Egalitarian thinkers have adopted Ronald Dworkin’s distinction between brute and option luck in their attempts to construct theories that better respect our intuitions about what it is that egalitarian justice should equalize. I argue that when there is no risk-free choice available, it is less straightforward than commonly assumed to draw this distinction in a way that makes brute-luck egalitarianism plausible. I propose an extension of the brute-luck–option-luck distinction to this more general case. The generalized distinction, called the ‘least (...) risky prospect view’ of brute luck, implies more redistribution than Dworkin’s own solution (although less than called for by some of his other critics). Moreover, the generalized brute-luck–option-luck distinction must be parasitical on an underlying non-egalitarian theory of which sets of options are reasonable. The presupposed prior theory may be inimical to the claim that justice requires equality rather than some other distributive pattern. (shrink)

Judging Positivism is a critical exploration of the method and substance of legal positivism. Margaret Martin is primarily concerned with the manner in which theorists who adopt the dominant positivist paradigm ask a limited set of questions and offer an equally limited set of answers, artificially circumscribing the field of legal philosophy in the process. The book focuses primarily but not exclusively on the writings of prominent legal positivist, Joseph Raz. Martin argues that Raz's theory has changed over (...) time and that these changes have led to deep inconsistencies and incoherencies in his account. One re-occurring theme in the book is that Razian positivism collapses from within. In the process of defending his own position, Raz is led to support the views of many of his main rivals, namely, Ronald Dworkin, the legal realists and the normative positivists. The internal collapse of Razian positivism proves to be instructive. Promising paths of inquiry come into view and questions that have been suppressed or marginalised by positivists re-emerge ready for curious minds to reflect on anew. There are many differences between the theories of Bentham and StuartMili specially in the ways in which both characterize the concept of pleasure.The concept, in turn, obviously has great influence on the utilitarian calculus. I am concemed in this paper with the issue of which of the two versions is most compatible with the liberal doctrine. In the procesa of establishing the compatibility of both versions with the liberal doctrine serious difficulties cannot be avoided, but this difficulties can be resolved (...) easily in Bentham's theory. This conclusion has been disputed from many quarters. Ronald Dworkin has raised objections to Bentham's theory from the point of view of liberalism while Jonathan Riley has attempted at building a liberal utilitarianism based-precisely- on Mill's theory. I set out to demostrate that Dworkin's objection may be overcome and I introduce, with purpose in mind, the concept of voluntarily accepted extemal reasons. 1 also believe that Riley's intent is doomed to fail, because it introduces elements of perfectionism and patemalism into the theory. We discuss the criteria for deriving new information from coordinate transformations, focusing on the property of implementability, or measurability in practice. We contrast the role of coordinate transformations in classical and quantum physics, and demonstrate that many well-known applications fail to meet the criteria for new information. Finally, we discuss some mathematical properties of the coordinate transformations, and then relate these properties to a practical measurement scheme.

This paper argues that research on normative issues in the life sciences will benefit from a tighter integration of philosophy of science. We examine research on ethical, legal and social issues in the life sciences (“ELSI”) and discuss three illustrative examples of normative issues that arise in different areas of the life sciences. These examples show that important normative questions are highly dependent on epistemic issues which so far have not been addressed sufficiently in ELSI, RRI and related areas of (...) research. Accordingly, we argue for the integration of research on the epistemic aspects of the relevant areas of science into ELSI research to provide a better basis for addressing normative questions. This article surveys western business ethics' recent history to show how this ethic has neglected recently its religious traditions and become construed more narrowly as an applied philosophy and social science. It argues that this narrowness has confused business ethics' role in business education and helped to weaken the distinctiveness of certain institutions of higher education. It then suggests ways that western business ethics might become more integrated, interesting, and autonomous as an academic discipline by incorporating its key religious traditions.

The Conferences of John Cassian constitute one of the more noteworthy contributions to early monastic literature. While it reveals decidedly Eastern influences, particularly Evagrius, it is a western contribution completed by the early decades of the fifth century. Among these recollections of what the Eastern fathers taught about the monastic life, Conferences Nine and Ten figure among the most important.4For in these two Conferences Cassian gives both his teaching on the nature and mystery of contemplative prayer and the method or (...) practice by which the monk is disposed unceasingly to this grace; moreover, it is also where one finds Cassian's commentary on the Our Father. This is a very interesting coincidence: the former is characterized by silence, the later by words. The question as to the possible relationship between the two suggests itself for further consideration. (shrink)

Cognitive load theory has been widely used to help understand the process of learning and to design teaching interventions. The Cognitive Load Scale developed by Leppink and colleagues has emerged as one of the most validated and widely used self-report measures of intrinsic load, extraneous load, and germane load. In this paper we investigated an expansion of the CLS by using a multidimensional conceptualization of the EL construct that is relevant for physical and online teaching environments. The Multidimensional Cognitive Load (...) Scale for Physical and Online Lectures goes beyond the CLS's operationalization of EL by expanding the EL component which originally included factors related to instructions/explanations with sub-dimensions including EL stemming from noises, and EL stemming from both media and devices within the environment. Through three studies, we investigated the reliability, and internal and external validity of the MCLS-POL using the Partial Credit Model, Confirmatory Factor Analysis, and differences between students either attending a lecture physically or online. The results of Study 1 provide initial evidence for the validity and reliability of the MCLS-POL within a higher education sample, but also highlighted several potential improvements which could be made to the measure. These changes were made before re-evaluating the validity and reliability of the measure in a new sample of higher education psychology students, and psychological testing students. Together the studies provide evidence for a multidimensional conceptualization cognitive load and provide evidence of the validity, reliability, and sensitivity of the MCLS-POL and provide suggestions for future research directions. The most recent work dealing expressly with adoption in Greece is Wentzel's article in Hermes lxv , 167–76, ‘Studien über die Adoption in Griechen-land’. Her article ranges widely over the whole subject and includes a list of all the inscriptions known to her which refer to adoptions, as well as a list of the adoptive formulae found in these inscriptions. In the present article I shall deal more fully with these formulae.

A psychoanalyst looks at the portrayal of love in poems from Homer to Shakespeare, discusses Freud's writings on love, and examines the relationship between narcissism and love.

I contend that Kurzban et al.'s model is silent on three issues. First, the extent to which opportunity-cost computations are automatic or deliberative is unclear. Second, the role of individual differences in biasing opportunity-cost computations needs elucidating. Third, in the absence of tasks, task persistence will be indefinite, which seems unfeasible, so perhaps integration with a limited-resource account is necessary.

In physiognomy, sensory, perceptual, and affective connotations are suggested by an object. For example, a mountain, in addition to being literally big, may also seem “quiet, looming, and threatening.” The capacity of physiognomically endowed but meaningless stimuli (like taketa and maluma) to transfer these meanings to similarly unfamiliar but neutral stimuli was examined on 15 perceptual, affective, and sensory rating scales (N = 118). The meanings of the two neutral stimuli were influenced in 26 instances (vs. 8 cases in which (...) the neutral stimuli followed one other); most changes were affective and sensory rather than perceptual; and the shifts in meanings were noncongruent—taketa’s “aggressiveness,” for example, led to a “peaceful” rating of the two neutral shapes. We contend that individual-level (“i-frame”) intervention strategies can be appropriately integrated with system-level (“s-frame”) strategies to optimize population-level behavior change. We outline instances of effective “i-frame” interventions, and how coordinated, integrated, well-resourced interventions that encompass components at both levels, and has organizational and user-group support, may optimize sustained behavior change intervention efforts, and allay practices that undermine “s-frame” components.

For at least the past several decades, judges around the world have been looking beyond their own states' jurisprudence to international law and the decisions of foreign courts in order to apply domestic law, part of a phenomenon Anne-Marie Slaughter calls "judicial globalization.".
