Josse Clichtove represents a turning point in the history of disputation, for he combines one of the earliest accounts of the doctrinal disputation with one of the latest accounts of the obligational disputation. This paper describes the nature and significance of the theories that he offered. Particular attention is paid to the doctrines of truth, necessity and possibility which lie behind his doctrines; and also to the light which his work throws on the aims and nature of an (...) obligational disputation. Thomas d’Aquin au XIIIe siècle, Marsile Ficin, le Cardinal Bessarion, Pietro Balbi, ami du Cardinal Nicolas de Cues, le dominicain Jean Cuno chez Alde Manuce à Venise au XVe siècle, Josse Clichtove, d’abord élève et collaborateur de Jacques Lefèvre d’Étaples, au début du XVIe, sont des figures par lesquelles s’est transmise la tradition platonicienne au Moyen Âge et à la Renaissance. De diverses manières, ces savants, au milieu de leurs contemporains, ont été les artisans d’une histoire de la (...) culture humaniste, dont plusieurs épisodes peu connus sont étudiés dans ce livre. En les réunissant, on obtient une image quelque peu renouvelée du mouvement des idées qui devait prolonger jusqu’à l’époque moderne la posternité du néoplatonisme athénien en Italie et en Europe. This article examines the implications for contract law of Rawls' theory of justice as fairness. It argues that contract law as an institution is part of the basic structure of society and as such subject to the principles of justice. Discussing the basic structure in relation to contract law is particularly interesting because it is instructive for both contract law and Rawlsian theory. On the one hand, justice as fairness has clear normative implications for the institution of contract law. Scholars have revealed how moral evaluation is woven into formal administrative processes. While research examining these dynamics tends to assume that a person’s naturalized identity (such as race and gender) precedes administrative processing, we argue that social categorization by administrators is the tacit precondition upon which further processing takes place. We make this argument by looking at a set of unusual cases: parole hearings where prisoners fall outside of, conflict with, or move between categories of gender, sexuality, race, and ability. (...) We find that categorization acts as a prerequisite to moral evaluation. When administrators cannot easily categorize a prisoner, they resolve this uncertainty by denying parole. Yet, social categorization can also serve as a pathway to moral approval and administrative allocation. In certain situations, administrators encourage prisoners’ identification with a new social category as proof that they are deserving of parole. In both cases, successful administrative categorization occurs through a combination of what we call narrativization, or crafting a narrative around one’s identity that aligns with administrators’ presumptions, and authorization, or marshalling official evidence from prior classification moments to support identity claims. These insights extend our understanding of classification, moral evaluation, and the administrative reproduction of inequality. (shrink)

With the development and increasing use of diverse public involvement methods over the past decade, formal technology assessment has shifted from a largely closed, intrainstitutional tool of policy analysis and advice to a tool for the social assessment of scientific-technological issues at the interface between politics and public discourse. Through citizens’ conferences, scenario workshops, and consensus conferences, technology assessment has effectively been opened up to the public sphere: Citizens and interest group representatives are drawn into the process of assessing scientific (...) and technological issues alongside experts, the process often takes place in public, and its outcomes are made widely available for information and debate. This article analyzes the public involvement agenda in technology assessment from the conceptual perspective of the “public sphere.” It discusses key features of public sphere–oriented technology assessment, including public access, actor involvement, and deliberation. And it considers the implications of the public sphere dimension for future developments in participatory technology assessment. (shrink)

Randomized controlled trials are often considered the gold standard for estimating causal effect, but they may lack external validity when the population eligible to the RCT is substantially different from the target population. Having at hand a sample of the target population of interest allows us to generalize the causal effect. Identifying the treatment effect in the target population requires covariates to capture all treatment effect modifiers that are shifted between the two sets. Standard estimators then use either weighting, outcome (...) modeling, or combine the two in doubly robust approaches. However, such covariates are often not available in both sets. In this article, after proving L 1 {L}^{1} -consistency of these three estimators, we compute the expected bias induced by a missing covariate, assuming a Gaussian distribution, a continuous outcome, and a semi-parametric model. Under this setting, we perform a sensitivity analysis for each missing covariate pattern and compute the sign of the expected bias. We also show that there is no gain in linearly imputing a partially unobserved covariate. Finally, we study the substitution of a missing covariate by a proxy. We illustrate all these results on simulations, as well as semi-synthetic benchmarks using data from the Tennessee student/teacher achievement ratio, and a real-world example from critical care medicine. Anatomo-functional studies in humans point out that handedness and language-related functional laterality are not correlated – except during language production; and that the convergence of language and hand control is located in the precentral gyrus, whereas executive functions required by movement imitation and phonological and semantic processing converge onto Broca's area. In this book, Dean Kowalski argues that filmmakers can “do” philosophy when creating a fictional narrative film, and utilizes a careful and extensive analysis of Joss Whedon’s fictive creations—Buffy the Vampire Slayer, Angel, Firefly, Dollhouse, and The Cabin in the Woods —to establish this thesis.

Joss Whedon deserves credit for using the vehicle of his enduringly popular television series, Buffy the Vampire Slayer and Angel, to expose California's colonial history and raise questions regarding sustained responsibilities to the U.S. colonial past. This article, however, points out the ways in which BtVS and Angel, especially in the season four crossover episode of BtVS entitled “Pangs,” perpetuate the notion that this history and the indigenous peoples affected by it have vanished. It argues that this erasure of contemporary (...) American Indian peoples leaves reflective and ethically engaged people like Buffy and her "Scooby Gang"—and, by extension, socially conscientious fans of the show—without resources to be responsive to sustained colonial power structures in the present, and to the living indigenous peoples who continue to both suffer from and resist these structures. Philosophers often rely on their own examples and intuitions, which can be problematic since philosophers are a small group with their own set of biases and limitations. Science fiction can assist with this problem through the provision of examples that are both designed by non-philosophers and intended to be thought-provoking and plausible. In particular, when philosophers teach, we can use science fiction for examples that raise relevant issues in interesting contexts, while also being fully fleshed out. In this paper, I (...) explain how I use Joss Whedon’s Firefly to teach political philosophy, ethics, and existentialism. I hope to show the usefulness of good science fiction for the purpose of teaching philosophy in new and engaging ways. (shrink)

This schedule, provided as a companion to my “Teaching Firefly” article, was used for a sophomore level philosophy course that was populated mostly by non-majors. The original idea for the course was to develop a popular culture philosophy course that would attract students from all over campus, which was meant to both introduce them to multiple philosophical ideas and theories and hopefully convince some of them to major or minor in philosophy. The course was quite successful at drawing Whedon fans (...) from across the university (after a certain amount of advertising through posters and social media). Students were very engaged with both discussions of episodes and the readings. (shrink)

Every year, the Vietnamese people reportedly burned about 50,000 tons of joss papers, which took the form of not only bank notes, but iPhones, cars, clothes, even housekeepers, in hope of pleasing the dead. The practice was mistakenly attributed to traditional Buddhist teachings but originated in fact from China, which most Vietnamese were not aware of. In other aspects of life, there were many similar examples of Vietnamese so ready and comfortable with adding new norms, values, and beliefs, even contradictory (...) ones, to their culture. This phenomenon, dubbed “cultural additivity”, prompted us to study the co-existence, interaction, and influences among core values and norms of the Three Teachings –Confucianism, Buddhism, and Taoism–as shown through Vietnamese folktales. By applying Bayesian logistic regression, we evaluated the possibility of whether the key message of a story was dominated by a religion (dependent variables), as affected by the appearance of values and anti-values pertaining to the Three Teachings in the story (independent variables). Our main findings included the existence of the cultural additivity of Confucian and Taoist values. More specifically, empirical results showed that the interaction or addition of the values of Taoism and Confucianism in folktales together helped predict whether the key message of a story was about Confucianism, β{VT ⋅ VC} = 0.86. Meanwhile, there was no such statistical tendency for Buddhism. The results lead to a number of important implications. First, this showed the dominance of Confucianism because the fact that Confucian and Taoist values appeared together in a story led to the story’s key message dominated by Confucianism. Thus, it presented the evidence of Confucian dominance and against liberal interpretations of the concept of the Common Roots of Three Religions (“tam giáo đồng nguyên”) as religious unification or unicity. Second, the concept of “cultural additivity” could help explain many interesting socio-cultural phenomena, namely the absence of religious intolerance and extremism in the Vietnamese society, outrageous cases of sophistry in education, the low productivity in creative endeavors like science and technology, the misleading branding strategy in business. We are aware that our results are only preliminary and more studies, both theoretical and empirical, must be carried out to give a full account of the explanatory reach of “cultural additivity”. This article addresses recent science fiction films about the colonization of outer worlds, or space-steading, in the context of the longer colonial history of the frontier. Paying particular attention to Interstellar (Christopher Nolan, 2014), Serenity (Joss Whedon, 2005) and The Wild Blue Yonder (Werner Herzog, 2005), I argue that colonizing outer space is not only a race to the new frontier, but that this takes place because technologies that picture space have quickened the pulse. Through its imagining of the end (...) of times as a reiteration of colonizing adventure, and the emptying of people from their place, the technology of film has itself produced the accident (Virilio, 2007) of an uninhabited earth. As suggested by the cinematically derived kinesis of wormholes, space wrinkles, and warp speeds, what might be left as a form of life is none other than film itself. The hyper-kinesis of film spectacle takes on a non-human life of its own, which, in science fiction film, constitutes a form of self-alienation, removing viewers from the places they actually inhabit and displacing the histories they unfold. In this way, I address what is truly cinematic about the film frontier traversed by the new space of uber-masculine adventurer-settlers. (shrink)
