientists, geographers and lawyers, working all together in an interdisciplinary effort to move beyond approaching the experiential with a territorial mindset. The hope is that the “dark dream” of human exploitation/colonization of outer space will not turn from a political and legal speculation into a future reality. (shrink)

This essay, between serious and facetious, addresses an apparently secondary implication of the planetary tragedy produced by Covid-19. It coincides with the ‘problem of the veil,’ a bone of contention in Islam/West relationships. More specifically, it will address the question of why the pandemic has changed the proxemics of public spaces and the grammar of ‘living together.’ For some time—and it is not possible to foresee how much—in many countries people cannot go out, or enter any public places, without wearing (...) a sanitary mask. In short, almost all of us, by obligation or by urgent advice from the public authorities of the various countries, will not live the public sphere with our faces uncovered. The alteration of the social context affecting many Western countries will inevitably involve also the ‘local’ perception of the Islamic veil and—as a matter of equality—the consistency of the prohibition of wearing it. What will thus become of the ban on wearing it in public places established by some countries such as France and asseverated by the ECHR? If everyone can and will have to go around with their faces covered, why should only Islamic women be discriminated against? Will not the change in boundary conditions produced by Covid-19 also induce Western people to re-categorize the meaning of the veil? And will this re-categorization not directly affect the ‘fact’ of wearing the veil, that is, its empirical perception? And still, will this psycho-semantic change not show how empirical perceptions are cultural constructs rather than ‘objective facts,’ as such allegedly independent from the observer’s point of view? Consequentially, will the plurality of perceptions and cultural meanings related to the gesture of covering one’s own face not gain renewed relevance in determining the legitimacy of wearing the veil? The socio-semantic earthquake produced by Covid-19 compels us to rethink this and other issues orbiting around the translation of ‘facts’ into legal language; furthermore, it highlights the instrumentality of many ideological/partisan and ethnocentric assumptions passed off as objectivity regarding those alleged ‘facts.’ The essay will attempt to provide an answer to the above questions by proposing a semiotic-legal approach to intercultural conflicts and, indirectly, the pluralism in law. Recently the CJEU decision in the case of ‘Ewa Glawischnig-Piesczek v. Facebook Ireland Limited’ has raised the issue of the transcultural/trans-territorial signification of hate speech and hate crimes. Taking a cue from this decision and the related semiotic/legal implications, the paper proposes an analysis of the semio/pragmatic conditions for the production of performativity inherent in hate speech across different cultural universes of discourse. Given that web-based digital communication is global—at least, potentially—regardless of any spatial/political compartmentalization, it crosses different semio-cultural circuits. (...) This trans-spatiality implies transcultural crossings that can multiply and even transfigure the semantic implications of the original signifier and the related prognoses of ‘semantic effectiveness.’ Cultural boundaries therefore may function as a kind of ‘horizon of events’ for hate speech and, more inclusively, all linguistic acts and their legal signification/classification. The question then arises regarding whether and to what extent the performativity of hate speech is able to withstand the variation of cultural boundary conditions. Insofar as cultures are universes of experience, the issue to be investigated broadens, and ends up invoking the question of whether or not the production of performativity implicitly presupposes and tacitly epitomizes the semio-pragmatic implications/consequences (or, in Peircean terms, ‘bearings’) coextensive with cultural universes of experience. Were this the case, it would seem to call into question the very possibility of ‘making things only with words,’ or more explicitly, the alleged meaning of ‘linguistic acts.’. (shrink)

This essay addresses the relationships between prescription and description in legal rules. The analysis will focus on the culture-laden connotations of factual categories implied in all legal sentences and/or provisions. This investigation is spurred by the need to assess the impact of cultural difference in people’s understanding of legal imperatives and, symmetrically, how that impact is to be considered in the application of law. Differences in ways of categorizing the world could position the cultural pre-understanding required by law, and the (...) pluralism recognized and protected by constitutional principles and human/fundamental rights discourse, at a crossroads. Hence, even when we find an illegitimacy or an ignorance about what legal rules do not explicitly state but instead implicitly presuppose, this does not exclude that behind that ignorance there may be something worthy of legal protection. A question emerges: is it legitimate and reasonable to consider the ignorantia facti resulting from differing ways of categorizing the factual world as automatically and uncritically subject to the principle ignoratia legis non excusat? The essay continues with an assessment of the possible consequences of ignorantia facti in the administration of justice in multicultural societies and migration contexts. For this purpose, the opportunity for an intercultural use of law—including within national law—will be considered as a means of avoiding the discriminatory application of ignorantia facti. This topic will be addressed by leveraging both semiotic and cultural-anthropological analytical tools, including the well-known greimasien “contrat de véridiction”. (shrink)

The Bible recounts that in Eden, Adam gives names to all the animals. But those names are not only representations of the animals’ nature, rather they shape and constitute it. The naming by Adam contains in itself the divide between the human and non-human. Then, there is the Fall: Adam falls and forgets Being. Though he may still remember the names he gave to the animals in Eden, he is no longer sure about their meaning. Adam will have to try (...) to remember his own intentions. Through this effort he can also become aware of how he thinks, who he is, and what was the natural order he knew before the Fall. Medieval bestiaries tell us this story. Bestiaries are works of word play populated by animal figures. They depend on back-and-forth anthropomorphization, or circular metaphor. Animal figures are portrayed as both a mirror of human nature and a window on it. Bestiaries served as means for the moral education of human beings and, at the same time, a way to criticize the current state of humanity, including political and ethical habits. Within the moral irony of medieval bestiaries we can find the origin of the invented nature that modernity will try, subsequently, to insert into natural rights discourse through the teleological oxymoron of their naturalized and naturalizing counter-factuality. I will propose a historical-semiotic journey through the ironic representations of the human-beasts from the ancient world to contemporaneity. The proposal resulting from this cultural excursion is that the words included in the many national and international Rights declarations operate much like the names Adam gave to the animals and still more as they were re-read in medieval bestiaries, both textual and musical. So, can the words of Rights still serve as musical scores, open to an infinite play of re-signification? If we were able to overcome the modern culture/nature and human being/animal dualisms, we could cast, today as in the past, a zoological gaze on human rights by means of contemporary bestiaries and, in this way, perhaps find the gist of rights’ names and our ever regained and ever lost again humanity. In this essay both the facts/values and facticity/normativity divides are considered from the perspective of global semiotics and with specific regard to the relationships between legal meaning and spatial scope of law’s experience. Through an examination of the inner and genetic projective significance of categorization, I will analyze the semantic dynamics of the descriptive parts comprising legal sentences in order to show the intermingling of factual and axiological/teleological categorizations in the unfolding of legal experience. Subsequently, I will emphasize the translational (...) and enactive cognitive disposition underlying the construction of the second premise of the so-called judiciary syllogism and thereby the untenability of the idea that ‘law makes its facts.’ Hence, I will try to bring to the fore the cultural pre-assumptions encapsulated in the positivistic and therefore also formalistic or analytical approaches to legal experience and the loss of their inner consistency when legal experience confronts the phases and major changes of global semiotics. Finally, I will strive to relativize the opposition between the positivist and non-positivistic theories of law in view of an understanding of legal experience focused not only, or at least not primarily, on what ‘law is’ but also on ‘how’ it unwinds through, and _in spite of_, environmental and semantic transformations. In this paper we will demonstrate that a computational system can meet the criteria for autonomy laid down by classical enactivism. The two criteria that we will focus on are operational closure and structural determinism, and we will show that both can be applied to a basic example of a physically instantiated Turing machine. We will also address the question of precariousness, and briefly suggest that a precarious Turing machine could be designed. Our aim in this paper is to challenge (...) the assumption that computational systems are necessarily heteronomous systems, to try and motivate in enactivism a more nuanced and less rigid conception of computational systems, and to demonstrate to computational theorists that they might find some interesting material within the enactivist tradition, despite its historical hostility towards computationalism. Mario Bunge, author of the monumental Treatise on Basic Philosophy, is widely renowned as a philosopher of science. In this new and ambitious work he shifts his attention to the social sciences and the social technologies. He considers a number of disciplines, including anthropology, sociology, economics, political science, law, history, and management science. Bunge contends that social science research has fallen prey to a postmodern fascination with irrationalism and relativism. He urges social scientists to re-examine the philosophy and the (...) methodology at the base of their discipline. Bunge calls for objective and relevant fact-finding, rigorous theorizing, and empirical testing, as well as morally sensitive and socially responsible policy design. (shrink)

We put forth an account for when to believe causal and evidential conditionals. The basic idea is to embed a causal model in an agent’s belief state. For the evaluation of conditionals seems to be relative to beliefs about both particular facts and causal relations. Unlike other attempts using causal models, we show that ours can account rather well not only for various causal but also evidential conditionals.

This paper examines a fundamental philosophical difference between two radical postcognitivist theories that are usually assumed to offer the same view of cognition; namely the autopoietic theory and the enactive approach. The ways these two theories understand cognition, it is argued, are not compatible nor incompatible but rather incommensurable. The reason, so it is argued, is that while enactivism, following the traditional stance held by most of the cognitive theories, understands cognitive systems as constituting a natural kind, the autopoietic theory (...) understands them as constituting only a conventional kind. Additionally, the paper shows that AT’s conventionalist stance about cognition, far from being an undesirable or useless position, offers some methodological virtues that might be timely and welcome in the agitated and revolutionary climate of current cognitive science. We propose a method of learning indicative conditional information. An agent learns conditional information by Jeffrey imaging on the minimally informative proposition expressed by a Stalnaker conditional. We show that the predictions of the proposed method align with the intuitions in Douven, 239–263 2012)’s benchmark examples. Jeffrey imaging on Stalnaker conditionals can also capture the learning of uncertain conditional information, which we illustrate by generating predictions for the Judy Benjamin Problem.

El propósito de este artículo consiste en mostrar el carácter social del contractualismo de Fichte. Para realizar ese propósito se comienza examinando la conexión entre trabajo y ciudadanía como una condición de la legitimidad política. Luego se presenta esa conexión en el marco del siempre posible desarrollo histórico de la naturaleza humana. Por último, se indican las razones de la recepción de Fichte como un precursor del socialismo germánico.

Originally published as Scientific Research, this pair of volumes constitutes a fundamental treatise on the strategy of science. Mario Bunge, one of the major figures of the century in the development of a scientific epistemology, describes and analyzes scientific philosophy, as well as discloses its philosophical presuppositions. This work may be used as a map to identify the various stages in the road to scientific knowledge. Philosophy of Science is divided into two volumes, each with two parts. Part 1 (...) offers a preview of the scheme of science and the logical and semantical took that will be used throughout the work. The account of scientific research begins with part 2, where Bunge discusses formulating the problem to be solved, hypothesis, scientific law, and theory. The second volume opens with part 3, which deals with the application of theories to explanation, prediction, and action. This section is graced by an outstanding discussion of the philosophy of technology. Part 4 begins with measurement and experiment. It then examines risks in jumping to conclusions from data to hypotheses as well as the converse procedure. Bunge begins this mammoth work with a section entitled "How to Use This Book." He writes that it is intended for both independent reading and reference as well as for use in courses on scientific method and the philosophy of science. It suits a variety of purposes from introductory to advanced levels. Philosophy of Science is a versatile, informative, and useful text that will benefit professors, researchers, and students in a variety of disciplines, ranging from the behavioral and biological sciences to the physical sciences. In this paper we argue that the formalisms for decoherence originally devised to deal just with closed or open systems can be subsumed under a general conceptual framework, in such a way that they cooperate in the understanding of the same physical phenomenon. This new perspective dissolves certain conceptual difficulties of the einselection program but, at the same time, shows that the openness of the quantum system is not the essential ingredient for decoherence. †To contact the authors, please write to: (...) A discussion concerning whether to conceive Artificial Intelligence systems as responsible moral entities, also known as “artificial moral agents”, has been going on for some time. In this regard, we argue that the notion of “moral agency” is to be attributed only to humans based on their autonomy and sentience, which AI systems lack. We analyze human responsibility in the presence of AI systems in terms of meaningful control and due diligence and argue against fully automated systems in medicine. With (...) this perspective in mind, we focus on the use of AI-based diagnostic systems and shed light on the complex networks of persons, organizations and artifacts that come to be when AI systems are designed, developed, and used in medicine. We then discuss relational criteria of judgment in support of the attribution of responsibility to humans when adverse events are caused or induced by errors in AI systems. (shrink)

With special relativity, we seem to be facing a conundrum. It is a very well-tested theory; in this way, the Minkowski spacetime must be “capturing” essential features of space and time. However, its geometry seems to be incompatible with any sort of global notion of time. We might only have local notions of now (present moment) and time flow, at best. In this note, we will explore the possibility that a pretty much global notion of now (and time flow) might (...) be hiding in plain sight in the geometry of the Minkowski spacetime. (shrink)

One of the open questions in Bayesian epistemology is how to rationally learn from indicative conditionals (Douven, 2016). Eva et al. (Mind 129(514):461–508, 2020) propose a strategy to resolve this question. They claim that their strategy provides a “uniquely rational response to any given learning scenario”. We show that their updating strategy is neither very general nor always rational. Even worse, we generalize their strategy and show that it still fails. Bad news for the Bayesians.

This paper assesses the novelty of NSMs - or better, of any social and political movement in contemporary Western societies - in the light of their capacity to develop systems of relationships which cut across established social and political cleavages. It illustrates first the relational bases of Rokkan's concept of cleavage, and its contribution to the understanding of social movements; it then shows how Simmel's concept of the intersection of social circles and his distinction between concentric and crosscutting circles may (...) be fruitfully applied to the analysis of political cleavages and their changing forms. In the conclusions, the elements of an approach to the study of the newness of social movements, based on the integration of Rokkan's and Simmel's principles, are introduced. (shrink)

The question of the animal is one of the most intensely debated in the contemporary philosophical arena. The present article makes the case that Husserl’s phenomenological approach offers a stimulating and open-ended perspective on this discussion. The animal, indeed, is an instance of extreme otherness, which pushes phenomenology to its limits. The paper opens with an outline of the methodological issues raised by the question of the animal. It then examines what the animal—at this point, taken as a whole—and the (...) human being have in common and what Husserl sees as the main differences between them. A critical aspect here is the question of personhood. Finally, Sect. 3 traces Husserl’s progression from a general concept of animality to detailed and nuanced phenomenological descriptions of different animals and their intra- and inter-specific relationships. Husserl understands that the threshold that joins and divides human beings and animals is difficult to pin down, because there is more than one threshold: it is plural. (shrink)

A través del uso combinado de fuentes hebreas y cristianas, se ofrecerá una síntesis de la compleja red de factores, reglas y teorías que moldearon el ecosistema social de las comunidades hebreas en Cataluña. En este sentido, el autogobierno comunal era el resultado de la convergencia entre la legislación real y la producción normativa y teórica de las comunidades. Nuestro (...) objetivo es presentar el carácter poliédrico de esta realidad a través de los privilegios concedidos por los monarcas aragoneses a sus súbditos judíos, los modelos políticos desarrollados por los intelectuales hebreos, la legislación interna de las comunidades y el conjunto de factores sociales e históricos que impulsaron la evolución del sistema comunal. In this paper, it is presented a historical account of the formulation of the quantum relativistic wave equation of an electron – the Dirac equation, issues regarding its interpretation that arose from the very beginning, and the later formulation of this equation in relation to a quantized electron-positron field, which implies a new interpretation. The way in which solutions obtained under each interpretation of the equation relate to one another is also considered for the simple case of hydrogen-like problems.

Among the influential contributions of Alfred Tarski to logic and philosophy, and close in importance to his widely applied and discussed definition of truth, one finds his definition of logical consequence for formal languages. Like his definition of truth, Tarski's definition of logical consequence has been widely and fruitfully applied. Unlike the definition of truth, that of logical consequence has been rarely discussed philosophically. The main aim of this dissertation is to offer a thorough discussion of some philosophical issues arising (...) from the neglected definition. ;The point of departure is an interpretative reading of the relevant writings by Tarski. This reading yields historically interesting data that refute other recent readings. It also provides philosophical illumination, by clarifying how Tarski thought that his definition satisfied some pretheoretic desiderata. ;Next it is discussed whether Tarski's definition satisfies other pretheoretic desiderata, not stated by Tarski and in some cases not endorsed by him, but which are desiderata nonetheless from reasonable standpoints. These include the desiderata that all instances of logical consequence in Tarski's defined sense be instances of analytical implication, and that they be instances of valid implication. The conclusion of this part of the dissertation is that, under reasonable assumptions regarding the field of applicability of the definition and the concepts used in it, there are reasons to believe that these desiderata are met, and none to believe they are not. ;Finally, the problem of logical constants is examined. The concept of a "logical constant" is the only concept not taken from logic and mathematics that appears in Tarski's definition. The problem of logical constants is that of replacing the primitive 'logical constant' with a defined, better understood concept, and in a such a way that the resulting defined concept of logical consequence meets the previously discussed desiderata. The main conclusion of this part is that some attempts to do this replace the obscure with the more obscure, while other attempts that seem to be in the right spirit have shortcomings of their own. Recently, Michael Wheeler has argued that despite its sometimes revolutionary rhetoric, the so called 4E cognitive movement, even in the guise of ‘radical’ enactivism, cannot achieve a full revolution in cognitive science. A full revolution would require the rejection of two essential tenets of traditional cognitive science, namely internalism and representationalism. Whilst REC might secure antirepresentationalism, it cannot do the same, so Wheeler argues, with externalism. In this paper, expanding on Wheeler’s analysis, we argue that what compromises REC’s externalism is (...) the persistence of cognitively relevant asymmetries between its purported cognitive systems and the environment. Complementarily, we argue that an antirepresentationalist ancestor of enactivism, the autopoietic theory of cognition, is able to deliver and secure externalism, thus offering the explosive combination that Wheeler claims us needed for a revolution in cognitive science. Considering Butler's "tragic trilogy"-a set of interventions on Sophocles' Antigone, Euripides' Bacchae, and Aeschylus's Eumenides-this book seeks to understand not just how Butler uses and interprets Greek tragedy, but also how tragedy shapes Butler's thinking, even when their gaze is directed elsewhere. Through close readings of these tragedies, this book brings to light the tragic quality of Butler's writing. It shows how Butler's mode of reading tragedy-and, crucially, reading tragically-offers a distinctive ethico-political response to the harrowing dilemmas of our current (...) moment. (shrink)

In 1951 Eric Voegelin dedicated a long and very dense essay to the Utopia of Thomas More, subsequently integrated in a larger portrait of the Renaissance political thought. The critical interpretation of Voegelin focuses on the breakdown of the traditional order and the emerging of a new vision of Man and Politics in the early sixteenth century, and particularly on the risks related to the mundane eschatology of which the work of More is involuntary and somewhat inconsistent anticipation.

In this article we will put forward the proposal that the concept of functional diversity can be considered as a relevant analytical category necessarily applicable as a perspective of analysis to the social sphere. To this end, we will situate the idea of functional diversity in six different and interrelated dimensions of human experience, which we call: body dimension, relational, political, ethical, social and cultural dimension, in relation to the corresponding dimensions of the social sphere. The idea of functional diversity (...) will appear as a fundamental element in each of these six dimensions, extending from the body to culture. We consider this breadth in the scope of the idea’s presence to be essential as an argument in favour of its conceptual importance. This approach to the idea of functional diversity will involve, at the same time, a deconstructive examination of the discourse of ableism, which we consider to be opposed to the discourse emanating from the anti-ableist perspective of functional diversity. If, as such a category, functional diversity manages to embrace such a wide spectrum of dimensions of human experience and social life, the possibility of beginning to include it in an epistemic-political sense as a necessary analytical perspective in the social sphere acquires value, perhaps as relevant in the future as the gender perspective is at present.
