A study of how public service has changed in this new era of interconnectedness.

This paper critically assesses Chiara Cordelli’s Kantian theory of the legitimacy of public administration. I argue, first, that Cordelli’s understanding of Kantian legitimacy offers an insufficiently robust defense of democracy: it leaves too much scope for rule by epistocrats, individuals who are wiser than others in ascertaining the demands of justice. Second, I argue that Cordelli should be open to the eventual abolition of bureaucracy, through the increased involvement of ordinary citizens in public administration. Fiscal equivalence in the public administration of justice requires local police and courts to be financed exclusively by the populations that benefit from their services. Within a polycentric framework, broad based taxation to achieve fiscal equivalence is a desirable principle of public finance because it conceptually allows for the provision of justice to be determined by constituent’s preferences, and increases the political accountability of service providers to constituents. However, the overproduction of justice services can readily occur when (...) the benefits of the justice system are not enjoyed equally. Paradoxically, the same properties that make fiscal equivalence desirable by imposing restraint and control between constituents and local government also create internal pressures for agents of the state to engage in predatory, revenue-generating behavior. Amidst the ideology, efficiency and bitter contention of international economy, the importance of leadership or public administration had long been under-stressed as an avenue for any better solution. Nonetheless, within a changing mode of interaction in the global community, an increasing ethos for the kind of common basis of ethics or agreement, at least in the level of class administrators or noble citizenry including the academicians, business leaders, bureaucrats and so, could be congruent for the public good (...) on the national and international plane. A rapid transformation for the informative society or sharing and humanity or social justice generally is seen to enable the possibility of new openness against the divergences from various reasons. Typically, I consider the public administration other than law, inter alia, could have strands to leap for any grand promise or for any cosmopolitan public value since it tends progressive and less ideological. At the core of ambition underlie the ethics of public administrators or their responsibility for the constituents and global public. The paper deals with two illustrative cases from the experience of South Korea which matters at the negative and positive concept of liberty. They will be investigated, empirically at some extent and in view of the ethics of congressmen and public officers. I, then, turn to explore the western theories and tenets often associated with their moral standard. This essay explains how to use the calculus of consent framework to think more rigorously about self-governance, and applies this framework to the issue of evaluating federal regulatory agencies. Robust political economy is the idea that institutions should be designed to work well even under weak assumptions about decision-makers’ knowledge and benevolence. I show how the calculus of consent can be used to analyze both incentives and knowledge problems. The calculus is simultaneously a theory of self-governance and a tool for (...) robust political economy analysis. Applying this framework to the case of public administration leads to the conclusion that private goods (such as medicine) tend to be over-regulated, public goods tend to be under-regulated (such as enabling too much pollution), and regulatory agencies tend to be over-centralized (and should in most cases either be replaced with certification markets or moved to state level). In the late XVII century in England has establishes the school of “political arithmetic”, which goal consisted in the analysis of social phenomena on the basis of quantitative indicators. Its main representatives became William Petty, John Graunt and Charles Davenant (1656-1714). The latter left a mark in the history of England as a philosopher, politician and publicist, who made a significant contribution to the development and implementation of the methods of “political arithmetic”. The object of this research is the views (...) of the English thinker, reflected in his pamphlets and treatises of the 1690’s. The subject is the Davenant’s views on the principles and tasks of “political arithmetic” in the context of his political theory. Special attention is given to correlation between Davenant’s views on the development of “political arithmetic’ and his concept of public administration. The scientific novelty lies in the comprehensive examination of the political and economic views of Charles Davenant within the framework of his attitude on the method of “political arithmetic”. The author delivers a thesis on the importance of the political and epistemological context, which formed Davenant’s views on the quantitative indicators. Grasp of quantitative data Davenant correlated directly with the practice of administration. According to the philosopher, a public official having the capacity for “evaluation” and proper interpretation of data could avoid many mistakes in decision-making and reliance on “bad” advices. The thinker suggested that possession of quantitative data and their competent interpretation could increase the efficiency of administration. (shrink)

Information technology, that assortment of technology that enables the conversion of data into information, has had an enormous impact on the field of public administration and its theoretical foundation. This article explores five of them. It begins with a discussion of one of the primary impacts of information technology on public administration theory: the development of systems theory and its descendants including the study of complex systems, chaos, and complexity theory. The importance of information technology in (...) decision-making is explored next. Does information technology free us from the limits of bounded rationality or are we simply overwhelmed by the volume of information available via new sources, such as the Internet and the World Wide Web? The third role examined is the use of information technology as a research tool to make previously intractable problems solvable. Computer capability has enormously advanced the theoretical underpinnings of public administration. Fourth, the significance of information technology as a change agent that calls for revision of other theoretical postulates is investigated. As information technology has diffused into public organizations, how has it called into question what we previously thought about the foundation of bureaucracy? This chapter examines public policy as it applies to public education for students with disabilities in the United States. Public policy with respect to ‘special education’ has made important strides in the past half century and is not unjust in the explicit ways that it used to be. However, current US public special education policy is still unjust insofar as it is an instance of what Guy Adams and Danny Balfour call ‘administrative evil.’ Addressing this administrative (...) evil will require both procedural changes in special education and addressing the ‘micropolitics’ of individualized educational plan meetings. Referring to Habermas’ groundbreaking book ‘The structural transformation of the public sphere’, the article discusses contemporary transformations of higher education and science. In order to do so, in a first step a post-Habermas perspective will be developed, which implies two changes to the theoretical foundations guiding Habermas’ analysis: On the one hand, we are in the midst of a social transformation that has led to a pluralization of the understandings of the public – that is, publics. The representation (...) of society in society no longer finds a homogeneous form; it takes place only within the framework of different partial publics. These publics gain importance for different types of organizations (companies, public administrations, NGOs, etc.). This is where the second change to Habermas’ concept comes in because, on the other hand, from the perspective taken in this paper, such publics are constructs of the organizations themselves, that is, imagined publics. The fruitfulness of such a post-Habermas perspective on the public sphere will be illustrated by focusing on higher education and science. Universities as the organizational embodiment of higher education and science, not only represent a discursive space in the public sphere, but they are also increasingly transformed into strategically acting organizations that imagine and actively shape the publics that are relevant to them. Four examples will be used to present empirical observations that emerge from the theoretical perspective proposed here. These examples, however, require more in-depth investigations and only serve as illustrations for a new research agenda on ‘imagined publics’. In the end of this contribution, it is asked how far-reaching the discussed change processes towards universities as strategic organizations are, and what consequences result concerning a discursive and communicative understanding of universities. The last decade or so has seen an explosion of scholarship by American law professors on what has become known as administrative constitutionalism. Administrative constitutionalism is a catchphrase for the role of administrative agencies in influencing, creating, and establishing constitutional rules and norms, and governing based on those rules and norms. Though courts traditionally get far more attention in the scholarly literature and the popular imagination, administrative constitutionalism scholars show that administrative agencies have been extremely important participants in American constitutional (...) development. Section I of this essay identifies three different versions of administrative constitutionalism—(1) Engagement with Existing Constitutional Doctrine; (2) Resolving Questions of Statutory Meaning that Implicate Constitutional Questions; and (3) Shadow Administrative Constitutionalism—and provides examples from the scholarly literature to illustrate these distinct manifestations of administrative constitutionalism. Section II of this essay discusses the normative turn in administrative constitutionalism scholarship. Much of this normative literature is implicitly or explicitly premised on the notion that agencies are more likely to pursue progressive goals than are other government actors. Section III of this essay disputes the notion that agency constitutional decision-making is “democratic” and that agencies are naturally inclined to serve progressive goals. Finally, Section IV of this essay notes that scholars who support broad agency autonomy to work out and enforce their own constitutional visions have failed to consider how their work fits in with the economic and political science literature on agency behavior. One can predict, based on that literature, that agencies given broad autonomy under the guise of administrative constitutionalism will primarily be inclined to expand their scope and authority at the expense of countervailing considerations. The paper is premised on the well-recorded fact that R.B. Haldane, throughout his working life, remained fascinated with German idealist philosophy. The paper unravels Haldane’s own perception of the relation between his philosophical interests and his diverse policy-orientated work at the beginning of the twentieth century. Many commentators have noted this relation but often pass over it as a curious detail of his biography. The most basic tool his philosophy gave him was a way of analysing problems. This (...) philosophical stance was not an ex post facto rationalisation but conversely was always his first thought on encountering a problem. To solve a policy problem one has to identify the leading ideas of that particular mode of human experience. Haldane believed that finding such rational principles underlying all forms of experience was the first duty of a politician, lawyer or civil servant. He contended that this painstaking ideational analysis would ultimately lead to the most effective policy solutions. The paper focuses first on Haldane’s initial encounter with German philosophical culture in both Edinburgh and Göttingen, second, it unpacks the key philosophical themes which characterize his approach, derived largely from his reading of Hegel’s Science of Logic. Thirdly, it turns - in the light of his philosophical beliefs - to his overt commitments to policy developments in the Edwardian new liberalism, military reform, administrative and civil service policy reorganisation, and finally his extensive work in education policy, particularly in the university sector. This essay examines the administrative state as a ubiquitous phenomenon that results in part from the mismatch of incentives. Using two dramatic episodes in the history of economics, the essay considers two types of mismatch. It then examines how economists increasingly endorsed the “general good” as a unitary goal for society, even at the expense of private hopes and desires. More than this, their procedures and models gave them warrant to design mechanisms and advocate for legislation and regulations to “fix” (...) the supposedly suboptimal choices of individuals in service to the overarching goal. The rise of New Welfare Economics dealt an additional blow to the sovereignty of individual motivations, notwithstanding that Hayek and Buchanan warned that this engineering approach allowed social goals to override individual preferences. Throughout, the argument is that it is important to recognize that people within or advising the administrative state are influenced by the same sorts of motivations as actors throughout the economy. There has always been a tension, in theory, between the public accountability and the professional efficiency of the agencies of the administrative state. How has that tension been handled? What would it be like for it to be well handled?

China is rising. As China ascends in power, it is likely that ?Western? administrators ? American and European, in particular ? will find that they must interact with Chinese administrators more and more. In this article, I offer readers a brief glimpse into Chinese administrative ethics through an investigation of two forms of Chinese philosophy ? Confucianism and Taoism. In addition to reviewing these philosophies, I derive some consequences for a public service ethic that lies between the East (...) and the West. In particular, this article includes some recommendations for the managerial implications of these two philosophies in the context of increased political and administrative connections between the West and China. There are certain moments, such as the American founding or the Civil Rights Movement, that we revisit again and again as instances of democratic triumph, and there are other moments that haunt us as instances of democratic failure. How should we view moments of democratic failure, when both the law and citizens forsake justice? Do such moments reveal a wholesale failure of democracy or a more contested failing, pointing to what could have been, and still might be? Public Trials (...) reveals the considerable stakes of how we understand democratic failure. Maxwell argues against a tendency in the thinking of Plato, Rousseau and contemporary theorists to view moments of democratic failure as indicative of the failure of democracy, insomuch as such thinking leads to a deference to authority that unintentionally encourages complicity in elite and legal failures to assure justice. In contrast, what Maxwell calls "lost cause narratives" of democratic failure reveal the contingency of democratic failure by showing that things "could have been" otherwise-and, with public action and response, might yet be. A politics of lost causes calls for democratic responsiveness to failure via practices of resistance, theatrical claims-making, and re-narration. Maxwell makes a powerful case for the politics of lost causes by examining public controversies over trials. She focuses on the dilemmas and diagnoses of democratic failure in four instances: Edmund Burke's speeches and writings on the Warren Hastings trial in late 18th century Britain, Emile Zola's writings on the Dreyfus Affair in late 19th century France, Hannah Arendt's writings on the Eichmann trial in 1960's Israel, and Kathryn Bigelow's recent narration of (the lack of) trials of alleged terrorist detainees in Zero Dark Thirty. Maxwell marshals her subtle, historically grounded readings of these texts to show the dangers of despairing of democracy altogether, as well as the necessity of re-narrating instances of democratic failure so as to cultivate public responsiveness to such failures in the future. Thus, when Marx argued that it was high time philosophy “change the world,” his was a revolutionary challenge. Today, philosophy is an analytic affair and analytic philosophers seek less to explain the world than to squirrel out arguments or, more descriptively, to resolve the minutiae of this or that name problem. Faced with diminishing student demand, analytic philosophers have taken to (...) urging that everyone from primary school students to scientists be required to study philosophy. Just so, applied philosophers demand to be engaged as consultants on practical projects. Granting that the demand that philosophers be appointed to public policy projects is understandable, inasmuch as everyone, as Hegel observed, desires recognition, this article argues that no argument has been made that the results would benefit any but the appointees while reinforcing current administrative... This article is dedicated to the memory of Peter Kemp (1937–2018), whose extraordinary influence since the 1960s as an academic scholar and public intellectual transformed the Scandinavian philosophical scene in the post-analytic period. His contributions are viewed in the light of a rich biographical context, from his 1973 doctoral defense and his unflagging commitment as a teacher and author to his continued critique of narrow philosophical perspectives. I emphasize the unparalleled success of Kemp in addressing and challenging both the (...) broader society and its constituent elements of political leadership, public administration, and the business community. Finally, I show the impact of his personal life on his aim to link critical thinking and conviction in developing a philosophical commitment. This essay examines certain epistemic problems facing administrative states’ efforts to draft efficient regulations for their societies. I argue that a basic feature of the administrative state’s authority, namely its monopoly over the production of legally binding rules for all members of a geographically defined society, creates epistemic problems that impede efficient rule-making. Specifically, the administrative state’s monopoly over the production of legally binding rules prevents multiple public policies from being simultaneously implemented and compared. The resulting singularity of administrative (...) states’ regulatory decisions prevents observation of the counterfactual effects of policies that were possible but which were not implemented. The absence of observable policy counterfactuals frustrates efforts to assess the efficiency of administrative states’ decisions, as it is impossible to determine whether different policies would have generated greater benefits at lower cost than the policy the state implemented. As these epistemic problems are derived from the singularity of administrative states’ decisions, they exist independently of principal agent problems, suboptimal incentives, or the preferences and capabilities of administrative personnel. This volume analyzes welfare policies by looking at the making of their target publics. It examines how these populations are identified and constructed by policy making. The contributors apply the classic theoretical question about who gets what, when, and how, but also suggest the revisiting of policy-feedback analysis. Coverage includes empirical case studies in different geographical areas. It looks at Europe, the United States and also considers Mayotte, set in a post-colonial context. In biology, evolution has a very specific meaning, namely the application of a generative variation-selective retention scheme to change. Applying this to the administrative sciences is more exacting: describing what the variation consists of, how replication of the generated variation occurs and delineating the population from which the selection is made are far from easy. While it is the intention of this special (...) issue as a whole to provide some empirical examples of evolutionary change in the public and private sectors, this introduction will lay out the main lines of thought in what is often referred to as universal Darwinism and what this means in the administrative sciences. Key concepts here are generative variation, selective retention, and selective institutional environment. According to the authors, the Darwinian scheme of evolutionary theory focuses on how new ideas or concepts arise, how they propagate and influence wider actor thinking and on how the institutional environment in which they operate affects their differential survival. This evolutionary process is an interplay between actors and replicators (sounds, images, and in this context mostly words) in which it cannot be said in advance which one is fooling the other. In today’s world there is diversification of different models of higher education. At the same time, the multiplicity, the diversity of higher education models does not exclude their identity. Internationalization and integration of higher education in a global and international dimension raise a lot of new questions to the theory and practice. Almost every developed country has the rich experience of building the higher education system. The analysis of this experience can aid development and enrichment of the national educational system; (...) it provides an opportunity to avoid repeating the same mistakes and to discover the new approaches to solving some problems in this area. Therefore, based on this, we consider that it is impossible to claim the creation of the strategy of modernization educational and scientific reforms, which affect the educational and scientific institution of the society in the management of scientific and educational space without analysis of the existing models, schools, directions, their classification in contemporary philosophy of education. It concern as well the sphere of the social philosophy of education as the sphere of management of education. The continuity of public education, qualitative management, their intensity can only be achieved under two conditions of the fundamental character. The first one is use of new, theoretically grounded and practically proven management, philosophically developed, accessible and technically supported high technology of social activity, education, training, and learning. The second condition is the perfect acquisition of the methodology of socio-axiological and research activity. The structure must provide the same conditions for equitable selection of civil, educational and scientific-educational actions, excluding coercion and domination. It is noted that the existence of developed civil society among the existing conditions and prerequisites for the successful formation and functioning of educational systems and effective models of multilevel educational management is necessary. Thus, we can conclude that the strategy of the modern world development proposed by the social philosophy of upbringing and education is a key in the field of social administration, philosophy, and pedagogy. This is what we exactly mean by education, science or some of the paradigms of upbringing and education as a dominant one on a certain socio-historical stage. Contemporary critics of the administrative state are right to highlight the dangers of vesting too much power in a centralized bureaucracy removed from popular oversight and accountability. Too often neglected in this literature, however, are the dangers of vesting too little power in a centralized state, which enables dominant groups to further expand their social and economic advantages through decentralized means. This article seeks to synthesize these concerns, understanding them as reflecting the same underlying danger of state capture. It then (...) articulates a set of heuristics for the design of public and administrative institutions, which aim at minimizing the risks of capture from both public and private sources. By following these heuristics, it claims, we can successfully employ the administrative state as a weapon against concentrated private power, rather than allowing it to serve as a tool of dominant groups. Public university business schools appear to struggle in upholding their educational self. Corporate scandals linked to business graduates raise questions about the role of PUBS in the development of civilized societies. This study develops an ethical decision making model in the PUBS context based on moral theories and then empirically tests the model. The model hypothesizes that individuals’ moral philosophies in terms of egoism and utilitarianism as well as subjective norm in terms of peer influence affect their unethical behavioural (...) intention. Moreover, this study compares ethical levels between business students with those from other disciplines. Data was collected using a structured questionnaire from established public universities in Malaysia. The data was analysed using the Smart Partial Least Squares, a second generation structural equation modelling software, as well as the SPSS version 23. The results reveal that moral philosophies and subjective norm exert positive and significant effects on unethical behaviour intention. The study, however, found no significant effect with regard to unethical behaviours between business and non-business students. The authors argue that a university’s status may explain a student’s intentions towards ethics. Implications of the results and future research are proposed. (shrink)

Several presidents have created bioethics councils to advise their administrations on the importance, meaning and possible implementation or regulation of rapidly developing biomedical technologies. From 2001 to 2005, the President's Council on Bioethics, created by President George W. Bush, was under the leadership of Leon Kass. The Kass Council, as it was known, undertook what Adam Briggle describes as a more rich understanding of its task than that of previous councils. The council sought to understand what it means to advance (...) human flourishing at the intersection of philosophy, politics, science, and technology within a democratic society. Briggle's survey of the history of U.S. public bioethics and advisory bioethics commissions, followed by an analysis of what constitutes a "rich" bioethics, forms the first part of the book. The second part treats the Kass Council as a case study of a federal institution that offered public, ethical advice within a highly polarized context, with the attendant charges of inappropriate politicization and policy irrelevance. The conclusion synthesizes the author's findings into a story about the possible relationships between philosophy and policy making. This article is the result of a survey taken to determine the respect and position of Business Ethics as a field of study within Schools of Business Administration. 379 questionnaires were delivered to individual, not institutional, subscribers to Business Ethics Quarterly. 158 were filled out and returned, for a response rate of 41.6%. The general finding from an analysis of those responses is that many persons active in the teaching and research of Business Ethics at large (over 10000 students) (...) and very large (over 30000 students) universities, both public and private, believe that neither their teaching nor their research "count" for merit salary increases and promotion/tenure decisions at their institutions, and that few enjoy high levels of support from deans, faculty, or students. Contemporary thinkers have not been hesitant to talk about the end of religion, the end of philosophy, or the end of morality. In such a context, our society is based on what Lipovetsky calls a minimal ethics. We live at the crossroads of two types of discourses: one proclaiming moral decadence, and another that speaks about the revival of morality. The fact that ethical maximalism quits the contemporary scene does not necessarily mean that it leaves a complete vacuum. The (...) emptiness opens towards the manifestation of ethical creativity in the space of minimal ethics. In public space, and in administrative ethics, the secularization of ethics offers the possibility of feeling comfortable with promoting a form of moral relativism that does not alienate people from the sensation of ethical certainty that offers existential comfort through its firm values. Gumport chronicles the rise of "industry logic," as a departure from "social institution logic," in public higher education in the latter twentieth century. Industry logic refers to colleges restructuring for financial efficiency and developing more ties with industry. Since the 1970s, increased public scrutiny and demands for accountability have pushed colleges to become more corporatized and privatized. Gumport's sociological analysis is grounded in data from nine in-depth case studies that span three sectors of public higher education.

The three intertwining careers of William Torrey Harris [1835-1909] in philosophy, philosophy of education, and educational administration converge in twelve of the Annual Reports of the board of directors of the St. Louis public schools, most of the essential features of which he formulated as the superintendent of schools from 1867-79. These twelve reports, comprising philosophical and educational principles, have been acclaimed nationally and internationally to be among the most valuable official publications in American educational literature. (...) The major purpose of this paper is to clarify the nature and scope of the philosophical principles of Harris expressed in his Annual Reports. The areas of philosophy represented are metaphysics, anthropology, epistemology, ethics, and philosophy of religion. While the motivation and context of these philosophical principles are pedagogical in orientation, it is evident that Harris produced here a philosophical synthesis worthy of consideration in a formal survey of the history of American philosophy.
