The legitimacy of humanitarian intervention has been contested for more than a century, yet pressure for such intervention persists. Normative evolution and institutional design have been closely linked since the first debates over humanitarian intervention more than a century ago. Three norms have competed in shaping state practice and the normative discourse: human rights, peace preservation, and sovereignty. The rebalancing of these norms over time, most recently as the state’s responsibility to protect, has reflected specific international institutional environments. The contemporary (...) legitimacy of humanitarian intervention is based on UN Security Council authorization of the use of force. Although the Security Council is often viewed as representative of great-power influence, international acceptance of its role is based on the role of non-permanent members and their support for the sovereignty norm. The current rebalanced norms supporting humanitarian intervention, institutional bias that protects state sovereignty, and the changing character of mass violence may undermine the tenuous contemporary legitimacy of humanitarian intervention. Normative adjustments and new institutional designs are required to insure the legitimacy of international action that protects populations against mass violence. (shrink)

Law is an ontologically ideal entity. This feature shall be explored in order to explain why law cannot be perceived by the senses, why its contents can remain constant over time, why it can in principle be translated and why it does not have a dual nature. Due to law’s ontologically ideal nature it is independent from time and space, normative in kind and open for rational arguments. In a recent paper [J. G. Vargas and D. G. Torr, Found. Phys. 27, 599 (1997)], we have shown that a subset of the differential invariants that define teleparallel connections in spacetime generates a teleparallel Kaluza-Klein space (KKS) endowed with a very rich Clifford structure. A canonical Dirac equation hidden in this structure might be uncovered with the help of a teleparallel Kähler calculus in KKS. To bridge the gap to such a calculus from the existing Riemannian Kähler calculus in (...) spacetime, we commence the construction of a teleparallel Kähler calculus in spacetime. In the process, we notice: (a) Unknown to him, one of Einstein's equations in his attempt at unification with teleparallelism states that the interior covariant derivative of the torsion is zero. (b) A mechanism exists in the tangent bundle of teleparallel spaces for producing confinement (in the applicable cases, one would have to show why nonconfinement also occurs, rather than the other way around). (c) When the torsion is not zero, the interior covariant derivative in the sense of Kähler, δF, does not coincide with *d*F. The system (dF = 0, δF = j) rather than (dF = 0, *d*F = j) should then be used for generalizations of Maxwell's electrodynamics. (shrink)

Six of the essays were originally in 1958 in a special issue of "Daedalus"; of the remainder there is a selection from Whitehead's Symbolism: Its Meaning and Effect, and three original contributions of value, of which Erich Kahler's essay on "The Nature of Symbolism" is outstanding.--J. In 1960–1962, E. Kähler enriched É. Cartan’s exterior calculus, making it suitable for quantum mechanics (QM) and not only classical physics. His “Kähler-Dirac” (KD) equation reproduces the fine structure of the hydrogen atom. Its positron solutions correspond to the same sign of the energy as electrons.The Cartan-Kähler view of some basic concepts of differential geometry is presented, as it explains why the components of Kähler’s tensor-valued differential forms have three series of indices. We demonstrate the power of his calculus by (...) developing for the electron’s and positron’s large components their standard Hamiltonian beyond the Pauli approximation, but without resort to Foldy-Wouthuysen transformations or ad hoc alternatives (positrons are not identified with small components in K ähler’s work). The emergence of negative energies for positrons in the Dirac theory is interpreted from the perspective of the KD equation. Hamiltonians in closed form (i.e. exact through a finite number of terms) are obtained for both large and small components when the potential is time-independent.A new but as yet modest new interpretation of QM starts to emerge from that calculus’ peculiarities, which are present even when the input differential form in the Kähler equation is scalar-valued. Examples are the presence of an extra spin term, the greater number of components of “wave functions” and the non-association of small components with antiparticles. In this paper, we present an intrinsic characterisation of projective special Kähler manifolds in terms of a symmetric tensor satisfying certain differential and algebraic conditions. We show that this tensor vanishes precisely when the structure is locally isomorphic to a standard projective special Kähler structure on \/\mathrm {S}\mathrm {U})\). We use this characterisation to classify 4-dimensional projective special Kähler Lie groups.

The letters convey a picture of Broch’s political discussions with Kahler. Other topics covered in the letters include the intentions of his novels and his theory of mass hysteria as well as the cultural-historical essay “Hofmannsthal and his Time”. The letters also reveal personal details ‑ old Austrian retrospectives as well as current friendships with women and the efforts of his sponsors to promote his fame.

Once Weber's entire conception of science is taken as a basis for an inspection of Kahler's argumentation against Weber, then against Kahler's opinion Weber's positions do not at all appear obsolete or outmoded, but innovative and topical. Depending more upon fundamental axioms of the George-Circle than it has been outlined in scholarship so far, Kahler's own claim for novelty at the same time has to be clearly repudiated.

The theory of exterior differential systems plays a crucial role in Cartan’s whole mathematical production. As he once recognized, all the germs of his subsequent work were contained there. Indeed, it provided him with powerful technical tools that turned out to be very useful in many different fields such as the theory of partial differential equations, the theory of infinite dimensional Lie groups (Lie pseudogroups) and differential geometry. Nevertheless, scarce attention has been paid to this area of historical research thus (...) far. Although authoritative scholars have investigated the foundation of exterior differential calculus in Cartan’s early papers, no specific analysis of Cartan’s subsequent works laying the foundations of what nowadays is known as the Cartan–Kähler theory has been yet provided. This article represents a first attempt to remedy this unsatisfactory state of affairs by focusing on Cartan’s work on Pfaffian systems at the very beginning of the past century. The analysis of Cartan’s relevant papers is preceded by a description of the historical context in which such contributions were conceived. In this respect, special emphasis will be put on some works by Engel and von Weber on Pfaffian systems, which laid the basis for the subsequent geometrical developments of Cartan’s theory of exterior differential systems. This Article falls into three general parts. The first part starts with an important question: is the insanity defense constitutionally required? The United States Supreme Court will finally try to answer this question next term in the case of Kahler v. Kansas. -/- I say “finally” because the Court refused to answer this question in 2012 when it denied certiorari to an appeal brought by John Joseph Delling, a severely mentally ill defendant who was sentenced to life in prison (...) three years earlier for two murders. Delling never had the opportunity to plead the insanity defense because his home state, Idaho, had abolished it in 1982. -/- By depriving Delling of the right to plead insanity, Idaho violated Delling’s Fourteenth Amendment right to due process and his Eighth Amendment right against “cruel and unusual” punishment. Naturally, the same is true for many other mentally ill and disabled defendants who have been prosecuted in Idaho and in the other three states that have abolished the insanity defense: Kansas, Montana, and Utah. -/- The second general part of this Article notes an insight that I stumbled upon in the course of researching the first part: the insanity defense and the mistake of law defense both require ignorance of the law, what I refer to as “normative ignorance.” Indeed, normative ignorance is what makes both of these defenses exculpatory in the first place. -/- Given this critical connection, there is a way for Idaho, Kansas, Montana, and Utah to resume compliance with the Constitution. Instead of reinstating the insanity defense per se, which might be politically unpopular, they should just broaden their mistake of law defense to include normative ignorance caused by cognitive incapacity that is itself caused by mental illness or disability. -/- Still, this Article is not merely directed at these four western states. It is directed at the other forty-six states as well. Because they already have an insanity defense, they need not incorporate it into their mistake of law defense. But in the third general part, I will argue that they should still expand their mistake of law defense to cover defendants who either lack a reasonable opportunity to learn the law or reasonably but mistakenly infer from widely accepted norms or ethics that their conduct is lawful. The power of the Dirac algebra is illustrated through the Kähler correspondence between a pair of Dirac spinors and a 16-component bosonic field. The SO(5, 1) group acts on both the fermion and boson fields, leading to a supersymmetric equation of the Dirac type involving all these fields.

It is shown that relativistic spacetimes can be viewed as Finslerian spaces endowed with a positive definite distance (ω0, mod ωi) rather than as pariah, pseudo-Riemannian spaces. Since the pursuit of better implementations of “Euclidicity in the small” advocates absolute parallelism, teleparallel nonlinear Euclidean (i.e., Finslerian) connections are scrutinized. The fact that (ωμ, ω0 i) is the set of horizontal fundamental 1-forms in the Finslerian fibration implies that it can be used in principle for obtainingcompatible new structures. If the connection (...) is teleparallel, a Kaluza-Klein space (KKS) indeed emerges from (ωμ, ω0 i), endowed ab initio with intertwined tangent and cotangent Clifford algebras. A deeper level of Kähler calculus, i.e., the language of Dirac equations, thus emerges. This makes the existance of an intimate relationship between classical differential geometry and quantum theory become ever more plausible. The issue of a geometric canonical Dirac equation is also raised. (shrink)

We point out that a certain complex compact manifold constructed by Lieberman has the dimensional order property, and has U-rank different from Morley rank. We also give a sufficient condition for a Kahler manifold to be totally degenerate (that is, to be an indiscernible set, in its canonical language) and point out that there are K3 surfaces which satisfy these conditions.

In this work, we show how this twofold role of observables constitutes a key feature in the conceptual analysis of classical and quantum kinematics, shedding a new light on the distinguishing feature of the quantum at the kinematical level. A work in this genre inevitably invites comparison with the 1953 anthology of Vivas and Krieger. Though containing some duplication of the contents of the earlier volume, Weitz's collection makes many additional, fine selections available--e. g., three examples of Erwin Panofsky's techniques; Hospers' "The Concept of Artistic Expression"; Malraux on style; Chapter IX of Cassirer's Essay on Man; and a direct encounter in which Erich Kahler has prepared a traditional, humanistic rebuttal to Weitz's own contention that 'art' cannot be (...) defined. This is a basically expository article, with some new observations, tracing connections of the quantum potential to Fisher information, to Kähler geometry of the projective Hilbert space of a quantum system, and to the Weyl-Ricci scalar curvature of a Riemannian flat spacetime with quantum matter.

The article is devoted to social problems of modern science (as it were interpreted Max Weber) considered in the context of the system-communicative approach by N. Luhmann. In contrast to the modern work of art, the modern science, as M. Weber believes, is associated with the fundamental unattainability of “true being”, and, as a result, with the transitory character of any scientific achievement. The specialty of modern science, as Weber noted, is determinated, on the one hand by its self-understanding, due (...) to the “peculiarity of the current moment”, and, on the other, by its transformation into a kind of blind spot of scientific observation. As a result, Weber formulated the main problem of the meaning of modern science: he wondered why any scientist needs a science under (1) external alienation and (2) inaccessibility of a scientific object? Moreover, the category of truth not just acquires its special value, but also sets a special meaning to the purpose of scientific communication, that becomes an object but not a property of scientific search. The main content of the article is the study of the Weberian concepts of the external (science as a profession) and internal (science as vocation) social factors of modern science as they were interpreted by E. von Kahler, G. Rickert, M. Scheller, K. Loewit. The authors discuss their attempts to modernize the fundamental Weberian distinction of truth/value as a principle of inclusion in the scientific community, that was formulated as a response to the “Weber’s challenge”. The authors argue that von Kahler criticized the Weberian concept for the incompatibility of the spatial and temporal discreteness of science within the “organic understanding” of the unity of the world. At the same time Scheler and Rickert payed special attention to the problem of subject specification of science. K. Levit discussed the possibility of Weber’s substitution of objectivity as a key distinction of modern knowledge with some opposite attribute. In the final part, the authors summarize the inconsistency of predictions about the further internal differentiation of scientific disciplines and the rejection of research motive for “genuine being”. Rudolf Carnap is widely regarded as one of the most important philosophers of the twentieth century. Born in Germany and later a US citizen, he was a founder of the philosophical movement known as Logical Empiricism. He was strongly influenced by a number of different philosophical traditions, and also by the German Youth Movement, the First World War, and radical socialism. This book places his central ideas in a broad cultural, political and intellectual context, showing how he synthesised many different (...) currents of thought to achieve a philosophical perspective that remains strikingly relevant in the twenty-first century. In a fascinating article in The Journal of Ethics, Eleonore Stump contends that while the flicker of freedom defense is the best available strategy for defending the principle of alternative possibilities against the threat posed to that principle by the Frankfurt cases, the defense is ultimately unsuccessful. In this article I identify a number of difficulties with Stump’s criticism of the flicker strategy. Along the way, I also clarify various nuances of the strategy that often get overlooked, and I highlight (...) the advantages of one version of it in particular. (shrink)

Research suggests that contact with nature can be beneficial, for example leading to improvements in mood, cognition, and health. A distinct but related idea is the personality construct of subjective nature connectedness, a stable individual difference in cognitive, affective, and experiential connection with the natural environment. Subjective nature connectedness is a strong predictor of pro-environmental attitudes and behaviors that may also be positively associated with subjective well-being. This meta-analysis was conducted to examine the relationship between nature connectedness and happiness. Based (...) on 30 samples ( n = 8523), a fixed-effect meta-analysis found a small but significant effect size ( r = 0.19). Those who are more connected to nature tended to experience more positive affect, vitality, and life satisfaction compared to those less connected to nature. Publication status, year, average age, and percentage of females in the sample were not significant moderators. Vitality had the strongest relationship with nature connectedness ( r = 0.24), followed by positive affect ( r = 0.22) and life satisfaction ( r = 0.17). In terms of specific nature connectedness measures, associations were the strongest between happiness and inclusion of nature in self ( r = 0.27), compared to nature relatedness ( r = 0.18) and connectedness to nature ( r = 0.18). This research highlights the importance of considering personality when examining the psychological benefits of nature. The results suggest that closer human-nature relationships do not have to come at the expense of happiness. Rather, this meta-analysis shows that being connected to nature and feeling happy are, in fact, connected. (shrink)

The purpose of the present systematic and critical review was to assess the findings and to identify the gaps in the literature concerning gay and bisexual fathers. A comprehensive search of relevant literature using electronic databases and reference lists for articles published until December 2016 was conducted. A total of 63 studies, spanning from 1979 to 2016, were collected. More than half of the studies were published after 2011 and the overwhelming majority were conducted in the United States. Nine themes (...) were identified in the studies reviewed: (1) Pathways to fatherhood; (2) Motivations for fatherhood; (3) Parenting experiences and childrearing; (4) Family life and relationship quality; (5) Gender and father identities and gender-role orientation; (6) Disclosure of sexual identity; (7) Social climate; (8) Father’s psychosocial adjustment; and (9) Children’s psychosocial adjustment. It was found that research on gay fatherhood appears to be more heterogeneous than on lesbian motherhood, perhaps because of the variety of pathways to parenthood (via co-parenting, adoption, fostering, or surrogacy). Two-father families are becoming more visible in research on sexual minority parenting and gradually transforming the conceptualization of parenting in family research. (shrink)

How far has the Darwinian revolution come? To what extent have evolutionary ideas penetrated into the social sciences and humanities? Are the “science wars” over? Or do whole blocs of disciplines face off over an unbridgeable epistemic gap? To answer questions like these, contributors to top journals in 22 disciplines were surveyed on their beliefs about human nature, culture, and science. More than 600 respondents completed the survey. Scoring patterns divided into two main sets of disciplines. Genetic influences were emphasized (...) in the evolutionary social sciences, evolutionary humanities, psychology, empirical study of the arts, philosophy, economics, and political science. Environmental influences were emphasized in most of the humanities disciplines and in anthropology, sociology, education, and women's or gender studies. Confidence in scientific explanation correlated positively with emphasizing genetic influences on behavior, and negatively with emphasizing environmental influences. Knowing the current actual landscape of belief should help scholars avoid sterile debates and ease the way toward fruitful collaborations with neighboring disciplines. (shrink)

To celebrate the four-hundredth anniversary of Galileo's birth, the University of Rochester held a series of lectures on the thought and influence of Galileo; there were six contributors and their work groups itself into three areas. The first of these is the importance and relevance of Galileo in modern thought and society: these were discussed by Giorgio di Santillana and Gilgerto Bernardino respectively. Norwood Hanson and E. W. Strong study the work of Galileo in dynamics and his theory of measurement. (...) The last two papers are concerned with the role of science in society—they spring from the confrontation of Galileo and the Church, the first indication of the special problems the scientific disciplines would face in their intercourse with the rest of society—and are by Philip Abelson and Erich Kahler. Although this brief collection cannot provide a full view of the scope of Galileo's activities and their subsequent impact, we are still able to feel that some of the vast gap between ourselves and the initiator of modern physics has been spanned, and that he can be seen more clearly for it.—P. The article deals with the so-called „System Althoff“, that is the network of advisers Friedrich Althoff, ministerial director of the Prussian ministry of cultural affairs, created and employed in order to administer the faculties of theology at Prussian universities. In addition to leading the process of decision making in the ministry itself, he recruited a number of theology professors from the two dominant Church parties to advise him on appointing new professors. Famously, he consulted the opponents Hermann Cremer, a “positive” (...) biblicistic Systematic professor in Greifswald, and Adolf Harnack, a Ritschlian Church Historian in Berlin, but he also counted theologians like Friedrich Loofs and Martin Kähler among his advisers. The article’s main body focusses on Althoff’s correspondence with Cremer and Harnack in order to analyse the minister’s practice of administration in depth. In a second step the paper will relate the minister’s relationship with his two most prominent theological advisers to the wider „System Althoff“ in theology. Both parts serve to show that Althoff rationalized and professionalized the process of decision making in the ministry of cultural affairs by carefully considering different professorial advises in light of the current (church) political climate. A growing body of literature has engaged with mass incarceration as a public health problem. This article reviews some of that literature, illustrating why and how bioethicists can and should engage with the problem of mass incarceration as a remediable cause of health inequities. “Mass incarceration” refers to a phenomenon that emerged in the United States fifty years ago: imprisoning a vastly larger proportion of the population than peer countries do, with a greatly disproportionate number of incarcerated people being members (...) of marginalized racial and ethnic groups. Bioethicists have long engaged with questions of health justice for incarcerated people, including consent issues for those participating in research and access to health care. This article provides an overview of the individual and public health impacts of mass incarceration. The article argues that mass incarceration is a bioethics issue that should be addressed in medical education, identifies opportunities for bioethicists to guide hospitals’ interactions with law enforcement officials, and calls on bioethicists to be in conversation with medical and nursing students and health care professionals about these groups’ advocacy efforts concerning structural racism, police violence, and mass incarceration. This study concerns the ideas of one particular philosopher, Henri Bergson, whose views of time, intuition, and creativity have had a significant impact on art, literature, and the humanities, both in his time and in our own. Although it is generally recognized that Bergson's ideas have significantly impacted the arts and the humanities, it has not been recognized how they have also had a creative influence on the sciences as well. Nor has it been realized that this was one of (...) his most basic contentions. Bergson's conception of intuition--his fundamental insight into reality--was not limited to fugitive insights into human existence. By realizing previously unsuspected possibilities for research and discovery, his endeavors were also meant to make possible new advances in the sciences. If it enabled his cousin by marriage, Marcel Proust, to explore human memory in depth, it also inspired psychologists like Daniel Schachter to use Bergson's ideas to make real contributions to contemporary memory science. If his notion of creative evolution brought many thinkers to a belief in human creative freedom, it brought others (notably Alexis Carrel and Pierre Lecomte de Noüy) to a scientific study of biological time. Among his successful speculations was the theory of the Big Bang cosmology. 'Getting Bergson Straight' shows many points at which Bergson's ideas anticipated future developments in the sciences. This was seen clearly by the Nobel Prize-winning physicist Luis de Broglie who viewed Bergson's physics as presaging quantum physics. Thus, the text is well situated for arts, humanities, social science, and natural science classrooms studying creative thinking and/or intellectual history. (shrink)
