The author undertakes an attempt to present the philosophical and legal concepts comprising the legacy of a German theoretician of law, Gustav Radbruch, in respect of justice. The historical context for Radbruch is World War II, which forced German lawyers to face the question of the limits to which positive law is binding. Radbruch’s theory makes a breach in the legal positivism current of German legal reflection and thus belongs to what is known as the third way, setting out new (...) prospects in the history of the philosophy of law. The thread described by the author is the manner in which Radbruch connects natural law with legal positivism, demonstrating that, within a legal reality, they may exist in parallel. (shrink)

In this ambitious study of the development of Charles Peirce 's realism, Mateusz Oleksy attempts "to show that over the course of his entire career Peirce significantly modified his position on realism ". Oleksy differentiates between Peirce 's earlier scholastic realism and Peirce 's mature realism, which Oleksy calls pragmatic realism. "One of the main theses of this book," he proclaims in the introduction, "is that PR is incompatible with SR as a whole, and that it replaces the latter (...) in Peirce 's mature thought". Oleksy proposes to defend this thesis in the four ensuing chapters, "knowing very well that Peirce would most likely protest, since all throughout his career he declared loyalty to SR". (shrink)

This paper argues that the so-called ‘paradox’ of dehumanization is a mirage arising from misplaced abstraction. The alleged ‘paradox’ is taken as challenge that arises from a skeptical stance. After reviewing the history of that skeptical stance, it is reconstructed as an argument with two premises. With the help of an epistemologically structured but pluralistic frame it is then shown how the two premises of the Skeptic’s argument can both be debunked. As part of that it emerges that there are (...) a couple of ways how dehumanization can be realized, and one such realization can be sufficient for affirming the reality of dehumanization for a specific case. This paper applies crip theory (McRuer, 2006, 2018) as well as other key conceptual tools from disabled childhood studies (Runswick-Cole et al., 2018) and disability studies in education (Cousik & Maconochie, 2017) as a tactic intended to question and resist the story of overcoming as it manifests itself within the discourses and practices of self-regulation in early learning classrooms. This paper offers a brief overview of the range of self-regulation strategies enacted within educational settings in Ontario, Canada, that purport to (...) support young children in overcoming themselves on their way to normalcy. This paper also engages in crip theory as a strategy to both question and disrupt the taken for granted assumption that self-regulation entails a return towards or a sustaining of the efficient and productive neoliberal individual in school systems. Finally, this paper considers how we might not only invite but embrace the disruptions that occur when embodied differences refuse to be overcome by demands to self-regulate. Ultimately, a key aim of this paper is to resist how discourses and practices of self-regulation in Early Childhood Education and Care (ECEC) establish the overcoming narrative as a means to cure, fix or exclude embodied differences while contemplating the vibrant possibilities embedded within learning with and from disabled childhoods. This paper revisits Donnellan’s distinction between referential and attributive uses of definite descriptions and argues that it is not exhaustive. Donnellan characterizes the distinction in terms of two criteria: the speaker’s intentions and the type of content the speaker aims to express. I argue that contrary to the common view, these two criteria are independent and that the distinctive features may be coinstantiated in more than two ways. This leaves room for nonattributive and nonreferential uses of definite descriptions. Kripke’s notions (...) of general and specific intentions provide a framework that accommodates such cases. Additionally, it proves useful for the analysis of the use of proper names with specific nonsingular intentions. The paper also discusses how the interpretation of the use of definite descriptions as attributive or referential (or neither) is sensitive to which theory of singular thoughts one adopts. (shrink)

The complexity and emotional/psychological responses to the environmental challenges of the 21st century has led to the coining and development of new words and concepts that, for some people, better describe how they are personally grappling with anthropogenic ecosystem damage and climate breakdown. This paper identifies some of the more commonly used environmental neologisms within scholarly literature and evaluates their usefulness and contradictions for those influenced by the virtue ethics promoted by the ancient Stoics and the Catholic Church. We find (...) that environmental neologisms, when framed by these philosophical and/or theological ideas, offer an alternative and, ultimately, helpful means to contemplate the nature of what might be considered an environmental crisis and how best we might address, or at least, mitigate it, as conscientious spiritual human beings. This article proposes an account of knowing-who constructions within a generalisation of Hintikka’s quantified epistemic logic employing the notion of a conceptual cover Aloni PhD thesis [1]. The proposed logical system captures the inherent context-sensitivity of knowing-wh constructions Boër and Lycan, as well as expresses non-trivial cases of so-called concealed questions Heim. Assuming that quantifying into epistemic contexts and knowing-who are linked in the way Hintikka had proposed, the context dependence of the latter will translate into a context dependence of (...) de re attitude ascriptions and this will result in a ready account of a number of traditionally problematic cases including Quine’s well-known double vision puzzles Quine. Image is said in many ways. In view of its equivocal nature, we could choose to clear its analytical path, replace its historical transit or give up. Instead, this paper proposes an alternative by reflecting on the temporal dimension of the image. For this reason, it makes use of two nodal reflections: the Benjaminian notion of dialectical image, and the link between image and emotions as explored contemporaneously by queer theory. The notion of dialectical image allows us to envision, even (...) beyond its author, another link between image and history, which allows us to understand it not only as a linguistic phenomenon, but also in its visual and audiovisual dimension. Queer theory in its affective turn has presented a possible link between images and affects that allows the composition of an ephemeral archive that declassifies our temporal categories (CVETKOVICH, 2018) and the ethical question about our primary responses in the face of the image (BUTLER, 2010). The journey through both notions addresses, ultimately, the temporality of images in its critical power, that old insistence on thinking of images that contain their own destruction. (shrink)

Considera-se que constituem meios de formação por excelência e se inscrevem entre os múltiplos processos de constituição do sujeito urbano. integraram um conjunto de estratégias formativas da medicina dirigidas aos cidadãos com vistas à produção de comportamentos e atitudes de urbanidade e civilidade. O estudo examina um dos modos de realização da formação sanitária empreendida por médicos gaúchos junto a uma escola técnico profissional para trabalhadores, nas primeiras décadas deste século, no Rio Grande do Sul. Busca-se demonstrar que as ações e estratégias desencadeadas pelos médicos conferiram uma forma, uma identidade ao processo de formação, forma essa associada à constituição de sujeitos com consciência sanitária e comportamento higiênico. A investigação volta-se para a extensa rede de saberes e poderes que elegeu a escola como (...) locus privilegiado de atuação de higienistas que associaram a prática da higiene a um ideal de civilidade, urbanidade e progresso. Philosophy in the 20th century witnessed a schism between so called ‘analytic’ and ‘continental’ schools of philosophy. One of the aims of the IJPS from its inception was to provide a space for articles attempting to overcome, or at least foreshorten, that divide. This paper critically examines the various understandings of the divide and takes a quick glance at some of the attempts to bridge it.

El presente texto procura articular una serie de aristas surgidas de una práctica docente en torno al saber filosófico diagramado académicamente. En concreto, constituye una reflexión sobre la alfabetización académica en las carreras de Filosofía de nivel universitario y, más específicamente, en relación con una inquietud fundamental: ¿cómo enseñar a comprender/producir un texto académico en tal marco institucional? Con el objetivo de determinar algunos indicios que ayuden a reflexionar sobre lo que abre tal pregunta, en este trabajo se busca exponer (...) algunos aspectos emanados de mi experiencia como docente universitaria y abordar la comprensión/producción de textos académicos desde una perspectiva filosófica. It seems natural to think that there are aesthetic reasons for action and that an artist must be guided by such reasons as he or she begins work on the canvas or poem or symphony or marble. This latter supposition seems at odds, however, not only with classical inspiration theory but also with the views of one of the last century’s most important philosophers of art, R. G. Collingwood. We propose an account of acting for an aesthetic reason inspired by (...) G. E. M. Anscombe’s Intention, specifically by her concept of ‘practical knowledge’, which we believe can accommodate Collingwood’s reservations about the sort of knowledge of their ends, and of the means to those ends, which artists have as they engage in their creative activity. El presente trabajo tiene como objetivo realizar un análisis contextual de la direccionalidad del marxismo latinoamericano desde la muerte de José Carlos Mariátegui hasta nuestros días. Inevitablemente, este empeño tropieza con las diversas formas en que se ha manifestado el pensamiento de izquierda, con sus disímiles proyecciones, y, sobre todo, con la forma en que ha enfrentado los distintos acontecimientos históricos en el continente. O presente artigo tem por objetivo apresentar as contribuições da estética da existência em Foucault para o âmbito da educação. Inicialmente será apresentado, em linhas gerais, os três domínios de sua produção teórica: Arqueologia do Saber, Genealogia do Poder e Estética da Existência. Posteriormente, será exposto mais profundamente a terceira fase de sua obra, destacando as ideias acerca do conceito do Cuidado de Si e a sua relação com o ambiente escolar e a formação docente. A estética da existência caracteriza-se (...) como o terceiro domínio foucaultiano e concerne na ideia da vida como obra de arte, onde por meio das práticas de si, cuidado de si, governo de si, _parrhesía_ e exame de consciência o sujeito torna-se capaz de estilizar sua existência, moldando sua vida e sendo artesão de si mesmo. Os apostes teóricos que fundamentam a pesquisa, além do Michel Foucault, são: Veiga-Neto (2016), Brandão (2011), Barcelos, Rabelo e Rodrigues (2009), entre outros autores. Esses correlacionam a obra do Filósofo Michel Foucault com a Educação. A partir da relação estabelecida entre a Estética da Existência e a Educação, percebeu-se que a escola têm sido, desde a sua fundação até os dias de hoje, um espaço que prioriza a disciplina e a normatização. Portanto, faz-se necessário introduzir nesse espaço saberes que possibilitem um novo modo de formar os sujeitos para que esses sejam conscientes e desfrutem da sua liberdade, que por muitas vezes lhes é retirada. La autora se pregunta por la medida en que los problemas que se identificaban como actuales en el primer número de Derechos y Libertades se mantienen como desafíos al discurso de los derechos humanos. La conclusión a la que llega es que todavía hoy es necesario discutir sobre la universalidad, la participación,las desigualdades, la degradación de los derechos sociales, el papel de los derechos en las relaciones internacionales y el medio ambiente. Además, a los anteriores, se suman la amenaza del (...) terrorismo y la respuesta a esta amenaza, así como el auge de los populismos de extrema derecha, y el impacto de la revolución tecnológica.En la actualidad, un contexto marcado por el Antropoceno, el cambio climático y el impacto de las nuevas tecnologías convierte en perentorio el discurso de los derechos y, sobre todo, la extensión de este más allá de los entornos académicos a través de la educación en derechos. In this paper I explore the differences between how Martin Heidegger and Wouter Kusters understand the role that anxiety as an encounter with the nothing plays for the origin of philosophy. Despite an important overlap between Heidegger and Kusters on the critical distance they take from the discourse of psychology and psychiatry and their valuable attempt to de-psychologize the discourse around anxiety and prioritize its existential insights, I argue that Kusters’ view of the nothing primarily as groundlessness and, subsequently, the (...) view that anxiety leads to philosophy through the route of extreme skepticism is at odds with Heidegger’s view that anxiety as an encounter with nothing reveals the world as a whole. Este artículo analiza las lecturas que realizó Martin Heidegger de la Ética a Nicómaco de Aristóteles a partir de las anotaciones y subrayados que se conservan en un ejemplar que perteneció al filósofo alemán y que actualmente se custodia en la Biblioteca Histórica de la Universidad de Salamanca. Las diversas notas y glosas manuscritas que Heidegger anota al margen de las páginas en la obra de Aristóteles permiten conocer mejor la influencia que este libro ejerció en la filosofía heideggeriana y (...) descubren que «el taller histórico y filológico» que Martin Heidegger instauró a partir del texto aristotélico fue crucial para el desarrollo de algunos conceptos fundamentales de su pensamiento. Geschlecht und Gewalt, das Thema dieses Bandes, betrifft nicht nur die Frage nach den Charakteristika und Ursachen sexueller Aggression, sondern auch die Frage nach angeblichen geschlechtsspezifischen Formen der Aggression. Der vorliegende Beitrag befasst sich mit beidem und diskutiert sie als Teil von begrifflichen Ausweitungen der Kampfzone, d.h. der Erweiterungen des Aggressionsbegriffs im Verlauf der wissenschaftlichen Aggressionsforschung der zweiten Hälfte des 20. Jahrhunderts. Der Beitrag zeigt unter Anderem: was als Aggression wahrgenommen wird und in der Wissenschaft als solche gezählt wird, verändert (...) sich mit der Gesellschaft. Dabei wird aus epistemologischer bzw. wissenschaftsphilosophischer Perspektive gezeigt, wie sich rassistische, Status-, und Geschlechtsstereotype auf begriffliche Entscheidungen in wissenschaftlicher Forschung auswirken und somit die wissenschaftliche Arbeit am Begriff beeinflussen können. The oldest record of the notion of “mercy”, raḥmān, in Aramaic is known from a bilingual text in which the word is the translation of the Akkadian rēmēnû. The latter is used in Mesopotamian onomastics, hymns and prayers, which delivered the oldest formulae of calls for the mercy of gods, especially in a recurrent expression: “the merciful god, that is good to pray,” translated verbatim in the Aramaic text of the statue of Tell Fekheryeh. Almost a thousand years later, the (...) same wording has been inherited unchanged in Palmyrene Aramaic. Nevertheless, the Palmyrene interest on the divine epithet raḥmān and its revival in Palmyrene epigraphy may be explained by the influence of the new Roman concept of clementia. Meanwhile, this contribution proposes to outline a chronology of the Aramaic inscriptions from Syria and Palestine, in which raḥmānāʾ is either the main substitute for the divine name, or a major divine epithet. As the Akkadian phonetic assimilates the consonant to the laryngeal but preserves the velar, the supposed East Semitic root was rḥm, not rḫm. On the contrary, in the Arabian Peninsula, the earliest attested root is rḫm, as evidenced by South Arabic onomastics or toponymy. A late use of rḥm in South Arabic as a verb or noun is the result of a loan from Aramaic and does not appear until the fifth century AD. The first South Arabian inscriptions naming the monotheistic god raḥmānn are preceded by the Palmyrene inscriptions by almost two centuries and are contemporary with the Jewish-Aramaic inscriptions in the Palestinian synagogues, which call the God Raḥmānāʾ. Late, the Aramaic epithet was transferred to the Arabic al-raḥmān, through South Arabian. (shrink)

The EU's Farm to Fork strategy (European Commission European Commission. 2020. Farm to Fork strategy. https://food.ec.europa.eu/horizontal-topics/farm-fork-strategy_en. Accessed 31 August 2023.) highlights the need for a resilient food system capable of providing affordable food to citizens in all circumstances. Behind the provision of affordable food for EU citizens there is the effort of many migrant and seasonal food workers (MSFWs). In Almería, Spain, the area with the biggest concentration of greenhouses in the world, MSFWs face vulnerability in the form of physical (...) and institutional invisibility despite performing the essential task of providing affordable food for the EU’s food system. This paper aims to move on from structuralist concerns and place MSFWs’ lived experiences at the center, including the (in)formal nature of their food practices, to understand how the people that feed Europe feed themselves. A combination of social practice theories and diverse economies is used to explore MFSWs’ daily food routines. These theories are used as lenses that inform the data collection process, performed through semi-structured interviews, photography, and observations. The findings of the study reflect a dynamic portfolio of (in)formal practices that evolve based on the length of stay in the county. These practices demonstrate how the EU food system resilience relies on the diverse economies of migrant settlements. We conclude that informality is a reality in the EU food system, and that shedding light on previously hidden food practices and their structures can help us envision food security interventions that are inclusive for all actors involved. Esta circunstancia provocó que los traductores se dirigieran a su autor para comentar la obra así como para hacerle partícipe de algunos problemas que les iban surgiendo. El epistolario conservado entre Miguel de Unamuno y sus traductores nos ofrece así una fuente inestimable de conocimiento para comprender mejor la génesis y el alcance de la que, según Unamuno, fue su obra capital. Gracias al hallazgo de unas cartas inéditas, podemos reconstruir cómo fue el proceso de traducir Del sentimiento trágico de la vida, teniendo en cuenta todos los acontecimientos que se sucedieron al inicio del siglo XX. El artículo versa sobre la necesidad de la filosofía del derecho en el presentey en el futuro. Se expone la perennidad de los temas sobre los que seocupa esta materia, definiéndola como ciencia de lo razonable. Entre lasmúltiples cuestiones para las que la filosofía del derecho es imprescindibleuna de ellas es la interpretación jurídica que realizan los jueces. Las distintasteorías que se han elaborado a lo largo de los dos últimos siglos, especialmentedesde la ilustración, han dado lugar a una reflexión (...) sobre la argumentaciónjudicial, que sigue desempeñando un lugar crucial en laenseñanza de estas materias en las facultades de derecho y en los operadoresjurídicos. De ahí que la filosofía del derecho siga siendo un instrumentoimprescindible en el presente y en el futuro de nuestras sociedades, quequeda corroborado por la experiencia de la autora, catedrática de filosofíadel derecho y juez durante estos cinco últimos años en el Tribunal Europeode Derechos Humanos en Estrasburgo. La “Escuela de Salamanca”, como etiqueta histórica, ha sido cuestionada y actualizada en múltiples ocasiones y desde intereses muy diversos. En este artículo se investiga el origen del concepto en la teología alemana del siglo XIX (en autores como Franz Ehrle y Gerhard Schneemann, especialmente) y se presta atención al contexto político y religioso en el que emerge (la denominada _Kulturkampf _alemana), con el propósito de comprender mejor las notas definitorias que se le otorgaron.

Este artículo propone considerar el perdón como un acto social y muestra las ventajas explicativas de dicha perspectiva. En la primera parte del trabajo se revisa la definición de acto social planteada por Adolf Reinach, se presentan algunas objeciones a la consideración del perdón como acto social y se responde a ellas. En la segunda parte se exploran tres ventajas explicativas de esta propuesta: la primera, frente a la crítica de Nussbaum al perdón perverso, la segunda, frente a la crítica (...) de Serrano y Cázares al perdón moralista, y, la tercera, en atención a la polisemia del perdón. La centralidad que tiene la dimensión erótica en nuestras sociedades occidentales se refleja, entre otros múltiples fenómenos, en amplios y diversos nichos de mercado tendientes a generar ganancias por medio de la oferta de cuerpos, bienes y servicios que promueven la maximización de las experiencias sensorio-sexuales y la optimización del cuerpo en términos estéticos y eróticos. La producción de subjetividades se juega en el marco de un mercado que ofrece experiencias que combinan diversión, esfuerzo y autopromoción bajo las lógicas de (...) los insoslayables marcadores sociales de la diferencia.Al calor de estos fenómenos contemporáneos, tejidos por las tramas del erotismo, el género y el mercado, el presente artículo se propone realizar un análisis performático y performativo de una experiencia de participación observante en un taller de seducción femenina realizado en la ciudad de Córdoba. Se abordarán las técnicas corporales que fueron enseñadas, aprendidas y ensayadas en el taller y, en un segundo momento, el tipo específico de ideal regulatorio de la feminidad que estaba siendo propuesto tanto por medio de las particulares citaciones erótico-corporales que fuimos instadas a reiterar como por el discurso experto del profesor del taller. Con ello, se busca construir una descripción densa de esta instancia apostando a que amplíe los modos de abordar y conocer cómo estos paradójicos espacios reúnen experiencias y discursos de normalización y reactivación de viejos mandatos femeninos, a la par que transforman convenciones ligadas al género y la sexualidad. Using a design-based research approach, we studied ways to advance opportunities for children and families to engage in engineering design practices in an informal educational setting. 213 families with 5–11-year-old children were observed as they visited a tinkering exhibit at a children’s museum during one of three iterations of a program posing an engineering design challenge. Children’s narrative reflections about their experience were recorded immediately after tinkering. Across iterations of the program, changes to the exhibit design and facilitation provided by (...) museum staff corresponded to increased families’ engagement in key engineering practices. In the latter two cycles of the program, families engaged in the most testing, and in turn, redesigning. Further, in the latter cycles, the more children engaged in testing and retesting during tinkering, the more their narratives contained engineering-related content. The results advance understanding and the evidence base for educational practices that can promote engineering learning opportunities for children. (shrink)

O estudo, ainda em andamento, se justifica pela urgência em respeitar o povo cigano e compreender suas demandas. Pretendemos também, como nossa pesquisa e através de nossa fotoetnografia miúda, ampliar espaços nos chamados Estudos das Infância. Urge que os grupos ciganos sejam vistos pelos seus valores, seus modos de vida e suas narrativas, incluindo as (...) narrativas das crianças. (shrink)

El presente texto propone una articulación entre las principales nociones del posfundacionalismo de Jean Luc-Nancy, Alain Badiou, Claude Lefort y Ernesto Laclau y lo que denomino “vitalismo dialectico” de Vladimir Safatle. El cruce planteado es significativo en tanto se considera que la propuesta de Safatle (en obras como El circuito de los afectos [2019] y A paixão do negativo [2006]) viene a habilitar la inscripción del principal axioma teórico posfundacionalista, “la ausencia de fundamento último”, en la propia constitución psicoafectiva del (...) sujeto. Esta operación daría lugar a una biopolítica posfundacional emancipatoria posible de encarnar nuevos cuerpos o formas de subjetivación. (shrink)

In a range of peace process scenarios, the expert’s knowledge has become a fundamental tool for generating information systems as a mechanism for the storage and circulation of data. These information artifacts are supposed to faithfully document situations of human rights violations and contribute to the design of public policy and the construction of collective memory. Following Latour’s (1993) original coinage of the term coproduction, this paper analyzes how the Inter-Institutional System of Information for Justice and Peace (SIIJYP)1 was designed (...) to define victims of war and means of reparation from the State in Colombia. From an actor network theory perspective, we explain how victimizers become the main beneficiaries of the application of the SIIJYP. To comprehend this unintended social impact of the technological artifact and how it becomes an artifact that functions as an aseptic mediator of the historical-judicial truth, and the policy of transitional justice, we examine the relations between human and nonhuman actors, how information is collected, organized, hierarchized, and negotiated, as well as the consequences of the technical and legal construction of the notion of victims of war.
