With regard to organ donation, Germany is an ‘opt-in’ country, which requires explicit consent from donors. The relatives are either asked to decide on behalf of the donors’ preferences, if these are unknown or if the potential donor has explicitly transferred the decision to them. At the core of this policy lies the sociocultural and moral premise of a rational, autonomous individual, whose rights require legal protection in order to guarantee a voluntary decision. In concrete transplantation practices, the family plays (...) an even more important role. Potential donors and their families decide while being embedded in relations, a point which does still not gain full recognition. This particular discrepancy between policy and practice creates conflicts, which remain taboos of academic inquiry and public discourse. Our analysis shows a plurality of the family’s role in the transplantation process, which reveals an inner tension of the organ donation system. This tension provokes epistemic opacity on the one hand and different collective strategies as responses to discursive exclusion on the other. In future deliberations about organ donation, it is important to create spaces for open discussion, but also practices of communicative engagement, which take care of the needs and emotions attached to taboos. In the last few decades, the democratic credentials of global governance institutions have been extensively debated in the fields of international relations and political philosophy. However, despite their prominent role in the architecture of global governance, club governance institutions like the Group of Seven (G7) or the Group of Twenty (G20) have rarely been considered from the perspective of democratic theory. Focussing on the G20, this paper analyses its functions in international political practice and discusses whether, in exercising these functions, (...) the G20 exhibits a democratic deficit. As a standard of democracy, the analysis uses the all-affected principle, according to which all those who are affected by a policy decision should be given the opportunity to participate in decision-making. This paper identifies several democratic shortcomings of the G20, for instance related to the exclusion of citizens of non-member states and a lack of parliamentary and public control. By describing realisable reforms that could to some degree alleviate these shortcomings, it is shown that more democratic institutional alternatives are feasible. Thus, the ascription of a democratic deficit to the G20 is warranted. (shrink)

Global governance has a major impact on the lives of people around the world. However, traditional theories of legitimacy were usually developed for states and are not suitable for the diversity of global governance institutions that exist today. This book first develops a normative concept of legitimacy that is applicable to all political institutions. According to this concept, to regard an institution as legitimate means ascribing it the right to exercise its function in political practice. Secondly, the book discusses how (...) the use of this concept opens up new perspectives in the debate on legitimacy criteria for global governance institutions. In this context, the book analyses the relationship of legitimacy to the values of justice and democracy and discusses the role of feasibility constraints and the all-affected principle in legitimacy judgements. The concept of legitimacy as the right to function opens up the conceptual space to accommodate the insight that legitimacy criteria are not the same for all global governance institutions, but depend on their function and context. Thirdly, the book applies the developed theoretical framework to a specific global governance institution, the G20. (shrink)

One supposition underlying the Anderson & Lebiere target article is that the maximally broad “encompassing of its subject matter – the behavior of man” is regarded as an unquestioned quality criterion for guiding cognitive research. One might argue for an explicit specification of the limitations of a given paradigm, rather than extending it to apply to as many domains as possible.

Das Problem, Kierkegaard zu übersetzen, untersuchen Eberhard Schreiber, Tim Hagemann und Caren Wicka vor allem am Beispiel von Schrempfs geliebt-gehassten Übersetzungen. Klaus Müller und Marcello Neri zeigen, welch wichtige Impulse Kierkegaard dem italienischen Hermeneutiker Luigi Pareyson und dem deutschen Theologen Eugen Drewermann gab. (shrink)

La séduction est une constante de la relation humaine. Elle est à la fois prise de pouvoir sur l’autre et bénéfice narcissique pour le séducteur, qu’elle conforte dans l’estime qu’il a de lui-même. La séduction appartient aux deux sexes, mais, lorsqu’on cherche dans la littérature des exemples de séduction, on trouve curieusement plus de séducteurs que de séductrices. À partir d’exemples littéraires, l’auteur tente de définir les voies et les moyens de la séduction. Transgression et perversion avec Don Juan, plaisir (...) et instinct avec Casanova, stratégie et ruse avec Valmont. Sans oublier les plans élaborés de la carte du tendre, héritière au XVII e siècle de l’amour courtois du Moyen Âge, et la méthode très sophistiquée de séduction exposée par le philosophe danois Soeren Kierkegaard dans Le journal d’un séducteur.
