Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die Schreiben Schmitts, (...) die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. Sie sind zugleich ein spannendes Zeitdokument und ein Beitrag zur Geistesgeschichte Deutschlands und Spaniens. (shrink)

In this paper, I argue, first, that Hegel defended a version of the analytic/synthetic distinction—that, indeed, his version of the distinction deserves to be called Kantian. For both Kant and Hegel, the analytic/synthetic distinction can be explained in terms of the discursive character of cognition: insofar as our cognition is discursive, its most basic form can be articulated in terms of a genus/species tree. The structure of that tree elucidates the distinction between analytic and synthetic judgments. Second, I argue that (...) Hegel has an interesting and so far unexplored argument for the analytic/synthetic distinction: Hegel argues that the systematic relationship between concepts expressed in a genus/species tree can only be expressed through synthetic judgments. Third and finally, I explore some of the implications that the arguments in the first two parts of the essay have for understanding the way in which Hegel differs from Kant. I argue that Hegel accepts Kant's point that discursive cognition cannot be used to cognize the absolute. However, Hegel thinks that we can, nevertheless, cognize the absolute. I explore the character of this non-discursive cognition and argue that we can understand Hegel's glosses on this form of cognition—as simultaneously analytic and synthetic and as having a circular structure—through contrasting it with his account of discursive cognition. As a consequence, I argue that we must give up on attempts to understand ‘the dialectical method’ and ‘speculative cognition’ on the model of discursive cognition. (shrink)

Since September 11th, 2001 the Western and Eastern world has been confronted again with violence in the name of religion. As a fundamentalist understanding of religion is a fruitful basis for war and terror, it is essential to empower the liberal movements in the world religions, to support a peaceful community of people from different cultures and religions. Therefore, it is of central importance for our own religious self-concept how faith and reason can be combined to make it possible to feel at home in our own religion and to welcome a pluralistic society. German description: Obwohl in den meisten Religionen Frieden als anzustrebendes Ziel gilt, wurden Religionen immer wieder zur Legitimation von Gewalt genutzt. Seit den Ereignissen des 11. September 2001 ist die westliche und ostliche Welt erneut konfrontiert mit der Gewalt im Namen der Religion. Insofern ein fundamentalistisches Religionsverstandnis den Nahrboden fur Krieg und Terror bildet, kommt es darauf an, die liberalen Krafte und Stromungen in den Weltreligionen zu starken, um ein friedliches Zusammenleben von Angehorigen verschiedener Kulturen und Religionen zu fordern. DieVorlesung über Moralphilosophie aus den 1770er Jahren ist eine wichtige Erläuterung und Ergänzung zur Grundlegung der Metaphysik der Sittenvon 1785. Die Neuedition der so genannten Menzer-Vorlesung präsentiert diese Vorlesung auf dem aktuellen Stand der Forschung. Zugrunde gelegt ist die Nachschrift Kaehler, die seit 1997 zum Kant-Archiv in Marburg gehört. Abgeglichen ist der Text mit mehreren Handschriften des Archivs der Berlin-Bandenburgischen Akademie der Wissenschaften und der Staatsbibliothek Berlin. Aus diesen Überlieferungssträngen schöpfend, verfasste der Kirchenvater Augustin seine Schrift De libero arbitrio (Über den freien Willen). Durch die weitere Theologie- und Philosophiegeschichte zieht (...) sich dann die Auseinandersetzung darüber, in welchem Mass der menschliche Wille frei bzw. unfrei ist. So bestritt etwa Luther gegen Erasmus die Willensfreiheit in Fragen des Heils. This paper reports on the findings of a qualitative study to understand how active adherence to the Christian faith influences the way SME owner-managers conceptualise their business practices. The study was based on in-depth interviews with 21 Christian SME owner-managers in Germany and the UK. Using a socio-psychological approach, the data analysis yielded a range of linguistic and conceptual resources that are peculiar to Christian discourse and that have the potential to influence business activity in rather distinctive ways. This paper (...) particularly focuses on those Christian concepts that could be regarded as distinct 'frames' for action. It outlines what effect these concepts had on the respondents and how they were related to business practices. The paper also discusses how this study could inform further research into the influence of other socio-cultural forms of identity on economic actors' conceptualisations of their own practice. In this paper, I argue for two principles to determine the temporal interpretation of modal sentences in English, given a theory in which modals are interpreted against double conversational backgrounds and an ontology in which possible worlds branch towards the future, The Disparity Principle requires that a modal sentence makes distinctions between worlds in the modal base. The Non- disparity Principle requires that a modal sentence does not make distinctions on the basis of facts settled at speech time. Selection of (...) the modal base will set these principles against each other, or allow for their cooperative interaction. For a root modal base, there is a conflict and disparity wins. The resulting interpretation is future. For a non-root modal base, the principles cooperate. Non-disparity determines a non-future interpretation and disparity requires the sentence to go beyond what is known by the speaker. (shrink)

In his treatises A Defence of Common Sense, Proof of an External World, and Certainty, G.E. Moore wanted to put an end to the modern doubts about the certainty of reality and the ‘external world’ by pointing to the undeniable plausibilities of ‘empirical propositions,’ such as ‘I know that this is my hand’ or ‘I know that the earth had existed before my body was born.’ Wittgenstein, who was intensely grappling with Moore’s proofs during the last one and a half (...) years before his expected death, still questioned these proofs and countered them with his concept of language games – including a different logic of the ‘connection with reality.’ Philosophically, he thereby left many loose ends in all places and admittedly a ‘gap’ between them, which he was no longer able to close. But he prepared for closing the gap by means of his concept of orientation, which he had initiated in his Philosophical Investigations without defining it in this term. In a new interpretation of On Certainty from the perspective of the Philosophy of Orientation, this paper tries to show how the attention to the phenomenon of orientation and the language game in which it is expressed can close this gap and thus carry on Wittgenstein's late philosophy to a certain point. The aim of this article is to show how the critically acclaimed and award winning film Margin Call may be used in business ethics teaching. Set in a fictional investment bank at the dawn of the financial crisis, the film zooms in on the motivations and decision-making of people who had much to lose from the crash of the hitherto very profitable mortgage-backed securities market. The film offers rich material for analysis of behaviours that contributed to the crisis. The article (...) will set out topics for classroom discussion, including the impact of incentives and power structures, contextual factors that distance people from the consequences of their actions, and considerations of how the banking industry may be transformed. What is Europe, if it is not a geographical unit and still is not an economic and political unit? What is this Europe that has indulged in the excesses of war and mass murder up to the end of the 20th century, but wants to see itself as incorporating the ideals of justice and goodness? Europe was never simply 'Europe', it always questioned itself, it had to understand itself as Europe and thus found its unity in its philosophy. On the 25th anniversary of Berry’s historic papers on the geometric phase, I discuss here our neutron interferometry experiment in which this phase is clearly separated from the dynamical phase. The connection of this experiment to the observation of the sign reversal of the wave function of a fermion during a 2π precession in a magnetic field by three groups independently in 1975 is discussed.
