In 2016, France passed a major law that is unique in giving terminally ill and suffering patients the right to the controversial procedure of continuous deep sedation until death (CDS). In so doing, the law identifies CDS as a sui generis clinical practice, distinct from other forms of palliative sedation therapy, as well as from euthanasia. As such, it reconfigures the ethical debate over CDS in interesting ways. This paper addresses one aspect of this reconfiguration and its implications for the (...) intentions at work in this complex time at the end of life. The concept of intention is often considered central to the ethics of end-of-life care, but its role is recognized to be problematic, with charges of elusiveness and ambiguity. I aim to show that consideration of the French law affords a new understanding of the intentionality of CDS, and that in addition to the obvious importance of this for clarifying the ethics of the practice, it may suggest new ways of addressing the wider problem of ambiguous clinical intentions at end of life. Soil balancing is widely used in organic farming, but little is known about the practice because technical knowledge and goals for the practice are produced and negotiated within an alternative community of practice (CoP). We used a review of the private soil balancing literature and semi-structured interviews with farmers and consultants to document the knowledge, shared meanings, and goals of key actors within the soil balancing CoP. Our findings suggest this CoP is dominated by discourse between private consultants and farmers, (...) with few contributions to or from scientists or the peer reviewed literature. The idea of soil balancing is centered around improving soil quality through adjustments in Base Cation Saturation Ratios (BCSR), and practitioners report a wide range of positive agronomic outcomes. For most soil balancers, however, BCSR is only one part of a broader approach to soil health management that also utilizes traditional soil fertility recommendations and soil health-building cultural management practices. Meanwhile, a survey of land grant university soil fertility specialists and the peer-reviewed literature documented a high degree of skepticism and a lack of scientific evidence that BCSR can boost crop yields. We conclude that this scientific discourse reflects a disconnect from the practices and meanings used in the soil balancing CoP. While tensions between the dominant and niche agricultural knowledge systems are not unique, we believe a better appreciation for the nuanced meanings and goals within the soil balancing CoP present an opening for expanded collaborations with scientists doing research on soil health. Science studies has long been concerned with the theoretical and methodological challenge of mess—the inevitable tendency of technoscientific objects and practices to spill beyond the neat analytic categories we construct for them. Nowhere is this challenge greater than in the messy world of large-scale collaborative science projects, particularly though not exclusively in their start-up phases. This article examines the complicated life and death of the WATERS Network, an ambitious and ultimately abandoned effort at collaborative infrastructure development among hydrologists, engineers, and (...) social scientists studying water. We argue in particular against the “forensic imagination,” a particular style of accounting for failure in the messy world of large-scale network development, and against two common conceptual and empirical pitfalls that it gives rise to: defaults to formalism and defaults to the future. We argue that alternative postforensic approaches to “failures” like the WATERS Network can support forms of learning and accountability better attuned to the complexities of practice and policy in the real world of scientific collaboration and network formation. Color has been studied for centuries, but has never been completely understood. Digital technology has recently sparked a burgeoning interdisciplinary interest in color. The fact that color is a quality of perception rather than a physical quality brings up a host of interesting questions of interest to both artists and scholars. What's left of a dream is stored at the Stanford Law School library in 12 fat green loose-leaf binders and several legal boxes of supporting documents and briefs. They chronicle the 54 days that Lawrence Lessig, the Elvis of cyberlaw, helped Judge Thomas Penfield Jackson with the mother of all tech litigation: Department of Justice v. Microsoft. It was to be Lessig's greatest moment.

The guiding inspiration of this book is the attraction and distance that mark the relation between anthropology and philosophy. This theme is explored through encounters between individual anthropologists and particular regions of philosophy. Several of the most basic concepts of the discipline—including notions of ethics, politics, temporality, self and other, and the nature of human life—are products of a dialogue, both implicit and explicit, between anthropology and philosophy. These philosophical undercurrents in anthropology also speak to the question of what it (...) is to experience our being in a world marked by radical difference and otherness. In The Ground Between, twelve leading anthropologists offer intimate reflections on the influence of particular philosophers on their way of seeing the world, and on what ethnography has taught them about philosophy. Ethnographies of the mundane and the everyday raise fundamental issues that the contributors grapple with in both their lives and their thinking. With directness and honesty, they relate particular philosophers to matters such as how to respond to the suffering of the other, how concepts arise in the give and take of everyday life, and how to be attuned to the world through the senses. This memoiristic essay is a contribution to the Common Knowledge symposium titled “Fuzzy Studies: On the consequence of blur.” While probing his personal memories and making a case for devaluing our intellectual constructs, the author, an anthropologist, examines paintings by Paul Cézanne and Pieter Bruegel, poems by Wallace Stevens and W. H. Auden. The essay argues that each self-deluding “reality” we construct is only temporary, destined to fall back into the elusive, undifferentiated zone of overlap and ambiguity from which it (...) has emerged. Therefore, the author urges, we should temper the intellectual “rage for order” with an openness to chaos and contingency, along with sustained and careful attention to creative works and religious practices in which the mind appears to grasp its limits. In this way, we may substitute what Stevens called “ghostlier demarcations” for our clear, exact, and self-deceptive certainties. (shrink)

The first was practical to bring together and assess the wealth of data provided over the previous decade while realizing that newer data would come in even as the book was being printed. He hoped the comprehensive picture would prepare the reader and himself to that new data as it emerged. The second was to produce a textbook about general relativity in which geometric ideas were not given a starring role for (...) This paper presents a way of thinking about how to respond to the pluralism of modern societies that avoids any commitment to contractualist norms of political justification. The argument developed appeals to the notion of a constitutional settlement. Constitutional settlements are complex on-going social practices that both express certain values to which political societies are committed and establish procedures for resolving disputes among members of these societies. As such, they are a product of both moral commitment and the balance of (...) power. The paper shows how constitutional settlements relate to issues of stability and non-subjugation in politics, and explains how they can ground a distinction between justice and legitimacy. (shrink)

In this paper, I build on Wittgenstein’s metaphor of a toolbox to introduce the metaphor of ‘tool confusion’ – how differing conceptual constructs may be applied, or misapplied, to one another and the effect that such applications have on the advancement of management theory. Moving beyond metaphor, I investigate a theory of management through two specific philosophical lenses (Popper and Lyotard). This analysis tests both the theory and the philosophies with regard to how each philosophy may be applied as a (...) tool to advance theory towards more effective application. Preliminary conclusions confirm that the application of partial philosophies is not as useful as the application of complete philosophies. Deeper contemplation, however, suggests that there is no upper limit to the completeness of philosophies. Thus, the problem of completeness is inescapable. In place of completeness, I explore the use of perceptual tools that are more specific, foundational and concise. Engaging in a second investigation, I use structures of logic (circular, linear, branching and co-causal) to investigate the subject theory. This investigation suggests at least two important insights relating to the structure of theory and the fuzziness of theory. Combined, these investigations and related conversations suggest rigorous methods for advancing theories and a more normative role for the philosophy of management that will support the accelerated advancement of management theory and practice. The recent case of German siblings Patrick Stübing and his sister Susan Karolewski has reignited debate over the criminalisation of sexual intercourse among consanguine descendants. The primary justification for criminalising incest is the purported increased risk of genetic disabilities among offspring, but is criminalising sexual intercourse an empirically sound and proportionate response to this increased risk? To answer this question we must consider the specifics of the harm in question and the magnitude of the harms of the intervention. The example (...) of incest law has important implications for liberal societies. If we can justify imprisoning consenting adults for choosing partners who will increase the risk of having children with disabilities, then we set a troubling precedent for all couples who may pass on genetic disorders to their children. Although the essays in this volume acknowledge that the primary locus for the love and care of children is the family, they also engage other contexts including religious communities, courts, and legislative bodies.In a section dealing with social-psychological perspectives on this theme, Peter Benson and Eugene Roehlkepartain make the case that doing the best for children requires shifting from a deficit model that focuses on what children lack to a model that emphasizes their developmental assets. Some properties are causally relevant for a certain effect, others are not. In this paper we describe a problem for our understanding of this notion and then offer a solution in terms of the notion of a program explanation.

We explore the different meanings of “quantum uncertainty” contained in Heisenberg’s seminal paper from 1927, and also some of the precise definitions that were developed later. We recount the controversy about “Anschaulichkeit”, visualizability of the theory, which Heisenberg claims to resolve. Moreover, we consider Heisenberg’s programme of operational analysis of concepts, in which he sees himself as following Einstein. Heisenberg’s work is marked by the tensions between semiclassical arguments and the emerging modern quantum theory, between intuition and rigour, and between (...) shaky arguments and overarching claims. Nevertheless, the main message can be taken into the new quantum theory, and can be brought into the form of general theorems. They come in two kinds, not distinguished by Heisenberg. These are, on one hand, constraints on preparations, like the usual textbook uncertainty relation, and, on the other, constraints on joint measurability, including trade-offs between accuracy and disturbance. This book is devoted to applied ethics. We focus on six popular and controversial topics: abortion, the environment, animals, poverty, punishment, and disability. We cover three chapters per topic, and each chapter is devoted to a famous or influential argument on the topic. After we present an influential argument, we then consider objections to the argument, and replies to the objections.
