Lethal Autonomous Weapons (LAWs) are robotic weapons systems, primarily of value to the military, that could engage in offensive or defensive actions without human intervention. This paper assesses and engages the current arguments for and against the use of LAWs through the lens of achieving more ethical warfare. Specific interest is given particularly to ethical LAWs, which are artificially intelligent weapons systems that make decisions within the bounds of their ethics-based code. To ensure that a wide, but not exhaustive, survey (...) of the implications of employing such ethical devices to replace humans in warfare is taken into account, this paper will engage on matters related to current scholarship on the rejection or acceptance of LAWs—including contemporary technological shortcomings of LAWs to differentiate between targets and the behavioral and psychological volatility of humans—and current and proposed regulatory infrastructures for developing and using such devices. After careful consideration of these factors, this paper will conclude that only ethical LAWs should be used to replace human involvement in war, and, by extension of their consistent abilities, should remove humans from war until a more formidable discovery is made in conducting ethical warfare. This chapter proposed a novel design methodology called Value-Sensitive Design and its potential application to the field of artificial intelligence research and design. It discusses the imperatives in adopting a design philosophy that embeds values into the design of artificial agents at the early stages of AI development. Because of the high risk stakes in the unmitigated design of artificial agents, this chapter proposes that even though VSD may turn out to be a less-than-optimal design methodology, it currently provides a (...) framework that has the potential to embed stakeholder values and incorporate current design methods. Panarchy is a normative political meta-theory that advocates non-territorial states founded on actual social contracts that are explicitly negotiated and signed between states and their prospective citizens. The explicit social contract, or a constitution, sets the terms under which a state may use coercion against its citizens and the conditions under which the contract may be annulled, revised, rescinded, or otherwise exited from. Panarchy does not advocate any particular model of the state or social justice, but intends to encourage political (...) variety, innovation, experimentation, and choice. With its emphasis on explicit social contracts, Panarchy offers an interesting variation on traditional social contract theories. Today, Panarchist political thought is particularly relevant and interesting in the context of globalization, increased international migration, the weakening of national sovereignty, the rise of the internet "cloud" as a non-territorial locus of political and protopolitical social networks that are not geographic, the invention of cryptocurrencies that may replace national currencies, and the rise of urban centers where people of many different political identities live and work together. This is the first volume to bring together key philosophically and politically interesting yet often overlooked Panarchist texts. From the first published translation of de Puydt seminal 1860 article to contemporary Silicon Valley political theory, the volume includes Panarchist texts from different eras, cultures and geographical regions. The amassed wealth of theoretical insight enables readers to compare different texts in this tradition of political thought and distinguish different streams and varieties within this political tradition, in comparison with Cosmopolitanism, Contractarianism, and Anarchism. Cultural diversity between residents and staff is significant in aged care homes in many developed nations in the context of international migration. This diversity can be a challenge to achieving effective cross‐cultural communication. The aim of this study was to critically examine how staff and residents initiated effective cross‐cultural communication and social cohesion that enabled positive changes to occur. A critical hermeneutic analysis underpinned by Giddens’ Structuration Theory was applied to the study. Data were collected by interviews with residents or (...) their family and by focus groups with staff in four aged care homes in Australia. Findings reveal that residents and staff are capable of restructuring communication via a partnership approach. They can also work in collaboration to develop communication resources. When staff demonstrate cultural humility, they empower residents from culturally and linguistically diverse backgrounds to engage in effective communication. Findings also suggest that workforce interventions are required to improve residents’ experiences in cross‐cultural care. This study challenges aged care homes to establish policies, criteria and procedures in cross‐cultural communication. There is also the challenge to provide ongoing education and training for staff to improve their cross‐cultural communication capabilities. (shrink)

BackgroundWith the emergence of Brain Computer Interfaces, clinicians have been facing a new group of patients with severe acquired brain injury who are unable to show any behavioral sign of consciousness but respond to active neuroimaging or electrophysiological paradigms. However, even though well documented, there is still no consensus regarding the nomenclature for this clinical entity.ObjectivesThis systematic review aims to 1) identify the terms used to indicate the presence of this entity through the years, and 2) promote an informed discussion (...) regarding the rationale for these names and the best candidates to name this fascinating disorder.MethodsThe Disorders of Consciousness Special Interest Group of the International Brain Injury Association launched a search on Pubmed and Google scholar following PRISMA guidelines to collect peer-reviewed articles and reviews on human adults published in English between 2006 and 2021.ResultsThe search launched in January 2021 identified 4,089 potentially relevant titles. After screening, 1,126 abstracts were found relevant. Finally, 161 manuscripts were included in our analyses. Only 58% of the manuscripts used a specific name to discuss this clinical entity, among which 32% used several names interchangeably throughout the text. We found 25 different names given to this entity. The five following names were the ones the most frequently used: covert awareness, cognitive motor dissociation, functional locked-in, non-behavioral MCS and higher-order cortex motor dissociation.ConclusionSince 2006, there has been no agreement regarding the taxonomy to use for unresponsive patients who are able to respond to active neuroimaging or electrophysiological paradigms. Developing a standard taxonomy is an important goal for future research studies and clinical translation. We recommend a Delphi study in order to build such a consensus. (shrink)

Purpose: This study aimed to develop a stroke effectiveness test in table tennis based on the temporal game structure to assess the ball speed and ball placement of the players, with a purpose to analyze its reproducibility and validity. Methods: Nineteen male table tennis players participated in this study. The test was performed twice during the first session and once during the second session to assess the intrasession and intersession reproducibility, respectively. Moreover, the test was examined on its ability to (...) discriminate between regional and local performance-level players and on the relationship between the test results and the table tennis performance to assess the discriminant and concurrent validity, respectively. In general, the test consisted of 11 simulated rallies of 2–5 balls with the effort and rest ratio of 0.5, and focused on attack with offensive strokes at defensive balls delivered by a robot randomly between the left and right positions on the table. Results: Ball speed, ball placement, and ball speed-ball placement index showed satisfactory reliability and agreement outcomes. Additionally, the Bland-Altman plots show the systematic error of the analyses closer to 0, and that most values were within the limits of agreements. Concerning validity analyses, regional players had higher scores of ball placement and ball speed-ball placement index as well as made fewer errors than local players. Moreover, ball placement, ball speed-ball placement index, and percentage error presented a strong and significant correlation with table tennis performance. However, ball speed was slightly different between the regional than local players and this variable was not related to table tennis performance. Conclusion: Our findings show evidences that the test is reproducible. Moreover, discriminant and concurrent validity are confirmed for ball placement and ball speed-ball placement index. (shrink)

En la primera sección, hemos desarrollado ejemplos y hecho observaciones a modo de análisis para probar por qué las narrativas son importantes para nuestras emociones secundarias. What is Love? Discourse about Emotions in Social Sciences The study of emotions has been one of the most important areas of research in the Social Sciences. Social Psychology has also contributed to the development of this area. In this article we analyse the contribution of social Psychology to the study of emotion, understood as a social construct, and its strong relationship with language. Specifically, we open a discussion on the basis of the general characteristics of the Social Psychology of (...) emotions and the contributions from different disciplines in this area of research, to give meaning to the relationship they have with the language of emotions. In this regard, we have reviewed basic references for the study of the construction of an emotion, and thematically classified them into three broad categories: 1) Contributions from different backgrounds and perspectives; 2) Construction and de-construction studies of emotion, and 3) Postconstructionist studies of emotion. In the first category, we consider the main contributions from the Social Sciences, which can be summarized in two areas: philosophical-construction of an emotion; mainstream-psychology of emotion. In the second category we have began with the relationship between emotion and language and the social construction of emotion, i.e., its discursive status. We end with postconstructionist theories, i.e., Butler's concept of performance and technoscience. To give more meaning to this line of research, the use of a concrete example of emotion seemed appropriate. Thus, we chose "love". (shrink)

In the sixth century a.d., Procopius of Kaisareia (Palestine) wrote eight books on the wars against the Persians, Vandals and Goths, as well as a book on the building activity in the reign of Justinian I. Whereas his history of war is the work of an objective historian, his so-called "secret history" (historia arcana) is filled with gossip and rumors that circulated within the imperial court. Procopius is a source to both historians and philologists.

A comparison between the Prolegomena of Chapter II of De iure praedae and the Prolegomena of De iure belli ac pacis leads to the conclusion that the ideas of Grotius on legal systematization have changed considerably between 1604 and 1625. Whereas Grotius starts in IPC with general principles with a rather unclear distinction between leges and regulae, in IBP he gives first the philosophical and theological basis of international law, intertwined by a concise set of general legal rules, mostly derived (...) from Roman law after its reception in Western Europe. The general outlines of legal systematization in the early-modern period are expounded. In the attempts of legal systematization the concept of subjective rights is essential. These subjective rights are not, as is sometimes assumed, a medieval renewal of legal technique, but can be found essentially already in classical Roman law of the first centuries AD.The institutional system is not yet visible in De iure praedae, it might be different for De iure belli ac pacis. Significant here are possibly the expressions ius ad bellum and ius in bello. (shrink)

_ Source: _Volume 38, Issue 1, pp 71 - 105 Grotius’s theory of punishment provides a unique lens through which to view his evolving thought on sovereignty between _De Indis_ and _De iure belli ac pacis_ and the implications of that evolution for Grotius’s theory of the ius in bello. Throughout both works, Grotius attempted to leave open the possibility of private punishment and private warfare, a position not easily squared with prevailing views of sovereign authority. Initially, Grotius was content (...) with a theory marrying the private right of punishment with more traditional Scholastic views of sovereignty through a transfer of the private right from individuals into the hands of the sovereign. This theory also adopted traditional views of subject responsibility for sovereign acts—and, by extension, the exposure of subjects to punishment for the acts of their sovereign. By the time of his mature work, however, Grotius turned away from natural law justifications for collective responsibility and collective punishment, denying that subjects had to answer for the acts of their sovereign as a necessary incident of the compact creating civil society. This led Grotius to refer virtually all forms of collective responsibility, such as reprisal or punishment exacted through war, to the law of nations. This sharp reduction of the natural consequences of the creation of sovereign power also enabled Grotius’s argument that the private right of war, and in particular the private right of punishment, remained available after the creation of civil society. This note studies the 1650 edition of Hugo Grotius’s De iure belli ac pacis. Using online and card catalogues, we have located eighty-nine copies, thirty-seven of which we examined in person, with an additional six fully digitised copies online. We hope that this research note on the preliminary results will generate greater interest in this unduly neglected edition. The note shows how, despite the connection established in the history of seventeenth-century politics that emphasized the ties between Grotius and the Peace (...) of Westphalia, the reception of Grotius’s 1650 edition bore no relation to the debates at Osnabrück and Münster. However, this is an influential edition, cherished by collectors and authors. According to our findings, it would be reproduced in a number of later reprints. (shrink)

This research note is the eighth instalment in our series of preliminary findings on the census and study of the reception of De iure belli ac pacis. The note presents a bibliographical description of Laurentius’ 1647 re-issue of the 1631 edition by Blaeu, considers Laurentius’ motivation and methods of production, lists and maps the currently known twenty-three surviving copies, and briefly describes two notable exemplars.

This research note offers a contextual overview of the printing history of Johann Blaeu’s 1646 octavo edition of Hugo Grotius’s De iure belli ac pacis (ibp). The note examines the printing process of the last edition that was prepared while Grotius was still alive, though it was published after his death. The note also sheds light on the theological dimension of some readers’ annotations, and concludes by discussing the impact this edition had on the modern versions of the text.

This article provides new information on the publication history of the first edition of the text that, according to many scholars, laid the ground for the growth of international law: Hugo Grotius’s De iure belli ac pacis. Drawing on the preliminary findings of the Grotius Census Project at the Max Planck Institute for Comparative Public Law and International Law, funded by the German Research Foundation (Deutsche Forschungsgemeinschaft), the following pages shed light on the first three states of the typescript, the (...) sources that Grotius had access to in France while drafting the book, and the early circulation of the 1625 edition, published by Nicolas Buon in Paris. The goal of this publication is to disseminate updated information on the printing history of this key text in the history of legal and political thought, and to invite readers to come forward with more information about the location of the remaining copies of the text, in order to advance our understanding of the rise of international law around the world. The first edition of Hugo Grotius’s De iure belli ac pacis was published in Paris by Nicolas Buon in 1625. An unauthorised second edition appeared in Frankfurt a year later, from the reputable Wechel press. After Grotius made hundreds of changes to the first and second states of the first edition, and failed to convince the publisher Nicolas Buon of the merits of printing yet another edition of the book, the Wechels’s release of a new edition sought to capitalise on (...) the high demand for the text, as copies had sold out in Central Europe by the summer of 1625. In this preliminary report on the 1626 edition, using online and card catalogues, we have located 59 surviving copies. We examined thirteen copies in person, and another three fully digitised copies online, and on the basis of this small sample we have been able to draw a number of conclusions. We hope that this research note on preliminary results will generate interest in this unduly neglected edition, and that readers will kindly bring further copies to our attention. (shrink)
