This article traces the semantics of ?life? and ?vitality? in Carl Schmitt up to the 1930s. It shows that Schmitt deploys these vitalist elements against the modern ?spirit of technicity? in his attempt to combat the lack of substantial ideas in modern politics. However, Schmitt himself cannot escape a fundamental political relativism. There remains an unstable tension at the heart of his thought between the quest for substance and the quest for order. The latter is relativist because it is (...) a quest for order as such, any order. Although Schmitt's semantics of life and vitality is not drawn from a biological register, it adopted a völkisch meaning in 1933. Anti-Semitism becomes a form of life and racial homogeneity fills in for substance. The article concludes that, while there are good reasons for criticizing the modern ?spirit of technicity,? Schmitt's critical model is fundamentally flawed. (shrink)

Germany is an interesting case with respect to the governance of reprogenetics. It has a strong profile in the technosciences and high aims regarding the global bioeconomy, yet her regulation of human genetics, reproductive medicine and embryo research has for a long time been rather restrictive. German biopolitical exceptionalism has often been explained by reference to Catholicism and the legacy of the Nazi past. The Germans, so goes the common story, have learnt the lessons of history and translated them into (...) unconditional respect for human dignity, which in turn translates into unconditional protection of human life, including the human embryo, and the firm repudiation of any eugenic distinction between ‘life worth to live’ and ‘life not worth to live’. This, however, is not the whole story. Alongside deontological strictness we find another strand of governing body politics and reprogenetics in Germany, the rule-and-exception model, running from the mid-1970s abortion law via the 2002 Stem Cell Act to the 2011 regulation of pre-implantation genetic diagnosis. In contrast to the former, that strongly draws on Kant and his concept of human dignity, the latter bears resemblances to Carl Schmitt's concept of state of exception. The article will show that the rule-and-exception model builds the exception into the rule and transforms the meaning and mandate of ethics, namely from safeguarding ethical standards to deciding about the exception. Given that the exception has now tended to become the rule, the question is whether the lessons of history will govern German reprogenetics for much longer. (shrink)

Pragmatic explanations deny this, and say that theintuitions are due to misleading implicatures. This paper argues thatboth explanations are incorrect. Remembering seems, to philosophers and scientists, one of the most mystifying of human activities. Yet natural language users have no problem understanding what is meant by ‘memory’. Memory is simply the ability to recall personally experienced events and certain kinds of information such as facts, names, or faces; or how to perform certain actions, like riding a bike or playing chess. It is on this basis that people sometimes make claims about themselves or others having a good or bad memory, (...) especially for things like names, numbers, or faces. Why then is memory such a mystery? Because, firstly, of its diversity: memory enables us to perform a plethora of different tasks, including the continuous interpretation of every moment of consciousness. Secondly, different forms of memory have different standards of accuracy, and often dramatically different criteria for success. (shrink)

New data-driven technologies yield benefits and potentials, but also confront different agents and stakeholders with challenges in retaining control over their data. Our goal in this study is to arrive at a clear picture of what is meant by data sovereignty in such problem settings. To this end, we review 341 publications and analyze the frequency of different notions such as data sovereignty, digital sovereignty, and cyber sovereignty. We go on to map agents they concern, in which context they appear, (...) and which values they allude to. While our sample reveals a considerable degree of divergence and an occasional lack of clarity about intended meanings of data sovereignty, we propose a conceptual grid to systematize different dimensions and connotations. Each of them relates in some way to meaningful control, ownership, and other claims to data articulated by a variety of agents ranging from individuals to countries. Data sovereignty alludes to a nuanced mixture of normative concepts such as inclusive deliberation and recognition of the fundamental rights of data subjects. (shrink)

Die Studie untersucht die Entstehung der modernen Philosophiegeschichte, wie sie sich im Übergang vom Barock zur Aufklärung als philosophische Disziplin innerhalb des gelehrten Diskurses der historia literaria konstituierte. Die Auffassung, daß Philosophie ein Produkt menschlicher Verstandestätigkeit sei und mit dem Denken der Griechen beginne, erweist sich dabei als Resultat eines Traditionsbruchs, mit dem die entstehende Aufklärung sich vom christlichen Aristotelismus der Schulphilosophie sowie von den platonisch-hermetischen Spekulationen der Schwärmer und Pansophen absetzte. In der Umbruchphase zwischen Barock und Aufklärung entsteht so (...) der moderne philosophiegeschichtliche Kanon, der sich fundamental von der zuvor gültigen historischen Logik der Wissenschaftsgeschichte unterscheidet. Die Geschichte der Philosophie wird nun nicht länger als Sammelbecken unterschiedlich perfekter Ausformulierungen einer archetypischen Weisheit verstanden, sondern im Kontext der 'Entdeckung der geschichtlichen Welt' als ein kontingenter temporaler Prozeß menschlicher Wissenschaftsentwicklung begriffen. Wie es zu dieser Entdeckung der Philosophiegeschichte kam und worin ihre wissenschaftsgeschichtlichen Implikationen bestehen, ist Gegenstand der Darstellung, die gegenüber der bisherigen Forschung verstärkt die Interdependenzen zwischen theologischem, philosophischem, rechts- und literärgeschichtlichem Diskurs berücksichtigt. L’interactivité est communément perçue comme la marque caractéristique des technologies digitales et, par extension, de différentes formes de fictions, de médias ou d’œuvres numériques – de la littérature hypertextuelle et des jeux vidéo au net art. On peut toutefois s’interroger sur le sens précis qu’il convient de donner à cette notion, ainsi que sur les promesses auxquelles elle est souvent associée. À défaut de pouvoir cerner un concept unique et maxi-englobant d’interactivité, nous suggérons qu’il est plus profitable de tenter d’identifier (...) des types et des degrés d’interactivité. Nous tentons de montrer pourquoi cette théorie pluraliste et gradualiste est plus attrayante que d’autres approches développées dans la littérature récente. Nous mettons enfin cette conception à l’épreuve du jeu vidéo, en montrant qu’elle permet de réévaluer le rôle que joue l’interactivité dans ce médium, mais qu’elle met aussi au jour les limitations inhérentes des fictions interactives que l’on y trouve. Être vu, nu, par un chat ; essayer de savoir quel effet cela fait d’être une chauve-souris ; penser les modes de cohabitation et de compagnonnage que nous formons avec les animaux, en dépit de toutes les violences que nous leur faisons subir, constituent autant d’expériences de pensée limites qui ont ponctué le discours philosophique sur l’animalité au xxe siècle. Il n’est pas étonnant que Cora Diamond fasse un cas de toutes ces expériences : ce qu’elle nomme « une difficulté (...) de la réalité », c’est-à-dire un point d’achoppement entre la pensée et ce qu’elle essaye de saisir, le réel, qui est susceptible de nous faire perdre nos concepts. Je me propose dans ce texte d’explorer les voies de cette difficulté, qui sont souvent des voies contournées ou des déviations. L’idée est aussi de réfléchir aux moyens dont la philosophie dispose pour affronter cette difficulté, sans dénégation et sans déviation. (shrink)

According to the expressivist objection, laws that only allow assisted dying for those suffering from certain medical conditions express the judgement that their lives are not worth living. I have recently argued that an autonomy-based approach that legally allows assisted suicide for all who make an autonomous request is a way to avoid the expressivist objection. In response to this, Thomas Donaldson has argued that rather than avoiding the expressivist objection, an autonomy-based approach extends this objection. According to Donaldson, this (...) is because helping a person achieve a goal requires endorsement of that goal. In this reply, I show that Donaldson misunderstands the target of the expressivist objection: it is not aimed at an individual’s attitude towards another person’s death but rather at a legal regulation. Moreover, helping someone end their life does not necessarily require endorsing this goal—instead, respect for a person’s autonomous choice can be another reason for providing assisted suicide. Donaldson also assumes that the autonomy-based approach requires doctors to accept autonomous requests for assisted dying. Yet, this approach merely makes it legal for individuals (not necessarily only doctors) to provide assisted suicide to autonomous persons but does not require anyone to do so. (shrink)

Historian Dmitry Peretolchin quotes several of my publications on the creation and application of political technologies in the United States in his program about Saul Alinsky on the House of Cards podcast on the Den TV channel. An advertisement for the conference "Russian World Against the Global Reich" was inserted into this broadcast. This article: analyzes the statements of the podcast about Alinsky and his main ideas; showes that the main source of Alinsky's political technologies is the experience of professional (...) revolutionaries in Russia and that they in no way confirm the idea of a global Reich; describes the political technology that Alexander Prokhanov and his media complex uses to implement the Fifth Empire project, which is currently merged with the ideology of the Russian World; analyzes the ideological orientation of the House of Cards podcast and the Picture of the World club on the Den channel. The articles illustrates how the authors of the podcast are working to substantiate the propaganda direction of the media complex. The article also aims to show that political technologies, in particular, technologies of co-organization continue to develop and be implemented in countries with different political systems and can be applied to various types of social movements. In discourses on digitization and the data economy, it is often claimed that data subjects shall beownersof their data. In this paper, we provide a problem diagnosis for such calls fordata ownership: a large variety of demands are discussed under this heading. It thus becomes challenging to specify what—if anything—unites them. We identify four conceptual dimensions of calls for data ownership and argue that these help to systematize and to compare different positions. In view of this pluralism of data ownership (...) claims, we introduce, spell out and defend a constructive interpretative proposal: claims for data ownership are charitably understood as attempts to call for theredistributionof material resources and the socio-culturalrecognitionof data subjects. We argue that as one consequence of this reading, it misses the point to reject claims for data ownership on the grounds that property in data does not exist. Instead, data ownership brings to attention a claim to renegotiate such aspects of thestatus quo. (shrink)

This paper provides an overview of the development of Jewish studies in Germany since reunification. After a brief historical review of the subject in the nineteenth century with the development of modern Reform Judaism and the science of Judaism created by Jewish religious and secular scholars, it focuses on the development of the past thirty years, in which not only the Jewish community but also Jewish studies have increased in importance. The growth of the Jewish community was largely due to (...) immigration from the Soviet Union, but also partly to young Israelis who moved to Berlin. In line with these different backgrounds, a new interest in diaspora research emerged. The paper also deals with the difference between German Jewish studies and those of most other countries, where Jewish studies are mainly designed by Jewish scholars. (shrink)

This open access book presents an ethical approach to utilizing personal medical data. It features essays that combine academic argument with practical application of ethical principles. The contributors are experts in ethics and law. They address the challenges in the re-use of medical data of the deceased on a voluntary basis. This pioneering study looks at the many factors involved when individuals and organizations wish to share information for research, policy-making, and humanitarian purposes. Today, it is easy to donate blood (...) or even organs, but it is virtually impossible to donate one’s own medical data. This is seen as ethically unacceptable. Yet, data donation can greatly benefit the welfare of our societies. This collection provides timely interdisciplinary research on biomedical big data. Topics include the ethics of data donation, the legal and regulatory challenges, and the current and future collaborations. Readers will learn about the ethical and regulatory challenges associated with medical data donations. They will also better understand the special nature of using deceased data for research purposes with regard to ethical principles of autonomy, beneficence, and justice. In addition, the contributors identify the key governance issues of such a scheme. The essays also look at what we can learn in terms of best practice from existing medical data schemes. (shrink)

Ce débat, comme cela a déjà été noté dans un certain nombre de publications récentes, est en fait hanté par une question sceptique, qui fut posée à la photographie dès son invention : si l’image photographique s’excepte du régime traditionnel de la représentation et si elle est bien le résultat d’une prise de vue automatique, en quel sens pouvons-nous encore dire qu’elle (...) est artistique? Il me semble que le concept goodmanien d’exemplification permet de répondre au défi lancé par le sceptique. J’essaie de montrer pourquoi. Plus encore, je m’emploie à montrer comment le concept goodmanien d’exemplification pourrait s’accommoder assez bien de la spécificité du médium photographique. (shrink)

In this systematic introduction to the philosophy of Charles S. Peirce, the author focuses on four of Peirce's fundamental conceptions: pragmatism and Peirce's development of it into what he called 'pragmaticism'; his theory of signs; his phenomenology; and his theory that continuity is of prime importance for philosophy. He argues that at the centre of Peirce's philosophical project is a unique form of metaphysical realism, whereby continuity and evolutionary change are both necessary for our understanding of experience. In his final (...) chapter Professor Hausman applies this version of realism to contemporary controversies between anti-realists and anti-idealists. Peirce's views are compared to those of such contemporary figures as Davidson, Putnam, and Rorty. The book will be of particular interest to philosophers concerned with American philosophy and current debates on realism as well as linguists working in semiotics. (shrink)

The intention of this article is to provide a brief account of the present-day relationship between academics and judges in Italy, while also taking account of the continental historical experience. In addressing this theme, the article will take its cue from developments in England—during the past three decades—where the monologue of academics and judges has been slowly developing into an ever more intensive and (...) transparent dialogue. Cet article porte sur les pratiques contemporaines d’écriture qui mêlent récit de soi et théorie. Je m’emploie à montrer qu’une intelligence du monde social (des rapports de classe, de genre, de race et d’autres formes de domination) s’exerce à l’étage des vécus singuliers. Ce n’est pas seulement que les gens sont différents les unes des autres – encore que j’insiste sur la vérité et la force d’une affirmation à première vue si banale –, mais aussi qu’un sens renouvelé de l’objectivité (...) s’obtient lorsque la production d’un savoir est réfléchie depuis la position particulière de celui qui l’énonce. Une telle théorie de la dépiction peut sembler iconoclaste, voire complètement fausse, et ce, parce que nous y voyons à tort une explication de la représentation picturale. Elle offre (...) cependant, rapportée à d'autres intuitions philosophiques qui essaiment ailleurs dans l’œuvre de Goodman, une meilleure compréhension du fonctionnement des images.ABSTRACTIn this paper, I draw unexpected conclusions from Nelson Goodman's views on depiction. Faithful to the symbolic turn of aesthetics in the twentieth century, Goodman argues that pictures are as conventional and natural as scripts. Unlike scripts, however, pictures work in dense symbolic systems. The difference between image and script cannot be found where we would have spontaneously looked: in our perceptual experience of pictures. Obviously, the structural approach which is at stake in Languages of Art is iconoclast; we often consider it surprising, or even absolutely misleading, perhaps because we do not connect the analyses Goodman conducts in his essay with the experience we ordinarily have of pictures. I argue that Goodman's position becomes clearer when it is reduced to a much more modest philosophical purpose: to offer a criterion for discrimination between scripts and pictures. Pictures, unlike scripts, are dense. Of course, that does not explain depiction. However, my account of Goodman's view, when connected to intuitions about cognitive processes that have spread elsewhere in his work, sheds light on the way pictures are connected with the objects they depict. Les jeux vidéo sont des artefacts qui possèdent des propriétés esthétiques et qui donnent lieu à des pratiques d’appréciation riches et variées. Dans la littérature contemporaine, plusieurs philosophes se sont demandé s’ils entraient dans la catégorie traditionnelle de l’art. Une autre façon de considérer la chose, qui ne présuppose aucune définition de l’art, consiste à appréhender la forme artistique particulière à laquelle appartiennent les œuvres vidéoludiques. Cet article propose ainsi de repérer les propriétés esthétiques standards et variables des œuvres vidéoludiques (...) en tant que forme artistique, pour partie déterminée par les propriétés du medium des arts numériques.
