Muʽtazilah is one of the kalām schools in which intellectual freedom is seen the most and therefore divergences within the sect are the most common. Although al-usûl al-ḥamsa/five principles constitute the main framework on which Muʽtazilah has agreed, opposing ideas have emerged within the sect on the principles of ʽadl (divine justice) and al-manzilah bayna al-manzilatayn and on the issues of nature and imamah. As a matter of fact, Muʽtâzilī scholars wrote many refutations to each other on the disputed issues. (...) One of those who have opposing views within the Muʽtazilah is Muḥammad b. Shabīb al-Baṣrī (d. mid 3rd/9th century), who lived between the end of 2nd and the middle of the 3rd century of hijra. Ibn Shabīb is one of the students of Ibrāhīm Ibn Sayyār al-Naẓẓām (d. 231/845), who was one of the leading scholars of Muʽtazilah. He initially opposed the principle of al-manzilah bayna al-manzilatayn, while he was Muʽtezilî, and accepted the Murji’ah approach on this issue. However, after he accepted the idea of irjā’, he continued his loyalty to Muʽtazilah with regard to the principles of tawhīd (divine unity) and ʽadl. Ibn Shabīb, who had a theological assembly of his own and is respected by the people in Baṣra, was an important scholar who stands out with his comprehensive knowledge of religious and philosophical schools of his time. In the doxographical tradition, his adoption of Murjī’ ideas is generally emphasized, except that he has not been referred to much. However, when the sources of kalām are examined meticulously, it is understood that he influenced many Muslim theologians with his works and views and that he was a source for them regarding many topics. The most important reason for this is that he was one of the first scholars to defend the Islamic belief against various philosophical and religious movements. Naturally, this situation provided him with a wide knowledge of religious and philosophical trends. Considering the quotations made from him, it is understood that he recorded this accumulation in a doxographical work. Another remarkable feature of Ibn Shabīb is that he was one of the first scholars to write in the genre of Kitāb al-Tawhīd. It is possible to see both contextual and methodological effects of this work in the quotations and narratives of Al-Māturīdī's book with the same name. What makes him different is that he adopts Muʽtazilī and Murjī’ ideas at the same time and develops a unique discourse on the subjects of grave sins and waʽīd (divine warning). Although he was raised in a strong tradition of thought such as Muʽtazilah, his ability to oppose his sect and his teacher Al-Naẓẓām and also to develop a different definition of faith despite accepting the doctrine of irjā’, makes him stand out as an original and intellectual personality. His different definition of faith is important in that it represents a more moderate approach to the issue of takfīr. For, he drew an encompassing framework based on the Quran and the Sunnah regarding the definition of faith and the conditions of takfīr, thus, he tried to preserve the unity of Muslims. He did not consider the denial of controversial issues that are not explicitly included in the Quran and Sunnah as a reason for takfīr. With this attitude, Ibn Shabīb took an important approach in ensuring social peace and free thought. In this article, all the information contained in Muʽtazilī sources, and doxographical works related to the life, scientific personality and theological views of Ibn Shabīb are gathered and analyzed, and then his theological thought is reconstructed based on these data. In lieu of an abstract, here is a brief excerpt of the content:THE PROBLEMS OF VIOLENCE AND CONFLICT IN ISLAM Qamar-ul Huda Boston College This paperis aworkin progress and itanalyzes theIslamic reasoning for the use of violence and conflict while also examining the reconciliation of violence in accordance to the Qur'ân and sayings of the Prophet Muhammad (Hadîth). Generally the ethics of violence and the interpretation of its use in the Islamic tradition was historically connected to legalists and theologians who (...) collaborated in devising policies for the imperial state. Their reading of the sources to support violence can be explained in areas of survival, self-defense, and resistance to oppression. Here, violence is explained in terms ofthe needs ofthe state, meaning that what is good for the government is good for the religion of Islam. More modern scholars of Islam are revisiting the problem of violence and the weaknesses ofclassical interpretations, and also examining, in light of the Qur'ân and Hadîths, contemporary issues like rights of the unborn, abortion, individual versus communal self-defense, domestic violence, and unprovoked aggression. The scope ofthis paperis, first, to discuss the ideas ofharmony and divine unity in Islamic theology and also the reasons Ithink they are crucial to any understanding of violence. Second, I proceed to analyze some of the ideas relating to violence "for" and "against" God in the Islamic tradition and how those ideas fit into the larger Islamic theology. Third, I am interested in presenting the specific verses from the Qur'ân, as well as Hadîths or sayings of the Prophet that deal with war, conflict and violence, and demonstrate that their contextuality is crucial. Fourth and last, but not least, I will suggest some new hermeneutics for Qamar-ul Huda81 using all of the above for developing, enriching, and incorporating it into an Islamic liberation theology that is desperately needed in the modern Islamic world. I. Islamic Theology, Muslims, and Divine Unity The beginning of all Islamic thought begins with God, or more specifically, with the testimony of faith or shahadâh,1 the statement that "There is no Godbut God, and the ProphetMuhammad is theMessenger.2" This attestation for Muslims is understood to be a unique certainty upon which all other truths depend and exist. With this as the starting point for Islamic beliefand practices, and indeed for all Islamic theology, the logical question for us here at COV&R is, then, to ask: "What is the Islamic perspective on peace and violence as it is related to God and to the testimony of faith?" Also, along the same line of thinking, one needs to pursue the question: "How does the Islamic faith respond to the problems ofviolence, i.e., destructive behaviorto oneselforto others by persons who thus believe that they are thereby serving and surrendering to God?" The word islam3 stems from the root salâm, "peace." The literal sense ofthe word is to be liberated from something or to gain peace in respect to it. Those who participate in this act of surrendering to the Divine are called Muslims, and through submitting one's will to God's Will, one gains safety from error, deviation, and corruption. One is integrally tied into the Divine Unity and is in harmony with the Divine. With this in the background, alThe shahadâh was established during the early period of the Prophet's missionary work. The belief that "There is no God but God, and the Prophet Muhammad is the final Messenger" was hostile to the religious practices of the Arab Bedouin culture. What distinguished the new Muslim converts was that they publicly affirmed the shahadâh and rejected contemporary cultural and religious norms of idolatry. After each reference of the beloved Prophet Muhammad, it is the custom in islam to recite or write "peace be upon him" (or pbuh). The actual Arabic benediction is sa'ala allahu alayhi wa salâm sometimes written in English as SAWS. For the sake ofnon-repetitiveness and to make it easier for the reader's eyes, this paper will not include that benediction after each reference. As in every religious issue, the two main resources of Islām which are the Qur’ān and the Sunnah/ḥadīths are the first reference sources for deciding the things that are forbidden by Islam. There is no evidence in the Qur’ān that suggests specific types of animals are forbidden to eat except pork. Other than pork, only the animals which are slaughtered without the name of Allah, their blood and their carcass are forbidden to consume. Except these restricted ill-gotten meats, in the (...) Qur’ānic verses there are no other limitations referring to different animals. However, in Ḥadīth sources there are some narratives referring to the Prophet Muḥammad, implying that He named some other forbidden animals beside the ones specified in the Qur’ān. Collecting the narratives and evaluating them as a whole will contribute for a better understanding of the rules and principles of prohibitions that the Prophet Muḥammad imposed on this issue. Moreover, it will help to identify whether those rulings on some animals are unconditional and world-wide or cause-related and thus changeable according to the conditions. Furthermore, in this matter, although some animals‘ meat are not mentioned as forbidden in the Qur’ān, they are banned by the Prophet Muḥammad. This brings the need to highlight the importance of the capacity of the Prophet Muḥammad on deciding what is permissible (ḥalāl) and forbidden (ḥarām) in the religion.SummaryWhile the authority for determining what is ḥalāl (lawful) and what is ḥarām(forbidden) belongs essentially to Allah, the Prophet Muḥammad is also authorized to appoint what is ḥalāl-ḥarām by Allah.Authority of the Prophet Muḥammadrelated to the issue is not absolute and stems from the Qur’ān. The matter of prohibition of the animals, which are commanded or forbidden to be slaughtered by the Prophet Muḥammad.At the end of the studies conducted based upon ḥadīth resources, in particular Kutūb al-Sittah (the well-known six ḥadīth books), it has been discovered that the animals, which are mentioned as not being permissible in the narratives, they are limited to domesticated donkey and the species of “predatory animals, predatory birds”, namely wolf, fox and cat. Even though the narratives about hyena imply as eatable, hyena is included in this article as it’s a predatory animal.The narratives regarding the prohibition of meat of domesticated donkey were transferred by approximately twenty Companions in respect to the time of the Battle of Khyber. This prohibition is generally stated in the ḥadīthresources as: “We were having dire hunger at the nights of Khyber. When the day for Khyber came, we encountered domesticated donkeys. We immediately slaughtered them. When we put the meat in the pot and started to boil it, crier of the Prophet Muḥammadcalled “Knock over the pots and don’t eat any of the donkey meat”. Regarding the issue there are such statements of some Companions like “we were banned from eating domesticated donkey”, “The Prophet banned the meat of domesticated donkey” among the narratives about the ban. In addition to a large number of narratives about the prohibition of domesticated donkey meat, there are two narratives related to permission of the Prophet for eating domesticated donkey and a narrative that Ibn ‘Abbās did not accept the ban. One of the said narratives is not among the narratives in the Kutūb al-Sittah while the other one is stated solely in the Sunanof Abū Dāwūd and thought to be acceptable by the traditionists. Even though this narrative’s authenticity is accepted, it is understood that there is an implication for the permission based on a necessity. According to the narrative, Ibn ʿAbbās referred to 145thverse of the surah al-An’am as a proof to his view saying “What ḥalālis what Allah allowed, what ḥaramis what Allah forbidden and the things about which there is no judgement of Allah are mubāḥ (permissible)”. As for us, the fact that Ibn ʿAbbās did not accepted the prohibition implies that he did not recognize the Prophet’s command related to the prohibition as an absolute prohibition. The conveyances of many Companions, which are consistent with each other, about the Prophet’s prohibition on eating domesticated donkey during the Battle of Khyber, proved that the prohibition was applied. Even though there is no dispute about prohibiting domesticated donkey, it is controversial whether the prohibition is absolute, constant or provisional based on certain reasons. It is more reasonable to accept that this prohibition was provisional and it was based on certain reasons. Because there are many narratives bearing information that this prohibition was due to several reasons and this is a situation which needs to be considered. Accordingly, there are three reasons, nearly all of which are attributed to judgement of the Companions. These were the facts that domesticated donkey was used in transportation; it used to eat filth and it was slaughtered/consumed without distributing booty/paying taxes. The seeking of the Companions for any reason for this prohibition indicates that they needed to comprehend this prohibition and that the prohibition is not absolute and constant.There is no explanation neither in the resources where the narratives are included nor in the annotation about when, where, why and in which context the prohibition regarding the predatory animals was realized. It is highly possible to assume that the Prophet prohibited these animal as they eat carcass. Another interesting issue within this regard is the fact that there are narratives and views indicating permissibility of eating hyena, which is a predatory, while predatory animals are forbidden in the narratives. Statements of the Prophet related to permissibility of eating hyena, which are considered authentic by traditionists and information about the Arabs who used to eat hyena and some of the Companions who praised eating hyena indicate that urf (custom) has a primary and decisive role about permissibility of eating meats. Regarding this matter about the hyenas, the narratives pointing out some Companions like ʿĀʾisha bint Abī Bakr and Ibn ‘Abbās who viewed prohibition of animals other than the prohibited animals in the Qur’an as inapplicable and other issues referring to the dispute indicate that prohibition of the Prophet Muḥammadfor predators can not be accepted as an absolute and unquestionable prohibition. Some of the prohibitions mentioned in ḥadīth narratives, except these animals, stem from the way of feeding and slaughtering of some animals. It is understood that consuming meat and milk of the animals that eat filth is prohibited in order to abstain from the things harming human health and mujassam (killing an animal with an arrow, etc. by fastening it as a target) is prohibited as carcass is banned and it is not permissible to torture and harm animals. Some of the prohibitions are related to the some animals, which were allowed and banned to slaughter by the Prophet. As the Prophet commanded some animals to be slaughtered and some animals not, meat of these animals was considered as forbidden. There is a dispute among the scholars, whilst there is not any statement of the Prophet about whether the animals included in this group can be eaten or not. The influence of this dialogue on the development of cosmological ideas in antiquity and the Middle Ages was very great. At a time when the knowledge of Greek philosophy and science in Western Europe had almost vanished, the Timaeus was the only Greek cosmological work to circulate freely in learned (...) circles. The translation and commentary of Chalcidius (c. 350) made the Timaeus available to Latin scholars, at least up to c. 53. But interest in the Timae~s was sustained for a long time before that. The lost commentary of Posidonius of Apamea (d. 51 B.C.), the De animae procreatione in Timeo of Plutarch (d. A.D. 125), the commentary of Proclus (d. 485), extant up to 44d,1 are the most important links in this continuous chain of Platonic cosmological exegesis in antiquity. In the Arabic tradition, the Timaeus had a decisive impact on the development of cosmological ideas also. Plutarch and Proclus were familiar names in the history of Platonic and post-Platonic thought, but I am not aware that the Stoic Posidonius, whom Zeller has described as ".the most universal mind that Greece had seen since the time of Aristotle," 2 was known to the Arabs, or that any mention of his commentary on the Timaeus is to be found in the Arabic sources. General interest in Platonism was an early feature of the philosophical wave which swept the Islamic learned world in the 8th century, and Zeller may be right in saying that it was the Platonic School of Athens which gave Muslim Neoplatonism its peculiar stamp. 3 One of the earliest translators of philosophical texts into Arabic, Yah.ia (b. al-Bit.riq) who flourished in the 2rid half of the 8th century, is credited with the translation of the Timaeus, later retranslated or revised by Hunain (b. Ish~q; d. 873) and Yahia (b. 'Adi and not, as Sarton has it, b. Khalīfa b. Khayyāt(d. 240/854-855) was an historian- muḥaddith in the ʿAbbāsid’s period. There are references in sources to his competence in history and lineage rather than Ḥadīth. Two works of him have survived. The first one is al-Ṭabaḳāt which is about study of men and the second one is al-Taʾrīkhwhich chronologically narratesthe events in the history of Islam until 232 AH. The latter is the most significant work to be applied for the historiography of ibnKhayyāt. In this article, Khalīfa b. (...) Khayyāt’s methodology in historiography is examined. In this study, the early period of Islamic histography is handled and the subject is discussed comparatively. The main characteristics of his historiography are his adoption of a chronological style that facilitates the follow-up of the book, his knowledge for the lineage of those who died in wars and the details about the wars. Also, among the charactersitics are his application of isnād to his history book as a muḥaddith, his knowledge for the previous resources via his teachers who belong to the schools of al-Madīna and ʿIrāḳ and when required, his usage of ayah, ḥadīth and poems. These issues are dealed in the artcile with examples. Besides, a study in the West about Khalīfa b. Khayyātasserts that he was a follower of Umayyad dynasty and so this affected his historiography. In this article, this assertion is tackled by analyzing the whole book and it concludes that it is not valid because of some narrations against this assertion.SummaryKhalīfa b. Khayyāt (d. 240 / 854-55), who grew up in Basra, one of the most important centers of scholarship of the time and the meeting point of scholars, and he continued his scholarly works in this city. Since his grandfather and father are engaged in the field of Ḥadīth, Khalīfa b. Khayyāt started his scholarly adventure at an early age and he took his first education in the field of Ḥadīth.Scholars, in the early periods, continued their studies in the fields of sciences related to each other. Khalīfa b. Khayyāt’s studies are also in this kind. Although there are references in sources to his accumulation of Ḥadīth, Khalīfa b. Khayyāt ’s main area of ​​expertise is history and nasab/genealogy. The fact that his works and references to him in later sources are largely related to historical events, knowledge of the nasab/genealogy, and wafayāt (death dates of Ḥadīth scholars and narrators) reveals his considerable knowledge on these issues. Khalīfa b. Khayyāt lived in the period of ʿAbbāsid caliphs al-Maʾmūn (813-833) and al-Muʿtaṣim (833-842). This period is important because of the fact that the al-Mihna incident took place and the pressure on the Ḥadīth scholars increased. Although Khalīfa b. Khayyāt is not one of the direct opponents of Muʿtazila, his participation in a debate against them provides clues about the place where he stands. The scholarly atmosphere of Basra, enabled Khalīfa b. Khayyāt to benefit from a wide range of teacher-student network. In addition to his professors from whom he benefitted in the field of Ḥadīth, he had the opportunity to obtain the knowledge and understanding of the history of that time through his teachers who are important historians of the period in his field. Two works related to Khalīfa b. Khayyāt whose reliability is confirmed by djarh wa l tadil scholars reached to our time. One of the oldest Ṭabaḳāt works in the history of Islam is al-Ṭabaḳāt; the other one is the book, al-Taʾrīkh, which provides a new method for Islamic historiography.This study deals with the principles of the method of historiography, which can be put forward through Khalīfa b. Khayyāt 's al-Taʾrīkh. al-Taʾrīkhis important in terms of being the first example of chronological writing type in Islamic historiography and has not been subject to any independent study to date. There are two ongoing M.A. thesis about Khalīfa b. Khayyāt, however, no study has been identified that directly deals with its methodology of history. On the other hand, based on some riwāyats/narrations in al-Taʾrīkh, there is a work that claims that Khalīfa b. Khayyāt had sympathy towards Umayyads. The study named “Khalīfa b. Khayyāt’s History on the Umayyad Dynasty (660-750), prepared by Carl Wurtzel as his PhD. Dissertation, examined the life of Khalīfa, partly the historiography and the religious-political narrations in the work. On the case of Muʿāwiya’s (d. 60/680) request of the allegiance to Yazīd (d. 64/683), Wurtzel compared an event that took place between the envoy of Ibn al-Zubayr (d. 73/692) and Muʿāwiya with al-Balādhurī’s (d. 279/892-93) narrative and concluded that Khalīfa was an Umayyad sympathizer. However, Khalīfa b. Khayyāt’s exclusion of an event such as al-Mihna which was against the ʿAbbāsid and changed the course of history in his book, shouldn’t be considered as a symptom of sympathy; It would be more appropriate to accept it as a feature of history writing.At the top of Khalīfa b. Khayyāt's principles of historiography, adopting chronological method comes first. Accordingly, Khalīfa b. Khayyāt, gives a brief history about the siyar of the Prophet Muhammad at the introduction of the book. Then, by beginning from the first hijri year, he gives the important events, wars and deaths by the years. Sometimes, he refers to the people assigned by the caliphs of the period by referring to the Amîrs (Administrators) of the Hajj. He gives lists of those who died on both sides of the wars. The importance of mentioning the tribes of the deceased shows his competence in the knowledge of nasab. One of the highlights of his historiography is that he sometimes does not touch upon some of the events and situations that are considered to be turning points in Islamic history; and sometimes he does not go down into detail but just gives relevant narratives. For example, he doesn’t mention any narrations about the selection of the Caliph which perhaps the most fundamental point of separation between Ahl al-Sunnah and Shīʿa in the history of Islam.Although he gave detailed information about The Battle of The Camel (36/656) and Ṣiffīn cases (37/657), it is not possible to determine his views on this subject. In addition, he never mentioned the al-Mihna incident, which deeply influenced society and the scholarly environment during the ʿAbbāsid period. Isnād is also holds an important place in the methodology of history of Khalīfa who was a muḥaddith at the same time. In many of the narrations he used the words haddathanā and ahbaranā.In our study, the siyar section of al-Taʾrīkhwas examined in order to determine the sources of the Khalīfa’s historiography and has been seen that the works of Ibn Isḥāḳ (d. 151/768) and Ibn Hishām (d. 218/833) were the main sources of this chapter. Considering Khalīfa b. Khayyāt’s emphasize to isnād and his reach to Ibn Isḥāḳ 's work through the mediation of Bekr b. Suleiman, it can be said that he was dominant in historiography on the sources before him. Khalīfa b. Khayyāt rarely refers to Qur’anic verses and hadiths when describing events. He referred to the verses in only two places and hadiths in only five places. One of them, and perhaps the most remarkable one in the book is the Ḥadīth of the Prophet Muḥammad: “I am the guardian of whom; ‘Alī is his guardian” This narration is used in the letter of Caliph Mahdī (d. 169/785) of the ʿAbbāsid to khārijī (outer) Abd al-Salām b. Hishām who rebelled. The study is based on the principles outlined above. At the end of the study it is also considered that Khalīfa b. Turkish-Islamic literature contains numerous religious literar writings. In the existing literature, it can be seen that many kinds such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, and al-asmā al-ḥusnā were written. Al-Asmā al-ḥusnā, written in the form of poetry and prose, were mostly sharḥ or their khawaṣṣ were explained. Çihil-nām al-Manẓūm, which is mentioned in the study, was written as khawaṣṣ al-asmā al-ḥusnā. The work is a poet entitled as Fażāyī. Manuscript was written in the (...) last quarter of the fifteenth century, and thus, it is presumed that the poet lived in the same century. This work has been identified in a manuscript. In addition, the poet’s Hadiyyat al-aḥbāb, der-Bayān al-maqāmāt al-darwīshān, Kitāb al-sharʿiyyat al-arbāb, and Ghazaliyyāt al-Darwīsh Fażāyī four other works have been identified. In the writings of the asmā al-ḥusnās, the names of ninety-nine were emphasized. In this study, the forty names of God are expressed. The text presented is a continuation of the tradition of writing some prose works written in Arabic and Persian. Çihil-nām al-Manẓūm, written in Arabic prose and known as Asmā al-Idrīsiyya it can be seen as a free stsyle translation of the prophet Idrīs. Forty names in the content of the work, their proper-ties, when, how much and how to read is explained. In this study, firstly the information about the subject of Qurʾān, hadith, Arabic, Persian and Turkish literature in the beautiful names of God is provided. Then, the information about the poet Fażāyī was given. Çihil-nām al-Manẓūm was introduced and the transcriptional form of the text was given.SummaryOne of the reasons that deeply affect a nation is the change of religion. This change did not only affect the individual but also influenced the society in which he was born and grew. One of the nations with strong influence is the Turks. Turks, after Islamization, have estab-lished a new civilization. One of the areas where this Islamic civilization reflects is the literary aspect of society. In this literature, which has begun to be formed, religious genres such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, have been revealed. One of them is about God. Religious literary writings about God were written in the form of tawhīd and munājāts, which consist of one or more prophets found at the head of the dīwāns, or as the annotations of asmā al-ḥusnā or as khawaṣṣ asmā al-ḥusnā.In time, the need for some Turkish literary and scientific works to be translated into a different language were born. It can be seen that with some changes such as subtraction and addition, texts are rewritten or poetic works are translated into prose. The original of our research subject Çihil-nām al- Manẓūm’s is written in Arabic and prose. Çihil-nām al-Manẓūm, it is a munājāt of the work known as Asmā al-Idrīsiyya, which describes the call of prophet Idrīs.Asmā al-ḥusnā is a religious term used mostly to describe the attributes and names of God. In the Qurʾān, there is no information about the number of asmā al-ḥusnā mentioned as a concept. However, the number of the names of God in the Qurʾān is 155. This number is differ-ent in ḥadīths. It is widely accepted that the number of asmā al-ḥusnā is 99. Some Islamic schol-ars have argued against such restricting statements, arguing that ninety-nine names, such as the hiding of the Night of Qadr, were hidden in all Divine names during the month of ramaḍān, while others suggested that the number of ninety-nine was large number of asmās (names).The first examples of asmā al-ḥusnā were written in Arabic literature. Some of them are not detached: Abū Manṣūr al-Māturidī (d. 333/944) Kitāb al-Tawḥīd, Abū ʿAbdullāh al-Ḥalīmī (d. 403/1012) al-Minhāj fī shuʿabiʾl īmān, Taḳī al-Dīn Ibn Taymiyya (d. 728/1328) al-Īmān. A part of asmā al-ḥusnās is also a single work: Abū Isḥāq al-Zajjaj (d. 311/923) Tafsīr al-asmāi’llāh al-ḥusnā, Aḥmad b. Husayin al-Bayhaḳī (d. 458/1066) al-Asmā al-ṣifāt and ʿAbd al-karīm b. Havāzin al-Quşayrī (d. 465/1072) Sharḥ al-asmāi’llāh. In addition to Arabic, it is useful to talk about some of the asmā al-ḥusnās which is written in Persian. Among them, asmā al-ḥusnās has a special importance. Many asmā al-ḥusnā were written in Turkish literature. The most famous among the verses of Ibn Isa b. Majduddīn ʿĪsā Saruḥanī (d. 967/559) is Sharḥ al-asmā al-ḥusnā. Other than that, Ḥusayin b. The mysterious secrets were revaled to him in 30 ṣuḥuf. His major miracles are governing spiritual beings, knowing the properties of the beings and possessing the knowledge of various unknown things. Again, he wrote a book about the char-acteristics of letters. Aristotle later wrote a commentary using the majority of the information found in this book. Some of the works are written to narrate the Prophet Idrīs’s praising God with forty names:Muḥammad al-Tunisian, al-Ravḍatu al-Sundusiyya fī asmā al-ḥusnā al-Idrīsiyya al-Suhrawardiyya; Shāb al-Dīn Yaḥya b. Ḥabash al-Suhrawardī, Çihil-nām. Among these, the most famous is the work called Asmā al-Idrīsiyyā, written by Suhrawardī. Here, in addition to the asmā al-ḥusnā (forty names), prayers, prayers, conquests, their meanings, and the merits of reading them are explained. The book is written in Arabic. Many copies of this work have been identi-fied. While the problem of nihilism is derived from a particular historical and intellectual context in Western philosophy, i.e., the pantheism controversy in modern German philosophy and the ideas of Nietzsche, non-Western thinkers also engaged with it and developed responses to it. In this article, I am interested in analyzing Muhammad Iqbal’s (1877–1938), a leading Muslim thinker (a Sufi) from India, engagement with the problem of nihilism and his response to it from a Sufi perspective. Arguing that the existing literature on (...) Iqbal fails to understand the deeper impact of Nietzsche’s ideas on Iqbal’s philosophy and the dramatic role “the problem of nihilism” played in causing changes in Iqbal’s philosophy, or on Iqbal’s intellectual development, in this article, I analyze how Iqbal’s encounter with the ideas of Nietzsche during his study period in Europe between 1905 and 1908 has introduced him to the problem of nihilism in its Nietzschean form, how this led Iqbal to a nihilistic mood/crisis from 1909 to 1913, and then how he later developed a response to nihilism by reconstructing the Sufi cosmology and by revaluating the Sufi values of the pantheistic/persian type of Sufism – the outcome of which is found in his philosophical poem Asrar-i-Khudî (1915). This paper demonstrates the political perspective of corporate social responsibility disclosures and, drawing on Weber’s notion of traditionalism, seeks to explain what motivates companies to make such disclosures in a traditional setting. Annual reports of 23 banking companies in Bangladesh are analysed over the period 2009–2012. This is supplemented by a review of documentary evidence on the political and social activities of corporations and reports published in national and international newspapers. We found that, in the banking companies over the period (...) of study, apparently neutral, corporate, philanthropic activities disclosed and promoted in CSR reports are inextricably linked to powerful leaders’ personal projects and the ruling party’s agendas. We have demonstrated elements of traditional societies, including personal loyalty and the public display of loyalty, the master–servant relationship, and obedience to personal rather than formal authority, provide an understanding of why banks have employed politically charged CSR disclosure strategies. The paper contributes to disclosure studies where political motivations of corporate disclosure rarely discussed. The paper extends the debate on political CSR by demonstrating that the role of family and familial values at the organisational and national levels may be much more important when it comes to CSR disclosure and activities. This study aims to identify artificial intelligence (AI) technologies that are applied in climate-smart agricultural practices and address ethical concerns of deploying those technologies from legal perspectives. As climate-smart agricultural AI, the study considers those AI-based technologies that are used for precision agriculture, monitoring peat lands, deforestation tracking, and improved forest management. The study utilized a systematic literature review approach to identify and analyze AI technologies employed in climate-smart agriculture and associated ethical and legal concerns. The study findings indicate several (...) ethical concerns for deploying AI in climate-smart agricultural practices pertaining to data inaccuracy, other technical errors based on wrong recommendations or wrongful acts, data ownership and intellectual property issues, and economic issues resulting in digital division and privacy and security related issues. In this study, the ethical concerns were further examined based on criminal law, tort law, privacy and data protection law, and intellectual property law. In this regard, the study finds that the current tort law pattern is more suitable than the criminal law pattern to address some major ethical concerns, such as data inaccuracy and other technical errors based on wrong recommendations or wrongful acts. Finally, the study recommends that at the global level, all countries need to fill up the current gap of international law on climate-smart agriculture through agreeing on a standard set of legal provisions and enhancing collaboration in innovation and deployment of climate-smart agricultural AI. It further recommends that at the local level, countries need to adopt suitable regulations addressing multi-stakeholders’ interests associated with the deployment of climate-smart agricultural AIs. Due to the advance computer technology, the use of probability distributions has been raised up to solve the real life problems. These applications are found in reliability engineering, computer sciences, economics, psychology, survival analysis, and some others. This study offers a new probability model called Marshall–Olkin Extended Gumbel Type-II which can model various shapes of the failure rate function. The proposed distribution is capable to model increasing, decreasing, reverse J-shaped, and upside down bathtub shapes of the failure rate function. Various (...) statistical properties of the proposed distribution are derived such as alternate expressions for the density and distribution function, special cases of MOEGT-II distribution, quantile function, Lorenz curve, and Bonferroni curve. Estimation of the unknown parameters is carried out by the method of maximum likelihood. A simulation study is conducted using three different iterative methods with different samples of sizes n. The usefulness and potentiality of the MOEGT-II distribution have been shown using three real life data sets. The MOEGT-II distribution has been demonstrated as better fit than Exponentiated Gumbel Type-II, Marshall–Olkin Gumbel Type-II, Gumbel Type-II, Marshall–Olkin–Frechet, Frechet, Burr III, Log Logistic, Beta Inverse Weibull, and Kumaraswamy Inverse Weibull distributions. In a communication network with a source node, a multicast tree is defined as a tree rooted at the source node and all its leaves being recipients of the multicast originating at the source. The tree or bandwidth cost is normally measured by its utilization of tree links along with the quality of service measures such as delay constraint and end-to-end delay. However, if nodes are allowed to join or leave the multicast group at any time during the lifetime of (...) the multicast connection, then the problem is known as dynamic multicast routing problem. In this article, we combine a greedy approach with static multicast routing using Tabu Search to find a low-cost dynamic multicast tree with desirable QoS parameters. The proposed algorithm is then compared with several static multicast routing algorithms. The simulation results show that, on a large number of events, i.e., where nodes are leaving or joining, the proposed algorithm is able to find multicast trees of lower cost and more desirable QoS properties. BackgroundIn Pakistan, drug promotion practices, ethical or unethical, have rarely been in the spotlight. We aimed to assess the perception and barriers of medical representatives (MRs) and doctors (MDs) regarding ethical promotion of pharmaceuticals in Pakistan.MethodsA cross sectional survey was conducted in seven major cities of Pakistan for 6-months period. Self-administered questionnaire was used for data collection. Logistic regression and five-point Likert scale scoring was used to estimate the perceptions and barriers.ResultsCompared to national companies (NCs), the medical representatives (MRs) of (...) multinational companies (MNCs) strongly believed that their companies follow World Health Organization (WHO) (OR; 5.31, p = 0.0005), International Federation of Pharmaceutical Manufacturers & Associations (IFPMA) (OR; 6.45, p = 0.0005) and national codes of ethics (OR; 5.84, p = 0.0005). MNCs trained their MRs (OR; 6.68, p = 0.0005), provide accurate and valid scientific data (OR; 4.01, p = 0.007) with adequate system of accountability and controls on product samples (OR; 1.96, p = 0.047), while, NCs sponsor social or entertainment activities, seminars and conferences, and all sort of facilitation in form of gifts of their choice and clinic renovation for medical doctors (MDs). MDs perceptions were similar to MRs mentioned above, yet strongly agreed that companies offer cash payments or equivalents to MDs. The MRs of NCs/mncs and MDs agreed/strongly agreed that no external accountability, profiteering, pressure on sale targets, job insecurity, condoning unethical promotion by high-ups’ and business promotion by junior MDs were the predominant barriers.ConclusionIn conclusion, MRs of MNCs and MDs believed that MNCs follow certain codes of ethics in the promotion of pharmaceuticals, while NCs tend to be more profit oriented and even condone unethical promotion. All stakeholders, MRs, MDs and companies, might pose certain barriers, intentionally or unintentionally, in ethical promotion. (shrink)

Virtue signaling serves to express moral and ethical values publicly, showcasing commitment to social and sustainable ideals. This research, conducted with non-WEIRD samples to mitigate the prevalent WEIRD bias (i.e., the tendency to solely rely on samples from Western, educated, industrialized, rich, and democratic societies), examines whether the scarcely studied virtue-signaling construct mediates the influence of consumers’ attachment anxiety (vs. avoidance) on their green purchase behavior and prosocial responses. Drawing on attachment theory and the emerging virtue-signaling literature, the current work (...) reports the results from three studies (_N_ total = 898) in which consumers’ attachment patterns were not only measured, as in most prior related research, but also manipulated. Study 1 confirmed the unique ability of measured attachment anxiety, but not attachment avoidance, to predict consumers’ green purchase behavior and prosocial tendencies, with virtue signaling mediating these links. Study 2 manipulated participants’ attachment patterns, finding further support for the mediating role of virtue signaling between attachment anxiety (vs. avoidance) and these dependent variables. Study 3 provided a more nuanced account for our virtue-signaling conceptualization by documenting that self-oriented, but not other-oriented, virtue signaling mediated the link between attachment anxiety and both our key outcomes in public contexts. From a managerial viewpoint, these findings indicate that anxiously attached consumers constitute a potentially lucrative segment for companies seeking to expand their market share of sustainable and ethically produced products. Computer vision and human–computer interaction are essential in many technological fields. Researchers in CV are particularly interested in real-time object detection techniques, which have a wide range of applications, including inspection systems. In this study, we design and implement real-time object detection and recognition systems using the single-shoot detector algorithm and deep learning techniques with pre-trained models. The system can detect static and moving objects in real-time and recognize the object’s class. The primary goals of this research were to investigate (...) and develop a real-time object detection system that employs deep learning and neural systems for real-time object detection and recognition. In addition, we evaluated the free available, pre-trained models with the SSD algorithm on various types of datasets to determine which models have high accuracy and speed when detecting an object. Moreover, the system is required to be operational on reasonable equipment. We tried and evaluated several deep learning structures and techniques during the coding procedure and developed and proposed a highly accurate and efficient object detection system. This system utilizes freely available datasets such as MS Common Objects in Context, PASCAL VOC, and Kitti. We evaluated our system’s accuracy using various metrics such as precision and recall. The proposed system achieved a high accuracy of 97% while detecting and recognizing real-time objects. (shrink)

The COVID-19 pandemic has caused a global crisis that particularly hit employment globally. Due to the economic crisis, many small businesses attempted to minimise their expenses by either closing or downsizing. During such organisational situations, the employees face negative workplace attitudes that lead to knowledge hiding and affect team performance. This study examines negative attitudes and their effect on team performance. Further, this study examines the mediating effect of knowledge hiding and moderating the role of servant leadership. Through a multi-time (...) data collection approach, the authors obtained 363 responses from the education sector in China during the COVID-19 pandemic. PROCESS Hayes model 1 and 4 were used for mediation and moderation analysis. Results show that job insecurity, cynicism, and role stress are significant forces behind knowledge-hiding behaviour. Furthermore, the knowledge hiding behaviour adversely affects task performance. Servant leadership shows a buffering effect on knowledge hiding behaviour caused by negative workplace attitudes. This is one of the first studies in the South Asian environment to examine the association between employees’ negative attitudes and task performance using knowledge hiding as a mediator and servant leadership as a moderator in the COVID-19 scenario. This study examines two stock market anomalies and provides strong evidence of the day-of-the-week effect in the Chinese A-share market during the COVID-19 pandemic. Specifically, we examined the Quality minus Junk strategy return on Monday and FridayQuality stocks mean portfolio deciles that earn higher excess returns. As historical evidences suggest that less distressed/safe stocks earn higher excess returns.. The QMJ factor is similar to the division of speculative and non-speculative stocks described by Birru. Our findings provide evidence that the QMJ (...) strategy gains negative returns on Fridays for both anomalies because the junk side is sensitive to an elevated mood and, thus, performs better than the quality side of portfolios on Friday. Our findings are also consistent with the theory of investor sentiment which asserts that investors are more optimistic when their mood is elevated, and generally individual mood is better on Friday than on other days of the week. Therefore, the speculative stocks earned higher sustainable stock returns during higher volatility in Chinese market due to COVID-19. Intrinsically, new evidence emerges on an inclined strategy to invest in speculative stocks on Fridays during the COVID-19 pandemic to gain sustainable excess returns in the Chinese A-share market. With the advancement of scientific collaboration in the 20th century, researchers started collaborating in many research areas. Researchers and scientists no longer remain solitary individuals; instead, they collaborate to advance fundamental understandings of research topics. Various bibliometric methods are used to quantify the scientific collaboration among researchers and scientific communities. Among these different bibliometric methods, the co-authorship method is one of the most verifiable methods to quantify or analyze scientific collaboration. In this research, the initial study has been conducted to (...) analyze interdisciplinary research activities in the computer science domain. The ACM has classified the computer science fields. We selected the Journal of Universal Computer Science for experimentation purposes. The J.UCS is the first Journal of Computer Science that addresses a complete ACM topic. Using J.UCS data, the co-authorship network of the researcher up to the 2nd level was developed. Then the co-authorship network was analyzed to find interdisciplinary among scientific communities. Additionally, the results are also visualized to comprehend the interdisciplinary among the ACM categories. A whole working web-based system has been developed, and a forced directed graph technique has been implemented to understand IDR trends in ACM categories. Finally, the IDR values between the categories are computed to quantify the collaboration trends among the ACM categories. It was found that “Artificial Intelligence” and “Information Storage and Retrieval”, “Natural Language Processing and Information Storage and Retrieval”, and “Human-Computer Interface” and “Database Applications” were found the most overlapping areas by acquiring an IDR score of 0.879, 0.711, and 0.663, respectively. With the popularity of location-based social networks, location prediction has become an important task and has gained significant attention in recent years. However, how to use massive trajectory data and spatial-temporal context information effectively to mine the user’s mobility pattern and predict the users’ next location is still unresolved. In this paper, we propose a novel network named STSAN, which can integrate spatial-temporal information with the self-attention for location prediction. In STSAN, we design a trajectory attention module to learn users’ (...) dynamic trajectory representation, which includes three modules: location attention, which captures the location sequential transitions with self-attention; spatial attention, which captures user’s preference for geographic location; and temporal attention, which captures the user temporal activity preference. Finally, extensive experiments on four real-world check-ins datasets are designed to verify the effectiveness of our proposed method. Experimental results show that spatial-temporal information can effectively improve the performance of the model. Our method STSAN gains about 39.8% Acc@1 and 4.4% APR improvements against the strongest baseline on New York City dataset. (shrink)

Internet-enabled technologies have provided a way for people to communicate and collaborate with each other. The collaboration and communication made crowdsourcing an efficient and effective activity. Crowdsourcing is a modern paradigm that employs cheap labors for accomplishing different types of tasks. The task is usually posted online as an open call, and members of the crowd self-select a task to be carried out. Crowdsourcing involves initiators or crowdsourcers, the crowd, crowdsourcing task, the process, and the crowdsourcing platform where requesters offer (...) various tasks and crowd workers complete these tasks. As the crowdsourcing is carried out in the online environment, it gives rise to certain challenges. The major problem is the selection of crowd that is becoming a challenging issue with the growth in crowdsourcing popularity. Crowd selection has been significantly investigated in crowdsourcing processes. Nonetheless, it has observed that the selection is based only on a single feature of the crowd worker which was not sufficient for appropriate crowd selection. For addressing the problem of crowd selection, a novel “ant colony optimization-based crowd selection method” is presented in this paper that selects a crowd worker based on multicriteria features. By utilizing the proposed model, the efficiency and effectiveness of crowdsourcing activity will be increased. (shrink)

The uncertainty of this situation produced various questions that perplexed educationists regarding what implications the pandemic would have on educational institutions, especially regarding how the switch to online education would impact the behavior and performance of students. This quantitative research employed the convenient sampling technique to collect data through structured questionnaires distributed to 396 students of higher education institutions who carry a mobile device. This study used descriptive and inferential statistics to make the data more meaningful. Structural equation modeling with AMOS software was used for hypothesis testing. The results showed that ML was a significant and positive predictor of SP and LB. Moreover, student LB partially mediated the relationship between ML and SP. The findings suggest that the academic performance of students can be enhanced by building a ML environment that aligns with the LB of students. Nevertheless, content suitable for ML must be developed, and future research should be conducted on this topic. (shrink)

This article discusses the haul stage which is held once a year on the date of death of the fourth former President of the Republic of Indonesia, namely Abdurrahman Wahid (Gus Dur), which demonstrates harmonious relations between adherents of different religions in Indonesia. Consequently, the haul rituals have become vehicles for affirming understandings of the interfaith dialogue. This study aims to map the use of haul rituals to promote interfaith value. Analysing YouTube videos, this study finds that interfaith dialogue forms (...) have been reflected in: (1) declarations of a cross-religious ideology, (2) the involvement of interfaith figures, and (3) the inclusivist discourses themselves. Gus Dur’s haul, thus, has provided collaborative spaces wherein interfaith dialogue value can be sustainably structured.Contribution: This research contributes to exploration of the haul stage, which takes place annually on the death anniversary of former Indonesian President Abdurrahman Wahid (Gus Dur). This article provides a brief background of how Comparative Theology is understood today, to point out features of how it is practiced that are responsive to issues peculiar to contemporary Catholicism, and to suggest how a version of CT might be developed that is more consistent with Islamic traditions of thought on related issues. In order to accomplish this last goal, a brief introduction to the traditional “Islamic sciences” is provided. It will be suggested that an Islamic Comparative Theology (ICT) (...) can be understood as a multidisciplinary field that draws on several Islamic sciences, as well as research in religious studies. I argue in favor of a blurring of the distinction between Comparative Religion and Comparative Theology, and point out that relevant discussions are to be found across a variety of traditional Islamic sciences, but that it would be advantageous to collect these discussions together and to augment them with information gleaned from both secular and Islamic approaches to the teachings of Muslim thinkers about theological issues, broadly understood, in comparison with what is found in non-Islamic traditions in such a manner to enrich our own understandings of the issues and those with whom we engage in dialogue. This paper makes a distinction between ahistorical causal-functional kinds and historical kinds, which include both type- and token-historical kinds, some of which are “copied kinds.” After showing how these distinctions play out in various social sciences, a number of reasons are put forward for the historical individuation of some social kinds. As in the natural sciences, historical individuation in the social sciences can enable us to infer common causes, explain synchronic causal properties, and discover exceptions to causal regularities, among other (...) epistemic aims. Objective: Governments consistently aim to enhance services and establish online connections to efficiently deliver necessary information. This study aims to evaluate the future potential of digital libraries in public libraries in Pakistan by examining various projects that have introduced innovative approaches to foster the development of digital library services. Methodology: The analysis utilized the Amos 24 version, employing the Structural Equation Model (SEM) for assessing model fit indices and validating hypotheses. Additionally, Statistical Package for Social Sciences (SPSS) version 24 was (...) employed for Pearson correlation and factor analysis. Findings: The results suggest the appropriateness of discussing three out of the seven elements/factors used to assess competence improvement. The study reveals that public library managers can offer both physical and online workshops to community members, addressing emotional management for customers, including children and adults, during post-crisis information retrieval. Practical Implications: The study on public library user literacy skills, user behavior, and digital resources and services integrates the exploration and development of online databases to address challenges faced by public library management and users amidst the information explosion in academic and research activities. This contributes to enhancing the satisfaction levels of public library users. Originality/Value: Librarians are encouraged to conduct online workshops to address challenges faced by research students in information-seeking scenarios, focusing on improving reading and literacy skills, understanding user behavior, and optimizing digital resources and services through a study of online databases. _This study examines the proposition that exports cause growth in gross domestic product GDP in the economy of Pakistan from 1973 to 2022. The study intends to analyze the export promotion strategy that was adopted by Pakistan's economy in the 1990s. Cointegration test reveals there is a long-run relationship between these two variables. However, causality is proved in both short and long-run from GDP to exports. The Trade openness and export growth both are prolonged association but in case of Pakistan (...) persistent depreciation of PKR could not achieve desired level of export earning which implies that J-Curve theory does not exist in Pakistan. This implies that growth in the domestic production base is vital to expansion in exports. The government or policymakers should give importance to and incentivize various production sectors of an economy so that they can contribute to the expansion of export markets._. (shrink)

Kinds that share historical properties are dubbed “historical kinds” or “etiological kinds,” and they have some distinctive features. I will try to characterize etiological kinds in general terms and briefly survey some previous philosophical discussions of these kinds. Then I will take a closer look at a few case studies involving different types of etiological kinds. Finally, I will try to understand the rationale for classifying on the basis of etiology, putting forward reasons for classifying phenomena on the basis of (...) diachronic features, thereby making a provisional case for considering at least some etiological kinds to be natural kinds. Disclosure of near miss medical error (ME) and who should disclose ME to patients continue to be controversial. Further, available recommendations on disclosure of ME have emerged largely in Western culture; their suitability to Islamic/Arabic culture is not known.

Asking whether the sexes are natural kinds amounts to asking whether the categories, female and male, identify real divisions in nature, like the distinctions between biological species, or whether they mark merely artificial or arbitrary distinctions. The distinction between females and males in the animal kingdom is based on the relative size of the gametes they produce, with females producing larger gametes (ova) and males producing smaller gametes (sperm). This chapter argues that the properties of producing relatively large and small (...) gametes are causally correlated with a range of other properties in a wide variety of organisms, and this is what makes females and males natural kinds in the animal kingdom. The chapter concludes with a discussion of the relationship between sex and gender: while the difference between the sexes is biologically grounded, the difference between genders is socially based. Since gender depends in part on the perception of sex, whether or not gender is real or not does not depend on whether sex is, since social reality is constituted in part by our perceptions. The claim that sexes are natural kinds in the animal kingdom does not imply that the biological differences among female and male humans do and should have social consequences. (shrink)

In this interview, which took place in July 2020, Muhammad Asghari, an associate professor in the Department of Philosophy at the University of Tabriz, asked eleven questions (via email ) to Professor Susan Haack, a distinguished professor of philosophy at the University of Miami. This American philosopher eagerly and patiently emailed me the answers to the questions. The questions in this interview are mainly about analytic philosophy and pragmatist philosophy.This interview was conducted via personal email between me and Professor Susan (...) Haack in July 2020. This interview, which Professor Hawk eagerly accepted, includes eleven questions about her biography and roles of various philosophers in her thought and finally about the influence of the philosophy of pragmatism on her thought. Of course, it goes without saying that the Haack's book Philosophy of Logic in Iran has been translated into Persian and he has published two articles in the quarterly journal of Philosophical Investigations (University of Tabriz) and I also have translated one of her articles into Persian. What was most interesting to me was the influence of pragmatism on Haack's thought that Charles Sanders Pierce, among classical American pragmatists, had as much influence on this philosopher's thought as John Dewey had in Rorty's thought. Nūr Muḥammad is one of the teachings in Sufism that studies the beginning of the creation of the universe. The Sufis discussed Nūr Muḥammad through God's tajallī (manifestation), and they believed that only Insan Kamil (Perfect Humans) possessed the perfection of His tajallī. This Sufi theory can be comprehended through the dhawqi approach. This research will deal with Nūr Muḥammad's theory of Sufism through the perspective of Tijaniyah Tarekat. The data for this study was obtained through library research utilizing a (...) documentary technique. The collected data will be analyzed using the descriptive analysis method. This study finds that the Tijaniyah Tarekat is a Sufism institution that bases its teachings and practices on the concept of Nūr Muḥammad in the form of ṣalawāt al-fātiḥ and ṣalawāt jawharah al-kamāl. This Tarekat's elucidation of Nūr Muḥammad is also built on and consistent with the explication of authoritative Sufis in Islam's intellectual and spiritual tradition. (shrink)

With the growing call for private sector actors to address global challenges, it is necessary to first assess whether regions with the greatest needs are accessing corporate philanthropy. In this paper, we ask whether corporate philanthropy is reaching those with the greatest health-care needs. Drawing on economic geography and corporate homophily, we argue that corporate philanthropy tends to exacerbate health inequality as grants are destined for counties with fewer health problems. We test and find support for this hypothesis using data (...) on health grants made by US corporate foundations and county-level health data. Our results that corporate health grants are less likely to go to counties which have a lower proportion of medical service providers and insured citizens suggest that corporate foundations are unwittingly complicit in worsening the resource gap between small, poor, rural counties and large, wealthy, urban counties. From an ethical perspective, we provide some guidance as to how this may be corrected. (shrink)

In general it is found that the corporate managers and stockholders possess totally different view about good governance of a company. Managers strongly believe that governance of their companies is quite well but stockholders view that it is very poor. The study found that the groups differ in perception especially in terms of turnover, production, capital, leverage, debt service, credit policy, solvency, human resource, recruitment, technology, customer satisfaction, internal control, strength, opportunity, competition, industry position, collective bargaining agent (CBA) issues, and (...) economic remedies; whereas, they have similar view in terms of adequacy of research fund, company weaknesses and threats, contingency plans, presence of political influence. The managers think that the companies do not have enough retained earnings and these should not be distributed among stockholders, but the stockholders thinkotherwise. Managers always perceive that they are underpaid whereas stockholders express the opposite view. Each group believes that it is the other group that dominates the decision-making. Both the group wants to have mutual interaction but stockholders want to interact more than the mangers. The study noted that corporate managers’ tenure is more with the company than a stockholder’s holding of stock. The study also found that the managers are better educated than the stockholders. The study observed serious gender biasness both in management position and stockholding of the corporations. Though both the groups belong to same age level but their distribution shows stockholders enter into the share market at an early age. (shrink)

Los estudios modernos sobre derecho islámico han puesto de relieve la necesidad de estudiar los procedimientos jurídicos en el Islam y el papel desempeñado por la práctica judicial en su formación. Se considera en general que, en el período temprano, los cadíes disponían de mayor libertad en lo relativo a testigos y métodos para establecer pruebas. Posteriormente y de forma gradual el sistema se volvió más rígido y restrictivo. En relación a este desarrollo, los investigadores han propuesto distintas fechas, que (...) van desde la segunda mitad del siglo VII hasta el siglo VIII e incluso hasta el siglo XI. Estos investigadores han tratado la doctrina de al-yamīn ma‛ al-šàhid como una excepción dentro del procedimiento establecido por la šarī‛a que, según ellos, se basaba estricta y mecánicamente en la doctrina de los dos testigos. Para dichos investigadores, la doctrina de al-yamīn ma‛ al-šàhid surgió bajo la influencia de determinadas locadidades o bien por influencia judía. Este artículo propone que esa doctrina debió de surgir en el contexto del período de la guerra civil, cuando las cuestiones sobre qiṣāṣ, qawad, qasāma y ḥakam fueron discutidas con frecuencia en relación con el Corán y la sunna común y cuando se sintió la necesidad de reformar la institución del ḥakam. Sobre la base de afirmaciones dispersas de ulemas que vivieron en fechas cercanas a ese período, afirmaciones que se ven confirmadas por los comentarios de Wakī‛, se concluye que Mu‛āwiya fue quien introdujo ese método para reformar la institución del ḥakam. La práctica judicial de esta doctrina también confirma que estaba demasiado difundida como para poder considerarla una práctica medinense o una práctica local, tal y como pretenden algunos juristas clásicos, los tradicionistas y algunos investigadores modernos.
