This article revisits Jeffrey Tulis’s The Rhetorical Presidency in the age of Trump, discussing the debates to which it originally responded, its core thesis and empirical evidence, as well as its impact on political science in the last three decades. The article’s second half turns to a recent critique of Tulis’s thesis by Ann C. Pluta, which manifests many of the misunderstandings that have persisted since The Rhetorical Presidency’s original publication. Habits of thought revealed in Pluta’s misunderstandings, I argue, are (...) emblematic of the political culture that is amenable to the simplistic yet politically effective appeals characteristic of rhetorical presidents like Donald Trump. Elements of the broader political-science world that are on display in Pluta’s article are symptomatic of political pathologies sustained and aggravated by the culture of the polity that political scientists inhabit and purport to study—the culture of the rhetorical presidency. ABSTRACTAnne C. Pluta’s reply to my critique perpetuates the errors that undermined the article I criticized. Pluta dismisses out of hand my suggestion that her mistakes are the result of the particular lens through which she and much of the political science community view the American presidency. Yet this suggestion has the merit of explaining why she contends that piling up nineteenth-century instances of presidential public “speech” undermines Jeffrey Tulis’s contention that the nature of presidential speech changed decisively at the (...) beginning of the twentieth century, such that rhetorical, often-demagogic appeals over the heads of Congress displaced public speech that affirmed the values of republican, constitutional government. Living systems are characterized as self-generating and self-maintaining systems. This type of characterization allows integration of a wide variety of detailed knowledge in biology.The paper clarifies general notions such as processes, systems, and interactions. Basic properties of self-generating systems, i.e. systems which produce their own parts and hence themselves, are discussed and exemplified. This makes possible a clear distinction between living beings and ordinary machines. Stronger conditions are summarized under the concept of self-maintenance as an almost unique character of living (...) systems. Finally, we discuss the far-reaching consequences that the principles of self-generation and self-maintenance have for the organization, structure, function, and evolution of single- and multi-cellular organisms. Recently, the Supreme Court of Nigeria in Tega Esabunor v Faweya & Ors (2019) LPELR 46961 (SC) dismissed an appeal seeking to quash the order of a magistrate court for the transfusion of blood to a baby. The appellants contended that the court had no jurisdiction to make theorder. The crux of the case was whether the parents’ right to consent to the child’s treatment based on religious beliefs supersedes the child’s right to live, thus reflecting the tension between a (...) parent’s right to give consent to the choice of treatment for their child, and the court’s power to override such rights through the inherent parens patriae jurisdiction of the state. The case also reflects the tension between the freedom of a parent to practise their religion and the right of a child to live, in the medical context. This article examines the findings of the Supreme Court in Tega Esabunor’s case, considering whether the court’s decision is in line with the generally accepted practice on when the state can intervene if persons with parental responsibility refuse medical treatment for an incompetent child because of religious beliefs.Cases from other jurisdictions are analysed to ascertain the position of foreign courts. It is submitted that the Supreme Court’s judgmentreflects accepted international practice regarding parental refusal of consent for medical treatment of a child. (shrink)

Dans le cadre de son travail pour l'armée, Wiener a développé une théorie générale des régulations. Nous nous intéressons aux origines de la théorie générale des régulations en Allemagne , montrant qu'elle prend naissance dans un contexte bien différent.Hermann Schmidt (...) , le principal acteur dans ce domaine en Allemagne, bien que physicien de formation, formula sa version de la théorie du contrôle à la fin des années 30, grâce aux différents systèmes de régulation qu'il était amené à étudier au bureau des brevets du Reich . A partir de l'analyse d'une combinaison de facteurs contextuels, nationaux, politiques et contingents, nous proposons une explication de la moindre influence de la théorie de Schmidt.The general theory of control and communication, better known as ‘cybernetics’, is usually considered to be the result of research done during the Second World War in the United States, principally by the American mathematician, Norbert Wiener . Based on his military work, Wiener developed a general mathematical theory of control and feedback system. We discuss the origins of control and feedback theory in Germany , showing that it arose in a very different context.Hermann Schmidt , the principal actor in Germany, though trained as a physicist, formulated his version of control theory based on his extensive hands-on experience with control mechanisms gained during his work as a patent officer in the late 1930s at the German State Patent Office. We also offer an explanation for why Schmidt's general theory of control did not have a great influence based on a combination of national, political, and contingent contextual factors. (shrink)

Im ersten Drittel des 20. Jahrhunderts ubte Henri Bergson insbesondere in Frankreich grossen Einfluss auf Philosophie, Wissenschaft und Literatur aus. Auch Henri Matisse, der den Philosophen zwar nie personlich traf, kannte dessen Gedankengut. Bereits 1908 tauchen in denSchriften Matisse' Formulierungen wie Tiefe des Gedankens, Verdichtung der Empfindungen, wesentlicher Charakter, dauerhaftere Interpretation auf, die allein durch die Philosophie Bergsons umfassend erlautert und begrundet werden konnen.Bei beiden sind Aspekte wie Intuition, Instinkt, Identifikation, Dauer, Entwicklung, Leben, Schopfung zentrale Gesichtspunkte. In der kunstgeschichtlichen Literatur (...) zu Matisse wurde zwar mehrfach auf den Bezug zu Bergson verwiesen, nun liegt jedoch erstmals eine eingehende Untersuchung dieser geistigen Begegnung vor. Der Autor stellt die zentralen Schriften Bergsons in ihren Grundzugen dar und akzentuiert die Gedanken, die mit Texten und Bildern von Matisse korrespondieren. Daneben eroffnet er weit reichende Einblicke in die kunstlerische und malerische Dimension des Werkes von Matisse. (shrink)
