A Theory of Argument is an advanced textbook intended for students in philosophy, communications studies and linguistics who have completed at least one course in argumentation theory, information logic, critical thinking or formal logic. Containing nearly 400 exercises, Mark Vorobej develops a novel approach to argument interpretation and evaluation. One of the key themes of the book is that we cannot succeed in distinguishing good argument from bad arguments until we learn to listen carefully to (...) others. Part I develops a relativistic account of argument cogency that allows for rational disagreement. Part II offers a comprehensive and rigorous account of argument diagramming. Norms—that is, specifications of what we ought to do—play a critical role in the study of informal argumentation, as they do in studies of judgment, decision-making and reasoning more generally. Specifically, they guide a recurring theme: are people rational? Though rules and standards have been central to the study of reasoning, and behavior more generally, there has been little discussion within psychology about why (or indeed if) they should be considered normative despite the considerable philosophical literature that bears on this (...) topic. In the current paper, we ask what makes something a norm, with consideration both of norms in general and a specific example: norms for informal argumentation. We conclude that it is both possible and desirable to invoke norms for rational argument, and that a Bayesian approach provides solid normative principles with which to do so. (shrink)

This paper presents a theory of reasoning with evidence in order to determine the facts in a criminal case. The focus is on the process of proof, in which the facts of the case are determined, rather than on related legal issues, such as the admissibility of evidence. In the literature, two approaches to reasoning with evidence can be distinguished, one argument-based and one story-based. In an argument-based approach to reasoning with evidence, the reasons for and against (...) the occurrence of an event, e.g., based on witness testimony, are central. In a story-based approach, evidence is evaluated and interpreted from the perspective of the factual stories as they may have occurred in a case, e.g., as they are defended by the prosecution. In this paper, we argue that both arguments and narratives are relevant and useful in the reasoning with and interpretation of evidence. Therefore, a hybrid approach is proposed and formally developed, doing justice to both the argument-based and the narrative-based perspective. By the formalization of the theory and the associated graphical representations, our proposal is the basis for the design of software developed as a tool to make sense of the evidence in complex cases. On the one hand, the achievements of this essay are honoured—in particular, a thorough differentiation of the different meanings of ‘argument’ and ‘argumentation,’ the semantic justification of the fundamentality of arguments as sequences of propositions, and the detailed critiques of alternative theories of argumentation. On the other hand, suggestions for strengthening the theory are added to Siegel's expositions, (...) which make different perspectives within the epistemological theory of argumentation recognisable. Virtue-based approaches have attracted significant recent interest in argumentation, including a recent anthology of Chinese translations of important articles in the field. In this article, adapted from the introduction to that anthology, we discuss the origins of virtue argumentation and some of the challenges it has faced, as well as attempt to provide an overview of recent work on the virtues and vices relevant to argumentation. In the final section we discuss the articles that were selected and motivate their selection.

The article outlines a general epistemological theory of argument: a theory that regards providingjustified belief as the principal aim of argumentation, and defends it instrumentalistically. After introducing some central terms of such a theory (2), answers to its central questions are proposed: the primary object and structure of the theory (3), the function of arguments, which is to lead to justified belief (4), the way such arguments function, which is to guide the addressee's cognizing (5), (...) objective versus subjective aspects of argumentation (6), designing different types of argument (7). Then the notion of '(argumentatively) valid argument' is defined and criteria for the adequate use of such arguments are introduced (8). In this book two of the leading figures in argumentation theory present a view of argumentation as a means of resolving differences of opinion by testing the acceptability of the disputed positions. Their model of a 'critical discussion' serves as a theoretical tool for analysing, evaluating and producing argumentative discourse. They develop a method for the reconstruction of argumentative discourse that takes into account all aspects that are relevant to a critical assessment. They also propose a practical code of (...) behaviour for discussants who want to resolve their differences in a reasonable way. This is a major contribution to the study of argumentation and will be of particular value to professionals and graduate students in speech communication, informal logic, rhetoric, critical thinking, linguistics, and philosophy. Data are presented that focus on the nature and development of argumentative reasoning. In particular our study describes how support for or against an issue affects memory for critical parts of an argumentative interaction, judgments of argument goodness, and the content of the reasons given in support of one view versus another. Two other factors were examined: developmental differences in argumentation skill and the conditional nature of supporting one side of an argument across varying contexts. Our results show (...) that even seven year old children can recognize, identify, and use the basic components of an argument to provide evidence for and make judgements about their favored position. Moreover, if position support is held constant across all age groups of students, seven year old children were found to give reasons and explanations that were highly similar in content and principle to college students. The same similarities held across age with respect to biases in memory and judgements of argument goodness. The primary difference between children's and college students' argument behavior lay in the side of an argument the students chose to support. Seven year old children and some eleven yearold children supported positions that impute more value to friendship and social consequences than to the maintenance and advancement of individual rights, as specified in a contract agreement. The similarities and differences across development are discussed with respect to a theory of argumentation that speaks to the importance of understanding the nature of goal conflict and a theory of intentionality in predicting how arguments will be represented and resolved. This paper begins a working through of Blair’s (2001) theoretical agenda concerning argumentation schemes and their attendant critical questions, in which we propose a number of solutions to some outstanding theoretical issues. We consider the classification of schemes, their ultimate nature, their role in argument reconstruction, their foundation as normative categories of argument, and the evaluative role of critical questions.We demonstrate the role of schemes in argument reconstruction, and defend a normative account of their nature against specific (...) criticisms due to Pinto (2001). Concerning critical questions, we propose an account on which they are founded in the R.S.A. cogency standard, and develop an account of the relationship between critical questions and burden of proof. Our ultimate aim is to initiate a reconciliation between dialectical and informal logic approaches to the schemes. (shrink)

In this article, we argue for the general importance of normative theories of argument strength. We also provide some evidence based on our recent work on the fallacies as to why Bayesian probability might, in fact, be able to supply such an account. In the remainder of the article we discuss the general characteristics that make a specifically Bayesian approach desirable, and critically evaluate putative flaws of Bayesian probability that have been raised in the argumentation literature.

I begin by looking at passages in Mill's System of Logic that circumscribe the range of logic as he understood the subject. His logic is clearly too narrow to be the arbiter of the extended arguments presented in his Utilitarianism, On Liberty, and The Subjection of Women. Looking at Mill's argumentative practice in those works we see that he is noticeably concerned to deal with objections, more so even than in giving arguments for his position. His practice is shown to (...) be consistent with his professed views about how opinions outside science and mathematics are to be justified. These views are stated primarily in On Liberty where Mill gives a standard of justification and proclaims the importance of dealing with objections as part of that standard. Given Mill's characterization of an art, or practice - also found in the Logic - it turns out that a case can be made that Mill's views on argumentation fit the criteria for an art, pretty much on a par with ethics as an art. In the sense that I give to 'argumentation theory' it seems entirely appropriate to say that implicitly Mill held a theory of argumentation, a theory distinct from other proposed theories of argumentation, and a theory worth further study and development. Sometimes pernicious circularities appear in definitions of fundamental concepts of argumentation theory. For instance, in pragma-dialectical theory, the concept of a fallacy and that of a critical discussion aiming at resolving a difference of opinion mutually presuppose one another. A similar relationship obtains, in argumentation theory at large, between the concept of argumentation and that of rationality. Again, the concept of an argumentative dialogue presupposes a concept of statement. Yet, statementhood is sometimes claimed to be determined by (...) a locution’s function in dialogue. Similarly, for the concepts of proof and argument. Are these circularities really objectionable? Are they resolvable? If they are not, how can we live with them? It will be argued that some of these problems can be neglected some of the time, but not all of them all of the time. Though there may be no royal road towards resolution, several strategies can be applied. But sometimes patience is what is needed. (shrink)

Dans cette contribution, j’examine la spécificité d’une perspective d’épistémologie sociale en théorie de l’argumentation en me livrant à une analyse critique de la théorie actuellement dominante dans ce champ, la pragma-dialectique de Franz van Eemeren. Cette perspective, d’inspiration interactionniste gricéenne, se réclame du « rationalisme critique », donc d’une perspective épistémologiquement « préservationniste » (au sens où elle préserverait l’idée de référence à des normes de la connaissance). Et pourtant, en faisant des normes du débat argumenté, y compris des normes (...) de la connaissance, de simples règles de « bonne conduite », elle témoigne, de facto, d’une position épistémologiquement « révisionniste ». Cette perspective manifeste, par ailleurs, une forme d’« expansionnisme » sociologique élémentaire, comme tel légitime si l’on considère qu’introduire deux sujets, c’est déjà introduire du social. La pragma-dialectique n’introduit pas de nouveaux sujets de connaissance sui generis, tels que les communautés épistémiques ou les institutions (ce qui serait pour Alvin Goldman le critère de l’expansionnisme, un critère à mon sens trop fort), mais comme il s’agit de rendre compte d’argumentations, elle doit envisager au moins deux interlocuteurs potentiels et donc dépasser le solipsisme épistémologique, une posture explicite chez Descartes et implicite dans la plupart des théories de la connaissance classiques, lesquelles font rarement réellement place à l’intersubjectivité. Malgré ses limites, la pragma-dialectique, par sa recherche de normes de la construction de la connaissance plus proches des processus effectifs ou naturels de la connaissance, pourrait constituer – épistémologiquement redressée – une contribution importante à une épistémologie sociale « naturalisée ». The basic question of this monograph is: how should we go about judging arguments to be reasonable or unreasonable? Our concern will be with argument in a broad sense, with realistic arguments in natural language. The basic object will be to engage in a normative study of determining what factors, standards, or procedures should be adopted or appealed to in evaluating an argument as "good," "not-so-good," "open to criticism," "fallacious," and so forth. The rhetorical theory of argument, if held as a conclusion of an argument, is self-defeating. The rhetorical theory can be refined, but these refinements either make the theory subject to a second self- defeat problem or tacitly an epistemic theory of argument.

He is among the originators of informal logic, an author of textbooks on the informal logic approach to argument analysis and evaluation and on critical thinking, and a founder and editor of the journal Informal Logic. In this paper, I have two primary goals. First, I show that the causal-based story approach in A hybrid formal theory of arguments, stories and criminal evidence is ill suited to negative causation. In the literature, the causal-based approach requires that hypothetical stories be causally linked to the explanandum. Many take these links to denote physical or psychological causation, or temporal precedence. However, understanding causality in those terms, as I will show, cannot capture cases of negative causation, which are (...) of interest to the Law. In keeping with this, I also discuss some of the difficulties Hybrid Theory invites by remaining silent on the nature of the causal links. In my second aim, I sketch a way for Hybrid Theory to overcome this problem. By replacing the original, underlying causal structure with contrastive causation in the law, Hybrid Theory can represent reasoning in which the evidence that is appealed to is causally linked via negative causation to the explananda. HSÜN Tzu's essay on "Rectifying Terms" is justly considered a work of "great logical interest." For in this essay, one finds a remarkably modern concern with such topics as the rationale for having terms; the empirical and pragmatic bases for the classification of terms; the formation of generic and specific terms; the importance of observing established linguistic practices; the necessity of complying with proper standards for the institution, ratification, and regulation of the uses of language ; the nature of argumentative (...) discourse ; and the problems inherent in successful linguistic communication. A careful examination of some passages in other essays also suggests an awareness of the distinction between deductive, inductive, and analogical inferences, though Hsün Tzu provides us no explicit discussion of the nature of reasoning and its validating rules. The article aims at elucidating the argumentation in Anselm's Proslogion by relating some aspects of it to the early medieval theory of argument. The focus of the analysis is on the "single argument" (unum argumentum), the discovery of which Anselm announces in the Preface to the Proslogion. Part 1 of the article offers a preliminary description of the single argument by describing the reductio ad absurdum technique based on the notion "that than which a greater cannot (...) be thought". Part 2 discusses the ideas about arguments and argumentation that Boethius presents in Book One of his In Ciceronis Topica. Part 3 draws attention to some early medieval sources (Abelard, Lanfranc, Anselm) that are witness to the importance of the Boethian ideas in Anselm's time. Finally, Part 4 argues that Anselm looked at his single argument in the Boethian framework and that the term "that than which a greater cannot be thought" should be identified as his single argument. The rhetorical view suggests that the goal of factual ar- gumentation in legal proceedings is to persuade the fact-finder about the facts under litigation. However, R does not capture our social expecta- tions: we want fact-finders to know the facts justifying their decisions, and persuasion does not necessarily lead to knowledge. I want to present an epistemic theory of argumenta- tion honoring our expectations. Un- der my account, factual argumenta- tion aims to transmit knowledge to the fact-finder.

When a new theory of argumentation becomes available on the English-speaking market, such as it is happening now through the translation of Harald Wohlrapp’s The Concept of Argument, it is always interesting to work out how the new input will interact with the work that has otherwise been done in the field. This comment aims to determine whether rhetoric has a place in Wohlrapp’s account of argumentation.

There are a wide variety of theories of causation available in the philosophical literature. For the philosopher working in philosophy of mind, who makes use of causal concepts, what is to be made of this embarrassment of riches? By considering a variety of theoretical perspectives, she can discover which principles or assumptions about causation are robust, and which hold only within particular frameworks. In particular, she should be suspicious when the different premises in an argument can only be made (...) true by shifting between different theories of causation. Various argumentation analysis tools permit the analyst to represent functional components of an argument (e.g., data, claim, warrant, backing), how arguments are composed of subarguments and defenses against potential counterarguments, and argumentation schemes. In order to facilitate a study of argument presentation in a biomedical corpus, we have developed a hybrid scheme that enables an analyst to encode argumentation analysis within the framework of Rhetorical Structure Theory (RST), which can be used to represent the discourse structure of (...) a text. This paper describes the hybrid representation scheme and illustrates its use for investigation of contexts that license omission of elements of an argument. The analyses given in the paper involve reconstruction of enthymemes. Defeasible argumentation schemes serve as a constraint on reconstruction. In addition, the examples illustrate several other types of contextual constraints on reconstruction of enthymemes. (shrink)

In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the (...) work, noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. Habermas himself was actively involved in the translation, adapting the text as necessary to make it more accessible to English-speaking readers. (shrink)

Argumentation theory is a distinctly multidisciplinary field of inquiry. It draws its data, assumptions, and methods from disciplines as disparate as formal logic and discourse analysis, linguistics and forensic science, philosophy and psychology, political science and education, sociology and law, and rhetoric and artificial intelligence. This presents the growing group of interested scholars and students with a problem of access, since it is even for those active in the field not common to have acquired a familiarity with relevant aspects (...) of each discipline that enters into this multidisciplinary matrix. This book offers its readers a unique comprehensive survey of the various theoretical contributions which have been made to the study of argumentation. It discusses the historical works that provide the background to the field and all major approaches and trends in contemporary research. Argument has been the subject of systematic inquiry for twenty-five hundred years. It has been graced with theories, such as formal logic or the legal theory of evidence, that have acquired a more or less settled provenance with regard to specific issues. But there has been nothing to date that qualifies as a unified general theory of argumentation, in all its richness and complexity. This being so, the argumentation theorist must have access to materials and methods that lie beyond his or her "home" subject. The paper considers contemporary models of presumption in terms of their ability to contribute to a working theory of presumption for argumentation. Beginning with the Whatelian model, we consider its contemporary developments and alternatives, as proposed by Sidgwick, Kauffeld, Cronkhite, Rescher, Walton, Freeman, Ullmann-Margalit, and Hansen. Based on these accounts, we present a picture of presumptions characterized by their nature, function, foundation and force. On our account, presumption is a modal status that is attached to a claim and has (...) the effect of shifting, in a dialogue, a burden of proof set at a local level. Presumptions can be analysed and evaluated inferentially as components of rule-based structures. Presumptions are defeasible, and the force of a presumption is a function of its normative foundation. This picture seeks to provide a framework to guide the development of specific theories of presumption. (shrink)

The incompleteness problem for virtue ethics is inherited by a virtue-based theory of argumentation as developed by Daniel Cohen. A complete normative theory of argumentation should be able to provide reasons for why argumentative virtues such as open-mindedness are worthwhile, along with being able to resolve conflicts of such virtues. Adumbrating virtue-based argumentation theory with a pragmatic utilitarian approach constitutes a more complete theory that can account for why argumentative virtues are worthwhile.
